Minutes from Planning & Zoning Commission hearing in accordance with
City Ordinance ~~139 on a request from Koch to rezone a plat (the Southwest
part of Lot 19, the Southwest part of Lot 20, all of Lot 17 and 18, Block
No. II., Koch Addition No. IIo, Schertz, Texas, Guadalupe County Texas,
G. Malpaz Survey, Guadalupe County, Texas, according to play recorded of
said Subdivision in Volume 2, page 114 of the Map and Plat Records of Guadalupe
County, Texas, and described more particularly as a 1.209 acre tract) on
the corner of Live Oak Rd. and Exchange Ave, to a C-1 Zone.
Commission Members Present:

Don Seeba
Chuck Sharp
Earl Sawyer
The hearing was called to order by the Chairman, Mr. Wise, and the
meeting was thrown open for comments from the property owners present.
1. Mr. Bill Schuler stated that he was the representative for the Koch'.s.
He said that the Koch request for rezoning was for the purpose of opening a
"White's" Store, and that the request was reasonable and that this would
be the highest and best use the land could be put too. He assured all present
that the noise level would be low and that the store would fit in with the
future needs of Schertz, and possibly could help reduce taxes of property
owners.
2. Mr. Collins (property owner) asked if this business would lower
the property value of residents.
3. Mr. Schuler stated that property values would not be lowered, and
asked if the Commission would read the types of business permitted in a
C-1 zone. Mr. Seeba read the C-1 regulation.
4. Mrs. Gant asked if a fence would be erected to protect nearby
residents.
5. Mr. Schuler stated that a privacy fence will be installed by White's.
6. 802 Exchange Mrs. asked if the property was being sold
or rented .
7. Mr. Schuler stated that the property was sold and that a contract had
been signed between the Koch's and White's Store (Mr. Kraft).
8. Mrs. Bobbie Koch stated that the property was already zoned R4 and
that under this classification an apartment could be built there with no
hearing, She also stated that the contract between the Koch's and 4Jhite's
Store would be cancelled if the property was not Zoned C-i.
9. Mrs. Woodward expressed fear that trash would be a problem.
10. Mr. Schuler stated that a privacy fence would screen trash from view.
11. Mr. Rowell said that he did not want to live across the street from a
store.
`12. Mr. Rowell (Fred) and Mrs. Woodward, 810 and 806 Exchange respectively,
(directly across Exchange from subject property) remained steadfastly against
rezoning and were the only two dissenting property owners present.
Therefore, the following recommendation is respectfully forwarded:
Recommendation to the City Council regarding Koch
property on the corner of Live Oak Rd. and Exchange
rezoning request.
The Planning and Zoning Commission hereby recommends that the Southwest
part of Lot 19, the Southwest part of Lot 20, all of Lot 17 ~ 18, Block No.
II, Koch Addition No. II, Schertz, Texas, Guadalupe County, Texas, G. Malpaz
Survey, Guadalupe County, Texas, according to plat recorded of said Subdivision
in Volume 2, page 114 of the Map & Plat Records of Guadalupe County, Texas,
and described more particularly as a 1.209 acre tract be rezoned from R4 to
C-1, provided that the following provisions are met:
(1) That only a White's Auto Store be built on this particular
property.
(2) That a fence with a minimum height of 8' (eight) feet be
erected between the White's Store and private property on
adjacent sides such as from Live Oak Rd, to alley and from
Exchange to alley in the form of an "L",
