The Schertz Planning and Zoning Commission and City Council held a Joint
Public Hearing on Tuesda~r, AuQUSt 14, 1984 in the Municipal Complex Council
Chambers, 1400 Live Oak Road. Members present were as follows:

#1 CALL TO ORDER
Mayor Sawyer called the meeting to order at.7:00 P.M. and turned the meeting
over to the Planning and Zoning Commission Vice-Chairman Yarling.
#2 PUBLIC HEARING: Zoning Change #58
To receive input from the public on a request by Charlie Kucherka to rezone
approximately 2.7 acres of land from Single Family ~.Dwel7ing District (R-1)
to Neighborhood Service District (NS).
The minutes of this public hearing is a duplication of the City Council
minutes.
#3 PUBLIC NEARING: Zoning Change #59
To receive input from the public on a proposal to rezone approximately 513
acres of land from Predevelopment District (PD) to Industrial District (Ml).
The minutes of this public hearing is a duplication of the City Council
minutes .
#4 PUBLIC NEARING: Zoning Change #60
To receive input from the public on a request by Leon Parker to rezone
approximately 70 acres of land from Predevelopment District (PD) to Mobile
Home District (P1H) with permission for a low water crossing across the
Cibolo Creek.
_ The minutes of this public hearing is a duplication of the City Council
minutes.
#5 SPECIAL PRESENTATION: FM 3009
Because of the length of the public hearing, it was agreed this item would be
presented by the Staff separately during theg~@ meetings.
#6 ADJOURNMENT OF THE PUBLIC HEARING
Vice-Chairman Yarling turned the meeting back over to the Mayor who adjourned
the Public Hearing at 8:25 P.M.
The Schertz Planning and Zoning Commission Commission convened in regular
session after the~Joint Public Hearing in the Municipal Complex Council

Vice-Chairman Yarling called the meeting to order at 8:33 P.M.

Special Session. July 17, 1984.
Lee Boswell make a motion to approve the minutes. Merwin Willman seconded the
motion and the vote was unanimous in favor,
#3 CONSIDER AND TAKE APPROPRIATE ACTION: Vacate and replat Horseshoe Oaks 26
Earl Hartzog advised the Commission a public hearing would be required on this
vacate and replat because some of the lots had been sold. The Subdivision
Ordinance has not changed since this law was passed by the state. Recommend
the Commission follow the guide lines outlined in Vernon statutes.
There was a lengthy discussion on why the lots needed to be changed. Neil
Fisher from PFA advised the Commission the lot changes were being made to allow
for larger homes in order to have the necessary side yards. There was some dis-
cussion on the difference between the reliminary and the area to be vacated.
Neil Fisher advised that there should~~e a~change from the preliminary and couldr'f
understand the reason - he would have the answer before the public hearing.
After a short discussion, Ray Stanhope made a motion to schedule the vacate and
replat for public hearing. Darwin Peek seconded the motion and the vote was
unanimous in favor.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Rezoning Request Homecraft - Bligh
Property FM 78 - 40 acres
Lynn Miilegan and John Ragsdale presented this rezoning request. There was a
lengthy discussion about Manufactured Homes, Mobile Homes and Modular Homes.
It was agreed these were Modular Homes and this should be a R5 rezoning request
instead of Mobile Home Districts. The master plan presented showed all lot
sizes as 50 x 100 and would be Single Family Dwelling. Some lots would be lar-
ger than 5,000 square feet and drainage areas and floodplain identification
would be part of the platting process.
Merwin Willman made a motion to disapprove the rezoning request until it was
submitted in accordance with Section 3,2, Article XIX of the. Zoning Ordinance.
The items were reviewed by the Commission and it was agreed a number of items
were omitted from the application on the plan submitted with the request. Lee
Boswell seconded the motion and the vote was unanimous in favor.
_ _ After a short discussion, ..Ray Stanhope made a motion to. schedule a special
session on Thursday, August 16 at 6:00 P.M. to consider this item. Lee Boswell
.seconded the motion and the vote was unanimous in favor.
#5 CONSIDER AND TAKE APPROPRIATE ACTION: Specific Use Permit - Satellite T.V.
_ reception dish in property zoned
- Residential District - 1116 Antler Drive
Earl Hartzog presented the Commission a copy of a letter from Clyde Dishong,
- 1116 Antler Drive; to place a satellite T.V. reception dish in his yard. The
Commission was advised that according to the ordinance this was a new and
scheduled use or maybe a need for a specific use permit.
Mr. Dishong advised the Commission on a ruling in Florida that these T.V.
dishes could not be handled any differently than a T.V. antenna.
After a lengthy discussion, Bob Andrews made a motion to have the City Attorney
check the legal aspect and schedule a public hearing, if necessary, for a new
and unscheduled use through the City Council. Darwin Peek seconded the motion and
- the vote was unanimous in favor.
#6 CONSIDER AND TAKE APPROPRIATE ACTION: Variance to sidewalk width - West side
of Cedar Lane
Earl Hartzog advised the Commission of the location in Horseshoe Oaks Unit I
and ,of HUD requirements for sidewalks. The Commission was advised this error
was noted before the final inspection of the project but was overlooked in the
framing inspection.
There was a short discussion.wi'th the Contractor, Steven W. Zbranek, about these
types of errors and it was common to have problems on the size of sidewalks.
Mr. Zbranek told the Commission the size of the sidewalks would be increased to
four feet in the rest of the project, and the change in size will hardly be
noticed. It was agreed by the Commission the City Inspector should have a check
list and the sidewalk width should 6e one of the items to check on the plans and
at the site.
Bob Andrews made a motion to approve the request for the ordinance and Lee Boswell
seconded the motion.
#7 CONSIDER AND TAKE APPROPRIATE ACTION: Special exception to Sign Ordinance -
Honey-Dew FM 78
Earl Hartzog advised the Commission a request has been submitted by Honey.-Dew
- for a special exception to the Zoning Ordinance on the restriction on flashing
- lights.

i ~ After a lengthy discussion on enforcement of ordinance, grandfather clause and
a traffic hazards, Ray Stanhope made a motion to recommend to the Board of
Adjustment this request be denied. Merwin Willman seconded the motion and the
vote was as follows:

Nays : Peek
' Abstentions: Boswell and Andrews
#8 CONSIDER AND TAKE APPROPRIATE ACTION: Zoning Change #58
The items discussed at the public hearing were reviewed by the Commission.
There was discussion of the public right-of-way access traded with Mr. Beck,
and Charlie Kucherka advised the Commission part of the trade agreement was
that we could use this area in his project as access to FM 3009.
Ray Stanhope made a motion to recommend approval of the Neighborhood Service
Zoning provided arrangements could be made for an interior road using Mr. Beck's
property as the only access to FM 3009. Bob Andrews seconded the motion and
.the vote was unanimous in favor.
#9 CONSIDER AND TAKE APPROPRIATE ACTION: Zoning Change #59
The recommendation for the roadway between the railroad tracks was discussed
by the Commission. It was agreed the master plan should be updated to include
_ this area with the road. Lee Boswell made a motion to recommend approval and
Merwin Willman seconded the motion. The vote was unanimous in favor.
#10 CONSIDER AND TAKE APPROPRIATE .ACTION: Zoning Change #60
The items discussed in the public hearing were reviewed by the Commission.
After a lengthy discussion, it was agreed the City Attorney should review the
rear access easement and determine if it could be used by the public. Ray
Stanhope made a motion to defer action, using the option for the ten days, to
have additional input from Mr. Parker and City Attorney on this matter. Bob
Andrews seconded the motion and the vote was unanimous in favor.
It was agreed to meet on this item in ten days. Thursday,. August 23, 1984 was
the date set for a spec~~a7 meeting.
#11 CONSIDER AND TAKE APPROPRIATE ACTION: planning and Zoning Commission applicants
Earl Hartzog advl~sed the Commissi'on~letters were sent to all the current appli-
cants on file and the following were present;
James Harden
,l.R. Wyatt
Robert Booth
Vice-Chairman advised those present that the Commission would like to interview
each applicant separately. However, because of the open meeting act, they were
not required to leave. The Commission interviewed each applicant, and after a
lengthy discussion, Ray Stanhope made a motion to recommend James Harden to
City Council. Lee Boswell seconded the motion and the vote was unanimous in favor

others for staying for the meeting.
#12 GENERAL DISCUSSION
Earl Hartzog gave the Commission a draft of the new Subdivision Ordinance.

Merwin Willman asked the members to check their files for the zoning report on
satellite dishes and please bring it to the next meeting.
#13 ADJOURNMENT
Vice-Chairman Yarling advised the Commission of the meeting scheduled for
Thursday, August 16, 1984 at 6:00 P.M. and adjourned the meeting at 11:48 P.M.
