A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AUTHORIZING AMENDMENT 1 (ONE)
TO THE EMS INTERLOCAL AGREEMENT WITH
GUADALUPE COUNTY FOR THE PROVISION OF
EMERGENCY MEDICAL SERVICES.
WHEREAS, the City of Schertz entered into an Interlocal Agreement with Guadalupe
County effective as of October 1, 2023 for the provision of Emergency Medical Services; and
WHEREAS, the City of Schertz has determined that the provision of certain emergency
medical services is a public purpose and within their statutory powers of government; and
WHEREAS, the City of Schertz wishes to amend the Interlocal Agreement with
Guadalupe County to cover anticipated operational budgeted shortfalls; and
WHEREAS, the City Council hereby finds that the amendment is reasonable and necessary
for the safety and welfare of the general public; and
WHEREAS, the City Council authorizes the City Manager to enter into the amended
Interlocal Agreement and take any additional action reasonably necessary to ensure such an
amendment is executed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS THAT:
Section 1. The City Council hereby approves and accepts Amendment 1 (one) to the
Interlocal Agreement for Emergency Medical Services as set forth in Exhibit "A".
Section 2. The recitals contained in the preamble hereof are hereby found to be true, and
such recitals are hereby made a part of this Resolution for all purposes and are adopted as a
part of the judgment and findings of the City Council.
Section 3. All resolutions, or parts thereof, which are in conflict or inconsistent with any
provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved
herein.
Section 4. This Resolution shall be construed and enforced in accordance with the laws of
the State of Texas and the United States of America.
Section 5. If any provision of this Resolution or the application thereof to any person or
circumstance shall be held to be invalid, the remainder of this Resolution and the application
of such provision to other persons and circumstances shall nevertheless be valid, and the
City Council hereby declares that this Resolution would have been enacted without such
invalid provision.
Section 6. It is officially found, determined, and declared that the meeting at which this
Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution,
was given, all as required by Chapter 551, Texas Government Code, as amended.
Section 7. This Resolution shall be in force and effect from and after its final passage, and
it is so resolved.

AMENDMENT NUMBER 1 TO THE
STATE OF TEXAS § INTERLOCAL AGREEMENT BETWEEN
§ GUADALUPE COUNTY AND THE CITY
COUNTY OF GUADALUPE § OF SCHERTZ, TEXAS, FOR
EMERGENCY MEDICAL SERVICES
This Amendment No. 1 (the "Amendment") is made and entered into as of the 1 sT day of October
2026, by and between the City of Schertz, a political subdivision of the State of Texas (hereinafter
referred to as "City"), and Guadalupe County, a political subdivision of the State of Texas
(hereafter referred to as "County").
WHEREAS, the City and County have entered into an Interlocal Agreement effective as of
October 1, 2023 (the "Agreement") for the City to provide emergency medical services to the
County; and
WHEREAS, the City and the County have determined that the provision of certain emergency
medical services is a public purpose and within their statutory powers of government;
NOW, THEREFORE, the City and the County agree to amend the Agreement as follows:
Section 3 of the Agreement is replaced and superseded by the following new Section 3
3. Term and Renewal
a) This Agreement shall be for a term commencing with the effective date of October 1,
2026, through and including September 30, 2028 (the "Term") unless either party to this
Agreement notifies the other party in writing that it wishes to terminate this Agreement.
Such notice shall be provided by registered or certified mail not less than one hundred
eighty (180) days prior to the end of the Term.
Section 4 of the Agreement is replaced and superseded by the following new Section 4
4. Consideration
a) In consideration of the City's provision of Emergency Medical Services during the Term,
the County agrees to pay the City in twelve (12) equal monthly installments within (30)
days after satisfactory acceptance by the County of all completed services as outlined
below:
Fiscal Year 2027 — $1,484,904.61
Fiscal Year 2028 — $1,633,395.07
b) The County agrees that, in addition to the fee payable by the County to the City pursuant
to Section 4(a), the City and its contracted designees will make every attempt to bill and
collect from the patient's insurance company. The City nor its contracted designees have
contracts with insurance companies; therefore we will not waive the unpaid portion of the
bill for any services rendered to them by the Department.
All other requirements, terms, and conditions in the Agreement that are not hereby amended are to
remain in full force and effect.
IN WITNESS WHEREOF, the PARTIES hereto, acting under the authority of their respective
governing bodies, have caused this amendment to be duly executed as of this I' day of October
2026.
