ORDINANCE NO. 50 ORDINANCE 4/050 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: 1. In accordance with the provisions of Vernon's Texas State Code of Criminal Procedure, Article 873, there shall be taxed against each defendant convicted in the corporation court of the city the items of costs as set out in the subsequent articles of this chapter, and the respective amounts set opposite each of said items shall be collected from each defendant so convicted, and together with the fine imposed when collected shall be deposited with the City Treasurer. . 2. PLEAS OF GUILTY: Whenever the defendant in in the corporation court shall plead "guilty" to the items of costs shall be taxed against and be paid by Arrest with or without warrant Commitment Release Trial Fee Attorney for the City, fee Filing and docketing Taxing costs Total any prosecution had charge, the following any such defendant: $1. 00 1.00 1.00 2.00 2.00 1.50 ,10 $8.60 3. PLEASE OF NOT GUILTY: Whenever the defendant in any prosecution had in the corporation court shall plead "not guilty" to the charge, the following items of costs shall be taxed against and paid by any such defendant upon conviction. Whenever the defendant in any prosecution had in the corporation court shall pleas "not guilty" to the charge and demand a trial by jury, and if found guilty, shall prosecute an appeal to the county court, the following items of costs shall be taxed against and paid by any such defendant, in addition to the costs taxed by the preceding paragraph: Amount of costs on please of not guilty $10.10 Summoning jury 1.00 Jury fee 3.00 Filing and approving bond of appeal 1.50 Preparing and filing transcript of appeal 1.50 Total $17.10 5. When a defendant is convicted of a misdemeanor in the corporation court of the City and his punishment is assessed at a pecuniary fine, if he is unable to pay the fine and costs adjudged against him, he shall be imprisoned in jail for a sufficient length of time to discharge the full amount of fine and costs adjudged against him, rating such imprisonment at three dollars for each day hereof.
