20. Guadalupe County Political Sign OrdinanceItem 61 ORDINANCE REGULATING POLITICAL SIGNS ON GUADALUPE COUNTY PROPERTY RECITALS: 1. WHEREAS, Persons seeking elective office have placed political advertising signs on certain property of Guadalupe County, Texas; and 2. WHEREAS, the signs that have been placed on said property have varied in size and that metal "T-Posts" (customarily used to construct fences) have been used to affix the sign to the property; and 3. WHEREAS, there have been prior occasions where the metal "T-Posts" that have been driven into the ground have hit water and electrical lines thereby causing damage to same; and 4. WHEREAS, some signs that have placed on said property are considerably large; and 5. WHEREAS, the "Schertz Annex", 1101 Elbel Road, Schertz, Texas is property owned by Guadalupe County and the building situated thereon is used as a polling place; and 6. WHEREAS, Justice of the Peace, Precinct 1, 2405 US Hwy. 90 East, Seguin, Texas is property owned by Guadalupe County and the building situated thereon is used as a polling place; and 7. WHEREAS, Section 61.003 of the Texas Election Code allows Guadalupe County to enact reasonable regulations concerning the time, place and manner of electioneering on said property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS COURT OF GUADALUPE COUNTY, TEXAS THAT THE FOLLOWING REGULATIONS RELATIVE TO POLITICAL SIGNS ON GUADALUPE COUNTY PROPERTY BE AND THE SAME ARE HEREBY ADOPTED AS SET FORTH BELOW: a. No signs may be placed or otherwise situated upon property owned by Guadalupe County, Texas utilizing Metal "T-Posts" such as those "T-Posts" customarily used for the construction of ranch fencing; b. No sign may be placed or otherwise situated upon property owned by Guadalupe County, Texas if said sign is larger than 2 feet by 2 feet. c. This Ordinance shall be in full force and effect from and after the date of passage by a majority of the Guadalupe County Commissioner's Court. d. As set forth in Section 61.003(c) of the Texas Election Code, a violation of the provisions of this Ordinance is a Class "C" Misdemeanor punishable by a fine only not to exceed $200.00 ADOPTED on this the 2-May of Joknua ry 2014.
