<br />ORDINANCE NO. 07 -M-31 <br /> <br />AN ORDINANCE BY THE CITY COUNCIL OF ItlE CITY OF <br />SCHERTZ, TEXAS AUTHORIZING ADOPTION OF ftlE CITY OF <br />SCHERTZ PARKS, RECREATION, AND OPEN SPACE MASTER PLAN <br /> <br />WHEREAS, the City Council (the "City Council") of the City of Schertz, Texas (the <br />"City") seeks to promote the public health, safety, morals, and general welfare of the City and <br />the safe, orderly, and healthful development of the City; and <br /> <br />WHEREAS, the Texas Parks & Wildlife Department (the "Department") requires that a <br />new Parks, Recreation, and Open Space Master Plan be developed every five years, adopted by <br />the City, and filed the Department in order for the City to be competitive in the Outdoor <br />Recreational Grant Program; and <br /> <br />WHEREAS, a Parks, Recreation, and Open Space Master Plan will ensure that the park, <br />leisure, and recreational needs of City residents and visitors to the City are met with quality and <br />excellence; and <br /> <br />WHEREAS, the City Council has determined that there should be a City Parks, <br />Recreation, and Open Space Master Plan; and <br /> <br />WHEREAS, the City Council finds that it is necessary and proper for the good <br />government, peace, welfare, or order of the City to adopt this Ordinance adopting the Parks, <br />Recreation, and Open Space Master Plan. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY ItlE CITY COUNCIL OF ItlE <br />CITY OF SLtlERTZ, TEXAS: <br /> <br />Section 1. The City Council hereby adopts the Parks, Recreation and Open Space <br />Master Plan attached hereto as Exhibit A. <br /> <br />Section 2. The recitals contained in the preamble hereof are hereby found to be true, <br />and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a <br />part of the judgment and findings of the City Council. <br /> <br />Section 3. All ordinances, resolutions, or other actions of the City Council, or parts <br />thereof, which are in conflict or inconsistent with any provision of this Ordinance are hereby <br />repealed to the extent of such conflict, and the provisions of this Ordinance shall be and remain <br />controlling as to the matters ordained herein. <br /> <br />Section 4. This Ordinance shall be construed and enforced in accordance with the <br />laws of the State of Texas and the United States of America. <br /> <br />Section 5. If any provision of this Ordinance or the application thereof to any person <br />or circumstance shall be held to be invalid, the remainder of this Ordinance and the application <br />of such provision to other persons and circumstances shall nevertheless be valid, and the Council <br />hereby declares that this Ordinance would have been enacted without such invalid provision. <br /> <br />Ordn (Parl<:s Master Plan). doc <br />
