11-26-1985 The Schertz Planning and Zoning Commission convened in a regular session on
Tuesday, November 26, 1985 at 7:00 P.M. in the Municipal Complex Conference
Room, 1400 Live Oak Road. Members present were as follows:

#1 CALL TO ORDER
Chairman Yarling called the meeting to order at 7:00 P.M.
#2 APPROVAL OF MINUTES:
Regular Session November 12, 1985
Merwin Willman made a motion to approve the minutes. Bob Andrews seconded the
motion and the vote was unanimous in favor.
Special Session November 19, 1985
Merwin Willman made a motion to approve the minutes. Ty Brisgill seconded the
motion and the vote was unanimous in favor.
#3 CITIZENS' INPUT
There was none.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Final Plat Sagemont Unit I
Merwin Willman commented .that all the items looked good except the requirement
for a tapered approach statement on the plat. Steve Simonson stated that would
go on the construction plans. Merwin Willman asked how we could be sure. Bob
Andrews remarked that we're working off this recorded plat and the tapered
approach should be shown, especially if in the future the land is sold. There
was a brief discussion on this.
Merwin Willman also pointed out that the statement dedicating the streets needs
to be signed by the owner - it is not signed on the plat.
Ty Brisgill commented on the fact that presently they have only one access to a
public street and according to the Subdivision Ordinance they should have two
accesses.
Ken Greenwald said that two accesses are shown on the master plan.
Ty Brisgill asked what we have that says they will put the second one in and
commented that it is theoretically possible they can build with only one.
Ken Greenwald said the problem was with the two other properties involved.
Bob Andrews commented it is a good idea to have the discussion on it included
in the minutes for future reference.
Merwin Willman remarked that the second access road should be built before
the subdivision is accepted by the City.
Ty Brisgill asked if we should approach it section by section - if we get to
the third section and there's still no road, what then?
Bob Andrews commented that even five years from now, the master plan will be
in the files of the Planning Coordinator.
Merwin Willman said it should be completed before the last section is built
out.
Bob Andrews suggested that maybe in the future we could stipulate the road be
built before starting another section.
David Allen commented on the fact that he had recommended the street names be
changed so they all wouldn't sound the same. -
Bob Andrews, stating that he objected to the size of the lots, did however make
a recommendation to approve the final plat for Sagemont Unit I contingent upon
the statement dedicating the streets be signed on the plat by the owner and the
statement concerning the tapered approach be included. on the plat. Merwin
Willman seconded the motion and the vote was unanimous in favor.
David Allen once again stated he would like it noted that he recommended the
street names be changed so_they are not similar in sound.
#5 CONSIDER AND MAKE RECOMMENDATION: Windy Meadows Subdivision - Request for
Curb Variance
Chairman Yarling asked if there were any comments from the Staff. Steve
Simonson replied he had given the members each a copy of the comments from
the Staff. The main objection was from the Streets and Parks Department
stating that a drive-over curb was unacceptable because it would not facili-
tate the proper use of the street sweeper.
Steve Simonson was asked if the drive-over curb would be all the way from
FM 1518 to Oak Street and Oak Street itself and he replied yes.
Mr. Simonson asked if the front of the land was zoned General Business and Ken
.Greenwald replied yes.
- There was~some discussion on why this kind of curb was needed and also as to
whether or not Windy Meadows and Oak were dedicated streets.
Steve Simonson said they were both dedicated streets and Bob Andrews commented
that with a drive-over curb, no curb cuts are necessary.
David Allen asked why do this everywhere if it is not zoned for mobile homes.
Bob Andrews remarked that drive-over curbs were not allowed in Schertz Business
R'Park which is adjacent to Windy Meadows Subdivision.
Ty Brisgill asked if there was any chance the streets would become part of
. the City's. Merwin Willman replied the City would not accept them unless
they met the standards for City streets.
After a brief discussion, David Allen made a motion to recommend disapproval
of the Windy Meadows Subdivision request for a curb variance because it does
not meet the standards for City streets. Ty Brisgill seconded the motion and
the vote was unanimous in favor.
At this time, before starting on the Zoning Ordinance, Steve Simonson said he
would~iike to discuss the information on easements he had been requested to
research. Mr. Simonson said you have to consider two things: (1) eminent
domain and (2) plat restrictions.
Mr. Simonson also stated that what. we say is looked at by the lawyer and what
the lawyer says is legal-and law and goes on the plat.
There was some discussion on easements particularly in regard to the erection
of accessory buildings. David Allen commented that the wording needs to be made
clear so that it can be understood by everyone.
The Commission made a few changes in the wording of the sections in the Zoning
Ordinance pertaining to easements and accessory buildings.
At 8:05 P.M. Chairman Yarling turned the meeting over to Vice-Chairman Andrews.
` #6 CONSIDER AND MAKE RECOMMENDATION: Zoning Ordinance
The Commission reviewed recommended changes by Earl Hartzog on R-1, R-6, R-7,
R-8, Definitions and Public Use District. They then made their own suggestions.
Vice-Chairman~Andrews commented .that the copies of the recommended changes
covered at the meetings and given to the Commission members each time are
appreciated. _
#7 GENERAL DISCUSSION
Merwin Willman, commenting on General Business zoning, said to keep in mind we
are setting up requirements for zoning along the interstate and main thorough-
fares.
Vice-Chairman Andrews said he had been checking into places people want to
build and wondered if there weren't some statistics available on how much of
an area should be zoned General Business in direct proportion to the population
of that area.
Merwin Willman commented we already have a lot of areas zoned General Business
and questioned if we need any more.
David Allen commented on the projected growth of the San Antonio-Austin Corridor
along IH 35.
Vice-Chairman Andrews asked what was going in beside the Church on FM 1518.
Steve Simonson said he understood it was a radiator shop and would check into
it.

Ty Brisgill asked if .there were any street lights planned on East Live Oak
Road from Maske Road to FM 3009 or on the creek side of. the park between
the school and the creek. There was no definite answer.
Mr. Brisgill also asked if the Commission was meeting on December 24, 1985.
He was informed it was highly doubtful.
.James Harden asked about the status of the trailer put up by Waste Management
and also the status of the request by Henry Gutierrez on behalf of Waste Manage-
ment to put up a second trailer.
.Ken Greenwald said the Council turned down the request for a second- trailer
and gave an extension of another year on the first trailer provided they
screened it off and cleaned up the junkyard.
James Harden asked that he be notified of any scheduled meetings on the
development of Schertz Parkway.
Merwin Willman said he had-some planning magazines for anyone interested. Mr.
Willman said they had some articles on the background of HUD and also some
articles on shopping malls.
The next regularly scheduled meeting is December 10, 1985.
There is a public hearing scheduled for December 17, 1985.
