12-10-1986 PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission and City Council conducted a Joint
Public Hearing on December 10, 1986 in the Municipal Complex Conference Room.
Members present were as follows:

#1 CALL TO ORDER
Playor Sawyer called the public hearing to order at 7:35 P.M. and turned it .over
to Planning and Zoning Vice-Chairman Bob Andrews.
#2 PUBLIC HEARING: Zoning Ordinance
Vice-Chairman Andrews explained the procedures for the public hearing. There was
no public present.
#3 GENERAL DISCUSSION
There was none.
#4 ADJOURNMENT OF PUBLIC HEARING
Vice-Chairman Andrews turned the meeting back over to Mayor Sawyer who adjourned
the public hearing at 7:37 P.M.
The Schertz Planning and Zoning Commission convened in a regular session, upon
completion of the public hearing, in the Small Conference Room.
#5 CALL TO ORDER
Vice-Chairman Andrews called the meeting to order at 7:40 P.M. Mr. Andrews
noted that an item "Consider and Make Recommendation: Zoning Ordinance" was
omitted from the agenda and should be added as Item #7A.
#6 APPROVAL OF MINUTES: Regular Session November 25, 1986
David Allen asked that. on page 7, Paragraph 10, second sentence, "but he and the
Fellowship" be changed to "but Kermit Harborth and the Fellowship".
-David Allen made a motion to approve the minutes, as amended, for the Regular
Session November 25, 198:6.. Merwin Willman seconded the motion and the vote
was unanimous in favor. Motion carried.
#7 CITIZENS' INPUT OTHER THAN AGENDA ITEMS
There was none.
#7A CONSIDER AND MAKE RECOMMENDATION: Zoning Ordinance
David Allen made a motion to recommend approval of the proposed Zoning Qrdinance.
Merwin Willman seconded the motion and the vote was unanimous in favor. Motion
carried.
#8 CONSIDER AND TAKE APPROPRIATE ACTION: Sycamore Creek Apartments - Request for
Extension of Time on Three Advertising
Signs
Vice-Chairman. Andrews commented the signs are located at Elbel Road and FM 3009,
at Elbel Road and Live .Oak, and at FM 78 and Live Oak Road.
David Allen remarked 'permission had been granted originally for the signs because
Sycamore Creek was having trouble renting the apartments.. Mr. Allen also stated
that for some reason he did not think their original .request had come through
Planning and Zoning.
Merwin Willman commented he had looked through all his minutes and couldn't find
anything.
Vice-Chairman-Andrews informed the Commission that. Sycamore Creek is presently
82% occupied and that in September and October their occupancy had been as high
as 92%.
There was discussion about the fact that approval for other signs, especially
those advertising a subdivision, was only granted until the subdivision reached
75% occupancy.
David Allen commented we have never given this type of leeway to other advertising
signs and maybe it's time Sycamore Creek stood on their own feet and took the
signs down.
Ty Brisgill said he agreed with David Allen, but did .point out that the 75% buildout
factor in a subdivision applies to a permanent structure.
Merwin Willman stated he didn't see where the signs are that much help.
David Allen asked how the Commission would feel about givirrg a 90 day terminal
extension.
Merwin Willman replied if they are up to 82% occupancy, he didn't see where the
signs are benefitting them.
Vice-Chairman Andrews responded to that statement by saying any sign is a benefit.
There was some discussion about the signs out front of the Sycamore Creek Apartments.

Vice-Chairman Andrews asked how about denying the request and giving them 60 days
to take: down the signs.
Ty Brisgill asked if that isn't circumventing and also asked if that isn't giving
them a variance.
After more discussion on the length of time they should be given to take down the
signs,-David Allen made a motion to deny the request from Sycamore Creek Apart-
ments for an extension of time on three advertising signs and to instruct
Sycamore Creek to remove the signs no later than January 15, 1987.
Merwin Willman seconded the motion and the vote was unanimous in favor. Motion
carried.
#6 GENERAL DISCUSSION
Vice-Chairman Andrews noted that one application for the vacancy on the Planning
and Zoning Commission has been received.
After some discussion, the concensus among the Commission was that they would like
to see the applicants at the regular meeting scheduled for January 27, 1987.
Vice-Chairman Andrews asked that copies of all applications be put in the package
for January 1:3, 1987.
Merwin Willman commented on the following signs:
(1) Sign advertising rental of backhoe still there at the corner of FM 78 and
First Street across from the Shoe Repair. Mr. Willman feels someone should be
able to take it down.
(2) Advertisement for washer and dryer service on a sign near Pecan Grove Mobile
Home Park.
(3) At Precast on IH.35, there appears to be an antenna. on top of the equipment -
is there a permit and how-high is the antenna?
(4) E1 Cue and True Performance both have signs with blinking lights.
In reference to the sign at True Performance, David Allen observed that when going
over the railroad tracks, you see the sign before you see the traffic light.
Merwin Willman commented he thought we had an ordinance regarding the prohibiting
of large commercial vehicles on City streets unless they are delivering or picking
up, but he could not find such an ordinance.
Mr. Willman felt we should ask City Council to come up with an ordinance limiting
these vehicles.
David Allen remarked that travel trailers, motor homes, etc. should be looked into
also.
David Allen mentioned he would like to see the City Comprehensive Plan which was
referred to in the motion denying the Specific Use Permit .for New Creation Christian
Fellowship.

Ty Brisgill remarked on several items:
(1) He asked Steve Simonson if any letters had been sent to developers along
FM 3009 informing them their bandit signs are supposed to be spaced 500 feet
apart. Steve Simonson replied he had called several of them.
(2) Asked if there had been any inspectors working on Saturdays and Steve
Simonson replied he did not know.
(3) Made the observation that the low water crossing across the'Cibolo Creek has
no reflectors and considered this a safety hazard.
(4) Asked if the guardrail on Dimrock had been inspected noting it doesn't match
the continuity of the subdivision.
(5) .Asked if-Mr. Gilmore had heard anything from the legal department on whether
or not building permits on additional sections of subdivisions can be .legally
stopped if the first section isn't accepted. Steve Simonson replied Mr. Gilmore
had-been informed it is legal, but it would take litigation.
(6) Asked if a developer, in particular Barshop, doesn't build anything within
six months after the preliminary plat is approved, do they have to refile the
preliminary plat: Steve Simonson replied yes they do have to refile, but Barshop
has a final plat.
Vice-Chairman .Andrews commented on the channel built into the road in front of
Thistle Creek and all the water that flows from it.
There was more discussion on large vehicles, on garbage trucks driving down the
middle of the road, on people working on vehicles parked in the street and on
cars parked in violation.
Steve Simonson asked the Commission for their help on a question that has come up
a lot lately regarding people wanting to put mobile homes in the newly annexed
Schermerville area. -Mr. Simonson said they all own acreage, they all are on
septic tanks,`and some claim it is a modular home rather than a mobile home they
will be locating there. Steve Simonson asked if we are going to enforce this
the same as we do in the City.
David Allen said he thought we had agreed that if the running gear is removed, it
is no longer a mobile home.
Vice-Chairman Andrews had brought in some specifications from HUD and there was
'discussion on these specifications and the current Mobile Home Ordinance in regard
to permanent and non-permanent foundations.
Merwin Willman ,commented we need to get something down in writing for future
reference.
Merwin Willman said probably a lot of that area is in the noise zone, but several
members pointed out that usually the modular homes are well insulated.
Vic3-Chairman Andrews asked if any of the Schermerville area is in the.floodplain.
Steve Simonson replied "Woman Hollering Creek" and several other areas are..
David Allen warned the Commission members that if they receive a call for donations
from an organization calling itself the Benevolent Order of Police, there is no

#10 ADJOURNMENT
Uice-Chairman Andrews adjourned the meeting at 8:41 P.M.
The next regularly scheduled meeting is January 13, 1987.
