ORDINANCE NO. 127
AN ORDINANCE OF THE CITY OF SCHERTZ, TEXAS PROHIBITING THE DEFACEMENT
OR PAINTING OF BUILDINGS AND FENCES OR OTHER PROPERTY AND PROHIBITING
THE PLACING OF ANY SIGN, PLACARD, NOTICE OR ADVERTISING DEVICE ON
U~ILITY POLES AND PROVIDING A PENALTY THEREFOR.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ. TEXAS:
Section 1.
~. It shall be unlawful for any person to post, paint or otherwise
exhibit on any building, fence, bulletin board or other property not
oft
belonging to _controlled by him, without the permission of the
person owning or controlling the same, any advertisement, poster,
bill or other notice or sign.
Section 2.
~ It shall be unlawful for any person to place any sign, placard,
notice, bulletin board or advertising device of any nature or kind
whatsoever upon or against any pole erected, used or maintained in
any street in the city for the support of any telegraph or telephone
wire, or electric lamp, light or wire. It shall be the duty of the

city marshal and ~ to remove any advertising matter attached
to or against any~ole in violation of this section.
Section 3.
Any person, firm or corporation who shall violate any of the terms
of this ordinance upon conviction thereof in the corporation court
shall be fined not less than $1.00 nor more than $20Q.00 for each
such offense and each violation and each day thereof shall be deemed
a failure to comply with the terms of this ordinanc~ and shall consti-
tute a separate offense.
Section 4.
It is the intention of the City Council that this ordinance,
a.nd every provision thereof, shall be considered separable; and the
invalidity of any section, clause, provision, or part or portion of
any section, clause or provision of this ordinance shall not affect
the validity of any other portion of this ordinance.

PROBLEM
Section 1 of Ordinance 127 leaves the authority
to the City Manager to grant or refuse permission
to a request to place signs within City right-of-
way or on Ci ty property.

POLICY
That the City Manager is hereby directed, under
Section 1, to refuse permission to place any
political advertisement, poster, bill or other
notice or sign, on City property or City con-
trolled right-of-way. All other advertisements,
posters, bills or other notices or signs will be
approved by the City Manager in writing when
determined by the City Manager not to be detri-
mental to health, safety or traffic safety.
