02-11-1992 PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission convened in a regular session on Tuesday, February 11, 1992 in the Municipal Complex Conference Room, 1400 Schertz Parkway.. Those present were as follows: PLANNING AND ZONING COMMISSION OTHERS PRESENT BOB ANDREWS, CHAIRMAN LONDA PHILLIPS JIM SHRIVER, VICE-CHAIRMAN .KEITH VAN DINE, SECRETARY CITY STAFF GEORGE VICK BOBBIE VONADA STEVE SIMONSOh, KEN GREENWALD, COUNCILPERSON ASST. CITY MANAGER NORMA ALTHOUSE, MEMBERS ABSENT _RECORDING SECRETARY MERWIN WILLMAN GARY BRLCKEN #1 CALL TO ORDER Chairman Andrews called the meeting to"order at 7:00 P.M. #2 APPROVAL OF°-MINUTES: Regular Session January.28, 1.992 Keith Van Dine made `a motion to approve the minutes,.for the regular. session January 28, 1992. Bobbie Vonada seconded the motion and the :vote was as follows: AYES: B. Andrews, K. Van Dine, G. Vick, B. Vonada NAYS: None ABSTENTIONS: J. Shriver Motion carried. #3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS Londa Phillips was at the meeting on behalf of Odo Riedel and had three items to bring before the Commission. (1) Presented the Emergency Preparedness Plan for Pecan Grove Mobile Home Park which had been compiled in cooperation with Police Chief Agee and Fire Chief Melton. (2) Reported that at the backside of the back entrance to Pecan Grove there are gates now so people can exit when it floods. , (3) Related that Mr. Riedel had been working with Rocky Aranda on the replat, but dismissed him yesterday, so tomorrow they will start with a new engineering firm. #4 CONSIDER AND MAKE RECOMMENDATION: Proposed .Changes o the Zoning Map and Proposed Special Overlay.. District - Schertz Parkway Chairman Andrews reminded the Commission they had received, in their packages, a listing of all the proposed changes<-to the Zoning Map and also a copy of the proposed Schertz Parkway Overlay District with all the changes as.auggested;at the last meeting. The Commission reviewed the proposed Schertz Parkway Overlay .District and discussed a few things, but had no further changes to recommend. Among those items 'discussed were banners on buildings versus banners across the roadway, flush .mounted signs, radio, TV or microwave towers allowed-with a Specific Use Permit, and whether or not 'a halfway house could. be permitted according to the Schedule of.,Jses. Keith Van Dine made a motion to recommend the proposed changes ro the Zoning Map and the proposed Schertz Parkway Overlay District be forwarded to City Council for review and the possible scheduling. of a public hearing. , .Tim..`. Shriv`r seconded the moticn and ;the ;:vote.. was unanimous in favor.` Motion carried. #5 CONSIDER AND MAKE RECOMMENDATION: Updating of Comprehensive Plan Included: in .the-Commissioners packages were pages on Goals.,; and Objectives, City Gover~iment and Economic Conditions which Steve.Simonson had compiled for review.` Mr. Simonson distributed some further information; to! the' Commission regarding Public Facility Services, a..:.population` growth chart, Appendix 6 (a City organization chart); Appendix 7 (Water Construction Projects),,Appendix 8 (Police Department Comprehensive Plan), and Appendix:9 tRecreation Facility Requirements). Mr. Simonson remarked he hopes the information is on ,the right track and informed them they should now have tin one: form or another) everything done, at least in draft form,. on items 1 through 5J listed in the Table of Contents.. Mr. Simonson then commented he will give them a better copy of the population information. ' Mr. Simonson advised he needs Chairman Andrews help with work on Housing, he will be working on Transportation, and Climate and Resources, which we already have, he will rework a little. -2- Steve Simonson went on to say he is dedicated to getting this thing off dead center. We will refine it the best we know how, put it in final draft version and send it to City ` Council for their comments. When it comes back from City Council with their comments, it will be sent to all departments far their last update and then put together in the recommended final version and sent to City Council for approval. Keith Van Dine had a question on land use. Mr. Van Line, saying land use has to tie in with other things, wanted to know if we want it as it was, as it is and how it's going to. - be in the future. Steve Simonson replied he thinks it would be best to show what it is and what we want it to be. Mr. Simonson went on to say that as far as a Comprehensive Plan is concerned, you have to be able to dream or it's worthless.. Keith Van Dine agreed.. Mr. Van Dine expressed the opinion- , that you have to write down the ideal situation. If it doesn ` t happen, it doesn't,' but' if it' s not ` written. ' down anywhere, it surellT won't happen. Steve Simonson explained that with a Comprehensive Pian you -hope for a utopian view tempered by reality. George Vick mentioned that the Ccmprehensive Plan.should tie in with the Capital Improvement Plan' and Steve Simonson pointed out it should be the other way around and then indicated that the beginnings are there right now. Keith Van Dine emphasized that"one of the most important keys to growth is water. George Vick observed, that as :far, for .example, as the Police Department and Fire Department are concerned, there: may be- some facilities needed which require large sums of ''money through taxes and these departments may have other; major programs we dan't know about. Mr. .Vick wanted to know -the overall income of the City. Steve Simonson stressed that five-year plans for.: various departments, some of them involving needed facilities, was part of the information he had provided them this evening. Mr. Simonson, also mentioned you don't want the overall income of the City included in this. Chairman Andrews, using the Schirmerville area as an example, noted it will be zoned R/A for sometime, that I-10 will eventually have some general business growth, and that water is needed if the area is to develop. Mr. Andrews added, also, that a larger tax base f_or the City will provide more income, it doesn't necessarily have to be a raise in taxes. -3- To this Steve Simonson stated that sales taxes provide life ` blood for cities and he feels IH-35 will supply a lot of growth. Mr. Simonson said he did not include funding for major projects, but suggestions for funding will have to be included. George Vick admitted he doesn't want the Commission to write a Comprehensive Plan that will be put on the shelf. Councilman Ken Greenwald, referring back to George Vick's statement about taxes, acknowledged there are various. ways to build things without raising taxes such as through bonds, through increments, and through an .increased tax base. Steve Simonson related that a Comprehensive Plan should be a physical plan with a guideline for the future. Mr. Simonson said, in his opinion, the legislature will eventually pass a; law whereby the Comprehensive'Plan is-.the primary .document far development within a city and not .the Zoning Ordinance. Councilman Ken Greenwald remarked. the City, is operating on what is probably a 5-year minimal plan:" Mrw Greenwald then` brought up an example from some yParS~back of bond, money. being approved for streets ir.-.Mobile Villa but no4 approved. for water lines .and how. t}.ie City ;-?aould have been foolish to put in the streets without .having first uut`in the water Iines. Steve Simonson informed the Commission there's,rio..athex plan out there from any department that they :don't have., Chairman Andrews suggested the Commission digest `the' _ information they have received, put, it in their books, and bring it back for discussion at the meeting of March <10th.- The Commission agreed to this plan.. #6 GENERAL DISCUSSION Jim Shriver: (a) Asked if the Planning-Commission Journal is something they receive periodically and Steve Simonson replied yes it is. tb) Referred to "Revisions to Code Relating to Junk and Abandoned Autos" given to the Commission several meetings back and asked what number (5) means. It reads as follows:. "(5) If a hearing is requested within ten t10) days after service of notice to abate the nuisance. the City must provide a public hearing before the .removal of the vehicle or before the Planning and Zoning Commission of the City of Schertz. A resolution or order requiring the removal of the vehicle or a vehicle part must include a description of the -4- vehicle and the correct vehicle identification number and license number of the vehicle if the information is available at the site." Mr. Shriver asked what this means. Steve Simonson declared that the lawyers had written it up and it is in compliance with State law. Councilperson Ken Greenwald replied it means the City needs some form of identification for the vehicle or vehicle part. Mr. Shriver asked if tY:is also means there has to be a public hearing and was told yes, if a hearing is requested, it has to be a public. hearing. Chairman Andrews mentioned this was the same paragraph Merwin Willman had questioned. They took.Planning,and Zoning out of the procedures, but put them back in for the public hearng.- (c) Mentioned Steve Simonson's notes to the Commission about Home Occupations and said discussion of this subject. should be on the next agenda. Steve Simonson admitted the section of the ordinance on Home Occupations needs a lot of refining. Chairman Andrewsinformed,the Commission his definition of a Home Occupation is am individual who wishes to work at home for the .purpose of gaining some resou~celincome- wthout- having to leave their family to_go to work. He doesn't think it should involve, for example, seven people in ',.the ;same _ family where all you have is the house, otherwi e why do we have General Business and Neighborhood Service zonings. Mr. Andrews asked the Commission to think it over before ahe nest meeting. _ Keith Van Dine brought up the point also, that it should be considered if the home occupation is a primary or secondary source of income. Chairman Andrews: (a) Reported there's an old school bus and an old truck parked on the lot behind Chico's Paint and Body Shop. Steve Simonson stated the property owner parked them there. Mr. Simonson said first the owner was going to start a construction business and then some other kind of business, but nothing has worked out so far. Mr. Simonson said he did require the property owner to put up,a fence. -5- ADJOURNMENT Chairman Andrews adjourned the meeting at 7:50 P.M.
