09-03-1985 PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission-and City Council conducted a Joint Public Hearing on Tuesday, September 3, 1985 in the Municipal Complex Council Chambers, 1400 Live Oak Road. Members present were as follows: PLANNING AND ZONING COMMISSION CITY COUNCIL THOMAS YARLING, CHAIRMAN EARL SAWYER, MAYOR BOB ANDREWS, VICE-CHAIRMAN CHUCK SHARPE MERWIN WILLMAN ADOLPH AGUILAR JAMES HARDEN KEN GREENWALD TY BRISGILL HAL BALDWIN DAVID ALLEN RAYMOND STANHOPE MEMBERS ABSENT DARWIN PEEK, SECRETARY CITY STAFF " EARL HARTZOG, PLANNING COORDINATOR NORMA ALTHOUSE, RECORDING SECRETARY JUNE KRAUSE, CITY SECRETARY JIMMY GILMORE, CITY MANAGER #1 CALL TO ORDER Mayor Sawyer called the meeting to order at 7:00 P.M. and .turned the meeting over to the Planning and Zoning Chairman, Thomas Yarling. #2 PUBLIC HEARING - Zoning Change #72 To receive input from the public on a rezoning request by Morton Southwest for a 105 acre tract of land from Single Family Dwelling District (R1 & R2) to General Business and Planned Unit Development (PUD). The minutes of this public hearing is a duplication of the City Council minutes. #3 GENERAL DISCUSSION There was none. #4 ADJOURNMENT OF PUBLIC HEARING Chairman Yarling turned the meeting back-over to Mayor Sawyer who adjourned the Public Hearing at 7:22 P.M. The Planning and Zoning Commission reconvened in a special session after the Joint Public Hearing in the Municipal Complex Conference Room. #5 CALL TO ORDER Chairman Yarling called the meeting to order at 7:28 P.M. #6 CONSIDER AND MAKE RECOMMENDATION: Zoning Change #72 There was a lengthy discussion on this zoning change. A lot of concern was expressed about the`5500 square foot lot size. Earl Hartzog commented that we need something in the ordinance between the 75' frontage and the 50' front- age. Mr. Hartzog said Morton Southwest went with the PUD zoning so their homes would not be classified as garden homes. Bob Andrews remarked that if there is nothing larger than 5500 square feet, then everything else is smaller. Earl Hartzog commented that the lots are basically the same as Woodland Oaks. He also commented that Savannah Square is a little bit smaller. Merwin Willman pointed out that a true PUD is a mixture of housing and land use. Mr. Willman also commented that we need to rework PUD. David Allen remarked that no doubt they are trying to build homes with the best salability so the developer can make a profit. Bob Andrews commented it is easier for the deve Loper to scale down rather than to scale up. He felt we would like to have more people in the future, but do not need wall-to-wall homes. Ty Brisgill made comment that some of the lots in Woodland Oaks originally sched- uled to be developed by Jim Shepherd Homes are still vacant. Earl Hartzog re- m inded him, though, that the lots have already been laid out and therefore will remain the same. Merwin Willman commented that the Subdivision Ordinance specifies the minimum lot size, but the developer can go bigger. Ty Brisgill said sometimes economics dictates the size. Chairman Yarling suggested Morton Southwest should match up with the adjacent lots in Horseshoe Oaks. David Allen commented that the main through streets going from one subdivision to another are like going through a maize. Earl Hartzog said the ordinance tells them to discourage through traffic. Merwin Willman said they are discouraging . through traffic hoping it will eventually use Schertz Parkway and relieve the con- gestion on FM 3009. Bob Andrews asked if we can request the developer to make a concession in kind. Earl Hartzog replied there is nothing in the ordinance - it should have been brought out at the public hearing. David Allen commented. that the children of people in the new subdivisions need recreational facilities. He felt without these facilities we are creating a ghetto-type situation. Earl Hartzog commented there is nothing in the ordinance at present regarding recreational facilities. Merwin Willman, noting that Woodland Oaks is providing it's own recreational facilities, remarked it is better to have them centralized than a bunch of small areas. Bob Andrews. commented he could foresee a runover from this area into the Wood- land Oaks Park. Merwin Willman said we can ask the developer about park land. Earl Hartzog pointed out this is the same ordinance as used at College Station. College Station lost a case in court, but then won an appeal. Mr. Hartzog com- mented that College Station is not developing because of requiring park land. Mr. Hartzog also commented no one can look into a crystal ball to predict future costs for land, sewer improvements, street improvements, etc. Merwin Willman said he thinks. sometimes we get too concerned about providing things for families. Bob Andrews commented he thought we have adequate playground facilities in Schertz. Ty Brisgill noted that we require two access streets in a subdivision, He asked if we take care of this when they present the plat. Earl Hartzog replied yes we do. Chairman Yarling asked for a motion on the zoning request. David Allen made a motion to recommend to Council the approval of Zoning Change #72, provided the lot sizes match up with. the adjoining lots on both sides. James Harden seconded the motion and the vote was unanimous in favor. #7 CONSIDER AND MAKE RECOMMENDATION: Subdivision Ordinance The Commission members reviewed the ordinance and presented suggestions and cor- rections as they reviewed. Chairman Yarling made a request that the revised Subdivision Ordinance be on the agenda for the September 10, 1985 meeting. #8 CONSIDER AND MAKE RECOMMENDATION: Applicants for Planning and Zoning Commission Chairman Yarling informed the applicants this was an open meeting. He also in- formed them that the Commission would interview each of them separately, and if they so desired, they could leave the room while the others were being interviewed. The Commission interviewed the following three applicants: George Vick - 508 Marilyn Drive Donald Wilson - 104 Firestone Allen Hamblen - 500 Aviation After all three applicants had been interviewed, Chairman Yarling asked them to leave the room while the Commission made it`s decision. As a result of the. Commission's discussion; Ty Brisgill made a motion to recommend to City Council Donald Wilson's appointment to the Planning and Zoning Commission. James Harden seconded the motion and the vote was unanimous in favor. The applicants were asked to come back in the room. Chairman Yarling informed them of the Commission's decision and thanked then for their interest and. for coming. #9 GENERAL DISCUSSION Earl Hartzog reminded the Commission their next meeting is September 10, 1985 and it has a full agenda. Mr. Hartzog said no one had been selected to take his place and Mr. Gilmore, the City Manager, would be filling in. Mr. Hartzog discussed some of the good and bad requirements of his position as Planning Coordinator. He said he had enjoyed working with the Commission and would still be working closely with them through his new employment. Merwin Willman asked if the Commission had deleted the non-access easement at the Schertz Business Park. Mr. Willman said if so it was a mistake. Earl Hartzog replied that the non-access easement was on the plat, but the project engineer had persuaded the Commission to delete it. There was some discussion on driveway cuts and the number allowed. Earl Hartzog commented that as long as there is enough space (beyone 100 feet), as many are permitted as needed. Mr. Hartzog also commented platting is what is needed to control it and the one-foot non-access easement is the control. Earl Hartzog remarked on the barricades closing off roads to Scenic Hills at Northcliffe. Mr. Hartzog said a mistake had been made granting them permission for a guardhouse - Comal County refuses to accept the plat as long as the barricades remain. .Mayor Sawyer had sent out some information packets and letters to several businesses. potentially relocating in our area. Earl Hartzog commented there had been two nice courtesy letters received back from Hampton Inns and GM. Bob Andrews asked about the status of Schaefer Park on FM 1518. Earl Hartzog replied he had sent a letter and Don Decker may possibly be in to request an extension. There was a brief discussion about Schertz ETJ south of FM 78. James Harden asked about the status of American Guesthouse - he noticed a sign had been put up. Earl Hartzog replied they were waiting on financing. Ty Brisgill asked when the walk through was scheduled for Woodland Oaks. Earl Hartzog informed him it was scheduled for September 10 ay 9:00 A.M. Ty Brisgill also commented he did not think the door to City Hall should be rusty - it gives a bad first impression. David Allen asked about the status. of Carda 35 (Barshop). Earl Hartzog replied the plat was tentatively scheduled to be presented September 24, 1985. Mr. Hartzog commented the Commission had questioned the third island. There is a big oak tree and Barshop is trying to save it. They have asked for permeal pavers and the Staff wants more information on this. There is concern over grass growing and possibly causing loss of traction. Chairman Yarling said in his opinion it was a good idea and should be looked into thoroughly. David Allen asked if there should be an Overlay Ordinance for Schertz Parkway. He also asked if we could use the Jack Hays Overlay Ordinance and just change the name. P1r. Allen commented it should be done before construction starts. Earl Hartzog commented you also have to take into consideration those businesses already located there. Merwin Willman commented the Commission may want to add some things to the Overlay Ordinance for Schertz Parkway and suggested this should be added to the Feedback List. David Allen made the observation that Schertz will have two beautiful entrances to the City (Jack Hays Blvd. and Schertz Parkway) and asked if there should be an Overlay Ordinance established for FM 1518. Merwin Willman commented that all of FM 1518 does not belong to Schertz and the AICUZ would present a problem. Mr. Willman said he felt FM 1518 would be only a minor entrance after Schertz Parkway is completed. Chairman Yarling invited Donald Wilson to the Next meeting scheduled for Septem- ber 10, 1985. There was some question as to whether or not enough members could be present at the next meeting for a quorum. Earl Hartzog suggested Bob Andrews contact Darwin Peek if he felt he needed him to have a quorum present. Chairman Yarling adjourned the meeting at 9:38 P.M.
