12-08-199211- :alp r PLANNING AND ZONING MINUTES The Schertz Planning and Zoning Commission conducted a public hearing on Tuesday, December 8, 1992 at 7:00 P.M. in the Municipal Complex conference room, 1400 Schertz Parkway, Schertz, Texas. Those present were as follows: PLANNING & ZONING COMMISSION BOB ANDREWS, CHAIRMAN OLIVER NELSON, SECRETARY BOBBIE VONADA DAVID RICHMOND KEN GREENWALD, COUNCILMAN MEMBERS ABSENT GEORGE VICK, VICE - CHAIRMAN MERWIN WILLMAN KEITH VAN DINE OTHERS PRESENT BETTY KRUETLER, 4212 SHADY OAK MARY GARCIA, 1012 ROBERT DERRICK WANDA KOCH, BOSWELL - NIEMIETZ REALTY CITY STAFF STEVE SIMONSON, ASST. CITY MANAGER NORMA ALTHOUSE, RECORDING SECRETARY (The public hearing was advertised to be held in the Council Chambers, but because only three citizens showed up, it was held in the conference room.) #1 CALL TO ORDER Chairman Andrews called the meeting to order at 7:04 P.M. #2 PUBLIC HEARING: To receive citizen input on the intent to consider renaming Jack Hays Blvd /FM 3009 to Roy Richard Dr /FM 3009 Chairman Andrews explained the procedures that would be followed for the public hearing and that Planning and Zoning has ten days to make its recommendation to City Council. Mr. Andrews then asked for Staff input. Steve Simonson reported that 31 letters had been sent to property owners effected by this proposed change.- Seven letters were returned - 4 opposed and 3 °in favor. Betty Kruetler of 4212 Shady Oak commented she has been in the area all of her life and has nothing against Roy (Doc) Richard, but thinks something such as a library should be named in his honor instead of this road. Mary Garcia of 1012 Robert Derrick asked why this is being done to which Chairman Andrews replied it is a request from City Council. Mrs. Garcia felt the name should be left as is. 1 Wanda Koch of Boswell - Niemietz Realty remarked she has been a resident of Schertz since 1945 and the name of the road should never have been changed in the first place from FM 3009.. Mrs. Koch then explained that she supports the letter that was returned to the City from Boswell - Niemietz Realty. The letter basically disapproves of the proposed name change stating cost to businesses and property owners and confusion to citizens. Chairman Andrews explained that City Council has the authority to change the name, Planning and Zoning is just an intermediary body. Mr. Andrews also suggested that the citizens attend the City Council public hearing which will be held December 15th in the Council Chambers. There was discussion about how the ten days comes in if Council's public hearing is scheduled for the 15th. Steve Simonson noted that the notice in the paper is put in for both Planning and Zoning and City Council at the same time to save time and expense, but the option is always there giving the Commission ten days to make its recommendation. Councilman Ken Greenwald related that City Council will still hold a public hearing, but it is not necessary to make a decision that evening. Oliver Nelson inquired how many letters went to people that own vacant land so therefore could care less about the name change and didn't respond. .Steve Simonson reviewed the seven letters that were returned. Of the four opposed, two were single family dwelling units, one was a business and one was a landowner with nothing on the land. Of the three in favor, two were. landowners with no :buildings on the lot and one was an investment company. David Richmond asked Steve Simonson if he is planning to tell the Commission what the letters say and Mr. Simonson summed up the replies of those opposed as against the cost, against the confusion and the questioning of why the City is doing this. Mr. Richmond then asked how long it has. been Jack Hays Blvd. and Steve Simonson replied since either 1986 or 1987. Bobbie Vonada wondered- who calls it Jack Hays Blvd. She thought it was FM 3009. .David Richmond asked what the Highway.D_epartment is going to call it and was told Jack Hays Blvd /FM :3009. Mr. Richmond then questioned where-it says that on IH -35. Steve . "Simonson answered there was a sign on IH -35 and the access road coming south, but he thinks they took it down when they started -2- construction. They will probably put it back up once construction is finished. #3 ADJOURNMENT OF PUBLIC HEARING Chairman Andrews thanked everyone for their input and adjourned the public hearing at 7 :19 P.M. The Schertz Planning and Zoning Commission convened in a regular session, after the public hearing, in the Municipal Complex conference room. #4 CALL TO ORDER Chairman Andrews called the meeting to order at 7:20 P.M. #5 APPROVAL OF MINUTES: Joint Session November 2-4, 1992 Bobbie Vonada made a motion to approve the minutes for the joint session November 24, 1992. David Richmond seconded the motion and the vote was unanimous in favor. Motion carried. #6 CITIZENS' INPUT OTHER THAN AGENDA ITEMS There was none. #7 CONSIDER AND MAKE RECOMMENDATION: Intent to consider renaming Jack Hays Blvd /FM 3009 to Roy Richard Dr /FM 3009 Bobbie Vonada asked what the cost is to the City and Steve Simonson advised it is $32.00 for every sign and there are approximately 11 signs. This, of course, does not count the manhours. Chairman Andrews asked about the signs on IH -35 - who pays for them. Steve Simonson replied the Highway Department. Oliver Nelson observed it's all taxpayer money. Steve Simonson stated you also have to take into consideration the cost to businesses. As a matter of fact, several people have told him that if it's changed again, they will just use FM 3009 as their address. Oliver Nelson inquired as to who Jack Hays is. Councilman Ken Greenwald replied he is one of the original Texas Rangers. who lived in the local area. Oliver Nelson asked about criteria for a street name change, or can it just be changed to anything at the request of a citizen. Steve :Simonson- pointed out the City does have a policy which outlines steps to follow on how to change the name, but there is no criteria as far as who a street can be named after. -3- Bobbie Vonada remarked that from what people have been telling her, they agree that something should be done to honor Doc Richard for all that he did to help develop Schertz, but they feel that a building, such as the community center or the library, a park, or perhaps a jogging trail should be named after him. Chairman Andrews acknowledged he has been hearing the same thing from people. David Richmond mentioned that recently some sections of I -10 were renamed, but people still call those sections I -10. He's not sure renaming a road is a good vehicle. Mr. Richmond went on to say that since the renaming of FM 3009 to Jack Hays Blvd. is so recent and is historically significant, he feels we need a plaque saying why we call it Jack Hays Blvd. Mr. Richmond also pointed out that it takes time, sometimes years, for people to get accustomed to calling something by a different name. Oliver Nelson expressed his agreement with those comments and suggested it is more appropriate to name a building, i.e., the community center, after Doc Richard. Chairman, Andrews commented he agrees and reminded the Commission when they make their recommendation to City Council they need to be specific about their reasons for that recommendation. There was then discussion about the expense to businesses such as business cards, letterhead, signs and billboards. Bobbie Vonada indicated that, in fairness to Boswell - Niemietz Realty, all this should be taken into consideration. They are probably one of the most productive businesses along Jack Hays Blvd. Oliver Nelson made a motion to recommend to City Council that the section of FM 3009 between IH -35 and FM 78, currently known as Jack Hays Blvd., not be changed to Roy Richard Dr. The reasons cited for this decision are as follows: (1) Due to the recent name change, Jack Hays Blvd. should be allowed to keep its name giving it time to grow and allowing time for people to become accustomed to calling it Jack Hays Blvd. instead of FM 3009; (2) Something else such as a building,.a park, a jogging trail or a residential street should be found to honor Doc Richard and his many contributions to the growth of the City; and (3) The expense to businesses such as letterhead, business cards, signs and billboards, as well as the expense to the City of Schertz, does not warrant the change. -4- Bobbie Vonada seconded the motion.and the vote was unanimous in favor. Motion carried. #8 CONSIDER AND MARE RECOMMENDATION: Development and Growth Plan update.(Review of State and Federal Services, Recreation, Schools and Public Housing) Chairman Andrews informed the Commission Steve Simonson has put together Goals, Objectives and Rationale on these four subjects for their review. We.will be seeking citizen input at the public meeting in January. Steve Simonson noted the public meeting will be held at the first meeting in January which is the 12th. State and Federal Services There was discussion about who goes after these services, grants, etc., about needing a lobbyist (it was decided information is fed in from so many sections, we probably have lobbyists without realizing it), and about the fact the City has liaisons as far as people on different boards /councils of organizations throughout the community. There were no changes to Steve Simonson's write -up. Recreation Current parks, areas designated as parks.that don't really lend themselves as parks,-greenbelts that could be used as parks (which idea does not appeal to residents in some subdivisions), the fact that a floodplain but not a floodway can be used as a park, the fact that sometimes in the past areas were dedicated as a park just so the City had to maintain them, the fact that Planning and Zoning has control over approval of a Master Plan designating park land, and the fact that the ordinance now states when a developer comes in with a Master Plan, he has to dedicate either land or money for a park were all discussed. There were no changes to Steve Simonson's write -up. Schools The need for higher educational facilities in the area, the need for public transportation for college students, the fact that in some cities the school and city get together and use each other's facilities, and the suggestion to invite Randolph to join us in this effort were all discussed. Steve Simonson was asked to include in his write -up something about maintaining contact with the education officer for RAFB :in- a -continuing effort to pursue higher -educational opportunities for our citizens. - -5- Public Housing Among those items discussed were the amount of public housing in Schertz of which people are not aware, the fact that of all the sister cities in the Randolph region, Schertz is the only one, that has a Housing Authority, that public housing should not .be concentrated in one area - it should 'be scattered throughout the City, that even though it's not advertised, the appropriate agencies such as GRASP and RACAP all know public housing is available, and that Planning and Zoning and the Planning Department should have input on public housing. There were no changes to Steve Simonson's write -up. Chairman Andrews asked the Commissioners to look over the plan and decide what subjects they would like to discuss at the public meeting in February and have their suggestions ready at the January 12th meeting. #9 CONSIDER AND TAKE APPROPRIATE ACTION: Cancellation of meeting scheduled for December 22, 1992 Bobbie Vonada made a motion to cancel the Planning and Zoning meeting scheduled for December 22, 1992. Oliver Nelson seconded the motion and the vote was unanimous in favor. Motion carried. #10 GENERAL DISCUSSION David Richmond: (a) Admitted he is a fan of recycling and asked if Schertz still has it and if they're considering adding additional times.. Councilman Ken Greenwald replied yes, they do still have it (there was an item about it in the Newsletter) and Henry Gutierrez will be at the Council workshop, so he will ask him how it's going. Mr. Greenwald also reported that Randolph AFB has started a program and the location is out behind the old youth center. Bobbie Vonada• (a) Asked everyone if they had seen the Christmas lights. Councilman Ken Greenwald advised they still need judges for the contest. Steve Simonson added there have been so-me changes in the contest from last year. die already has the plaques and so far we have - eleven entrants.. (b) Asked if the Water Department is still notifying.-people that their water will be off for a period of time and Steve Simonson said yes. a Councilman Ken Greenwald: (a) Reported City Council had a public hearing last Tuesday on the curfew and most citizens are in favor of it. Council approved the first reading and the second reading will be December 15th. The ordinance will become effective 15 days after it is published in the newspaper. Mr. Greenwald reminded everyone not to think of this as a panacea, but just as a step. Steve Simonson: (a) Related that as of January, he is the new Secretary of the San Antonio Chapter of the APA and he will be contacting the Commissioners about attending meetings. At this time David Richmond remembered he had wanted to ask if Mr. Ghormley of Hallmark - Ghormley had called back to arrange a tour for the Commission of some of that company's developments. Steve Simonson replied he had not heard back from him. Chairman Andrews: (a) Advised everyone that Merwin Willman rarely misses a meeting, but his. wife passed away several weeks ago. and his mother passed away over the weekend. He has gone to upper state New York for her funeral. He does plans to be back for the January 12th.meeting. (b) 'Wished everyone a happy-and safe holiday. (c) Hinted they still need volunteers for judges for the Christmas lighting contest and if anyone's interested, call Norma at City Hall at 658 -4611. #11 ADJOURNMENT Chairman Andrews adjourned the meeting at 8:25 P.M.
