AN ORDINANCE
PROVIDING FOR THE EXTENSION OF THE BOUNDARY
LINES OF THE CITY OF SCHERTZ, TEXAS, BY THE
ANNEXATION OF A TRACT OF LAND CONTAINING
29.176-ACRES OF LAND, OUT OF COMAS COUNTY.
WHEREAS, the hereafter described tract of land adjoins
the corporate limits of the City of Schertz, Texas, and does not
exceed one (1) mile in width; and
WHEREAS, public hearings on the question of whether
said land should be annexed to and become a part of the City of
Schertz, Texas, were duly called and notice thereof given and
said public hearings have been had, all in accordance with law;
and
WHEREAS, by the passage of this ordinance, annexation
of said territory will have been brought to completion within
ninety (90) days of the institution of annexation proceedingso
and
WHEREAS, the City Council of the City of Schertz,
Texas, is of the opinion and finds that such territory is
suitable for municipal purposes and that it is in the best
interest of the City of Schertz, Texas, and the citizens and
inhabitants thereof that said territory be annexed to and made a
part of said City; and
WHEREAS, the City Council has directed the City Manager
to prepare a service plan that provides for the extension of
municipal services into the area to be annexed in accordance with
lawj NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS>

THAT the following described territory containing
29.176 acres of land lying adjacent to and adjoining the City of
Schertz, Texas, be and the same is hereby added and annexed to
the City of Schertz, Texas, and said territory shall hereinafter
be included within the boundary limits of said City and the
various points contiguous to the area described are hereby
altered and amended so as to include said land and territory
within the corporate limits of the City of Schertz, Texas® said
land being more particularly described by metes and bounds as
f ollows e
Metes and bounds description of a 29.176 acre tract of land out of
Subdivision No. 56 and 35 of the Rafael Garza Survey No. 98,
Abstract No. 175, Comal County, Texas and also being out of the
southeastern portion of a tract called 66.36 acres, called First
Tract, and described in Volume 93, Pages 230-232 of the deed records
of Comal County, Texas, and being more particularly described as
follows:
COMMENCING: At an iron pin found at the intersection of the northeast
line of Hubertus Road and the northwest right-of-way line of
Interstate Highway No. 35, said point also being the south corner of
said 66.36 acres;
THEtJCE: N 30 04'05" W, 576.47 feet along the northeast line of
Hubertus Road to an iron pin. set for the south corner of a 0.476 acre
tract as recorded in Volume 153, Page 515 of the deed records of
Comal County, Texas;
THENCE: N 30 09'03" W, 79.56 feet along the southwest line of -said
0.476 acre tract and the northeast line of Hubertus Road to an iron
pin set for the south corner and the POINT OF BEGINNING of the herein
described 29.176 acre tract;
THENCE: N 30 09'03" W, 10.65 feet and N 30 04'5I" W, 1297.34 feet
along the northeast line of Hubertus Road to an iron pin set for the
west corner of this tract;
-THENCE: N 49 26'53" E, 809:25 feet to an iron pin set in the
. southwest fence line of~a 0:51 acre tract as recorded in Volume 209,
Page 93 of the deed records of Comal-Gounty, Texas;
THENCE: S 30 30'22" E, 6~.6T feet along'~the southwest line of said
0.51 acre tract to an iron pin set at`a fence corner for the south
corner of said 0.51 acre tract and an~irnterior,>corner of this tract;
THENCE: N 60 07'16" E, 116.43 feet along the southeast line of said
0.51 acre tract to an iron pin set in the northeast fence line of the
herein described tract for the east corner of said 0.51 acre tract
and a corner of ,;this tract;
THENCE: Along the northeast fence line of said 29.176 acre tract as
follows: '
S 30 43'36" E, 394.21 feet;
S 30 32'49" E, 391.40 feet;
S 30 45'16" E, 419.71 feet and
S 30 50'08" E, 184.01 feet to an iron pin set for the east
corner of this; tract;
THENCE: S 59 45'00" W, 927.65 feet to the POINT OF BEGINNING and
containing 29.176 acres of land.

THAT the Service Plan providing municipal services be
attached and made a-part of this ordinance annexing the area and
approved as a part of this ordinance. The Plan shall be
construed as a contractual obligation and be-valid for ten (10)
years and renewal shall be at the discretion of the City of
Schertz, Texas.
III
THAT the territory so described and the areas sa
annexed shall hereafter be a part of the City of Schertz, Texas,
and all taxable property situated therein shall hereafter bear
its pro rata part of the taxes levied by the City of Schertz,
Texas, and the inhabitants thereof shall be entitled to all of
the rights and privileges of all the citizens and shall be bound
by the acts, ordinances, resolutions and regulations of the City
of Schertz, Texas.
