04-28-1992 PLANNING AND ZONING MINUTES
The Schertz Planning and Zoning Commission convened in a regular
session on Tuesday, April 28, 1992 at 7:00 P.M. in the Municipal
Complex Conference Room, 1400 Schertz Parkway. Those present
were as follows:

#1 CALL TO ORDER
Chairman Andrews called the meeting to order at 7.:00 P.M.
#2 APPROVAL OF MINUTES: Public Hearing and Regular Session
April 14, 1992
Merwin Willman made a motion to approve the minutes for the
public hearing and regular session April 14, 1992. Bobbie Vonada
seconded the motion and the vote was unanimous in favor. Motion
carried.
#3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS
Londa Phillips asked if anyone had gotten a meeting together to
protest CCMA's raising of their fees.
Chairman Andrews explained that CCMA is raising their fees from
$500 to $948 and has scheduled a public hearing, in Austin, for
May 28, 1992. Anyone wishing to protest has to do so in writing
and have it to them 8 days prior to the public hearing.
Mr. Andrews indicated the City of Schertz Water Department has
filed a protest, but he is not aware of objections from any other
source.
#4 CONSIDER AND TARE APPROPRIATE ACTION: Final Plat Approval
of the Vacate and Replat of a Portion of
Schertz Modular Park, Unit One (PC #174-92)
Londa Phillips was at the meeting to represent this request.
Chairman Andrews asked for questions or comments from the
Commission.
Merwin Willman mentioned that the name of the street being
replatted should be on the plat, .and Councilperson Ken Greenwald
reminded Mr. Willman it is not a public street.
Merwin Willman made a motion to approve the final vacate and
replat of a portion of Schertz Modular Park, Unit One (PC
#174-92). Bobbie Vonada seconded the motion artd~•the vote was
unanimous in favor. Motion carried.
#5 GENERAL DISCUSSION
Bobbie Vonada•
(a) Announced she will miss the second meeting in May because of
vacation.
Merwin Willman•
(a) Related that the Commissioners used to each have a copy of
the City limits map with all the zonings shown on it. Mr.
Willman said he would like to have an updated copy for use at
home and wondered if anyone else was interested. Bobbie Vonada
and George Vick also expressed a desire to have a similar map.
George Vick asked about the size of the map and Steve Simonson
replied a good size to work with is 18" x 24".
(b) Informed the Commission that John Lund, a former Postmaster,
had died.
(c) Inquired if anyone from the City had seen today's article in
the Express-News about illegal billboard signs. They're saying
the big message sign at Central Park Mall is illegal because it
advertises off-premise items.
Chairman Andrews said that reminded him there is an article in
the Zoning News about a gentleman who had been issued state
permits to put up a billboard, but the city would not let him put
up the billboard so he sued. The city won the case.
George Vick referred to a couple of new signs he had seen along
FM 78 advertising Riedel's. Londa Phillips informed Mr. Vick
the signs were not new, they were simply refurbished.
Steve Simonson:
(a) Told the Commission he had received a request from Mike
Andrews, representing the Woodland Oaks Homeowners Association,
to put up signs similar to Crime Watch signs, on City poles, on
Woodland Oaks Drive and on Dimrock. The signs would say
"Woodland Oaks Homeowners Association Restrictions Enforced."

Mr. Simonson said he had written Mike Andrews a letter telling
him the Sign Ordinance specifically prohibits private signs in a
public right-of-way. Mr. Simonson further stated the letter
informed Mike Andrews his request is not an agenda item, but will
be brought up during general discussion items to get a feeling on
this from the Commission.
Steve Simonson indicated he thinks this may be the first of many
such similar requests because the Woodland Oaks Homeowners
Association has just taken someone to court and Jrio~ the case. As
a result of that, other homeowners associations are getting
active. Mr. Simonson then asked the Commission if they think
this should be an agenda item.
The Commission discussed this request bringing up the following
points:
1) Woodland Oaks has private property such as the swimming pool
and tennis courts where these signs could be pasted.
2) There is a procedure whereby they let potential homeowners
know that Woodland Oaks has a mandatory Homeowners Association
and also lets them know exactly what restrictions are enforced.
Anyone buying a home in Woodland Oaks is required to sign a paper
saying they have been informed of these facts.
Chairman Andrews mentioned that the San Antonio Board of Realtors
(SABOR), in its MLS (multiple listing service) advises of a
Howmeowners Association, whether or not it is mandatory, how much
it costs and to whom it's paid. If it's mandatory, that is in
the home buyers's contract and in the deed restrictions. If the
home buyer wants a copy of the covenants, he/she must call the
Homeowners Association.
3) Merwin Willman remarked that since they are informed of these
things up front, he sees no need for the signs. This was also
the consensus of the Commission.
Councilperson Ken Greenwald:
(a) Stated that on May 12th at 7:00 P.M. at the Guadalupe County
Commissioners Court there will be a discussion on regional solid
waste facilities.
(b) Reported that on May 14th, at Converse City Hall, there will
be a presentation on the Community Development Block Grant.
(c) Announced that June 20th is the annual Senior Citizen
Festival at Good Shepherd Parish Hall.
Chairman Andrews:
(a) Observed that the Street Department is not moving as fast as
some people would like, but they are making a concerted effort.

George Vick•
(a} Reported the annual festival at Good Shepherd Catholic
Church is May 3rd and they have an excellent barbeque dinner.
Chairman Andrews asked where they're going to park this year and
George Vick replied he thinks they have been talking with the
City.
Steve Simonson acknowledged they will have parl~Ag behind the
Community Center.

Chairman Andrews adjourned the meeting at 7:25 P.M.
The next ,regularly scheduled meeting is May 12, 1992.
