06-25-1985 PLANNING AND ZONING MINUTES
The City of Schertz Planning and Zoning Commission convened in a regular session
on Tuesday, June 25, 1985 in the Municipal Complex Conference Room, 1.400 Live
Oak Road. Members present were as follows:

#1 CALL TO ORDER
Chairman Yarling called the meeting to order at 7:00 P.M.
#2 APPROVAL OF MINUTES: Regular Session June 11, 1985
Plerwin Willman made a motion to approve the minutes. James Harden seconded the
motion and the vote was unanimous in favor.
#3 CONSIDER AND TAKE APPROPRIATE ACTION: Final Plat Schertz Modular Home Park
Earl Hartzog advised the Commission that the master layout was included in their
package. He also advised that the final plat was on four sheets and recommended
the following:
- sheet 3 of 4 needs match line C identified or better identification
on sheet 2
Note 3 should include police and emergency vehicles
- confirm FP1 78 right-of-way
- provide cross section of the floodplain elevation
--plat needs Volume and Page and owners of surrounding property
Mr. Hartzog also advised the Commission that Mr. Gilmore, City ~1anager, felt the
Commission has the authority to approve the development in the floodway and there
should be no need for Council action.
It was recommended the owner be required to comply with F.E.M.A. recommendations.
Paul Denim, representing Fisher Engineering, briefed the Commission on progress of
the plans at the Park for better water flow and drainage via new culverts and
bridges.
Merwin Willman, referring to Paragraph D of the Mobile Home Ordinance, asked about
whether an R.V. is required to back in but not out and if this was being enforced..
Leon Parker commented that there should be no problem with the enforcement of this.
Merwin Willman asked if the construction plans will contain an emergency warning
system. Ty Brisgill asked how the periodic inspections were going to be con-
ducted. Earl Hartzog commented that both were up to the City Emergency Manage-
ment Coordinator, Ed Melton.
There was a brief discussion on evacuation of the Park in case of emergency.
Paul Denim commented that the plans are. to have a main route and an alternate
route in an emergency situation.
Darwin Peek asked about how many F,E.M.A. recommendations can be enforced. Merwin
Willman commented it is up to the Park owner.
Chairman Yarling recommended approval of the final plat contingent upon Council
approval of the liability of R.V.'s in the floodway. Earl Hartzog commented that
D9r. Gilmore, City Manager, felt the Commission has the authority to approve
development in the floodway without need for Council action. -P1r. Hartzog pointed
out that there is a certain amount of liability to the City in the approval of any
development. Merwin Willman commented that each City Council member receives a
copy of the Planning and Zoning minutes.
Darwin Peek made a motion to approve the final plat for Schertz Modular Home Park
contingent upon requiring identification of the floodway, providing cross section
of floodplain elevation and requiring F.E.M.A. recommendations. Merwin Willman
seconded the motion and the vote was unanimous in favor.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Plan Northcliffe Development
Earl Hartzog advised the Commission that Mr. Steele did not attend the Schertz/
Cibolo Joint Commission meeting.
Ken Greenwald commented that Cibolo has the same minimum requirements as Schertz
as far as the 5,000 square foot lot size.
Earl Hartzog recommended that if this development should come about, the developer
should be held to the requirements of lot size, ingress/egress, building of roads
and building setbacks.
Darwin Peek made a motion to disapprove the Preliminary Plan Northcliffe Develop-
ment until all problems (minimum subdivision standards, additional access and
availability of utilities) were worked out. Merwin Willman seconded the motion
and the vote was unanimous in favor.
#5 CONSIDER AND TAKE APPROPRIATE ACTION: Final Plat Greer/Ross Subdivision
Earl Hartzog advised the Commission that the City Engineer had given his approval
of the construction plans and floodway. Mr. Hartzog also said the City Staff felt
the floodway should be identified on the plat.
Darwin Peek asked if the floodplain statement needed to be on the plat. Earl
Hartzog replied that according to the City Engineer, because the developer is going
to elevate the lots, the minimum slab-elevation statement should be sufficient.
James Harden asked if there were going to be driveways on Lots 7 and 8. Fred Ross
said they had been placed and the permits applied for.
Merwin Willman made a motion to approve the Final Plat Greer/Ross Subdivision
contingent upon the addition of the identification of the floodway,_a cross
section to identify the floodplain and identification of minimum slab elevation
for laymen. James Harden seconded the motion and the vote was unanimous in favor.
#6 CONSIDER AND MAKE RECOMMENDATION: Revised-Sign Ordinance
Ken Greenwald suggested that the Commission take the time to evaluate House Bill
1330 - City Regulation of.Signs - before making changes in the Sign Ordinance.
Everyone on the Commission will be receiving a copy.
Chairman Yarling recommended the revised Sign Ordinance be tabled and put on the
agenda for the next regularly scheduled meeting.
#7 GENERAL DISCUSSION
Earl Hartzog asked the members for an update on their addresses and telephone
numbers. He also advised them that name tags were being ordered.
Mr. Hartzog advised the Commission that the Schertz City Council and the Planning
and Zoning Commission will conduct a public hearing on July 2, 1985. The purpose
of the hearing is a rezoning request by Joseph Ruscin for an eleven acre tract of
land from Multi-Residential Dwelling District (R-4) to Neighborhood Service Dis-
trict (NS).
Mr. Hartzog also reminded the Commission of the Fourth of July Jubilee scheduled
at the Schertz Park.
Ken Greenwald briefed the Commission on some of .the items covered at a conference
he and other Council members had attended in Galveston. One of many items covered
was the difference between mobile homes and modular homes. He questioned why we
are going with the Southern Building Code versus the National Code.
Mr. Greenwald also told the Commission that those attending the conference had
received what amounted to a promotional briefing about Cardinal Industries.
(Everyone received a copy of some information about Cardinal.) Cardinal is looking
to locate one of their new plants in Texas.
Mr. Greenwald suggested the Commission needs to get started on the Mobile Home
Ordinance. He recommended four specific sections: R.U.'s, Mobile Homes, Modular
Homes and Manufactured Homes.
Mr. Greenwald also had some information about conducting plan commission meetings
and open meetings. He asked Earl Hartzog to have copies made for distribution to
the Commission members.
Councilman Ray Stanhope, referring to the copies received of the information about
Cardinal Industries, commented that the terminology clearly defines the difference
between modular homes and manufactured homes.
Both Mayor Sawyer and Councilman Stanhope remarked that the Council and Planning
and Zoning Commission meetings in Schertz seem to be conducted in a fairly orderly
manner in comparison to some other cities.
Merwin Willman said he had checked the minutes as far back as January 22, 1985
and could not find where a variance from 30' streets to 28' streets had been
granted for Windy Meadows. After a brief discussion, the other members agreed
it had been granted.
Mr. Willman also mentioned a sign on the corner of Oak and Pecan advertising the
future home of fast food. He commented this area was in the ACUIZ Zone and felt
a fast food establishment would be frowned upon. Earl Hartzog commented he did
not know if a permit had been applied for, but one would not be granted without
platting the land.
Ty Brisgill inquired about the number of City inspectors employed by Schertz. He
said he visualized that with the growth of the City there might be an enforcement
problem.
Ken Greenwald commented that the need for more City Staff had been discussed with
the City Manager - dependent upon the budget.
. Chairman Yarling commented upon the success of some other cities in enforcing no
parking on lawns.
Darwin Peek asked about potential problems when two cities have common boundaries.
Mayor Sawyer commented that the time to work out any problems was now - before
further development. Earl Hartzog said agreements have been signed on ETJ boundaries
for Schertz and Cibolo.
James Harden asked about the tour that was conducted on June 15, 1985. Chairman
Yarling said it was fantastic, Darwin Peek said it was informative,-and Mayor
Sawyer said it gave a good idea of the progress going on in the area.
Chairman Yarling asked about the status of the American Guestel. Mayor Sawyer
commented that it had experienced some setbacks.
The next regularly scheduled meeting is July 9, 1985.
