- The Schertz Planning and Zoning Commission convened in a regular
session on Tuesday, June 26, 1990 at 7:00 P.M. in the Municipal
Complex Conference Room, 1400 Schertz Parkway.. Those present
were as follows:

Chairman Brisgill called the meeting to order at 7:00 P.M.
#2 APPROVAL OL•' MINUTES: Public Hearing and Regular Session
June 12, 1990
+ Merwin Willman made a motion to approve the minutes for the
public hearing and regular session June 1?, 1990. Bob Andrews
seconded the motion and the vote was unanimous in favor. Motion
carried.

#4 CONSIDER AND MAKE RECOMMENDATION: Request from Rick and
Rita Saenz for an 8' Front Yard Setback
Variance at 501 Aviation
Rich and Rita Saenz ~,~ere at the meeting to represent this
request.
Chairman Bris ,ill as:~cd for Staff input. Steve Simonson noted
that Rick Saenz had r~et the requirements by paying the $50.00
filing fee for this ~~equest for an exr_eption to the Zoning
. Ordinanr_e an:1 had also submitted a fairly good detailed map for
the Commission's reviec.- which shows the setback variance he is

Chairman Brisgill inquired if this property is zoned R-2 and was
informed it is.
At -this. time Chairman Brisgill read an excerpt from the Zoning
- Ordinance,-Article XXIII Amendments, Section 2.2.2 Changes ands
Amendments, Paragraph 5:
"5. A_ petition for a change to a setback requirement and/or
another. requirement for property currently zoned may be
recommended for public hearing if any of the following conditians
are met:
a. If the applicant cannot make a reasonable use of the property
or earn a reasonable return without the requested amendment.
b. The requested amendment is peculiar to the property.
c. The request is not a condition caused by the applicant.
d. The health,:safety and welfare of the neighborhood and/or City
will not be effected by the requested change."
Jim Shriver indicated he would like for Rick Saenz to explain to
the Commission exactly what it is he plans to do.
Rick Saenz informed the Commission his family wants to stay in
Schertz, but they need a bigger home. The plan is to move the
old house out and put the new house at the same location. Mr.
Saenz commented he is requesting a variance so when the new house
is built, he can keep the same amount of area in back for his
- children to play.- The new house will be •a~~5 bedroom structure..
Mr. Saenz stressed to the Commission that his property at 501
Aviation is located on a corner lot, Lindbergh is a dead-end
street, and that the new house will riot stick out like a sore
thumb in the neighborhood.
Chairman Brisgill, noticing there`s room on eitr~er side of the
property, asked Mr. Saenz if he could use the sides. Rick Saenz
replied he had spoken with the engineer about this and the cost
would be $7,000 to $8,000 more because of having to change the
walls. The walls are prefabricated.
Chairman Brisgill also asked Mr. Saenz if he would be using the
same concrete and if the house is in sections like a modular.
Mr. Saenz replied there is no concrete, they ~.~ill have tc pour a
slab and the house is not a modular, it is a Ray Ellison Dome.
Chairman Brisgill asked if Lindbergh is a dead.-encl street and if
it is deeded to the City. Steve Simonson replied yes to both
questions.

Bob Andrews asked Rick Saenz if this request were to be denied
- could he use the existing garage to park his car - he would have''
- 20 feet in which to do it. Mr. Saenz replied that would be fine
if the City were willing to pave the street. Mr. Saenz pointed
out that whenever there`s a heavy rain, the runoff is-always onto
his property and has even cracked the concrete. Mr. Saenz
indicated that if the street were paved, he would consider
turning his garage the other way.
Chairman. Brisgill suggested Mr. Saenz take these concerns about
the street to City Council.
Merwin Willman mentioned that some years ago the City was willing
to deed over the dead-end on Lindbergh to the adjoining property
owners, but no one wanted it.
Rick Saenz expressed interest in owning the property and said
that if the City would take care of the curb, he would be willing
to do all the rest.
Once again, Chairman Brisgill recommended Rick Saenz take these
things up with City Council.
Chairman Brisgill inquired if the Commissioners had other
questions. Merwin Willman expressed the opinion he thinks some
of the 28 foot driveway could be used far the house. Mr.
Brisgill said he alsc has some concerns because of the rest of
the houses on the street being lined up on the 25' setback.
Earl Hartzog asked to spear at this time. Mr. Hartzog reminded
the Commission there are other homes in Aviation I-Ieights and
other R-2 areas in the City that have less than a 25' setback.
Mr. Hartzog continued on saying that Mr. Saenz, even kith the
variance, will still caind up being some 20 feet f nom the
curbline.
^•lerwin th'illman asked if this request won`t go to a Board of
Adjustment hearing and Steve Simonson replied yes it will.
Bob Andre~.-s made a motion to recommend to City Council that the
request from Rick and Rita Saenz for an 8` variance tc the front
yard setback requirement be scheduled for a public hearir~,. Jim
Shriven seconded the motion. and the vote was as follows:

Earl Hartzog related that Mr. Saenz had previously asked for the
right-of-way but his request was denied because Entex-uses it as -
an easement and the Staff was told there are- some utilities
there.
- Steve Simonson backed up Mr. Hartzog's statement saying there are
supposed to be.some City utilities in the right-of-way and he
will have to check into it further.
Chairman Brisgill explained to Rick Saenz that th-is
. recommendation being made tonight' by the-Commission is just to
schedule a public hearing. Mr. Brisgill said if Council agrees,-
then there will be two public hearings - the Commission will bald
one :and so will the City Council.
Steve Simonson informed Rick Saenz he will receive a letter from
him :with the probable dates of the public hearings.
Chairman Brisgill thanked Mr. and Mrs. Saenz for their time.
#5 GENERAL DISCUSSION
Bob Andrews:
(a) Welcomed Harry Bauman aboard as a member of the Commission.
Harry Bauman:

- (a) Had noticed during the discussion with Rick Saenz that the
word modular came up. Does the City have an ordinance against
modular homes?
Chairman Brisgill said no, but the City does ha~-e a Mobile Home
Ordinance.
Bob Andrews commented the City has nothing in any Ordinance to
preclude someone from building a modular hcrle in a residential
area. Mr. Andrews further stated he cannot justify exr_luding
modular homes when they are well constructed and meet the
Southern Building Code.

Chairman tc speak to the Commission. Chairman Brisgill commented

Steve Simonson:
(a) Stated that if the Commission's ready, it's time to get bacl~
to work on the City Comprehensive Plan. -
Chairman Brisgill asked if all the feedback has been received.
Steve Simonson replied there are still some areas where feedback
is needed, but he will give the Commission all he has written up
so far. Mr. Simonson also noted there will be blanks where maps
should be, but he will give it to -them clean (none of the old
plan versus the new, just the new).
After checking what's scheduled for upcoming agendas, Chairman
Brisgill requested that the Comprehensive Plan be placed on the
agenda of the next meeting.
- Chairman Brisgill:
(a) Welcomed Harry Bauman to the Commission and explained to him
about picking up his package .for the meetings from the Police
Dispatcher.
Merwin Willman asked Norma Althouse if she still has Joe
Potempa's information on the upcoming conference so it can be
given to Harry Bauman, and Mrs. Althouse replied yes she does.

Chairman Brisgill adjourned the meeting at 7:30 P.M.
The next regularly scheduled meeting is July 10, 1990.
