ORDINANCE NO. 137 . t ORDINANCE NO. D.1__ AN ORDINANCE REPEALING ORDINANCE NO. 50 OF TIlE CITY OF SCHERTZ, TEXAS. Whereas, the statutes of the State of Texas provide that no costs shall be lIillected in connection with the prosecution of criminal cases in the corporatm courts of the cities of the State of Texas except certain special fees therein provided; Now therefore, be it ordained by the City Council of the City of Schertz, Texas: 1. That Ordinance No. 50 of the City of Schertz, Texas is hereby repealed. 2. When a defendant is convicted of a misdemeanor in the corporation court of the city and his punishment is assessed at a pecuniary fine, if he is unable to pay the fine adjudged .against him, he shan be imprisoned in jail for a sufficient length of time to discharge the full amount of fine adjudged against him, rating such imprisorunent at five dollars for each day thereof. 3. The, reaordex of the corporation court of the City of Schertz, Texas is hereby authorized to assess, levy, and collect in the amount provided by law, those costs and special expenses dealing with the requisition of a personal bond and a special expense for the issuance and service of a warrant of arrest after due notice, not to exceed $7.50. Such special expenses and costs shall be paid into the MLmicipal treasury for the use and benefit of the City of Schertz, Texas. 4. All fines collected ,.by' or paid into the corporation court of the City of Schertz, Texas shall be paid into the MLmicipal treasury for the benefit of the City of Schertz, TExas.
