08-12-1986 i The Schertz Planning and Zoning Commission convened in a regular session on Tuesday, August 12, 1986 at 7:00 P.M, in the Municipal Conference Room. Those present were as follows: PLANNING & ZONING MEMBERS CITY STAFF BOB ANDREWS, VICE-CHAIRMAN ~ STEVE SIMONSON, PLANNING COORDINATOR MERWIN WILLMAN NORMA ALTHOUSE, RECORDING SECRETARY TY BRISGILL DAVID ALLEN OTHERS PRESENT DONALD WILSON KEN GREENWALD, COUNCILMAN TOM FLORES, FLORES ENGINEERS MIKE MOORE, GREAT WESTERN DEVELOPMENT MEMBERS ABSENT DARWIN PEEK BOB BRINK THOMAS YARLING, CHAIRMAN JAMES HARDEN, SECRETARY #1 CALL TO ORDER Vice-Chairman Andrews called the meeting to order at 7:00 P.M. #2 APPROVAL OF MINUTES: Before approval of the minutes., Vice-Chairman Andrews suggested that in the minutes for July 22, 1986 under #4 Consider and Make Recommendation: McKinney Homes - Request for Front Yard Setback Variance - Lockwood Lane, that the size of the variance (1 ft. 8 in.) be included in the minutes for future reference. A. Regular Session July 22, 1986 Merwin Willman made a motion to approve the minutes for the Regular Session July 22, 1986-(with the size of the .variance included under #4). Ty Brisgill seconded the motion and the vote was unanimous in favor. Motion carried. B..__ Special Session August 5, 1986 i Donald Wilson made a motion to approve the minutes for the Special Session August 5, 1986.. David Allen seconded the motion and the vote was unanimous in favor. Motion carried. #3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS There was none. #4 CONSIDER AND TAKE APPROPRIATE ACTION; Woodland Oaks, Unit 3, Master Plan, dated June 26, 1986 Tom Flores and Mike Moore were at the meeting to represent Woodland Oaks. Vice-Chairman Andrews asked if there were any Staff comments. -Steve Simonson, referring to the notes from him to the Planning and Zoning Commission members in their package, stated he had called Tom Flores about the street stub outs which were not shown on the Master Plan as required by the Subdivision Ordinance. David All"en commented this is too much of a closed subdivision. Mervin Willman remarked that on the old plan Starlight Lane was proposed to be stubbed out, but for some reason was missed by the Planning and Zoning Com- missio.n, and it is now a cul-de-sac. Mr. Willman pointed out also that on the. old plan there were stub outs on the north, the south and the west sides. -David Allen added that he does not like closed subdivisions. Vice-Chairman noted that on the City Master Plan this subdivision was to tie into East Live Oak Road eventually. Mervin Willman commented there is no way to build out Dimrock because of the houses already built on it. Tom Flores informed the Commission that in an effort to try and correct the water problem, they were considering connecting Dimrock to the back of the subdivision by straightening it out a little by means of utilizing an empty lot on Dimrock. There was a brief discussion on this proposal. Vice-Chairman Andrews asked Mike Moore if he knew how many different Master Plans there had been for Woodland Oaks. Mr. Moore replied to the best of his knowledge and recollection there had probably been three previous ones plus this current revision. Vice-Chairman Andrews said it was his understanding there were to be stub outs that would eventually tie into East Live Oak Road; FM 1518 and also one in the northeast corner. There was further discussion on the stub outs with Mike Moore pointing out it was of no benefit to them to stub. out .Woodland Oaks Drive to the Baxter. and Johnson property. Mr. Moore said the value of that would be to Baxter and Johnson and none to Woodland Oaks because it does not serve any of their lots. Vice-Chairman Andrews questioned the logic for turning a stub out into a cul- de-sac. ~ . Mike Moore replied that normally they have to stub out to the end-of the property line which in the case of Woodland Oaks Drive would involve a major drainage project and/or possibly an easement. Ty Brisgill asked if when they stub out they have to bring it to the property line. Steve Simonson said he would have to check on it. Vice-Chairman Andrews asked if there was a problem stubbing out any of the others besides Woodland Oaks_ Drive. Mike Moore replied they would like to have several alternatives depending on the drainage situation.. Darwin Peek, attending the. meeting as a concerned property owner, asked permis- sion to make a comment. Mr. Peek said this situation confirmed one of the fears he always had about-the disadvantages of being next door to a development with- -out benefit of access to it. r~~ d Vice-Chairman Andrews reminded Mike Moore there are no plans at the present time to build south of him, but we would like to ensure that the next builder has an opening. Mike Moore said he had no problems with the north or south stub outs. Mr. Moore said as far as the other there are several things they are trying to work out: 1. The Bindseil, Ackermann problem. 2. Woodland Oaks Drive - the bridge to Johnson Baxter property would be costly. 3. The situation in 2C and 4A left by Mr. Fisher. Mr. Moore further stated they are trying to avoid shooting themselves in the foot depending on the drainage. Vice-Cha~~rman Andrews suggested tabling approval of the Master Plan. Mike Moore commented they would like to have another several acres for a model cul-de-sac, but so far had not been able to work anything out. David Allen, pointing out there is development surrounding Woodland Oaks, told Mike Moore we are asking them to sacrifice a couple of lots so access goes on ..through. Mr. Allen said we don't want pockets of land here and there. Voce-Chairman Andrews asked Mike Moore if between now and August 26th would give them enough time to include the north and south stub outs. Merwin W illman said to keep in mind Woodland Oaks does not have to go straight. Mr. Willman also stated that when Schertz Parkway is finished, there will be .two ways to exit.. Vice-Chairman Andrews remarked we can let the Staff work on the stub out problem. Merwin Willman asked why they don't connect Woodland Oaks Drive with others so there's a way out and Mike Moore replied that would. involve about a million dollars in culverts. Ty Brisgill remarked that people speed on Dimrock and Woodland Oaks Drive. Mike Moore said they are asking for 3-way stops. Steve Simonson commented the Staff has to work out the traffic sign needs in the subdivision. Merwin Willman noted that the Planning and Zoning Commission realizes a Master Plan is not concrete. It does, however, give some idea of the proposed develop- ment. David Allen made a motion that #4, Consider and Take Appropriate Action: Wood- land .Oaks. Unit 3, Master Plan, dated June 26, 1986 and #5, Consider and Take Appropriate Action: Woodland Oaks, Unit 3, Final Plat, dated May 26, 1986 be tabled until August 26, 1986 meeting. Vice-Chairman Andrews commented we do not need to table both items. The motion°by David Allen was modified to table action only on #4, Consider and -Take Appropriate Action: Woodland Oaks Unit 3, Master Plan, dated June 26,_1986 {3~ until the August 26, 1986 meeting. Merwin Willman seconded the motion and the vote was unanimous in favor. Motion carried. Vice-Chairman Andrews said he would like to see the plans dated.. #5 CONSIDER AND TAKE APPROPRIATE ACTION: Woodland Oaks, Unit 3, Final Plat, dated May 26, 1986 Vice-Chairman asked if there were any Staff comments and Steve. Simonson said no. Mr. Simonson stated that all the problems listed by the City Engineer have been answered and it does conform to the original. David Allen commented they are to be congratulated on their street names. Tom Flores said most of the names on the list submitted had been approved by the Post Office and were on hold for them for approximately three years. David Allen had. a question on a line between Lots 42 and 43, and Mike Moore showed and explained to him it was an elevation line. Ty Brisgill asked if the developer had come in about acceptance of the first unit. Steve Simonson replied there is a meeting scheduled with himself, John Bierschwale, .and Ron Jaroszewski at which .time they will take a drivethrough and pinpoint the correction areas. Mr. Simonson also commented that perhaps Mr. Gilmore, City Manager, would participate in the drivethrough. Steve Simonson informed the Commission he now has the Kline Circle drainage plans. Vice-Chairman Andrews. inquired if the little square block in the corner is a utility box and was told it is. Mr. Andrews also asked if the. utility easement is on one side and the box on the other and Tom Flores replied that is correct. Mike Moore said GVEC had requested it that way to accommodate their equipment. Vice-Chairman Andrews akked if we have the tax certificates submitted with the final plat. Steve Simonson replied he will check on. it before it is recorded. Mike Moore remarked he is sure the bank will also require the same verification. Merwin Willman made a motion to approve the Final Plat for Woodhand Oaks, Unit 3, dated May 26, 1986 contingent on proof of the tax certificates. David Allen seconded the motion and the vote was unanimous in favor. Motion carried. At this time Vice-Chairman Andrews called for a short recess. #6 CONSIDER AND TAKE APPROPRIATE ACTION: Northcliffe Estates, Master Plan, dated July, 1986. There was no one at the meeting to represent Northcliffe. Merwin Willman asked if the piece on the top of the sheet was part of the Master Plan and was informed it was not. Merwin Willman also asked what "future first" means .and there was a brief dis- cussion on this.. Also discussed were the size of the lots near Country Club Boulevard. David Allen commented he would like to know the meaning of the dotted line and Donald Wilson thought maybe it was a division between units. Vice-Chairman asked, if on the Master Plan we don't see, does it meet our requirements and Steve Simonson replied yes it does. .Vice-Chairman .Andrews asked i-f there was any input from the Staff and Steve Simonson said no input - there are no problems. Merwin Willman made a motion to approve the Master Plan for Northcliffe Estates, dated July, 1986. .David Allen seconded the motion and the vote was unanimous in favor. Motion. carried. #7 CONSIDER AND TAKE APPROPRIATE ACTION: Northcliffe Estates Model Home Park, Final Plat, dated June, 1986 At this time Vice-Chairman Andrews discovered an error. On the .agenda and in the minutes #6'"Model .Home Park" should be eliminated and #7 the date should be changed to June, 1986. (This has been changed) Vice-Chairman Andrews asked if there was any input from the Staff. Steve Simonson informed the Commission they had the comments from Alan Lindskog on the changes we requested. Mayor Earl Sawyer arrived at the meeting at 8:07 P.M. David Allen questioned the need to place a non-access easement on a corner lot. Mr. Allen remarked that a corner lot is desirable because of the extra access to tKe side. Mr. Allen further stated he felt it is not necessary for these lots to be deeded with a non-access easement because of the fact that the City of Schertz controls the. curb cuts. Vice-Chairman Andrews commented that in case someone decides to convert their garage into a den .and add a detached garage, then they need to come in for per- mission fora curb cut. David Allen asked what is required for a curb cut and was informed a permit is needed. ' David Allen still questioned the logic of deeding it with a non-access easement and Vice=Chairman Andrews answered to avoid problems in the future. Ken Greenwald commented if you don't deed it and he does cut the curb without a permit, what have you got to go back on to make him put it back. David Allen said, in his opinion, that was the responsibility of the City Manager or his delegated authority, for example, the inspection department. Donald Wilson remarked you may find people think deeding it that way is a good .idea. .Steve Simonson said. it was his understanding that, from the City's point of view, if you have a major road come through, and the property is deeded with a non- access easement, then the person buying the property and the City both know you cannot built on it. David Allen maintained the argument did not apply because it is not a major (5) thoroughfare, it is a one lot long street. Vice-Chairman Andrews said it is a major entrance to Country Club Boulevard. and will be one of two major entrances to Northcliffe Estates. David Allen still maintained it is needless. Ty Brisgill commented we need to back up the City on it's decisions. Donald Wilson asked if there are any complications from the City on this and Steve .Simonson said no. Steve Simonson informed the Commission he had been in contact with Coma1 County and since approximately 80% of it is in Schertz, for continuity and our sanity we will handle, inspect and record the whole plot as being in Schertz. Ty Brisgill asked if they're going to put a cut in the island on Country Club. There was some discussion on this. Vice-Chairman Andrews asked the purpose of the 20' right-of-way and Steve Simonson replied they wanted it labeled as a greenbelt, but the City ..requested it be labeled as a right-of-way. Merwin Willman noted two things that should be on the plat: 1. Should show the entrance from St. Andrews onto Country Club Boulevard. 2. Dedication statement should be signed. Donald Wilson ?nade a motion to approve the Final Plat for Northcliffe Estates Model Home Park. contingent on making appropriate modifications and certifications, namely, showing the entrance from St. Andrews onto Country Club Boulevard and the signing of the dedication statement. Ty Brisgill seconded the motion and the vote was unanimous in favor. Motion carried. , #8 GENERAL DISCUSSION Ty Brisgill asked if we can put the .zoning classification on the plats when they come in and Steve Simonson replied yes we can. Ty Brisgill reported there was a massive clean-up in Woodland Oaks for Open House on the weekend and they piled all the junk in the middle of Hidden Grove Lane. Mr. Brisgill had pictures with him to show proof of the junk piles. Mr. Brisgill also said bobcats had dug into the streets and heavy equipment had run over the sidewalks and chipped curbs. As Mr. Brisgill pointed out, these are not hazards. but they are eyesores. Steve Simonson told Ty Brisgill that tomorrow (August Z3, 1986) the City would be out Tooking at the ut ility dips. Mr. Simonson said it's the City's feeling the:subcontractor did not backfill properly. Mr. Simonson assured Ty Brisgill the City is aware of all the problems and now that they fi-Wally have the. drainage .plans for Kline Circle, he feels it's a hopeful sign that. things can be worked out and corrected. . Ty Brisgill said he has lived out there for two years now and wonders how much they're going to let the developer have before the City accepts the first unit. Ken Greenwald commented the developer could just walk out and do nothing. Merwin Willman said he had done some research on the .property annexed in 1981 along IH 35 in front of Northcliffe. Mr. Willman said at the time they were told litigation was. going on and were asked not to do anything at-that time about zoning it. Mr. Willman suggested we put it on the next agenda and set it up for a public hearing. Merwin Willman asked if we had heard anything from the lawyer about the comments on the Overlay. Ken Greenwald said we have-six or seven lawyers working on .various problems. Ken Greenwald informed the Commission that on the agenda for the City Council Workshop on August 13, 1986 was the Planning and Zoning Commission's acceptance of their legal counsel. Donald Wilson asked for someone's opinion of the hand painted signs on the bingo parlor. Vice-Chairman Andrews said, in_his opinion, it was the work of a child. There was other discussion on this. Donald Wilson suggested the~City send a letter incorporating the comments of the Planning and Zoning Commission. Donald .Wilson .asked if we sent a letter to the State asking them to paint the white bicycle lines back on the side of Jack Hays Boulevard. Mr. Wilson said some mopeds really-.had traffic tied up because there are no bicycle lines. Steve Simonson said he would be seeing people from the State Highway Department on Thursday. Donald Wilson said he thought it would be nice if we made our request in writing. Donald Wilson said he had seen a deer hit near the entrance to Savannah Square and had immediately reported it to the police thinking maybe it could be taken to Boysville for processing and the police would know the appropriate people for the job. However, Mr. Wilson said he went back the next-day and the deer was still there. Mr. Wilson felt the police were more interested in his name, address, phone number, etc. than in the animal. Ken Greenwald said he would bring the matter up at the City Council Workshop. David Allen said he had a similar experience with the police department. He had reported a truck hauling trash from a construction site without it's dumper covered and therefore letting trash blow all over the highway. Mr. Allen said he felt the dispatcher was more interested in information about him than the truck. Mr. Allen said there is a State law that dumpers must be covered. Ken Greenwald said he would try to get the 800 number of a State trucking company you can call toll free and report these things. David Allen remarked he would like to see the Police Department exercise more authority. Vice- Chairman Andrews asked. what the cut-off date is for our dump site. Ken Greenwald replied he thought another .s ix-month extension had been granted. The next regularly scheduled meeting is August 26, 1986. #9 ADJOURNMENT Vice-Chairman Andrews adjourned the meeting at 8:46 P.M.
