AN ORDINANCE GRANTING PRIVILEGE OF USE IN PUBLIC STREET TO
LYLE M. FRY:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
That Whereas, the City of Schertz, Texas is the owner of
that portion of a public street in said City described as
follows:
BEGINNING at the SW corner of
Heights Addition for point of
THENCE SWan extension of the

THENCE NE a line
Avenue 10 ft.;

And whereas, the said portion of said street is not now
being used by the said city and;
Whereas, the said Lyle M. Fry wishes to use the said portion
of said street and said use does not interfere with the public
use of the streets and sidewalks of the city of Schertz, nor
does such use create any hazardous or dangerous condition
thereon;
Now therefore, the City of Schertz, Texas does herewith
authorize the Mayor of said city to enter into the agreement
hereto attached and made a part hereof.

And whereas, the said portion of said street right of way
is not now being used by the City of Schertz, Texas;
Now therefore, for and in consideration of the sumof $10.00
and other good and valuable consideration cash in hand paid
by Lyle M. Fry the said City of Schertz, Texas does herewith
grant the right to the said Lyle M. Fry to use the said strip
of land and to fence the same until such time as the said City
of Schertz shall terminate such rights. This grant is permissive
only and does not grant any right, title or interest to Lyle
M. Fry, his heirs or assigns im, and to the tract of land
other than the permissive use herein specified which said use
may be terminated at any time by the City of Schertz, Texas upon
written notice to Lyle M. Fry, his heirs or assigns. It is a
condition of this grant that no per~nent improvements shall
be erected by Lyle M. Fry, his heirs and assigns on the tract
of land herein above described. The rights herein granted shall
inure to the heirs and assigns of the said Lyle M. Fry.
