Subject: Update on Main Street and Town Center
Development
BACKGROUND
The purpose of this presentation is to provide an update to City Council on the Main Street and
Town Center projects. At this stage, the Comprehensive Master Plan for Main Street is nearing
completion and a second charette is scheduled for November 16th at 6pm for the planning
consultants to deliver some final imagery and the plans to the public. A draft capital
improvements project list is also included.
The Town Center market assessment, review of building program and some preliminary
development pro - formas have been completed and those will be discussed in more detail.
The presentation will discuss the rationale behind each of the steps taken to this point, how EDC
envisions the two projects finding synergies with one another, and explain the proposed next
steps for both projects.

Stainback Public/Private Real Estate ( SPPRE) has completed a brief review of the conceptual
Master Plans for the proposed Town Center at Schertz Parkway and Live Oak Road. In
conjunction with our review we consulted Joe Pobiner, former Director of Planning for HKS
Architects. The following is the result of a combination of viewpoints provided by SPPRE and
Mr. Pobiner.
Traffic and Circulation
The roundabout on Schertz Parkway is a good addition to the project. The roundabout provides
the ability to impact visitors and ease the flow of traffic into and through the development area.
However, given the radius of the traffic circle, it may be larger than required. For instance, a
smaller roundabout that lies within the City ROW may be sufficient considering the low average
daily traffic on Schertz Parkway. We suggest additional review by the City engineer be
completed in conjunction with a review by a traffic consultant be completed to determine the
applicability of a roundabout on a principal arterial of the City.
Schertz Parkway
A challenge with the development is that Schertz Parkway bisects the development, essentially
creating two `halves'. The typical Town Center design incorporates a street network which
allows the development to be self contained. The use type which will be most challenged with
this bifurcation is retail. Retail in many Town Center projects is easily accessible by pedestrians.
As currently designed, the pedestrian access across Schertz Parkway could challenge the success
of retail on both sides of the street. One technique to increase the street enclosure would be to
front the buildings on the east side closer to Schertz Parkway. To increase retail success, ground
floor retail could be included in several of these buildings. By moving parking to the back of the
buildings the enclosure would assist to naturally calm traffic (roundabout) and bring the retail
closer on each side. From this, additional pedestrian crossing options could be considered to
assist in crossing Schertz Parkway.

Office
The office space is largely concentrated on the east side and is reflective of a suburban office
pattern, not a Town Center pattern. Office could be repositioned and located above retail, with
better orientation towards Schertz Parkway. While the scale could not be determined, it appears
the depths of the office might be too shallow. It is also recommended that the office uses be
incorporated in the west side of the project, potentially above retail, and not isolating them to the
east side. Office uses will assist to create pedestrian traffic and support for retail during daytime
traffic.

Retail with greater frontage on Schertz Parkway
Public Facility
While the use type and function of the Public Facility is to be determined, our comment at this
point in the process is the proximity to the single family attached homes and the multifamily
units. If this building is noisy or causes excessive traffic, this could be a detriment to the
marketability of the residential units.

A Public Facility can serve as an anchor in Town Center developments, but often times there is
significant accompanying retail space. Because of the low amount of retail space in the Master
Plan, we believe it may be prudent to consider a retail anchor as a substitute for the Public
Facility location and potentially move the public facility to the east side of Schertz Parkway. A
suitable retail anchor in this location could be a bookstore (Barnes and Noble or Borders) or
boutique theatre. A brief demand study and comparables of bookstore demand has not been
completed. The location of the anchor site on the west side is possibly the most desired retail
location.
Hotel
In many Town Center projects, Hotels typically want to be associated with and embedded with
surrounding retail and restaurants. Having the Hotel bifurcated by Schertz Parkway and grouped
with office uses may not be the preference of hoteliers. Including ground floor retail with office
above on the west side would help support the Hotel. Depending on the Public Facility's
function, there could be great synergy with the Hotel on the east side of Schertz Parkway.
Garage
The garage on the east side of Schertz Parkway will assist to increase density however, the size
of the garage appears to dwarf the loft residential area. An option to explore would be to wrap
the garage with the residential or ground floor retail to better mask the garage.
Residential Areas
The square parcel at the northwest portion of the project area (currently excluded) could be a
significant property to include as it would create a more cohesive development plan and allow an
ideal project area configuration. If this property were included, residential uses could be moved
to the northern portion of the site, allowing a buffer to existing single family residences to the
north and west. In addition, inclusion of this parcel would allow for the development spine to
extend and accommodate a larger critical mass of mixed -use buildings. In addition, Residential
uses on the east side of Schertz Parkway could be explored further.
Summary
The project area's central location in the City, large land area and location on a major traffic
artery are significant positive attributes for the project. With minor modification and
considerations in the Master Plan, we believe the site has strong potential. In addition, because
of the suburban location, we believe that early phasing of horizontal mixed -use development
could be successful and mitigate risk to the developer.

Re: Schertz Town Center Market Assessment
Stainback Public/Private Real Estate ( SPPRE) has completed a preliminary market assessment
for the New Town Center project proposed in the City of Schertz, Texas. We completed this
assessment based on a review of industry data sources including analysis by CB Richard Ellis,
Marcus and Millichap, REIS and ESRI. In addition, SPPRE spoke with local brokers regarding
the strength of the local /regional market.
This is not a detailed market analysis and is intended only to support assumptions utilized in pro
forma financial analysis. SPPRE believes these are conservative estimates and are intended for
discussion purposes only.
Multifamily
San Antonio Region
Unlike the larger economy, the San Antonio metro area is well positioned to experience a fairly
low dip in the strength of the multifamily sector. Construction activity over the last two years
will bring online additional units in the latter half of 2009 and early 2010. The addition of these
units could increase vacancy, owner concessions and subsequently increase cap rates. The San
Antonio region economics are strong compared to the nation, with new employers and General
Services Administration (GSA) expansions bringing additional jobs to the region. These new
jobs should create additional multifamily demand, which is expected to increase at 1.5 %.
Employers such as USAA, Medtronic, and the Base Realignment and Closure (BRAG) act are
either expanding or consolidating operations in the region. The national downturn in the housing
market was largely avoided in the San Antonio region through tighter lending standards on a
statewide basis. The largest obstacle in the region is the ability to obtain construction and
permanent debt financing. Regional banks, often the largest lenders for this debt have greatly
increased their review of potential projects, the development team experience in the region and
the financial capacity of developers. Because of this, it has been difficult for out -of -state
investors and developers to execute projects. Projects that obtain financing are typically
partnerships that have local expertise and lending relationships. Because of the difficulty of
obtaining financing, as projects remain unsold, cap rates will continue to rise.
The SPPRE analysis of the project area is based on several factors related to each use type.
Included in this analysis is the review of the property attributes including location, size, land
area, configuration, topography and area amenities.

We believe that the location is advantageous to workers at Randolph Air Force base as well as
the employment generators at I35 and in San Antonio. Schertz Parkway is not intended to bear
the traffic load of larger thoroughfares like FM 3009. Because of this a Community/
Neighborhood density with a blend of retail, office, and residential should be an attractive
investment in the long term. Included in this is the potential for hike /bike trails that further
promote the connectivity of Schertz. The configuration and topography are normal. The site is
well located in the City within close proximity to City services, parks, and athletic facilities. The
location can also help support the development of North Schertz Parkway. The location of this
site would also indirectly support the redevelopment efforts on Main St. by increasing traffic
flow along FM 78
Northeast Submarket
SPPRE also reviewed comparable multifamily properties in the Northeast Submarket. Cities
included in submarket are Live Oak, Selma, Universal City, Schertz and Cibolo. Below is the
multifamily supply in the submarket extracted from available data sources.

The Retreat at Chelsea Park, the Vantage at Schertz and Sycamore Creek are the three most
comparable product types in the Schertz market. Units in the submarket lease for have a median
lease rate of $.71 /sf per month, have 208 units and were built in 1979. The Vantage at Schertz is
not listed in the data table, but the complex has 288 units, was built in 2008, has an average lease
rate of $876 /unit, and has 4% vacancy. In addition, the Legacy Oaks Apartments (located at I35
and Schertz Parkway) is a Class BB+ building with 256 units and is 96% occupancy. Other
apartment buildings are located near the project site on Schertz Parkway but they either did not
participate or could not be reached. Many of these units are in the Class CB range and would
likely not directly compete with a Class A product.

Within three miles of the site, the income projections highlight the greatest growth in income
levels between $50,000 and $74,000 per year. Within a three mile radius there is an anticipated
1.7% increase in the 25 to 34 age group, the greatest among all groups. Based on this data, the
low vacancy and limited concessions of the Retreat at Chelsea, the Vantage and Sycamore
Creek, it is likely that a Class A or B+ product would be supported. In addition, there may be a
market for rental single family attached product. Townhomes could provide a housing
alternative to the growing $75,000 to $100,000 income segment.
Multifamily Pro Forma Assumptions:
Unit Count: SPPRE recommends approximately 250 multifamily units as a Phase 1
development. In addition, approximately 75 to 100 Townhome units are estimated to be
supported and will be completed in phases based on presales.
Lease Rates
The average lease rates for Class A multifamily product in the Schertz submarket is $0.90 /sf per
month. We will use a conservative lease rate of $0.85 /sf in the pro forma. This will be balanced
with a range of unit counts to determine maximum utilization for the site.
Vacancy Rate
Among Class A multifamily developments, we believe a vacancy rate of approximately 7.5% is a
conservative estimate. All three projects in Schertz are at less than 6 %.

Based on limited availability of Class A multifamily, we believe that a lease up in approximately
six to eight months to stabilization is a conservative estimate.
Office
San Antonio Region
The diverse San Antonio economy that includes military, government and institutional
companies are expected to reduce the impact of the larger national recession. In the San Antonio
metro, major new employer announcements have come from Medtronic and the cyber command
center at Lackland AFB. As cited in industry research documents, the following industries are
the focus for additional growth in the region:

• Life Sciences/Biotech
• Government
• Financial Services
• Defense Security
• Pharmaceutical
• Communications
• Trade/Logistics
• Data Centers
• Leisure/Food Service
• Banks/Lenders
• F.I.R.E
The larger pressure on the economy will likely surpass job creation with layoffs in the metro
area. These pressures have resulted in difficulty for some owners to lease vacant office space,
specifically in the West and Northwest. In many submarkets, office owners have to negotiate
lease concessions, including increased tenant improvements, lease terms and allowances. These
factors have pushed the average lease rates down to levels not seen within the past 10 years.
Because of the vacancies, investors are hesitant to purchase new properties. Investment in
properties with high vacancies should increase once the economy improves and job losses
subside.

At an 8% vacancy rate the Northeast Submarket has the lowest vacancy against other
submarkets. The greatest demand for office space in this submarket is build -to -suit medical
office, health and professional services. Speculative office is not currently being financed.
SPPRE suggests focusing on niche business segments with a garden office development. SPPRE
does not suggest including speculative office in the Phase 1 pro forma.
Office Pro Forma Assumptions
Square Feet: We do not recommend speculative office development be included, however there
are opportunities in the market for build to suit garden office projects. We estimate between
10,000 to 30,000sf of professional office /medical space exists in the submarket near -term.
Because of this we recommend discussion begin early with expanding professional office tenants
in the submarket but not incorporating the use type in the pro forma.
Lease Rate
Class A office space in the Schertz submarket averages an asking lease rate of $21.90 /sf per year.
Class B/C lease rates are $16.88/sf per year. We believe Class A garden medical office space is
an ideal office tenant group with sufficient demand in the region. The growth of medical office
in the Judson Rd. and I -35 area supports this assumption.
Vacancy Rate
In 2009, the average vacancy rate for Class A office properties is 13.6 %. For Class B/C
properties the vacancy is 14.6 %.
Absorption
We suggest deferring any speculative office development to a future phase of development.
Office pad sites can be designated in the Master plan and included in Phase 1 if one or more
tenants are identified as potential users.
Retail
San Antonio Region
The long -term strength of the San Antonio region is evident by retailers' continued focus in the
region. Retail job losses are anticipated to be minimal compared with losses nationally. New
big box retail stores include Target, JC Penny and a specialty store by Saks Fifth Avenue called
"Off 5th" in northwest San Antonio. In addition, restaurants have expanded their presence
including Maggiano's, BJ's Restaurant & Brewhouse. Many investments are focused in the
Northwest area of San Antonio due to the large number of households and limited services.

The Northeast submarket has the highest vacancy rate with 11.9 %, a 120 basis point increase
over 2008. Absorption in the submarket is projected to be negative through 2011. The Forum
was noted by developers as being the strongest retail attraction in the submarket. Additional
research indicates that out -of -state investors believe that cap rates in the submarket need to
increase to meet investor return requirements. The "Schertz Town Center" retail project at FM
3009 and Elbel Rd. has been unsuccessful in preleasing neighborhood retail. Major retailers
have retracted their expansion plans to 50% to 80% of original estimates, and also prefer
locations with greater visibility and access. The Gateway Plaza project is 85% leased of
150,OOOsf of retail space constructed. The Live Oak Town Center is preleasing and is not yet
under construction.
One specific challenge to the retail Town Center site is the potential to have national retail and
restaurant tenants off of I -35. In this economy, national retailers have reduced their expansion
plans and require very conservative locations, close to interstates with high visibility, traffic
counts and income levels. The Town Center Site is located in a good demographic location and
close to amenities, but lacks the traffic and visibility or a major thoroughfare. The optimum
retailers for this site are neighborhood and community retailers, with specialty restaurants, delis,
and cafe, bookstores, dry cleaners, etc. to serve the residents.
Retail Pro Forma Assumptions
As with the Office component we do not recommend speculative retail development in Phase 1.
We do believe proper marketing with local retailers to identify potential tenants in addition to the
planned residential construction could generate interest. There may be some successes in the
retail plan once occupancy and success of the residential component is better determined.
Therefore at this stage, we do not recommend including a retail component in the pro forma on a
speculative basis.
Lease Rate
Retail space in the Schertz submarket varies between anchor and non - anchor tenants. The lease
rates for anchor tenants in the submarket average $9.74/sf and non - anchor tenants at $15.85/sf
per year.

Vacancy Rate
Among anchor retail tenants in the submarket, the average vacancy is 14.9% and non - anchor
tenants have vacancy of 12.8 %. One to three months offered as free rent.
Absorption
In the Northeast area specifically, one of the largest projects to debut is the Gateway Plaza and
Live Oak Town Center. The 850,OOOsf Gateway Plaza project is under construction with a
planned opening in the fourth quarter 2009. Both projects are still leasing space with Gateway
Plaza 85% leased out. The Gateway Plaza ownership has indicated a desire to sit and hold until
retail fundamentals improve. The Live Oak Town is a planned 600,OOOsf of retail space with
multiple anchors and restaurants.
Because of the turbulent credit market, the likelihood for speculative retail development is
unlikely. We do believe that small restaurant pad sites for ground lease or sale have potential. It
is likely that the development will need to mature with additional residential and office to
support the retail component.
Hotel /Conference Center
SPPRE believes that the strength of this industry segment be determined for the City of Schertz
over the next five to ten years. Both the Live Oak Town Center and the Gateway Plaza project
include a Hotel Conference Center in their Master Plans. In both projects, these buildings are
being postponed. SPPRE recommends this option be excluded from a Phase 1, but be planned in
the Master Plan and further review the market support for a facility and a potential public /private
partnership.
Public Facility
SPPRE believes that a public facility /activity generator be incorporated into the development.
This facility could serve as an anchor and could accommodate a wide variety of uses. A market
assessment should be completed to determine the range of public facility options that would be
appropriate for the City and complete a review of the potential market demand for specific uses.
SPPRE recommends this option be excluded from a Phase 1, but be planned in the Master Plan
and further review the market support for a facility and a potential public /private partnership.

A Regular Meeting was held by the Schertz City Council of the City of Schertz, Texas, on
November 10, 2009 at 6:30 p.m., in the Municipal Complex Council Chambers, 1400
Schertz Parkway, Building #4, Schertz, Texas. The following members present to -wit:

CALL TO ORDER REGULAR MEETING
Mayor Baldwin called the meeting to order at 6:30 p.m.
INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE
UNITED STATES AND STATE OF TEXAS.
Mayor Pro -Tem Fowler gave the invocation followed by the Pledges of Allegiance to the
Flags of the United States and State of Texas.
PRESENTATIONS
• Presentation/Discussion and possible action regarding a proposal from the
Historical Preservation Committee to undertake a renovation project for the
development of a History Heritage Museum at the City owned house on Live Oak
Road. (Dean Weirtz)
Mayor Baldwin recognized Committee Chair Dean Weirtz who gave a brief Power
Point presentation regarding the Commemorative History of the City of Schertz, the
Committees past and future projects. Chair Weirtz also asked the approval of the
Council to allow the committee to undertake a renovation project for the
development of a History Heritage Museum at the City owned house on Live Oak
Road. Mr. Weirtz answered questions from Council.
Mayor Baldwin and City Manager Don Taylor stated that they had spoken to Mr.
Weirtz and the committee about the use of the structure for a future museum and
believes this structure would require a tremendous amount of work and believes
that Mr. Weirtz and the committee could make it happen. Mr. Taylor stated that it
was his recommendation to the Council to allow the Historical Committee the use
of the structure on Live Oak Road.

Mayor Baldwin and Council thanked Mr. Weirtz and the committee members for
all their work on the various projects.
Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by
Councilmember Carpenter to authorize the Historical Committee the use of
structure as discussed on Live Oak Road for a History Heritage Museum. Vote was
unanimous. Motion Carried
HEARING OF RESIDENTS
Mayor Baldwin recognized the following citizens:
• Mr. Phillip Doyal, 861 Maske Road who spoke against the Maske Road closure.
• Mr. Jack Mitchell, 3413 Sherwin Drive who spoke against Chelsea Street closure.
• Mr. Ramon Cook, 913 Dimrock who addressed the Council regarding bike lanes vs.
mailbox access.
• Rosemary Grayson, 5213 Cabana Drive, who also addressed the Council regarding
bike lane parking.
Discussion and /or Action Items
1. Minutes - Consideration and /or action regarding the approval of the minutes of the
Regular Meeting of November 3, 2009.
Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by
Councilmember Carpenter to approve the minutes of the regular meeting of
November 3, 2009. Vote was unanimous. Motion Carried
2. Ordinance No. 09 -M -43 Texas Municipal Retirement System - Consideration
and /or action regarding approving an ordinance electing for the City to make current
service and prior service contribution to the City's account in the Municipal
Accumulation Fund of the Texas Municipal Retirement System at the actuarially
determined rate of total employee compensation. Final Reading (D. Dykes)
Mayor Baldwin recognized City Manager Don Taylor who stated that nothing had
changed since first reading.
Mayor Baldwin recognized Councilmember Carpenter who moved, seconded by
Councilmember Scagliola to approve Ordinance No. 09 -M -43 final reading. Vote
was unanimous. Motion Carried
3. No Parking in Bicycle Lane — Discussion regarding no parking, standing or loitering
in the City of Schertz Bicycle Lanes. (Item back on agenda for council discussion and
direction to staff)
Mayor Baldwin recognized City Manager Don Taylor who introduced this item
answering questions from Council.

Mayor Baldwin recognized Councilmember Carpenter who again stated the purpose
of bringing this item to Council for consideration was for the safety of the children
using the bike lanes in school zones. Mayor and Councilmember's briefly discussed
their views and concerns.
Mayor Baldwin recognized Assistant City Manager John Bierschwale who asked that
Council allow Public Works and the Engineering Department more time to develop a
plan to resolve the issues brought up and bring this back to Council with their
recommendations. Council concurred. No action taken on this item.
4. Election of Board of Directors for Comal Appraisal District Board —
Consideration and /or action casting the number of votes eligible to submit in the
upcoming election of the Board of Directors for Comal Appraisal District. (Mayor)
Mayor Baldwin introduced this item answering questions from Council. Council
discussed giving each candidate five votes each.
Mayor Baldwin recognized Councilmember Carpenter who moved to extend five
votes each to the candidates identified. Motion fails due to lack of second.
Council further discussed this and it was recommended that the Mayor Baldwin
contact the Mayor of Selma to obtain information on where the votes would help and
to bring this item back on the next agenda. This item was postponed to the November
17, 2009 meeting.
5. Award Bid # 09- PW- 39 -C -01 — West Dietz Creek — Wiederstein Road Bridge Class
Structure — Consideration and /or action awarding a bid for the West Dietz Creek,
Wiederstein Road Bridge to V.K. Knowlton Construction and Utilities, Inc. in the
amount of $251,632.55. (L. Dublin)
Mayor Baldwin recognized City Engineer Larry Dublin who introduced this item
who stated that as part of the 2006 Street Bond Election, the City designated
funding for improvements to West Dietz Creek from Maske Road to the Selma City
Limits. At the Wiederstein Road Crossing, a bridge class structure was not included
because Selma declined to participate in the funding. After the contract was
awarded, signs were posted showing the road to be permanently closed after a
certain date and following uproar from Selma citizens caused the City of Selma to
rethink their position and agrees to split the cost of the structure.
The project was bid on October 22, 2009 with eleven (11) contractors submitting. A
tabulation of the bids is attached showing the low bidder to be V.K. Knowlton
Construction and Utilities, Inc., with a bid of $251,632.55.
The City Engineer concurs with Ford Engineering, Inc. and recommends that Council
award the bid for the West Dietz Creek — Wiederstein Road Bridge Class Structure

Project to V.K. Knowlton Construction and Utilities, Inc., in the amount of
$251,632.55.
Mayor Baldwin recognized Councilmember Trayhan who moved, seconded by
Mayor Pro -Tem Fowler that based on the recommendation of the City Engineer that
the City award the bid for the West Dietz Creek, Wiederstein Road Bridge to V. K.
Knowleton Construction and Utilities, Inc., in the amount of $251,632.55. Vote was

6. FM 1103 & Chelsea Road Construction Project — Discussion and consideration
and /or action regarding the FM 1103 & Chelsea Road Construction Project. (D.
Taylor/L. Dublin)
Mayor Baldwin recognized Assistant City Manager John Bierschwale who introduced
this item stating the concerns of delaying this project in that it would cost the City
more time and more money. Mr. Bierschwale also addressed the concerns of
response times for emergency services. After considerable discussion, it was
recommended to press on with the project and allow Chelsea Road to close. No
action requiretL
7. Resolution No. 09 -R -57 — Discussion and consideration and /or action approving a
resolution appointing and reappointing Directors of the Reinvestment Zone Number
Two, City of Schertz and related matters. (M. Spain)
Mayor Baldwin recognized City Manager Don Taylor who introduced this item
who stated the Reinvestment Zone Number Two, City of Schertz, Texas (the
"Zone "), is governed by a Board of Directors (the "Board ") consisting of eleven
total directors (the "Directors "), six of whom are appointed by the City of Schertz,
two of whom are appointed by Bexar County, and one each of whom is appointed
by each of the San Antonio River Authority, the State Representative for the Zone,
and the State Senator for the Zone.
John Bierschwale and George Antuna are currently Directors of the Zone, and their
terms have expired. Staff recommends that the City Council reappoint John
Bierschwale and George Antuna to their positions as Directors of the Zone.
The City currently has one vacant Director position on the Board, and staff
recommends that the City Council appoint Gary Inmon as a Director of the Zone to
fill such vacancy.
Mayor Baldwin recognized Councilmember Scagliola who moved, seconded by

Mayor Baldwin recognized Mayor Pro -Tem Fowler who stated that Saturday,
November 7, 2009 he had the privilege of attending the Senior Craft Fest in the
absence of the Mayor being out of town. He stated that he was very impressed with
their activities and requested that the City advertize in the Schertz Tales their future
activities.
Mayor Baldwin recognized Councilmember Scagliola who attended the following:
• Monday, November 9, 2009 he attended the MIA/POW Cibolo Valley VFW
ceremony.
• Tuesday, November 10, 2009 he attended the Clemens ROTC Veterans
ceremony.

Mayor Baldwin recognized Councilmember Trayhan who thanked Assistant City
Manager David Harris for his assistance in educating one of his Political Science
classes.
Mayor Baldwin stated that City Councilman Dick Ketsel from the City of Cibolo
has been elected to serve as a representative to the Alamo Regional Rural Planning
Organization for the member cities of Guadalupe, Comal, Karnes and Wilson
Counties.
Mayor Baldwin stated that there is a need for an ex- officio non - government
alternate position on the MPO Transportation Policy Board and asked if the City
could get someone to fill out an application, submit it and be selected to the board.
The first year they would just be an alternate but then move up to a full -time
primary member in 2011. It was suggested that Assistant City Manager David
Harris be that individual.
Mayor Baldwin also stated that he had handed out a news release by Lone Star Rail
District and stated the following:
• Legislative funding: The Legislature allocated $8.7 Million specifically for
the regional rail system between Georgetown and San Antonio. This
funding will be used for the preliminary engineering and environmental
studies.
• Rail relocation funding: The 2009 Texas Legislature appropriated $182
million to the Texas Rail Relocation and Improvement Fund — the first
funding since voters approved the fund four years ago. The money is
intended to help move freight traffic out of urban areas.
• Union Pacific agreement: The Rail District reached an agreement with
Union Pacific to study the feasibility of moving through freight service to a
new line to free up the tracks for passenger rail.
• Federal funding: The Rail District has submitted an application to receive a
portion of the $8 billion in federal stimulus funding for rail. The Obama
administration identified Texas' I -35 rail corridor as a priority area for
future passenger rail.
Mayor Baldwin read the following: "From the perspective of our students,
faculty and staff, this corridor is one single region," said Dr. Denise Trauth,
president of Texas State University, with campuses in both San Marcos and
Round Rock. "We have faculty coming from Georgetown and from Boerne and
up to 10,000 students commuting up and down this corridor. Having rail gives
them a safe and predictable travel option and will help shape the choices they
make about where to work and live."
"Our plans for the future Texas A &M San Antonio campus include a rail
station, which would be huge for our University," said Dr. Maria Hernandez

Ferrier, President of Texas A &M San Antonio. "Imagine the `brain exchange'
between the Universities on the Corridor — Texas A &M San Antonio, UTSA,
Texas State and UT- Austin — when we could share faculty and conduct joint
research, and the students themselves could commute to class."
Mayor Baldwin further stated that the comprehensive market research program
launched by Lone Star Rail District in 2009 analyzed the broad spectrum of
opinions and perceptions of nearly 4 million potential customers throughout the
I -35 corridor.

TML Conference the City of Schertz received an award from Laser Fiche for the extended

Recommendation to create School
Zone on FM 1518 near Corbett
Middle School. (First Reading)
BACKGROUND
With the opening of the new Ray Corbett Middle School adjacent to FM 1518, the
Schertz - Cibolo Universal City School District petitioned TxDOT to create a school zone,
limited in speed during certain hours. As evidenced by the letter exhibit from TxDOT, it
is recommended that a 35 mph school zone be created in the vicinity of Ray Corbett
Drive.
FISCAL IMPACT
There will be no Fiscal Impact as TxDOT will install and maintain all signage required.
RECOMMENDATION
Staff recommends Council approval to create a 35 mph school zone in the vicinity of Ray
Corbett Drive, thus amending Section 86 -118 Maximum limits in School Zones on
specific streets.

BACKGROUND
Section 6.03(e) of the Texas Property Tax Code states "The chief appraiser shall calculate the
number of votes to which each taxing unit other than a conservation and reclamation district is
entitled and shall deliver written notice to each of those units of its voting entitlement before
October 1 of each odd - numbered year. Attached is the voting calculation worksheet that
indicates the number of votes the city is eligible to submit in the upcoming election of the Board
of Directors for Comal Appraisal District.
Attached is the 2010 -2011 Board of Directors ballot for the city. As per section 6.03(e) of the
Texas Property Tax Code, "Voting entitlement is determined by dividing the total dollar amount
of property taxes imposed in the district by the taxing unit for the preceding tax year by the sum
of the total dollar amount of property taxes imposed in the district for that year by each taxing
unit that is entitled to vote, by multiplying the quotient by 1,000 and by rounding the product to
the nearest whole number." In calculating this year's votes, it is determined that the City of
Schertz has 30 votes to cast in this election.
The ballot must be returned by December 15, 2009. This item was postponed to the next
Council meeting to allow the Mayor to contact the County for more details.
