09-13-1988 PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in a regular session on Tuesday, September 13, 1988 at 7:OO P.M. in the Municipal Complex Conference Room, 1400 Schertz Parkway. Van Dine Mction carried. #3 CITIZENS ` :INPIIT GTHER THAN AGlE11TDA ITEMS i A citizen commented. he had heard a report on the news stating that the expected revenue from traf.f.ic violations-for the City of a Schertz for .the coming year will rise from $100,000 to $400,000 ~ - acid he had-.some que~.tions on that: expected increase. Chairman _ - _ Andrews informed the gentleman he should take that question up _ - _.with City Council,- it has nothing-to do with Planning and Zoning. - Mr. Andrews also informed -him City Council - was having. a _ work-shop the next evening tWednesday, August 14th1. - ~ _ There was no other citizen input. #4 CONSIDER AND -MAKE RECOMMENDATION: Windy Meadow-Mobile Home - Park Request fog Exception to Mobile Home Ordinance A. .Section KI,B.2.c.(2) - Request exception from requirement that mobile home be no closer than 10' to any property line to requirement that mobile home be no closer than 5' to any property line. David and Betty. Dixon and .Steer Lance were at the meeting. to represent.this:request. Merwn.Wllman indicated this request.., confirms what was on the-. plat when it was-'approved (thee Commission. somehow missed the fact the plat indicated a 5' setback instead of a 10' setback). Mary Marsh asked Chairman Andrews if he wanted to mention the tour the. Commission took of Windy '.Meadow Mobile Hame Park. Chairman Andrews, reported that the Commission had toured Windy Meadow. on August 31, 1988 to see what has transpired at the mobile home park, ,to see how it is set up and to note the aesthetic .appearance of the parr. Mr. Andrews said, in his opinion, the park looks very-good. Merwin Willman made a motion to approve the request from Windy Meadow Mobile Home.:-Park for.. an exception to the Mobile Home Ordinance, Section XI,B.2.c.(2) (which states a mobile home shall - be no closer than.l0' to any property line) and allow that no mobile home shall be closer than 5' to any property line. Mary Marsh seconded the motion and the vote was unanimous in favor. Motion carried. B. Section XI,B.2.c.(4) - Request exception' from requirement of minimum distance between - mobile homes at any point being 25` provided, however, mobile homes parked end to end have a clearance of not less than 20' to a requirement that minimum distance between mobile homes at any point be 20' provided, however, mobile homes parked end to end have a clearance of not less than 16'.. Mary Marsh madam a motion to approve the request from Windy Meadow. Mobile Home Park- for an exception to the Mobile Home Ordinance, _ Section XI,B.1.c.(4) (which states minimum distance between - mobile homes at any-point .must be 25 provided; however, mobile - - - homes parked end_ to -end- have a cl-earance of not. less than 20' ) and :al-low that the distance- between mobile homes at any. point- -be - 20' provided, however, mobile homes parked end to end have a - clearance of not less than 16'.. - -2- Joe Potempa seconded the motion and the vote was unanimous in favor. Motion carried. _ #5 CONSIDER AND MARE RECOMMENDATION: Proposed Change to Mobile Home Ordinance, Section XI, Mobile Home Parks,.- Para. B.2.g. Design and Location of Storage. Facilities The proposed change is as follows: SECTION XI MOBILE HOME PARKS Paragraph B.2.g. Design and Location of Storage Facilities Current• Storage facilities with a minimum capacity of two hundred (200) cubic feet and a maximum of five hundred (500} cubic feet per mobile home space may be`provided on the mobile home space, or in compounds located within one hundred (100'} feet of each space. Where-provided, storage facilities shall be designed in a manner that will enhance the appearance of the park and shall be faced with masonry, ;porcelainized steel, baked enamel steel or other material equal in fire resistance, durability and appearance. Storage outside the perimeter walls of the mobile home shall be permitted only in such facilities. Proposed: Storage facilities with a maximum capacity of thirty (30) square feet (6 feet wide- x 5 feet deep) and a maximum height of eight (8') feet per mobile home space may be provided on the mobile home space. These storage facilities shall be desi ned in a manner that will enhance the appearance of the park and be porcelainized steel, baked enamel or other material equal in fire resistance, durability and appearance. Storage o~atside the perimeter walls of the mobile home shall be permitted only in such facilities. Storage facilities may be located directly behind the mobile home with the door(s) facing the rear of the lot and a minimum of four (4') feet between the storage facility and the mobile home, or on the side of the mobile home. However,- : that. side of the .storage facility that faces the rear .of the mobile home lot will be. even with the rear of the mobile home, with a minimum :of four (4') feet between the storage facility and. the mobile home. The Mobile Home Park owner, or.manager, may designate which of 'the two locations mentioned above is desired to maintain uniformity within the park. Chairman Andrews commented this proposal has-.come about as a _ _ - r-esult of the tour- of Windy- Meadow. - - - - _ Mary -Ma-rsh a~sl~ed if there is any_ .problem with those already - installed -and- Merwin Willman replied those already installed _ _ would be non-conforming until such time~as the occupant moves. -3= - - Chairman Andrews remarked that a sentence stating that fact needs to be added to the proposal. Ken Greenwald. questioned if there is room for a storage facility -since the granting of the exception for an end to end clearance of not less than 16' between mobile homes. Merwin Willman noted the storage facility can be installed one of two ways, either at the end or at the side of the mobile"home. Ken Greenwald then asked if it will be up to the manager of the mobile home park to decide which locatian is best for the storage facility and Merwin Willman said that is .correct. Chairman .Andrews said his only concern has to do with .the - distance of.the storage. facility from the mobile. home incase of fire. _ Mary Marsh made a motion to recommend to City Council approval of the;..proposed amendment to Section XI, Mobile Home Parks.,...- Paragraph: B. 2.. g. Design- and Location of Storage Facilities .with 'the addition of the foilawing sentence: Storage facilities in place as of the date of this Ordinance, not in compliance, may remain until such time as the current occupant and owner of the storage facility vacates the mobile home lot. Ty Brisgill seconded the motion and the vote was unanimcus in favor. Motion carried. #6 C®i~7SIDER AMID AWAKE RECOl~E11TDA~ION: Michael Ratchman of 2620 Kline Circle Request to seed and maintain -and put up a fens` across the empty lot next to 2620 Kline Circle (R-2? Michael Ratchman was at the meeting to represent this request. Chairman Andrews told Michael Ratchman it was a very impressive letter he had submitted for this request. - Mary Marsh asked who's let it is and Steve Simonson replied it is a City right-of-way. Mary Marsh then stated she felt it should be the City's responsibility to maintain it. Among the things Mr. Ratchman stated in his letter were that people drive .trucks over the lawn to dump gravel, motorbikes drive through and teenagers hangout in the lot at night. Merwin Willman commented he had driven out by the empty lot-and noticed _it could use some. clean-up, but he-saw no signs of vehicle use.--_ _ ~ Merwin Willman then asked how ma~_ complaints the City- had. - receiv~d about-the .lot and indic.ate~ that=it might-be _a liability problem.. - - _ _ _ -4- " Michael Ratchman then spoke, saying he had been maintaining the lot. Mr. Ratchman also said he had -spoken with several of his neighbors and they suggested the idea of taking a lease on the lot for a given number of years. - Ty Brisgill pointed out that if they put up fencing similar toy that of the surrounding homeowners, people would not be able to scale the fence, but there. would need to be access to the easements, for example, to the telephone and cable easements. - Merwin Willman commented if the City starts with one empty lot, putting up a fence, there .are others throughout the City and it would result in quite an expense. - Michael Ratchman remarked he has been living next.to the lot for three years and it has come to the point where he just wants"to make it look nice. Keith-Van Dine .asked if it would be possible for the neighbors to donate the fence and then have the City maintain the lot. - Ty Brisgill said` there would still be the problem with .having access to the easements. Mary Marsh stressed it is the City`s problem and asked what the chances are of getting the Iot into shape. Steve. Simonson informed Mrs. Marsh the Council. is looking for a reccrzmcndaticn from Planning and Zoning. Chuck Sharpe asked to speak at this time. Mr. Sharpe informed the Commission Michael Ratchman had made a good request and he _ thought they should lock on it favorably. Mr. Sharpe also mentioned that Bob Dietz maintains an empty lot in Deerhaven for much the same reason. Chairman Andrews noted there are lots of legalities involved and hn is confident the City Staff can worJ~ something out. Mr, Andrews also reiterated Steve Simonson's statement that Council is looking for a recommendation. Mary Marsh made a .motion to recommend to City Council' that the empty lot next to 2620. Kline Circle, in the :Woodland Oaks Subdivision, is the property of the City and therefore.the City's responsibility. It should be brought up to :standards and maintained adequately thereafter. Merwin Willman seconded the motion and the vote was unanimous in favor Motion carried . - - - - - - - _ _ _ _ - -Steve Simonson informed Michael Ratchman the_Cty Staff will get - - - - together with hi-m and work-on a solution to this problem. - _ -5- Mary Marsh asked Michael Ratchman if Woodland Oaks has a; Homeowners' Association. Mr. Ratchman said yes they do. Mrs. 1~Iarsh then. suggested he bring this problem (specifically, thee.. teenagers hanging out on the lot at night) up to them and get. them active and involved in helping to solve it. #7 CONSIDER AND TAKE APPROPRIATE ACTION: Bob Andrews, West.. . County Drive Chairman, Guadalupe County Fund - Request Permission to Place Fund Drive ,Thermometer in Front of Seguin Savings and- . Loran for 60 Days in Months of September and .October Vice-Chairman Ty Brisgill took over for Chairman- Bob Andrews on this particular agenda item.. - - Joe Potempa made a motion to approve the request from Bob Andrews, West County Drive Chairman, Guadalupe County United - Fund, to place a fund drive."thermometer in front of Seguin Savings and Loan for 64 days in the months of September and October. Andrews Motion carried. #8 CONSIDER AND TAME APPR®PRIATE ACTION: Preliminary ,Plat Approval Scenic Hills Phase II {PC 145-88) Alan Lindskog of Dannenbaum Engineering was at the meeting to represent this request. Merwin Willman commented on the private streets. Mr. Willman passed out to the Commission ccpies of the minutes. for the rleeting of November 12, 1985. At this meeting an eYCeption was granted permitting private streets; in Scenic Hills. However, that portion of Scenic Hills is not in our City. limits. A portion of the subdivision of Scenic I3ills Phase II, for which preliminary. approval is being. requested tonight, is in our City . limits and our ETJ and Mr. Willman pointed out our ordinance-says no private streets are permitted in the City limits. Steve .Simonson asked Alan Lindskog if the. County takes care .of any of_the.streets.. Mr. Lindsk~g repIied__no they do not, at.the - present time U.S.. Homes. is maintaining the streets, and will eventually -turn that maintenance over- to the Homeowners'. Association. - - _ - - _ - - -6- Chairman Andrews asked how funds are being collected by the Homeowners` Association to maintain the streets. Alan Lindskog said there is monthly dues-and all property .owners are required to belong. Chairman Andrews asked if that requirement is in the deed restr~.ctions and Alan Lindskog replied it is. George Vick then asked if it is in the deed restrictions of the existing homes or just in the deed restrictions of .the new ones .being built. Alan Lindskog said he_was not sure, he .has not read the deed restrictions on any of .the existing homes. Merwin Willman commented the~main thing is the streets are being constructed to City standards_ as they said they would be.. Chairman Andrews asked Steve Simonson if there is any Staff input. Mr. Simonson brought up the following:, 1.. Will have to vacate and r.eplat Scenic Hi11s Model Home.Park. 2. There is some .question about the drainage across the Firestone cul-de-sac onto Pebble Beach. 3. A one-foot non-access easement along Country Club Boulevard is required. 4. Water Department wants to know if there is any thaught'of looping the water system back into the City's. In response to number 4, Alan Lindskog informed the Commission negotiations are .underway far increased pumping facilities and the ,:.ngineer has determined there is enough feed to the present line. Mary Marsh asked Steve Simonson if he needs answers to all the questions now. Mr. Simonson said 'the Commission should determine if there is enough information for. preliminary plat approval and then all the questions would need 'to be answered before the final plat is approved. Mr. Simonson said approval cf the private streets would set a precedence. _ Alan Lindskog commented there would be a note included on the final plat giving the City and County permission to.enter when necessary. Merwin Willman stressed the need- to make everyone on the Commission aware that they are approving private streets. Merwin 6t?illman- also mentioned that. in .the-ir letter -Dannenbaum Engineering is requesting the rezoning of some-property f rom _ _ - Gener-al Business to R-5B. - - - -7- - 1 - Chairman Andrews listed several things which need to be addressed.:. before final plat approval: 1. vacate and replat cf Scenic Hills Model Home Park 2. one-foot non-access easement along Country Club Boulevard 3. possible public hearing possible rezoning Alan Lindskog questioned Steve Simonson on the problem with the.. drainage across the Firestone cul-de-sac onto Pebble -Beach and Mr. Simonson said he would go back to the City Engineer, and have him check it over again. Chairman Andrews concluded that the 'Commission needs lots of Staff informatien before final plat approval could be considered. Mary Marsh made a motion to approve the preliminary -plat for Scenic Hills, Phase II with the following items noted for carrectien or consideration: 1. Vacate and replat Scenic HiI1s Model Home Park. 2. Place one-foot non-access easement along Country Club Blvd. 3. Review drainage across the Firestone cul-de-sac ontc Pebble Beach. 4. Review current zoning along golf course which may require a public hearing to change from General Business to R-5B. 5. Review water distribution system as Ncrthcliffe now has a single lire for water source. Consider pcssibie loop system at FM 1103. Sharpe, dated 7-26-88, Recommending Proposed Connection of Fawn Drive and Antler Drive with a Turn-Around Street tR-1? Chuck Sharpe was at the meeting to represent this request.. Chairman Andrews :informed the Commission this item had been tabled two sessions ago. Chairman Andrews also asked if there was any Staff input.. Steve Simonson infcrmed him there. was not. _ At this .time Bob Dietz asked to speak. Mr. Dietz reminded the - = C-ommissiori that.. the last - t-ime th-is -item was- on the agenda., a - - motion to approve it died for` lack of a second because the - Commission wanted to know the feelings of the majority o-f the-- ` - i. -8- - homeowners. in Deerhaven. Mr. Dietz presented Chairman Andrews with a petition signed by 8.2 homeowners in the. Deerhaven - Subdivision giving their approval -of the request in Chuck Sharpe's letter. Mr. Di~t.z said this represents approximately 920. of the. homeowners in Deerhaven. Mary- Marsh asked for some information on the history of the streets in Deerhaven. Steve Siinorison told her they were put in by the developer and the City-maintains them. Mary Marsh said, in other words, the streets were."grandfathered" when Deerhaven was brought into the Schertz City limits. Steve Simonson. said that is correct and that any .additional streets would have: to"meet City standards. Chuck-.Sharpe pointed out hi letter is not addressing any changing of the streets.. The purpose of his letter is to change the City Master .Plan to show Fawn and_Antler connected. There was some discussion on the history of the streets in Deerhaven, on how the City Council elected to call them "suburban" atreets, and on how they were not widened at the wishes of the homeowners. Bob Dietz reminded the Commission they.. are not asking for the streets to be brought up to City standards, what they want is to make it difficult for the developer west of them so he won't wring a street through from the Schertz Parkway. George Vick commented they are asking the City to build a street not in conformance with the Ordinance. Chuck Sharpe stressed once again they are rot asking for a street, only a change to the Master Plan to show Antler and Fawn connected. Merwin Willman remarked it will not solve the current problem. - Joe Potempa asked, if the Commission approves the request and it goes into the Master Plan, can a developer request a change to the Master Plan. Chairman Andreas answered yes. George.Vick.commented this is redundant. Mary Mardi commented this is planning. Brisgill ABSTENTIONS: None Motion carried. #IU CONSIDER A11TD MAKE RECOMMEI~TDATION: Proposed Change of Schertz Modular Park from a Mobile Home Park to a Mobile Home Subdivision- - Don Decker of Bain McCrary Bain Engineering was at the meeting to represent this request.. Chairman Andrews asked for any Staff input. Steve Simonson said they need°a 50` right-of-way; not' 3.0', in the egress; a 24' country road would. be acceptable to the City; interior streets ` would have to be .private; a small part of Wise Lane is outside the City limits; any decision an the consideration of right-of- way would have to be handled in consultation with City Council. Merwin Willman informed the Commission that in a subdivision, the streets are dedicated streets. Mr. b~Tillman further stated that in the Mobile Hame Ordinance where it refers to Mobile Home Subdivisions, reference is made back tc every item except one - traffic circulation. The streets must meet the standards in the S~abdivision Ordinance. Mary Marsh asked if~ Windy Meadc~•. meets the standards cf the Subdivision Ordinance and Merwin Willman reminded her that Windy. Meadow is a Mobile Home Park rot a Mobile Home Subdivision. Chairman Andrews- cammented he agrees with Dan Decker on - everything except the streets. Mr. Andrews said he ,cannot accept that the residents would be paying City taxe s for private streets. Ken Greenwald. remarked that 5-10 years from now the residents will be demanding to know why the City is not repairing their streets. Merwin Willman made a motion to disapprove the request to change Schertz Modular Park from a Mobile Home. Park to a Mobile Home Subdivision until the.- streets meet the standards of the - _Subdivision Ordinance. Keith Van Dine seconded the mfltion. - - - Thers was mare discussion before the vote-was taken. 19- Ty Brisgill wondered if the Commission makes that recommendation, do. they lock Mr. Decker into use of the property as a subdivision.- It was agreed this recommendation would not landlock Mr. Decker. Mary Marsh acknowledged she has trouble rationalizing this recommendation, especially since they just finished the- . discussion with the. ....residents in Deerhaven regarding their "suburban" streets... Chairman Andrews pointed out-the Deerhaven Subdivision is 23 years old, the streets were built that way"before it was annexed into the City - Mr. Decker's proposal deals with a new project in the City. Joe Potempa :asked if there shouldn't be some kind of a warning..,. - system for the flood: problem which exists in the Schertz Modular Park.: Steve :Simonson informed Mr. Potempa that Don Decker has said he . will meek all''the requirements of a flood warning system and will bring the water up to City standards, the only problem is with the streets. At this time the vote was taken and the disapproval of the request was 'unanimous. Chairman Andrews informed Don Decker he has the right to appeal through City Council and. the Board of Adjustment. #li G~~TERAL I)ISCIISSIO~ Ty Brisgill hrought up the following: (1) Is there going to be any landscaping at City Hall? (Ken Greenwald .said it is im the budget.) (2) There is still dirt in the ditch at Dimrocl~ in Woodland Oaks. - (Steve Simonson said the City had .tried clean it cut, but they need a dry period so their equipment will not sink into the g round . ) (3) Would like to have some kind of written confirmation -from the City Attorney about what the Commission can do as far as requested exceptions to the Zoning Ordinance.- (Steve Simonson- said the :Zoning Ordinance is.law passed by City Council and must be administered by.City Council,. that.: is why .the Commission makes it's recommendations to City Council. Chairman-Andrews said the City Attorney had explained to him that Zoning .Ordinances are - _ - -enacted laws by eaected- aff icials of the City a-nd only - el-ected_ _ officials,- not- an appointed body,can make a change-to those laws. ) _Ty _ Brisgill asked if this.. applies only.- to the- -Zoning - _ - - Ordinance and was informed that is correct. - - - - '-11- (4) Inquired if Steve Simonson had asked Jerry Graham, Street's & Parks Superintendent, about the rusted-out barbeque grill at. the City Park. (Steve Simonson said-.he had not had a chance to check.`... on it yet.) - {5) Asked if Steve Simonson had checked on Woodland Oaks Drive in Greenshire Oaks, down by the bridge going toward the model home, _ where the road had been patched and is starting to crack. (Mr. Simonson said they have gone back to the engineer --the road has not been accepted by the City.) Merwin Willman brought up the following: (1) Four of the.Commissianer`s terms expire October 1st: Ty Brisgill, George Vick, Keith Van Dine and Mervin Willman. (2) Need some striping up to the Stop Sigri at - the low water crossing on .Aviation. (Jerr,y Graham said they have considered.. it' ~.l.~eady, but will have to come before City Council to get permission to make it a "No Passing" _ zone and ,they also need to get together with. Universal City. to make.. sure it does not` interfere with their traffic flow.) (3) Need some procedure whereby the Commission is notified of City Council acticn an any Commission recommendations. (An FYI attachment to the agenda was suggested. Steve Simonson said he will work out some method of ]seeping the Commission informed.) George Vick brought up the following: (1) The street striping laclrs great. (2 ) Someone is putting up a mobile home on FM 1518 across Pram ~~rindy Meadoc• Mobile Home Park. (Stc~~e Simcnscn said he would check into it.) (3) Noticed the road under the FM 78 railroad bridge is not opened yet. Joe Potempa asked what the railroad is laying now and Steve Simonson replied it is telephone cable. Mr. Simonson also infcrmed the Commission Southern Pacific has been sold and the_ engineer from there that the City was dealing with`. has retired. Joe Potempa also asked if a letter had been sent to the Railroad: Commission asking them to attend the .City Council workshop on September 28th. Steve Simonson said it had been sent, but as of: yet, there was no answer 'from them. Keith Van Dine. brought up the following: - - _ - - _ {1)_Asked if Steve Simonson had ever checked on the mobile home - ~ being located -off -Pfeil Road up on a hillside. (Steve Simonson - said the people obtained all their- permits.) -12= (2) Wondered' how thick the steel on the new water tower is because of deer hunting season coming up. (3) Received a nasty letter from a veterinarian in San Antonio about the Commission's consideration of allowing MediPure to locate in Schertz. (3)--What are. they going to do about all the dirt piled up by the new water tower? (Steve Simonson said after the City finishes it`s work, the dirt will be spread out evenly around the tower.) j (4) There are now four reflectors installed to warn people where the road in front of his property is being eaten away - is the City, going to fix the read? (Steve Simonson said funds for repairing.. the road :are in next year's budget..) - Mary Marsh asked if registration had been sent in for the upcoming APA conference- and if the room reservations had been made. -She was informed both things- had been accomplished.
