The Schertz Planning and Zoning Commission convened in a regular session on
Tuesday, January 14, 1986 at 7:00 P.M, in the Municipal Complex Conference
Room. Members present were as follows:

#1 CALL TO ORDER
Chairman Yarling called the meeting to order at 7:00 P.M.
#2 APPROVAL OF MINUTES:
Regular Session December 10, 1985
Merwin Willman made a motion to approve the minutes for the regular session on
December 10, 1985. Bob Andrews seconded the motion and the vote was unanimous
in favor.
Special Session December 17, 1985
Bob Andrews made a motion to approve the minutes for the special session on
December 17, 1985. David Allen seconded the motion and the vote was unanimous in
favor.
#3 CITIZENS' INPUT
There was none.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Final Plat Corridor 35
Steve Simonson informed the Commission the plat is in two sheets. Mr. Simonson
also said the platting is for the infrastructure and~not the land - it is needed
for drainage, streets, etc.
Merwin Willman commented the only question he had was about the tapered lane
approach since it is not shown. Mr. Willman said the FM 3009 Overlay Ordinance
requires an acceleration/deceleration lane, but we will accept a tapered lane
approach.
James Harden remarked on the street with three different names - Corridor Point,
Corridor Oaks and Corridor Hills.
Chairman Yarling asked if the post office had approved the street names and Steve
Simonson replied yes they had.
James Harden noted there is a stub out for the road to come out on IH 35.
There was a short discussion on the three street names. Bob Andrews said he
would have to research the minutes, but he thought when the preliminary plat was
brought in, the entire loop was called Corridor Parkway and City Council asked
them to change it to three different names for distinction.
Chairman Yarling said he thought a suggestion should be made for Corridor Hills
to come around from IH 35 to FM 3009 for distinction, specifically for the fire
and police departments.
Steve Simonson remarked that the Staff recommends approval.
Bob Andrews made a motion to recommend approval of the Final Plat, Corridor 35
contingent upon a tapered approach lane on Corri-dor Point and Corridor Oaks
and the platting for Corridor Hills to be tied into IH 35. David Allen seconded
the motion and the vote was unanimous in favor.
CONSIDER AND MAKE RECOMMENDATION: for Rezoningnof TwonTraBtsn Engineers) Request
Steve Simonson informed the Commission the Staff saw no problem with this.
Don McCrary of Henry Bain Engineers, representing CDR Investments, said they were
basically flip-flopping the two tracts. Mr. McCrary said they were trying to
change the progression of density of garden homes to regular homes. Mr. McCrary
commented this would probably better conform anyway to the tracts across the
road in Greenfield Village.
Chairman Yarling asked if we are obligated for a public hearing on this and it was
agreed we are.
Merwin Willman made a motion to recommend approval to City Council for a public
hearing of a request for rezoning of two tracts by CDR Investments. David Allen
seconded the motion and the vote was unanimous in favor.
#6 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary and Final Plat N.C.S. Subdivi-
sion, Unit 2
Steve Simonson brought to the Commission's attention the fact that O'Dell is still
listed on the plat as the owner. Mr. Simonson said it will not go into final sale
until the plat is recorded.
Steve Simonson also informed the Commission they are aware of the Overlay Ordinance
and also that the Staff saw no problem with this.
Chairman Yarling asked how far back the property went and Steve Simonson
. replied to the back of the strip.
Ty Brisgill noted that on the left-hand corner of the plat it says San Antonio
and Ken Greenwald said that CPS was out there and not GVEC.
Bob Andrews commented that the plat referred to the Overlay Ordinance.
Steve Simonson remarked this was the first business on the north side of IH 35.
Mr. Simonson asked the Commission if they still want to look at it the same as
the south side. It was agreed they did but would consider everything on an
individual basis.
Merwin Willman made a motion to recommend approval of the Preliminary and Final
Plat, N.C.S. Subdivision, Unit 2. James Harden seconded the motion and the vote
was unanimous in favor.
#7 CONSIDER AND MAKE RECOMMENDATION: CDR Investments - Request for Development Sign
along Jack Hays Boulevard
Steve Simonson informed the Commission the approximate location of the sign would
be near the sign on FM 3009 for Realty World.
Chairman Yarling asked if this sign meets the requirements for the Overlay Dis-
trict and Steve Simonson replied yes it does.
David Allen questioned if this is a temporary development sign and if they had
requested a time period.
Mr. Allen was informed it is a temporary development sign and Merwin Willman said
we can establish a time period.
David Allen also asked if there. was any indication on the materials to be used in
the sign and Steve Simonson replied no_
Chairman Yarling asked when they are planning on starting construction. There was
a brief discussion on this.
David Allen made a motion to recommend approval of a development sign along Jack
Hays Boulevard for CDR Investments for a period of 75% build-out or three years,
renewable on an annual basis. Ty Brisgill seconded the motion and the vote was
as follows:
AYES: Yarling, Harden, Willman, Brisgill, Allen, Greenwald
NAYES: None
ABSTENTIONS: Andrews
#8 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Plat~and Final Plat Payless
Gas Subdivision II - Jack Hays Boulevard and
Borgfeld Road
Steve Simonson informed the Commission that Payless needs to have a 50' building
setback instead of a 20' building setback on the plat.
David Allen questioned having the gas pumps in the front facing FM 3009 stating
that we did not allow Lone Star to have their gas pumps facing FM 3009.
Merwin Willman remarked that these will be covered by an awning like the ones
located at IH 35 and FM 1103.
Merwin Willman noted that the tapered lane approach needs to be included.
Jon Jack, Strasburger Enterprises, Inc., representing Payless said he thought
with the stop light the tapered approach would not be needed, but is no problem
if it is needed.- Mr. Jack pointed out there are two approaches on Borgfeld and
one on FM 3009.
The Commission felt for maximum safety the tapered lane approach is needed.
There was some discussion on the number of signs. Steve Simonson informed Mr.
Jack that Lone Star had given up one of their signs on the store to have one out _
by the street.
Merwin Willman informed Mr. Jack we need some type of sketch of the sign they want
~s=;'< to put out front. Mr. Jack had the sketch with him. and showed it to the Commission.
It will be a five foot brick sign displaying a logo with the type of gasoline,
price and credit cards accepted.
There was some discussion on whether or not the_sign would obstruct the view of
traffic once FM 3009 becomes a five lane, but it was decided it would not.
Steve Simonson informed the Commission that Mr. Jack had asked for permission to
have flags and a Coke machine on display for advertising the grand opening and
that ten days advertising is'allowed~in the Overlay Ordinance. Mr. Jack had some
pictures of other grand openings which he showed to the Commission.
David Allen made a motion to recommend approval of the Preliminary and Final Plat,
Payless Gas Subdividion II - Jack Hays Boulevard and Borgfeld Road contingent
upon the following: 1. indicate tapered approach lane on plat
2. change building setback on plat from 20' to 50'
3. number of signs limited to two as specified in
Overlay Ordinance
4. screening for dumpster
James Harden seconded the motion and the vote was unanimous in favor.
#9 CONSIDER AND MAKE RECOMMENDATION: C & L Properties - Request for rezoning - Jack
Hays Boulevard
§teve Simonson informed the Commission there were no Staff comments one way or
another - Mr. Kucherka has permits for each piece of property.
Charlie and Dennis Kucherka were both present to represent C & L Properties.
Mr. Charlie Kucherka said the plat had never been recorded and that it still indi-
cates a 25' setback, but that a 50' setback would be no problem. Mr. Kucherka
also informed the Commission he does not own the driveway on the Beck property.
Mr. Kucherka said he had previously requested Neighborhood Services, but after
discussion on the types of businesses he wanted to establish at the location, the
City Council recommended the zoning be changed to Office and Professional. Mr.
Kucherka is now requesting a zoning change from Office and Professional to
Neighborhood Services. He wants to be able to have a convenience store with
gas pumps which are not allowed in Office and Professional.
There was discussion on the types of businesses permitted in Office and Profes-
sional and whether or not Mr. Kucherka was aware of all of them. There was also
discussion on the agreement that needs to be reached between Mr. Kucherka and
Mr. Beck on the ingress/egress out of the right-of-way.
Bob Andrews informed Mr. Kucherka Yre have no option but to recommend a public
hearing for the zoning change request and also informed him we will need a drawing
similar to the one presented the-first time.
Bob Andrews made a motion to recommend approval to the City Council that the
request from C & L Properties for rezoning on Jack Hays Boulevard be scheduled for
a public hearing.- David Allen seconded the motion and the vote was unanimous in
favor.
Dennis Kucherka asked the status of FM 3009. Ken Greenwald replied it is in the
design stage. Steve Simonson said the best estimate is two years before any
construction starts.
Charlie Kucherka made some brief comments on a property located on Schwab Road
and the water supply at said location.
#10 ZONING ORDINANCE
Merwin Willman handed out some reading material on Mobile Homes saying it gave
some-background and information.
Mr. Willman also commented that the proposed Sign Ordinance is going to the City
Council for review at the Workshop on January 15, 1986.
The Commission reviewed Article XIX (Amendments) and Article XX (Specific Use
Permits) and made their suggested changes.
#11 GENERAL DISCUSSION
David Allen voiced a complaint about garbage pickup at 4:30 A.M. at the dumpsters
at the Val Verde Apartments... Mr. Allen said it had been occuring now since
Christmas.
David Allen also mentioned that there are quite a few For Sale signs along FM 3009
and wondered. if permits had been issued for them.
Ken Greenwald commented he did not think a permit was required for a For Sale sign
as long as it is on the selle:r's property.
James Harden asked if~Gutierrez had moved a bunch of their trucks. He had noticed
quite a few of them gone.
Ty Brisgill asked if there was something in our ordinances outlining specifications
for gas pump tanks.
Merwin Willman replied that was covered in the building codes and state regulations.
Steve Simonson commented he thought there were some new state restrictions covering
gas pump tanks.
Ty Brisgill also remarked that they have been putting bandit signs in front of
the reflectors for culverts and someone needs to mention it to them.
Steve Simonson commented that the Guy Chipman sign along FM 3009 needs to be
removed.
Ty Brisgill asked about the Gemcraft two-story homes and if they were allowed to
build them. Merwin Willman replied yes as long as they meet the required speci-
fications.
Ty Brisgill also commented that the reflector signs on East Live Oak Road are not
the same hieght.
Bob Andrews jokingly noted that after Gutierrez hit a pole, we got some Don't
Walk signs.
Merwin Willman commented that from time to time the subject of improvements on
FM 78 and the bypass are brought up. Mr. Willman said that sometime this month
Walter Ehlers will discuss-these at a Workshop and suggested the Commission members

Merwin Willman remarked on the article about Fort Collins out of TML and suggested
a letter be sent asking them for the Land Development Guidance System.
Chairman Yarling asked Steve Simonson to write a letter to them and Mr. Simonson
said he would.
Merwin Willman, referring to the letter from New Braunfels utilities, asked what
they were talking about.
Chairman Yarling said he .thought basically they were asking for people not to
interfere with easements.
Ken Greenwald made reference to the 6:00 P.M. news on the previous Monday night
about an incident where someone putting up a billboard hit a utility line. -
Merwin Willman commented that he noticed the Thistle Creek trailer was gone.
Chairman Yarling said they had their grand opening and had moved the trailer.
Ken Greenwald said the Sign Ordinance would be discussed at the Council Workshop
on January 15, 1986.
Mr. Greenwald also said the City was looking into buying a machine for striping the
streets. He said if they cannot afford to buy one, they will .need to rent one
.because some of the streets are in bad need of being restriped.
Ken Greenwald commented that we need to get something back in the ordinance
either asking developers to dedicate park land or make contributions for improve-
ments. Mr. Greenwald felt it should be done as soon as .possible considering all
the new housing that is springing up. +
Mr. Greenwald also commented that there is a possibility of more park area and a
police and fire substation near the Northcliffe area.
Ken Greenwald informed the Commission that on February 15, 1986 at the Community
Center there is a dance and auction for the benefit of the Library and the Humane
Society. He urged everyone to participate.
Steve Simonson said he had asked Walter Ehlers for the original plans for the
bypass and related documents and told the Commission members if they wanted to
see them to come by his office.
Mr. Simonson commented that the engineers in Seguin have suggested the bypass go
around~Cibolo, Schertz, Converse and the back of Randolph Air Force Base all the
way to I 10.
Mr. Simonson also commented there has been talk of having Schertz Parkway desig-
nated as State Highway 1518.
The next regularly scheduled meeting is January 28, 1986.
