PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission convened irr a regular session on
Tuesday, September 9, 1986 at 7:00 P.M. in the Municipal Complex Conference
Room. Those present were as follows:

#1 CALL TO ORDER .
Vice-Chairman Andrews called the meeting to order at 7:00 P.M.
#2 APPROVAL OF MINUTES: Regular Session August 26, 1986
• P1erwin Willman felt that the second paragraph under #6 GENERAL DISCUSSION
should go into more. detail,. for future reference. Therefore, added to the
second paragraph should be "Steve Simonson explained an administrative error.
appears in the last sentence of Section 11 'Variance' of Article I of the City
of Schertz Subdivision Ordinance No. 80-S-13 as approved by the Council on June
10, 1980. The sentence should correctly read: 'Variance shall not be granted
unless the City Planning Commission finds:
Merwin Willman made a motion to approve the minutes, as amended, for the Regular
Session August 26, 1986. Ty Brisgill seconded the motion and the vote was unan-
imous in favor. Motion carried.
#3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS
There was none.
#4 CONSIDER AND TAKE APPROPRIATE ACTION: Woodland Oaks, Unit 3, Master Plan, dated
June 26, 1986
Vice-Chairman Andrews stated. this had been tabled two sessions back based on the
need for stub outs'. Vice-Chairman Andrews also said he had asked for it to be
on this agenda and in the meantime had looked into the matter.
Vice-Chairman Andrews asked Steve Simonson if there was any update on the 30 to
60 days time period needed to work this out. Steve Simonson replied it should be
closer to 30 days.
Vice-Chairman Andrews questioned whether we want a corrective Master Plan or this
one and Merwin Willman replied it should be a corrective one.
David Allen asked what the options:are and Ken Greenwald answered you either
approve it or disapprove it.
Steve Simonson commented that, in effect, it had been disapproved.
Vice-Chairman Andrews asked if it would be in order to disapprove it.
After some discussion, David Allen. made a motion to disapprove the Master Plan,
dated June 26, 1986, for Woodland Oaks, Unit 3 based on the fact that the stub
outs do not conform to the requirements of the Subdivision Ordinance.. Merwin
Willman seconded the motion and the vote was unanimous in favor. Motion carried.
#5 CONSIDER AND MAKE REG4MMENDATION: McKinney Homes. - Request for Building Variances
in Horseshoe Oaks Subdivision, Unit 1 as
follows:
(a) 1.7' Variance at 2805 Cedar Lane
Lot 12, Block 3)
(b) 0.5` Variance at 2709 Lockwood Lane
tot 13, Block 5)
(c) 1.4' Variance at 1109 Mossy Lane
Lot 3, Block 3)
Jack Ogden was at the meeting. to represent McKinney Homes.
Vice-Chairman Andrews asked if .there was any more information and Steve Simonson
replied that .as McKinney Homes gets. the houses they are having. them surveyed.
Mr. Simonson also. said the Inspection Department had been spot checking houses,
but.after a' discussion'wit.h them it was decided they wil] start checking every
single house before .the foundation is poured.
Jack Ogden of McKinney.,H.omen•reported.to the Commission that this is now all. of
the encroachments they have found out of the twenty houses in Woodland Oaks.
Ty Brisgill had a question_on the side yard.setback, saying he had .measured 2709
and 2713 Lockwood Lane and there was only.._a.five foot '.side yard setbacks-gat these
locations: Steve. Simonson remarked that a11~of these were recorded with a five
foot setback. Vice-Chairman Andrews pointed out the whole area is zoned R-5B
which calls fora minimum side yard setback. of five feet. .
Merwin_Willman made a motion to .recommend approval of the request from McKinney
Homes for Building Variances in Horseshoe Oaks Subdivision, Unit 1 as follows:
(a) 1.7' Variance-at 2805 Cedar.Lane.(Lot i2 Block 3)
(b) 0..5' Variance at 2709.Lockwood Lane (-Lot 13, Block 5)

David Allen seconded the motion and. the vote was unanimous in favor. Motion
carried.

Merwin Willman asked where Morton. Southwest is building and was informed by Vice-
Chairman Andrews they are going in with Pulte Homes at Thistle Creek in Cibolo.
Mr. Andrews said or iginally Thistle Creek Subdivision had Pulte Homes and Home-
town builders, but Hometown never developed:
Steve Simonson informed the Commission (since the signs had already been. up
several times) he had written a letter to Morton Southwest explaining the process
for requesting permission to erect bandit signs.
Ty Brisgill questioned how many times Steve Simonson had contacted them and Mr.
Simonson said just-once and their letter requesting permission to erect bandit
signs was their response.
Ty Brisgill remarked it bothers him how these builders always find a way around
the rules. Mr. Brisgill went on to say that they put up their signs before
permission is -g ranted, even. though they are asked not to do so, and he considers
this a flagrant .disregard 'of the required procedure.-
Vice-Chairman Andrews commented there are those who go along willingly with what
you want and there are those who do not.
Merwin Willman noted that we are not the enforcing agency.
James Harden made a motion to approve the request from Morton Southwest to erect
10 bandit signs along FM 3009 between IH 35 and FM 78 so long as they are in
accordance with the requirements of the FM 3009 Special Overlay Ordinance. Merwin
Willman seconded the motion and the vote was unanimous in favor. Motion carried.
#7 GENERAL DISCUSSION
David Allen commented that Pecan Grove has put up a large sign on 'the side of a
building adjacent to Kountry Kitchen Restaurant and asked if they had gotten a
permit to put up the s5gn. Steve Simonson said he would have to check on it.
Steve Simonson stated our hands are tied to some degree as far as Pecan Grove.
Ken Greenwald said we can still enforce the City. Ordinances which are applicable.
Mr. Greenwald .also said it was_his understanding from the judge that what we cannot
do is restrict building permits for R.V.'s or mobile homes in regard to Pecan Grove.
Ty Brisgill brought up several matters:
(1) Dobie Heights signs were up again over the weekend;
(2) Yard sale signs advertising yard sale in Cibolo;
(3) Need a way to .enter. FM 3009 (like Greenfield Village) around Dimrock, Woodland
Oaks Drive and Savannah Square;
(4) No street light at Dimrock and Witten; and
(5) Questioned whether development in Woodland Oaks (Unit III) can go ahead if
the Master Plan is not approved. On this matter Steve Simonson said it is
mostly infrastructure work going on in Woodland Oaks and Merwin Willman reminded
Ty Brisgill that a Master Plan is not concrete.

James Harden asked if there was nothing that could be done to get an acceleration/
deceleration lane on FM 3009 at the Lone Star. Ice House. Steve Simonson replied
they. won't. budge. Mr, Simonson informed the Commission a.letter with the Mayor's:
signature had been sent to the State Highway Department asking for a traffic light
at the entrance of Woodland Oaks and Greenshire,Subdivisions., asking .for a
reduction in-the speed limit on Jack Hays Boulevard from IH 35. to FM 78, and also
giving them statisties.on accidents occuring~in that;- same. area. during. the. -
past ten months.. Mr._Simonson said a courtesy. copy of the letter had also been
sent to State Representative Edmund Kuemple.
Ty Brisgill commented ..that, in his opinion, the Planning and Zoning Commission
needs to incorporate something into-the City•Ordinances regarding access for the
handicapped.
Merwin Willman, noting that City Council had recently approved some changes in the
Planning and.Zoning Rules of Procedure, asked if the Commission could. get a copy
of .the retyped rules.
Ken Greenwald informed the Commission City Council had passed the Ordinance
indemnifying all the City Staff.
Ken Greenwald also reported that the insurance company has taken over the case
involving Pecan Grove. They have their-own lawyers, but will also still be
working with Fulbright and Jaworsk.i.
Ken Greenwald,.referr..ing to the;"Zo-Wing Report° in the Commission's package,
specifically the-information on land use capacity, said he would .like to see the
Planning and Zoning Commission ask Steve Simonson to send off.for some of the
material.
Ken Greenwald.~,reported.that at .the City Council. Workshop on.September 10, 1986
the Sign Ordinance and Zoning Ordinance are both on the agenda. Also, on the
agenda is the vacating.of Beacon Street south of Curtiss.. Mr. Greenwald said
several things had to be worked out on the vacating.
Ken. Greenwald said the City is looking at annexing a section of land at FM 482
and FM 225.2.
James hlarden commented that_the schools particularly~Dobie, got a real surprise
when school; started with an enrollment of way more students than anticipated.
Mr. Harden said they were having to-use facilities such as the auditorium to
accommodate the increased number of. students. Steve Simonson remarked he had
spoken with the schools earlier in the year and informed..them.of the projected
growth.
James Harden..asked David A1len.if.that.is.a new college on the south side of San
Antonio. Mr. Allen replied it is :and there was brief discussion on the subject.
Steve Simonson reported several items. regarding Woodland Oaks:
(1) Plans. have been approved. for the drainage and .construction should start
before the end of the month;
(2) Gemcraft is correcting some of the problems with the sidewalks, driveways,
etc.; and
(3) Gemcraft is moving on Unit III.

Mr. Simonson also reported that things have slowed down in Savannah Square.
Steve Simonson said the City has ordered two traffic counters.
Ken Greenwald informed the Commission that City, Council has approved an $1800.00
recording system for the Conference Room, Mr. Greenwald said the order has gone
in and hopefully it will be no later than 30_days.
Vice-Chairman Andrews questioned the status:of two items on.the Development Status
chart, namely Sagemont Unit .I and CDR Drainage. Steve Simonson informed Mr.
Andrews that Sagemont Unit I is waiting on the Schertz Parkway and there is a dis-
pute between the contractor and CDR on~the~CDR Drainage.
Donald Wilson asked if a letter had been written to the State Highway Department
about a bike lane on FM 3009. Steve Simonson replied he had talked to them but
there was almost no response.
Donald Wilson said he thought maybe something in writing would be better and Ken
Greenwald said that a letter written individually to Edmund Kuemple.(State;R~pre-
sentative) carries more weight.
Donald Wilson expressed his dismay with the school district's bus system saying
his son gets. out of school. at 3:30 P.M., is not picked up by the bus until 4:30 P.M.
and does not arrive home .until 5:30 P.M.
There was a brief discussion on this with Vice-Chairman Andrews indicating part of
the .problem may be that all students now get out at 3:30 P.M. whereas in previous
years first and second graders were dismissed at 2:30 P.M. giving the bus drivers
extra time to make their rounds.
Vice-Chairman Andrews reported that the Lo e 0 k u division is forming a committee
to build a new entrance sign and he was ~~~~~-them, since he lives in Lone
Oak, to check into a couple of thing's with the City.
Mr. Andrews said it was the committee's understanding there had been a couple of
accidents involving the old sign and some insurance money to the City was also
involved. The Committee wants to know if they can use those funds.to rebuild, or
if they raise the money, will the City help them put up the sign.
Merwin Willman suggested_Vi.ce-Chai:rman,Andrews attend the Council Workshop on
September 10, 1986.and_bring the matter before. them.
.Ken Greenwald said to the best of his recollection there had been no insuranc e
money and hat.the City had=repaired the sign once free.of charge,. but vandalism
had destroyed it again.
David Allen remarked that this reminds him of something he had brought up sometime
ago to one of the developers about their entrance sign - who, where and how on down
the road is it going to be maintained.
Vice-Chairman Andrews said they'll have to handle it the same way as Lone Oak.
The next regularly scheduled meeting is September 23, 1986.
