11-12-1985 PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission convened in a regular session on
Tuesday, November 12, 1985 in the Municipal Complex Conference Room, 1400 Live
Oak Road. Members present were as follows:

#1 CALL TO ORDER
Chairman Yarling called the meeting to order at 7:00 P.M.
#2 APPROVAL OF MINUTES: Regular Session October 22, 1985
Merwin Willman made a motion to approve the minutes. Bob Andrews seconded the
motion and the vote was unanimous in favor.
#3 CITIZENS' INPUT
There was none. -
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Plat Sagemont Unit I
Chairman Yarling asked if there were-any Staff comments.
Steve Simonson informed the Commission that Tom Funk of SAFES questioned some of
the street names. The Streets and Parks Department expressed some concern over
the drainage into Woodland Oaks. Mr. Simonson also reported that Ford Engineering
recommends a one-foot non-access easement along the north side of Sagemont Drive.
Mr. Simonson said there had been some questions on the 12" water main, but Water
and Sewer Superintendent, John Bierschwale, felt that should be no problem.
Merwin Willman commented that the Commission should have received a master plan
before considering the preliminary .plat.
David Allen asked if this was a PUD and the answer was yes.
Don McCrary and Roger Medina of Henry Bain Engineers were at the meeting to
represent Sagemont Unit I.
Don McCrary said it was his understanding the master plan had been submitted
by Wendell Davis at the same time the rezoning request had been presented.
Mr. McCrary said the master plan was a good one and nothing had been changed.
There was a lengthy discussion on the required 50' frontage and the fact that
the Commission members could not determine this frontage on the preliminary
plat.
Don McCrary pointed out that two figures on the plat needed to be added
together and assured the Commission all the lots met the requirements of the
50' frontage.
There was also some discussion on the minimum 5500 square foot lot require-
ments and the fact that a stipulation of approving the rezoning was that the
lots match the adjoining lots in Woodland Oaks.
Chairman Yarling asked Don McCrary if he could make a blanket .statement that
all the lots were a minimum of 5500 square feet and all had a minimum of a 50'
frontage. Mr. McCrary answered he could absolutely make that statement.
David Allen asked Mr. McCrary how strongly he felt about the street names and _
if any of them would be subject to change. Mr. Allen commented that someone
from EMS had pointed out that several of the street names sound very similar
over the dispatch radio, especially in an emergency type situation..
Steve Simonson remarked that the street names have to be approved yet by the
San Antonio Post Office and Mr. McCrary said he would take David Allen's com-
ments into consideration.
Ken Greenwald asked Don McCrary if he had started the drainage calculations yet
and Mr. McCrary replied yes he had and .foresaw no problems as most. of this
development was at the top of a hill.
There was a brief discussion on the recommended one-foot non-access easement
and it was decided to go with the easement on Sagemont only.
Merwin Willman commented that the ordinance calls for acceleration/deceleration
lanes on the entrance to the development, but we could go with a tapered ap-
proach, that approach being 10' down to 0' in a ninety foot distance. Don
McCrary said that should be no problem with the stipulation that they could go
only as far as the guard rail at Autumn Winds and then start the approach.
Chairman Yarling pointed out that the Lot and Block Numbers and the Floodplain
Statement need to be on the plat.
Mer--win Willman also pointed out that the ordinance requires water and sewer lines
be indicated on the plat.. Don McCrary replied- that the sewer lines run down the
middle of the street and the water lines are in the setback.
Bob Andrews said he noticed gas lines indicated on the plat and asked if gas
service was anticipated in the area. Don McCrary said they originally thought so,
but it looked now as if it would be all electric.
There was more discussion on whether or not the Commission had a master plan. -
Steve Simonson did find the master plan - it had been submitted with_the PUD
rezoning request.
Merwin Willman commented that according to the ordinance the Commission needs
a master plan for any large tract of land, not just for a PUD.
Chairman Yarling asked if we have to accept the proposed PUD as the master plan
and if it meets the criteria. Merwin Willman said yes if everyone agrees.
Merwin Willman made a motion to recommend approval of the Preliminary Plat Sage-
mont Unit I provided the following corrections are made: Lot and Block Numbers,
Floodplain Statement, one-foot non-access easement on north side of Sagemont,
and the tapered approach at the entrance. David Allen seconded the motion and
the vote was unanimous in favor.
David Allen also commented again about the consideration of changing some of the
street names.
#5 CONSIDER AND MAKE RECOMMENDATION: Silvertree Park Subdivision - Request for
Setback Variance
Representatives of Silvertree are requesting approval of changes to some of the
side setback lines. Some of the lots presently are approved with 20' side set-
backs and they would like to revise these to the 7' setback as required in the
ordinance.
In regard to the letter in the Commission package, David Allen asked what a red
line plat was. He was informed it is a plat with red lines on it.
Steve Simonson informed the Commission the only Staff comments were from John
Bierschwale, Water and .Sewer Superintendent, regarding Cherrywood Lot #3. Mr.
Bierschwale was concerned if there was enough room for clearance with the fire
hydrant. Don McCrary, representing Silvertree Park, felt there should be no
problem. -
Chairman Yarling commented this setback variance was basically in line with what
was done on Cyrus McCormick.
David Allen made a motion to recommend approval of a request for setback variance,
as indicated on red line plat, for Silvertree Park Subdivision. Donald Wilson
seconded the motion and the vote was unanimous in favor.
#6 CONSIDER AND MAKE RECOMMENDATION: Scenic Hills Phase II,~Section I - Request
for Private Streets Variance
Bob Andrews asked Steve Simonson if he had gotten any legal opinions on the
request. Mr. Simonson replied he had not.
There was a brief discussion bringing up such matters as to whether or not the
City of Schertz provides utilities to Scenic Hills, whether or not the City of
Schertz provides any services to Scenic Hills, and whether or not they have a
Homeowner's Association.
Donald Wilson made a motion to recommend approval (as a continuation of private
streets) of a request for private streets variance for Scenic Hills Phase II,
Section I. Bob Andrews seconded the motion and the vote was unanimous in favor.
#7 CONSIDER AND MAKE RECOMMENDATION: Zoning Ordinance
The Commission reviewed and made their recommended changes to Article I through
Article V, Section 3.8 of the Zoning Ordinance.
Bob Andrews made a motion to accept the changes recommended to Article I through
Article V, Section 3.8 of the Zoning Ordinance. David Allen seconded the motion
and the vote was unanimous in favor.
Chairman Yarling said that Article V, Section 3.9 through Article IX would be
reviewed at the special session on Tuesday, November 19, 1985.
#8 GENERAL DISCUSSION
Steve Simonson informed the Commission that the City will be taking over a lot.
' of inspection functions - they will be making decisions on how the inspections
are to be done and who will be handling them. _
Ken Greenwald commented he had a letter from Larry Thomas and that the Joint
Venture Group would like to have an overlay ordinance written up for Schertz
Parkway.
Mr. Greenwald said the next Joint Schertz-Cibolo meeting would be on November
18, 1985.
Merwin Willman commented that in the past we have rezoned a lot of areas by
` request of prospective developers and the areas have sat there undeveloped.
Mr. Willman asked the Commission if they thought we should send the developers
` letters informing them that if nothing is developed, then the area will revert
back to the original zoning.
After some discussion on whether this should be on a specific or a selective
basis, the Commission agreed it was a good idea and should be done on a selective
basis. The Commission also felt this should be a stipulation from now on when an
area is rezoned for a prospective developer. There was discussion on setting up
some kind of time frame for this.
Bob Andrews said he had noticed a new Persimmon Hills Apartments sign on FM 3009
and wondered if it was a new one or the old one redone.
David Allen commented he wanted to thank whoever was responsible for getting the
yard across the street mowed - it had taken a long time to ,get results.
Ken Greenwald remarked that getting action as a result of letters is a lengthy
process.
Bob Andrews noted that the road to Dobie Middle School is now open and they are
working on the stop light at FM 3009 and Elbel Road. Ken Greenwald said they
had guaranteed the stop light by the end of November.
A Joint Public Hearing is scheduled for November 19, 1985.
Thee next regularly scheduled meeting is November 26, 1985.
