AN ORDINANCE
PROVIDING FOR THE EXTENSION OF THE BOUNDARY LINES
OF THE CITY OF SCHERTZ, TEXAS, BY THE ANNEXATION
OF A TRACT OF LAND CONTAINING 103.65 ACRES OF LAND
MORE OR LESS, OUT OF THE COUNTIES OF COMAL AND
GUADALUPE
WHEREAS, the hereinafter described tract of land adjoins the
corporate limits of the City of Schertz, Texas, and does not exceed one
(1) mile in width; and
WHEREAS, a public hearing on the question of whether said land
should be annexed to and become a part of the City of Schertz, Texas, was
duly called and notice thereof given and said public hearing has been had,
all in accordance wit~ahl~w~;ar~dd
WHEREAS, by the passage of this ordinance annexation of said
territory will have been brought to completion within ninety (90) days of
the institution of annexation proceedings; and
WHEREAS, the City Council of the City of Schertz, Texas, is
of the opinion and finds that such territory is suitable for municipal
purposes and that it is in the best interest of the City of Schertz, Texas,
and the citizens and inhabitants thereof that said territory be annexed
to and made a part of said City; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:

That the following described territory containing 103.65 acres
~ of land lying adjacent to and adjoining the City of Schertz, Texas, be,
and the same is hereby added and annexed to the City of Schertz, Texas and
said territory shall hereinafter be included within the boundary limits of
said city and the various points contiguous to the area described are hereby
altered and amended so as to include said land and territory within the
coprorate limits of the City of Schertz, Texas; said land being more parti-
cularly described by metes and bounds as follows:

tract. •
THENCE North 33°56' West, 760 feet more or less to a point in
the west line of the Richard Kraft 29.67 acre tract for the west
corner of the herein described tract.
THENCE North 48°55' East in a line parallel to and 900 feet from
the center line of I.H. 35, 2750 feet more or less to a point for the
north corner of this tract.
THENCE South 30°15' East, 1810 feet more or less crossing I.H. 35
to a point on the northeast side of an existing dirt road for the
east corner of this tract.'
THENCE South 48°55' West, in a line parallel to and 900 feet from
the center line of I.H. 35, 2350 feet more or less to a point in the
existing City limits of the City of Schertz for•the south corner of
this tract.
THENCE North 30°15' West, 1070 feet more or Less along the existing
City limits of the City of Schertz to a point in the north right-of-way
line of I.H. 35 for an interior corner of this tract.
THENCE South 45°55' West, 306.43 feet with the north right-~f-way
line of I.H. 35 to a point for an interior corner of this tract.
THENCE South 45°04' West, 194.90 feet with the north right-of-way
line of I.H. 35 to the POINT OF BEGINNING containing. 103.65 acres
more or less.
SAVE and except all acreage contained within the right-of-way
of I.H. 35.

THAT the territory so described and the areas so annexed
shall hereafter be a part of the City of Schertz, Texas, and all taxable
.property situated therein shall hereafter bear its pro rata part of the
taxes Levied by the City of Schertz, Texas, and the inhabitants thereof
sha11 be entitled to all of ,the rights and privileges of all the citizens
and s"hall be bound by the acts, ordinances, resolutions and regulations

There being a quorum present, the meeting was called to order by the
Mayor, and, among other proceedings had were the following:
The Mayor introduced the hereinafter set forth ordinance, which fi as
been read and considered at the last .Special meeting of the City Council on the
F 17 day of March, 1981 It was determined that the City Secretary had
caused a short synopsis of said proposed ordinance to be published in the
official City newspaper after its consideration at the last regular meeting of
the City Council and prior to this meeting.
Whereupon said ordinance was discussed and further considered by the
Council.
Thereupon it was moved by Councilmember Earl W. Sawyer
and seconded by Councilmember Jeff Duffield that said ordinance
be finally passed and adopted. The Mayor put the motion to a vote of the
members of the City Council and the ordinance was finally passed and adopted by
the following vote:

. SETTING A TIME, DATE AND PLACE FORA PUBLIC HEARING
PURSUANT TO THE PROPOSED ANNEXATION OF 331.35 ACRES
OF LAND MORE OR LESS OUT OF THE COUNTIES OF CO11AL
AND GUADALUPE
WHEREAS, the City Council of the City of Schertz, Texas,
desires to institute annexation proceedings concerning the territory
described herein, and
a
WHEREAS, in accordance with Section 6, Article 970x, Vernon's
Texas Civil Statutes, a public hearing is require, NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
THAT a public hearing is hereby scheduled for 7:00 o'clock
P. M., Tuesday, March 3, 1981, to be held in the Council Chambers of the
Municipal Complex Building, 1400 Live Oak Road, Schertz, Texas, to obtain
the views of the public concerning the proposed annexation of the follow-
ing territory:

REASONS FOR ANNEXATIONS
The three annexations(A-66, A-67 and A-68) into largely unhabited ~
territory were accomplished to close in the City limits, gain control
over anti`ci'pated development in those areas, and to provide Conti-
nui'ty to the City limits on I 35.
There'is no past or pending litigation connected with the three annex-
at ions. A11 were carried out 6y passage ofi ordinances by the City
Councl'1 in accordance with app1i~ca6le City Charter and State Statutes.

Dear Mr. Gilmore:
This is in reference to the three annexations
(Ordinance Nos. 81-A-10, 81-A-11, 81-A-12) to the City of
Schertz in Guadalupe County, Texas, submitted to the Attorney
General pursuant to Section 5 of the Voting Rights Act of
1965, as amended, 42 U.S.C. 1973c. Your submission was
received on May 8, 1981.
The Attorney General does not interpose any objections
to the changes in question. However, we feel a responsibility
to point out that Section 5 of the Voting Rights Act expressly
provides that the failure of the Attorney General to object
does not bar any subsequent judicial action to enjoin the
enforcement of such changes.

Dear Ms. Krause:
As you are probably aware, the Federal Office of Revenue Sharing may
adjust your city's entitlement as a result of changes in your municipal
boundary. However, prior to making such an adjustment, federal law requires
that the State of Texas provide a certification that each city over 5,000
population has complied with all Texas law in making these boundary changes.
In order to facilitate this process at the state level, Governor William
P. Clements has delegated the responsibility for such certification to the
Texas Department of Community Affairs.
Your city has submitted to us information concerning the following
boundary changes accomplished during the 198p calendar year.

this new form on all future reports.
