07-08-1986 PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission con vened in a regular meeting on Tuesday, July 8, 1986 at 7:00 'P. M. in the Municipal Complex .Conference Room. Those present were as follows: PLANNING AND ZONING COMMISSION MEMBERS ABSENT THOMAS YARLING, CHAIRMAN ' BOB ANDREWS, VICE-CHAIRMAN DONALD I~ILSON JAMES HARDEN, SECRETARY CITY STAFF MERWIi~ WILLMAN TY BRISGILL STEVE SIMONSON, PLANNING COORDINATOR DAVID ALLEN SYLVIA TAYLOR, RECORDING SECRETARY KEN GREENWALD, COUNCILMAN #1 CALLED TO ORDER Chairman Yarling called the meeting to order at 7:00 P.M. #Z APPROVAL OF MINUTES: 't A. Regular Session June 24, 1986: Mr. Harden stated he thought the Staff was correct, Stop-N-Go is on IH 35 and FM 3009 . Mr. Allen stated he did not intend to criticize the Staff but he feels Stop-N-Go is within the Overlay District. Mr. Simonson stated the Overlay District is being challenged therefore Richard Harris, City Attorney, wa_s asked to study the ordinance,'including the four corners in question. Mr. Willman made a motion to approve the minutes of June 24, 1986 regular session. Mr. Allen seconded the motion and vote was unanimously in favor. Motion carried. B. Special Session: _ Mr. Simonson explained due to a malfunction of the recorder the statement in question could not be varified but the minutes did need to be approved. Mr. Allen wi thdrew his' objection and moved to~" approve the minutes of the June 17, 1986 special session. Mr. Andrews seconded the motion and vote was unanimously in favor. Motion carried. #3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS There was none. #4 PRELIMINARY PLAT: Northcliffe Estates Model Home Park- . Donnenbaum Engineering Corp. There was no one present to represent Donnenbaum Engineering. /.g 9, Mr. Andrews asked if they were asking for a replatting. Mr. Simonson stated they .were not. Mr. Willman stated approval had been granted on May 8,..1984, as a preliminary plat. Mr. Simonson stated changes have been made since the approval. Mr. Allen asked what the .difference between a preliminary plat and a'final plat were. Mr. Simonson stated a preliminary plat is the initial legal document of what the. developer wants to build,. a final plat is the .same .except it must include the recommendations made by the Staff, Planning Commission, and the City Engineer. Mr.a Allen asked if the developer could submit as many preliminary plats as they desired. Mr. Simonson stated they could not. Mr. Andrews asked ifit was normal procedure to first s ubmit a Master Plan then the phases. Mr. Willman stated it was, adding the phases must - correspond wi th the Master P] an. Mr. Andrews asked if there would be an extension to Scenic Hills. Mr. Simonson stated there would not be an extension. Mr. Andrews suggested writing "Revised': on the original Master Plan. Mr. Simonson stated the original plan would be pulled and the "Revised" plan would be filed in its place, Mr. B risgill asked if the Staff. had anymore input on the Master Plan. Mr. Simonson stated. the recommendations made by the Staff and Ford-Engineering. One of Ford Engineerings request being that .the greenbelts be renamed to either right-of-ways o r easements. Mr. Andrews moved to recommend approval of Northcliffe Estates Model Home.Park upon completion of Staff recommendations. Mr. Willman seconded the motion and vote .was unanimously in favor. Motion carried.. #5 VACATE AND REPEAT: Schertz Modular Park-Unit 1 (Pecan Grove)- G. A: Pr .'t and Associates, Inc. - There was no one present to .represent ~G. A. Pratt and Associates. - - Mr. Yarling asked what the Staff recommendations were. Mr. Simonson stated the Staff recommended. the request be.den.ied because the safety lanes are .not the size (28 feet) allowed in the variance granted, and engineering data was om~i;tted from the plat. Emergency vehicles woul d have a hard time traveling in an.' area with safety lanes of the present size. Mr. Simonson added the request;is for.what has already been built. Mr. Harden stated the area is nice but they came in with one plan then go - out and built what they want. ~ Mr. Simonson stated the Staff likes the trees but the area is in the flood lain and the safet lanes .need to be the correct-size. P y 2 Mr. Yarling asked what happened to the area during the rain. Mr. Simonson stated the area handled the rain. Mr. Brisgill asked what recourse the Schertz Modular Park had if the request is denied. Mr. Simonson stated they could go before the Board of Adjustments. The original plat was completely ignored, they would have to ask for a ..variance. The City Engineer recommended an Amended Plat; an amended plat states an error was made on the original plat. Mr. Allen stated he would be wi] ling to work wi th the developer wi th anything but not the safety lanes. Mr. Yarling asked what would be requi red for the developer to meet the requi re- ments. Mr. Andrews replied they would have to cut down some trees. Mr. Allen asked i f the .28 foot safety lane included street parking. Mr. Andrews stated it did not. allow street parking. Mr. Simonson stated i f there was a fi re the sooner the Fire Department arri ved at the fire -the better, the departments of emergency services do not want ' obstructions. With the present safety lane sizes.it would be difficult for the Fire Department and SAFES to travel in the area. Mr. Andrews asked if it was normal procedure for a flood plain, safety lanes and other safety requirements to be accomplished before occupancy was allowed. Mr. Simonson replied i t was the correct procedure. Mr. Allen asked why inspections were not done on the roads. Mr. Greenwald stated the roads are private, adding if plat was disapproved the reasons should be listed. There was further discussion about the difference between a private and a dedicated street. Mr. Willman stated the difference irs.who maintance the streets . Mr. Harden asked if the developer could be asked to widen the streets. Mr. Simonson replied they could since the plat was not followed. He added he would be surprised if the City is not in court shortly due to this. Mr. Allen stated,it "scared" him not to be able to. get emergency vehicles-' into th.e area. Mr. Allen asked if there was any difference in the action they would take if an amended plat was presented. Mr. Simonsoh stated there was not. Mr. Allen made a motion to disapprove the vacate and replat request by Schertz Modular Park Unit 1 due to: a. width of safety lanes do not comply with variance granted of 28 feet b. other recommendations made by Staff (.see letter attached) c. uti 1 i ty easements Mr. Brisgill seconded the motion and vote was unanimously in favor. Motion carried. 3 i Mr. Yarling introduced a request by Payless... The request is for flag pennants from canopy and light pole to building. Also included is a sky 1 i ght (smal 1 spot light) to be operated four hours each night from July 18th through the 20th. Mr. Greenwald stated he di:d not like .the idea, of the spot light. The Commission agreed with Mr. `;Greenwald. Mr. Allen made a motion to approve Payless' request with the exception to sky 1 i ghts due to Kardies Ai rport and Randolph Air Force Base.. Mr. Willman seconded the motion and vote was unanimously in favor. Motion carried. #6 GENERAL ,DISCUSSION Mr. Andrews asked if legal opinion. had been recieved yet on what recourse Dobie Heights had available. Mr. Simonson replied he had not heard from the attorney on this matter yet. Mr. Andrews asked what the zoning ordinance stated about keeping animals in the Ci ty:~ ~~Mr.:Allen stated three animals of a species could be kept. Mr. Simonson asked if he could withdraw the Public Hearing for Donnenbaum since they had come. in with a Special Use Permit. The Commission granted Mr. Simonson permission to do so. Mr. Andrews asked if the City had considered selling products in the concession. stand at the park. Mr. Greenwald .stated if they did so it would reduce-the profits of the concession stands in th'e park, which-support the B.V.Y.A. Mr. Andrews had mentioned to Tom Dov.~y, City Inspector, the Cibolo Computer Glub was using the .park pavillion as ids offical_pick-up and drop-off point for its students. Mr. Andrews asked what .the Cities liability is. Mr. Greenwald stated the Cibolo Computer Club was uti 1 i zi n g the pavi 1 l i on illegally since the :use of the pavill.ion had not be coordinated with the City. Mr. Allen asked i f i t was di ffernnt from the Gi rl Scouts using the park. Mr. Greenwald stated i t was. The Girl Scouts have a contract wi th the Ci tq . and carry their own insurance. Mr. Willman stated he City Council had approved-the following: a, the rezoning of Northcliffe b. the .annexation of Shirmerville c, the final reading of CDR's rezoning request Mr. Willman asked if inspections were: done in Pecan Grove. Mr. Simonson replied they were.. . Mr. Willman stated he had noticed theybuildings at the park were being painted though they were being. painted in deferent colors. Mr. Allen asked if that was what i s meant by . a °colorful parl~~:" 4 Mr. Brisgill asked about the progress of the utility construction in Greenshire. Mr. Simonson replied it was going very slow. Mr. Brisgill added the utility construction signs in Woodland Oaks are hazardous because they obstruct drivers vision. Mr. Brisgill asked about the traffic signs in Woodland Oaks. Mr. Simonson stated he was surprised he had not reeieved a plat from Woodland Oaks Developers yet. Mr. Brisgill stated there was excessive trash out at Stop-N-Go again this past weekend. Mr. Simonson stated he would talk to the Ci ty Inspectors. Mr. Brisgill .asked if anything else was known about the Sche rtz Parkway. Mr. Simonson answered there was no new information. Mr. Allen once again informed the Commission he would be gone for two weeks starting July 14, 1986. Mr. Allen wished to compliment everyone involved in the parade but feels ' better traffic control measures should be taken. Mr. Allen inquired about the progress of the Sign Ordinance. Councilman Greenwald stated it was on the agenda for the workshop meeting of July 9th. Mr. Allen asked about the sign and billboards out on FM 3009. Mr. Simonson stated .there is a:_total ban on billboards. Mr. Allen stated he had seen signs being put up by the Caverans and Garden Ridge Pottery. Mr. Harden said the signs had been there, repairs were being done on the signs. Mr. Allen asked about the Overl ay District. Mr. Simonson stated the City Attorney was looking at the sign part of the ordinance. As soon as the `s-tudy was completed he would speak to th.e City -Manager. Mr. Greenwald added the sign ordinance. i tsel f is~ not a ~ problem but i t is in conflict with the Overlay District. Mr. Yarling asked what the status of Dobie Heights was. Mr. Simonson replied letters had been `sent to them but they have not responded. Mr. Yarling stated it seemed like people were doing what they wanted and ordinances .could not be enforced.
