AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS,
CALLING AN ELECTION TO BE HELD ON MAY 7, 2005 FOR
THE PURPOSE OF ELECTING THREE COUNCIL MEMBERS
FOR SAID CITY, SPECIFICALLY FOR PLACES 3, 4, AND 5.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:
THAT, an election be held in and throughout the City of Schertz, Texas (the City),
for the purpose of electing Council Members for Places 3, 4 and 5 respectively, to serve
for a term of two (2) years.

THAT, at said election the candidates receiving the highest number of votes for
Places 3, 4 and 5 respectively, be declared elected for a term of two years. Any candidate
desiring to have his or her name on the Official Ballot for said election shall, at least
sixty-one (61) days prior to said election day, file with the City Secretary an application
in writing in the form prescribed by the Texas Election Code requesting that his or her
name be placed on the Official Ballot and declaring as a candidate for Place 3, 4 or 5
respectively. The official first day for filing as a candidate is Monday, February 7, 2005
until 5:00 p.m. and the deadline for filing is Monday, March 7, 2005 until 5:00 p.m. That
any person failing to file said written application for candidacy by the time aforesaid shall
not be entitled to have his or her name printed on the Official Ballot. That the name of all
eligible candidates whose applications have been duly and timely filed shall be placed on
the ballot pursuant to a drawing as provided by law.

THAT, all qualified voters of said City shall be entitled to vote in said election.
IV
THAT, the ballots to be used in said election shall be prepared in conformity with
the Texas Election Code, as amended. That in holding and conducting said election,
voter forms, instructions and other materials required therefore, including the ballots,
shall be in both the English and Spanish language.

THAT, the polling place on May 7, 2005 is the Schertz Community Center, 1400
Schertz Parkway, Schertz, Texas and the polls will be open from 7:00 a.m. until 7:00
p.m.
VI
THAT, early voting by personal appearance will be conducted each weekday at
the Guadalupe County Office Building, 1101 Elbel Road, Schertz, Texas between the
hours of 8:30 p.m. and 4:30 p.m. beginning April 20, 2005 and ending May 3, 2005.

THAT, notice of said election shall be given in accordance with the provisions of
Title 1, Chapter 4, Texas Election Code.
VIII
THAT, the City Secretary is hereby authorized and directed to post notice of said
election in both English and Spanish languages, on a public bulletin board at the
Municipal Complex of said City, at the polling place for the holding of the election, and
at one other public place within said City, all of which notices shall be posted at least
twenty (20) days prior to the date set for said election.
IX
THAT, the City Secretary is further authorized and directed to cause notices of
said election to be published one time not more than twenty-five (25) or less than ten (10)
days prior to the date set for said election in a newspaper published and of general
circulation in the City.
X
THAT, this Ordinance shall take effect and be in full force immediately from and
after its passage on the date shown below.
