25-R-156 Order Special Election for Place 7RESOLUTION 25-R-156 A RESOLUTION BY THE CITY COUNCIL OF SCHERTZ, TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD ON SATURDAY, DECEMBER 20, 2025, FOR CITY COUNCIL PLACE 7 AND OTHER MATTERS IN CONNECTION THEREWITH WHEREAS, on October 19, 2025 a vacancy on the City Council Place 7 occurred pursuant to Texas Election Code 201.022; and WHEREAS, In accordance of the Texas Constitution Municipal Corporation Article 11, Section 11(c), any vacancy occurring on such a governing body shall be filled by majority vote of the qualified voters at a special election called for such purpose within one - hundred twenty days after such vacancy; and WHEREAS, pursuant to Schertz City Charter Section 9.01, in the event of a vacancy, a special election shall be held; and NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: Section 1. That a special election is hereby ordered to be held Saturday, December 201h, 2025, for the purpose of electing Council Member Place 7 and Section 2. That in accordance with Texas Constitution Municipal Corporation Article 11, Section 11(c), Notice of the Special Election shall be posted on the bulletin board at the Hal Baldwin Municipal Complex 1400 Schertz Parkway and on the city's website, and a like copy shall be published not later than the 15th day before Election Day in the newspaper of general circulation. Section 3. That Guadalupe County will oversee the City of Schertz Special Election for Saturday, December 20, 2025 (Counties: Guadalupe, Bexar, and Comal) with a Guadalupe County Election contract and shall be responsible for the appointment of the presiding judge and alternate judge for each polling location in accordance with Chapter 32 of the Texas Election Code and may employ other personnel necessary for the proper administration of the election; and Section 4. That election day voting will be 7 a.m. through 7 p.m., and location of the polling place will be at the Guadalupe County-Schertz Satellite Office at 1101 Elbel Road, Schertz TX, 78154. That the last day to vote for the SaturdayDecember 20, 2025, City of Schertz Special Election is Saturday, December 20, 2025. Section 6. The applications for ballots by mail must be received no later than 5:00 p.m., Saturday, December 20, 2025: Guadalupe County Lisa Hayes Guadalupe County Elections Administrator 3251 State Highway 123 North, TX 78155 Section 7. The recitals contained in the preamble hereof are hereby found to be true, and such recitals are hereby made a part of this Resolution for all purposes and are adopted as a part of the judgment and findings of the City Council. Section 8. All resolutions, or parts thereof, which are in conflict or inconsistent with any provision of this Resolution are hereby repealed to the extent of such conflict, and the provisions of this Resolution shall be and remain controlling as to the matters resolved herein. Section 9. This Resolution shall be construed and enforced in accordance with the laws of the State of Texas and the United States of America. Section 10. If any provision of this Resolution or the application thereof to any person or circumstance shall be held to be invalid, the remainder of this Resolution and the application of such provision to other persons and circumstances shall nevertheless be valid, and the City Council hereby declares that this Resolution would have been enacted without such invalid provision. Section 11. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Chapter 551, Texas Government Code, as amended. Section 12. This Resolution shall be in force and effect from and after its final passage, and it is so resolved.
