02-07-1989 PLANNING AND ZONING MINUTES The Schertz Planning and. Zoning Commission and City Council conducted a joint public hearing on Tuesday, February 7, 1989 at 7:00 P.M. in the Municipal Complex Council Chambers, 1400 Schertz Parkway. Those present were as follows: PLANNING AND ZONING COMMISSION CITY COUNCIL TY BRISGILL, CHAIRMAN MAYOR EARL SAWYER MARY MARSH, VICE-CHAIRMAN COUNCILMAN EARL HARTZOG KEITH VAN DINE, SECRETARY COUNCILMAN HAL BALDWIN MERWIN WILLMAN COUNCILMAN ADOLPH AGUILAR BOB ANDREWS COUNCILMAN KEN GREENWALD GEORGE VICK JOE POTEMPA OTHERS PRESENT CITY STAFF ALAN LINDSKOG, DANNENBAUM ENGINEERING KERRY SWEATY, CITY MANAGER JUNE KRAUSE, CITY SECRETARY STEVE SIMONSON, ASST. CITY MGR. NORMA ALTHOUSE, RECORDING SECY. *1 CALL TO ORDER Mayor Earl Sawyer called the meeting to order at 7:00 P.M. and turned it over tc Planning and Zoning Chairman Ty Brisgill. Chairman Brisgill commented there are two items on the agenda scheduled for a public hearing and then went on tc explain the rules of procedure that would be used for such hearing. ;2 PUBLIC HEARING: Specific Use Permit X89-1 To receive input from the public on the request frcm Mike Besch of Salvage Enterprises, 17051 iH-35 North, for a Specific Use Permit to allow location of a mobile home on the property for security reasons. Steve Simonson, Assistant City Manager, gave a brief presentation on the location of Salvage Enterprises. Mr. Simonson then infcrmed those present that based on Mike Besch's history of failure to comply with the Junk Yard Ordinance, the Staff recommends denial of this request. Neither Mike Besch, nor anyone representing him, was present at the public hearing. Councilman Aguilar asked Steve Simonson if-there had been any reply frcm the. letters sent to property owners regarding this request for a Specific Us e. Permit. Mr: Simonson reported that no replies had been received. There were no questions or further comments on this request. #3 PUBLIC HEARING: Zoning Change #90 . To receive input from the public on the request from Dannenbaum Engineering to rezone twa tracts of land in Scenic Hills Phase~II from General Business to R-5B. Steve Simonson gave a brief presentation bn the location of the land proposed for rezoning and reported that the Staff recommends approval of this request. Alan Lindskog of Dannenbaum Engineering was present at the public hearing to answer questions. Councilman Aguilar asked which way the homes will be facing. Alan Lindskog replied there are two holes on the golf caurse parallel to IH-35 and one of them will be moved back. Mr. Lindskog continued on saying the homes will front IH-35, however, the golf course fairway will be between them and the interstate, a street will go through, and pointed out that mast of the homes are designed with the living area to the back which would look out upon the golf course. Councilman Hartzog questioned Alan Lindskog about a road going through the gclf course and Mr. Lindskog said it crosses between the paths of one of the greens. Mr. Lindskog also said it was on the original Master Plan approved by the City of Schertz and will complete a Ioop through the subdivision. Mr. Lindskog did say, however, that the road is not located in ,this part of Scenic Hills where the rezoning is being requested. Bcb Andrews asked Steve Simcnson if there was any feedback from property owners regarding this rezoning request and Mr. Simonson reported no replies had been received. The Commission indicated they were aware of Staff input. Mary Marsh asked if the Commission knew cf Mr. Besch's history of non-compliance with the ordinance before recommending this request for a public hearing. Steve Simonson said the Commission knew quite a bit of the history, but it looked at that time like Mr. Besch was moving ahead to make the necessary corrections. Joe Potempa made a motion to recommend to City Council denial of the request from Mike Besch of Salvage Enterprises, 17051 IH-35 North, for a Specific Use Permit to allow locaticn of a mobile home on the property for security reasons. Mction carried. #g CONSIDER AND MAKE RECOMMENDATION: Zoning Change #90 Chairman Brisgill asked if there was any further discussion on this. There was none. Bob Andrews made a motion tc recommend to City Council apprcval of the request from Dannenbaum Engineering tc rezone two tracts of land in Scenic Hills Phase II from General Business to R-5B. Joe Potempa seconded the motion and the vcte was unanimous in favor. Motion carried. #10 CONSIDER AND MAKE RECOMMENDATION: Proposed Amendment to Subdivision Ordinance 87-5-11 In order to comply with the-State law, Steve Simonson had written up a proposed amendment to Sections 23 and 30 of the Subdivision Ordinance changing the lot size from 15;000 square feet to one-half acre 021,780 square feet). -3- . Chairman Brisgill reminded the Commission this was a necessary update to the Subdivision Ordinance. Bob Andrews made a motion to recommend approval to City Council of the proposed amendment to the Subdivision Ordinance as follows: Section 23 Lots Sec. 23.2 Lot Dimensions a. - change the lot size from 15,000 square feet to one-half acre (21,780 square feet) Section 30 Septic Tanks Sec. 30.3 Sewerage Systems Change the first sentence from 15,000 square feet to read one- . half acre (21,780 square feet) for single family dwelling. Merwin Willman seconded the motion and the vote was unanimaus in favor. Motion carried. #l~ GENERAL DISCUSSION George Vick brought up the following: (a) Said he was glad to be back. (b) Asked whatever happened to the Commission's recommendation for relocation of the Post Office mail drop boxes. (Steve Simonson said after review, the Staff recommended disapproval; the State was totally against it; and the Post Office felt the way they have things now is the best.) (c) Said there's a ditch all along Schertz Parkway and at the corner of Schertz Parkway and Maske Road, on the right hand side going toward IH-35, after a heavy rainfall last week there was garbaf~e flowing out of the ditch onto Schertz Parkway. tSteve Simonson said the area was just recently recontoured and pointed out the problem will be corrected.) Joe Potempa thanked Steve Simonson for the tour of the City last week. Keith Van Dine asked if the City had gotten the Stop Sign and the light he turned in tc the Police Department. Steve Simonson replied they had received them. Mr. Van Dine also asked if.he had signed all the copies o.f mylars he was supposed to sign. Steve Simonson told him yes, he had. -4- Steve .Simonson informed the Commission that after all the mylars for Stone Creek RV Park had been signed, Floyd McKee had put them in the tool box in his truck until he was able to take them to be recorded, and someone stole his tool box. Mr. Simonson did, say, however, that the mylars had been returned to Mr. McKee. Steve Simonson commented Mary Marsh had called him expressing some concern about the FM 78 widening and whether or not the previous agreement (before Southern Pacific was sold) for the 20' right-of-way would be honored by the new owners. Mr. Simonson said he had received a letter from the engineer stating they k~culd honor the previous agreement. Mr. Simonson also remarked we should have the schematics for the widening in approximately 6-8 weeks. Merwin Willman asked if they are giving the right-of-way or are we paying for it and Steve Simonson said we are paying for it. Mr. Simonson said we made a monetary offer and they accepted. Bob Andrews noted that the bridge they will be putting in on FM 78 will be a regular bridge outside the 100 year floodplain. Chairman Brisgill said he would like to commend the street department for doing an excellent job of putting sand on the streets during the recent spell of icy weather. It was suggested that Mr. Brisgill write a letter to that effect from the Planning and Zoning Commission. Chairman Brisgill also reminded the Commission of the notes from Steve Simonson in their package regarding the creation of a Public Use District and the definition of adult entertainment and what restrictions can be placed on this type of business. Mr. Brisgill told the Commission they should be thinking about these items. Mary Marsh had a brochure from the American Planning Association about the national conference being held in Atlanta this year. Mrs. Marsh asked if the letter had ever been sent to the APA about small city participation in the conference. Steve Simonson said he thought the letter and a package had >ueen sent, but he would check into it. Steve Simonson reported that the street crews had been on 12/12 shifts from Sunday morning through Monday evening during the icy weather. Mr. Simonson pointed out they had gone two hours on and off •uuring that time checking the sanding of the streets to make sure it was adequate. Mary Marsh asked how the distribution of the survey was coming and overall it was reported to be coming along fairly well. -5- X12. ADJOQRNMENT Chairman Brisgill adjourned the meeting at 7:29 P.M.
