07-22-1986 Y PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in a regular session on Tuesday, July 22, 1986 at 7:00 P.M. in the Municipal Complex Conference Room. Those present were as follows: PLANNING & ZONING COMMISSION. CITY STAFF THOMAS YARLING, CHAIRMAN STEVE SIMONSON, PLANNING COORDINATOR JAMES HARDEN, SECRETARY NORMA ALTHOUSE, RECORDING SECRETARY MERWIN WILLMAN TY BRISGILL OTHERS PRESENT DONALD WILSON KEN GREENWALD, COUNCILMAN TOM SCHAEFER, MCKINNEY HOMES MICHAEL MOORS, GREAT WESTERN MEMBERS ABSENT DEVELOPh1ENT ROMEY.JACKSON; STEWART TITLE BOB ANDREWS, VICE-CHAIRMAN RON JAROSZEWSKI DAVID ALLEN TOM FLORES, FLORES & COMPANY CONSULTING ENGINEERS #1 CALL TO ORDER Chairman Yarling called the meeting to order at 7:00 P.M. #2 APPROVAL OF MINUTES: A. Special Session June 30, 1986 Merwin Willman made a motion to approve the minutes for the Special Session June 30, 1986. Donald Wilson seconded the motion and the vote was unanimous in favor. Motion carried. B. Regular Session July 8, 1986 Merwin Willman made a motion to approve the minutes for the Regular Session July 8, 1986. Ty Brisgill seconded the motion and the vote was unanimous in favor. Motion carried. #3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS There was none. #4 CONSIDER AND MAKE RECOMMENDATION: McKinney Homes - Request for Front Yard Setback Variance - Lockwood Lane Tom Schaefer was at the meeting to represent McKinney Homes. Chairman Yarling reminded the Commission they had a diagram in their packet and also asked if there were any Staff comments. Steve Simonson informed the Commission McKinney Homes was buying what was left of the Jim .Shepherd Development in Woodland Oaks. Mr. Simonson stated that 2705 Lockwood Land was already built and the people from McKinney Homes realized it was encroaching and came to him with the request for the. front yard setback variance. Steve Simonson also informed the Commission that since it is a PUD and not a specific zoning, the Commission-can, if it so desires, recommend approval without a public hearing. Ty Brisgill commented he had also looked at 2709 Lockwood Lane and it appears the same encroachment exists there. Tom Schaefer remarked that McKinney Homes doesn't own 2709 Lockwood Lane yet. Ty Brisgili asked if .we would be handling these on an individual basis and was .told yes we would. Mr. Brisgill also commented that the cleaning up of the Jim Shepherd Homes by McKinney Homes is of benefit to both developments - McKinney and Gemcraft. Donald Wilson made a motion to approve, based on the description given us, the request from McKinney Homes for a front yard setback variance~at 2705 Lockwood Lane'. Merwin Willman seconded the motion and the vote was unanimous in favor. Motion carried. ~ ~~,c, ~r~, ~~/A~t~~~ Chairman Yarling thanked Mr. Schaefer and told him if he runs across more, we will handle them individually. #5 CONSIDER AND TAKE APPROPRIATE ACTION: Payless Gas - Request for Additional Signs ("Shell" Signs) No one was at the meeting to represent Payless. Chairman Yarling reminded the Commission they had a diagram in their packet and asked if there were any Staff comments. Steve Simonson commented Payless is putting up basically the same thing we approved for Lone Star.. Merwin Willman asked if the signs are to be lit and Steve Simonson replied yes they are. James Harden noted that the canopy is already there. There were some brief comments on the Grand Opening. Chairman Yarling asked if the signs are in compliance with the ordinance and Steve Simonson replied yes they are. Ty Brisgill observed that Lone Star has signs on two sides and Steve Simonson pointed out that Lone Star has two pumps,. but Payless has four pumps. Donald Wilson made a motion that based on the description given us of four (4) Shell Pectins at the Payless on Jack Hays Boulevard and Borgfeld Road we recommend approval of the request to attach. these signs to the existing structure known as the canopy. James Harden seconded the motion and the vote was unanimous in favor. Motion carried. #6 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Pi at - Woodland Oaks, Unit III Tom Flores, Michael Moore and Ron Jaroszewski were at the meeting to represent Woodland Oaks. _ (2) Chairman Yarling asked if there were any Staff comments. Steve Simonson informed the Commission most of_the comments were engineering con- siderations such as drainage, existing sewer lines and plat items contained in a letter from Ed Ford, City Engineer. (See Attached Copy) Mr. Simonson said the rest of the Staff comments were negligible presenting no real problems. Tom Flores spoke briefly informing the Commission they are cognizant of the existing problems, they are working on Unit III and they have completed approxi- mateiy 95% of Ed .Ford's comments. Mr. Flores also complimented the City Staff on being very cooperative. Steve Simonson said he would like to update the Commission on some of the pro- gress hopefully being made on the drainage problems in completed sections of Woodland Oaks. Mr. Simonson said meetings have been held and ~ possible solution of putting drainage underground from Kline to Hidden View and also easements allowed had been discussed. Mr. Simonson said the Streets & Parks Department would have the responsibility of maintenance, but it would be an amicable solution. Michael Moore commented they had asked Tom Flores to start working on Unit IV being hopeful of correcting the drainage problems. Ty Brisgill asked if there was some kind of time schedule of when those units completed would,be acceptable to the City. Ron Jaroszewski replied that by Friday of this week there will be a formal request in writing for a walkthrough inspection of 2B and 2C so that all problems can be pointed out by the City and noted. James Harden asked if the drainage already there would be going into what we're looking at now (Unit III). Steve Simonson replied they see no additional problems. Tom Flores said he feels Woodland Oaks can develop it's watershed without exceeding the legal limit of water that can be put on Mr. Ackermann's and Mr. Bindseil's land. - - Tom Flores explained his position on Mr. Ackermann and Mr. Bindseil saying he had tried to work with them and had even offered to assist them, but they were not receptive to his offer o.r his concepts. Mr. Flores also commented that some of the problem may be resolved when the Schertz Parkway is built. Merwin Willman made a motion to approve the Preliminary Plat for Woodland Oaks, Unit III contingent upon compliance with the City Engineer's comments contained in a letter from Ford Engineering. Ty Brisgill seconded the motion and the vote was unanimous in favor. Motion carried. #7 CONSIDER AND TAKE APPROPRIATE ACTION: Preliminary Plat and Final Plat - Vacate and Re plat a Portion of Aviation Heights (Beacon Avenue) There was a brief discussion on the alley and the easement. Steve Simonson com- mented Beacon dead ends into a grassy alley. James Harden asked why vacate and replat. Steve Simonson explained that the Rowell's had asked the City some time ago if it was going to do anything with the property. Mr. Simonson said the City has now (3) agreed to turn it back to the property owner. Merwin Willman made a.motion to approve the Preliminary and Final Plat to vacate and replat a portion of Aviation Heights (Beacon Avenue), specifically Lots lA and 1B, Block 32. Donald Wilson seconded the motion and the vote was unanimous in favor. Motion carried. #8 GENERAL DISCUSSION " Steve Simonson informed the Commission the City is in litigation with Leon Parker - he filed an injunction against us. Mr. Simonson said we will be in court Thursday. Steve Simonson also told the Commission the City will be hiring another Inspector. Merwin Willman asked if we have a public hearing coming up and Steve Simonson replied yes on August 5, 1986 regarding the Forbes property. Merwin Willman asked if we had heard anything from the lawyer on the Overlay and Steve Simonson replied the lawyer had been tied up on other matters. Merwin Willman, referring to the "Zoning Bulletin", page 4 on the subject of a variance denial said he liked it .because it pointed out that because you grant a variance does not. mean-you are setting a precedent, Merwin Willman commented that a lot of our action is covered by these court cases in the "Zoning Bulletin". Ty Brisgill asked if handicap ramps are required and was informed by Steve Simonson not unless the building is federally funded. Ty Brisgill commented we need to consider this in the future because none of the three new facilities (Payless, Lone Star, Stop-N-Go) have them. Ty Brisgill remarked on several signs: (a) Dobie Heights bandit signs up Sunday, (b) washer and dryer for sale sign up by Payless, and (3) La Petite has portable sign between them and FM 3009. Chairman Yarling said he had noticed a flashing portable sign at the trailer park on FM 1518. Ty Brisgill asked if La Petite had to make a cut in Savannah Drive for a sewer connection. Steve Simonson replied if they did they would have had to get permission from .Johnny Bierschwale and Jerry Graham. On the subject of Savannah Square, Steve Simonson informed-the Commission that .the one-year warranty inspection for it would be this week. Steve Simonson reported that the City Council is backing Planning and Zoning in their rescision of permission for Thistle Creek bandit signs, but Rob Sult is still threatening to sue. There is a public hearing scheduled for August 5, 1986. The next regularly scheduled meeting is August 12, 1986. #9 ADJOURNMENT Chairman Yarling adjourned the meet~~~ at 7:52 P.M.
