Gilbert and Associates, on Behalf of Wheatstone Development Corporation, for the Rezoning of 86.6 Acres of Land From R-2, R-4; R-5 and NS to R-6 (ZC #108) - Chairman Andrews explained the procedures that would be followed for the public hearing and that Planning and- Zoning has ten-days to make its recommendation to City Council. - Mr. Andrews then asked for Staff input. Steve Simonson reported that 72 letters had been sent to property owners within 300'. One letter was returned as undeliverable, 1 was returned as opposed to the rezoning, and 3 were returned in favor of the rezoning. Mr. Simonson also mentioned there had been a lot of calls. Chairman Andrews .commented on the present zoning of the land saying it-is diversified.. It is currently zoned with a mix of R-2-, R-4, R-5 and NS and the Wheatstone Development Corporation - is asking .for .l.t. all .to be .coned; R-6 which is residential with . a mi-ni;mum~ of 6; d0`0'"-aquare foot'- lots - . Mr. Box said-the average lot will be 60'~x 116', the homes will -range from approximately 1550 square feet to ,2500 square feet, and- the.~price of the homes will rangefrom . $91,000 ~ to - $1.17,000..with the upscale homes being. built..in the.. wooded.. area. - ~N~r.: .Bcix~ ~ related ~:-:they ~wi1.1- Yi~e ~ dedicating. 1:.8 `-acres .'along ~ ~ . ~ Borg.feld ~ road as a pubhi.c~ park and will then create a 2:2 'acre _ - park within the subdivision itself for use by residents only. The two parks will not connect. Wheatstone will also take advantage of the drainage ditch with jogging paths, etc. and you will see walkways at the end of each cul-de-sac. They are looking for some kind of conveyance, possibly a bridge, from one side of the ditch to the other. - - . .:'Mr: Box went on- to say .Kerry Gilbert ~ is tfie Planning ~ Engineer - for the project and the local engineer is Don McCrary. Chairman Andrews asked if any of the citizens present had questions. Rosa Ervin of 1505 Greenwood inquired~if the homes will be 100 brick and Jim Box replied he believes.the one story homes will . be all brick, but the- two..--story .homes will have some .wood exterior similar to those being built in Woodland Oaks.-~ Mrs. Ervin then asked if the Silvertree residents will have an entryway to the park and the pool and .Jim Box responded by reiterating they are dedicating a public park along Borgfeld - Road, -but the new subdivision is its own entity and will not .provide access for Silvertree residents to the private park and pool facilities. Steve Simonson added that the City is trying to obtain a grant - from the Foresters-Service~to help beautify the public park and make it- an educational xeriscape project. - - Roger Behne -of 1221 Idlewood questioned the location of the sidewalk along the bank and weed control maintenance of the drainage channel. Chairman Andrews noted the sidewalk will be on the opposite side of the bank and Steve Simonson stressed the drainage channel will not be allowed to get in the shape it has been in the past. -2- Ray Wofford of 1200 Spicewood commented on the lot size and -.then wondered why they are requesting variances to the setbacks - (front yard .from 25' to 20' and side yard from 15' to 10'). _ , Jim Box:' .replied they. feel a "aarge backyard.:, is much. more . important ` • than a -,large -front yard because'~tMat's" where ~ the cfiildren play and then noted that 10.' between houses is pretty normal iri subdivisions Fay Simmons of 1216 Cyrus McCormick questioned where the expensive homes will be built and Jim Box indicated in the wooded area. . ~ Ms, Simmons .further .stated she had been told. by~ her insurance oompany~ she .had to' have flood. insuran~e~ because `the' area. is. in . ~ . . the f~l.ood zone,. ~ Steve Simonson ~ ts~ld Ms Simmons~.~ to come ~ in and see him ahd~ he would give her' a .copy of the new. flood. plain map, approved by FEMA and officially effective as of September 30, 1992, which takes her area out of the flood zone. Mr. Simonson went on to explain that the drainage ditch was built for the ultimate build out of the area and takes the area up out of the flood zone. A. drawing of the Master Plan for Dove .Meadows had been displayed, and ~Ms:~. Joann Nalley of 1224 Idlewood noted it .appears they are trying to maintain the trees on the other side- of the ditch. Jim Box related they will try to save as many trees as possible and Chairman Andrews pointed out this drawing is not an absolute, it is .a conceptual idea. Ms. Nalley then mentioned that when she moved to Silvertree they were told there was no gas available, yet this drawing is showing a.gas line. Steve Simonson commented that is~a .major .transmission main which runs through the City, but there is' no gas available for the subdivision. Ms. Nalley remarked on the green spot/insert shown on the drawing and asked what it represents. Jim Box answered it is a brick barrier. Roger Behne of 1221 Idlewood asked if the FM 3009 to Silvertree . strip of land is part of this plan and was informed by Steve Simonson it is not. That strip is zoned for business. - .There was some discussion on the number of homes with Chairman Andrews saying they are planning to build 309. Jim Box .noted -there will.-two access points - one off FM 3009 and one off Borgfeld Road. Sharon Jost of 1200 Cedarwood asked if sidewalks are in place and Jim Box replied they will be. Ms. Jost expressed concern about the increase in traffic and mentioned that young people hang around the area behind the -3- drainage ditch. Patsy Woodward of 1513 Greenwood inquired if there are several types of homes, said it seems like a lot of homes in a small area .and wondered if the streets are narrower than normal. .7im.•. Box.: .r.eplied to .the question about the types.•of homes ''and,: . ~ . indicated there 'are 5 models and various elevations.. Chairman Andrews addressed the street question assuring Ms. Woodward that the, streets have to meet all City standards including widths for use by emergency vehicles. Steve Simonson acknowledged there will be a 30' paved surface . which :is the same as other streets in the City. Ms. Joann Nalley of 1224 Idlewood questioned when the expected completion time for Dove Meadows will be and Jim Box answered as soon as. possible, however, in all probability 2-3 years. _ Gerald Fruge of 1512 Greenwood commented he can't tell where Schertz stops and Cibolo begins. Steve Simonson .related Dietz Road is the separation line - CCMA is in Schertz, but. the road itself is in Cibolo. Roger; Behne of 1221 Idlewood asked why the lots are 60'. David Richmond wondered if the Commission had discussed the size of the Silvertree lots in comparison .to the size of .,the., ~ lots : ~ for Dove Meadows . end. "was' told the .lots. ~in Slbertree run anywhere from 5,000 square feet up to .8,400 square feet. Merwin Willman made a motion to recommend approval to City Council of the request from Kerry R. Gilbert and Associates, on behalf of Wheatstone Development Corporation, for the. rezoning of 86.6 acres of land from R-2, R-4, R-5 and NS to R-6. .George Vick seconded the motion and=the vote was unanimous in favor. Motion carried. #8 CONSIDER AND MARE RECOMMENDATION: Request from Rick and Rita Saenz, 501 Aviation, for a 3' Special - Exception to the Side Yard Setback Require- - ments -of the Zoning Ordinance Allowing Them to Face a New House, on an Angle, Toward the hntersection of Aviation and Lindbergh -Rick and Rita Saenz were at the meeting to -represent this - request. Chairman Andrews asked for Staff input. Steve Simonson admitted this is one of the most confusing things he has ever seen. The area was originally platted in 1928 and then replatted in 1959. Mr. and Mrs. Saenz own lots 39 and 40 and lots 56 and 57. The gas company's equipment is on the back area of lots 39 and 40 and there is an alley between lots 39 and 40. Mr. Simonson said as far as he knows, -5- ~ Y the City doesn't use the alley. Technically, you can't build a driveway on an~ alley, so the City and Mr. and Mrs. Saenz would have to work out some kind. of agreement. However, the ` _ `Commission .can: only deal with.. the side. yard .setback .ret~uest. . 'Mr: ~ E.~H..; Nordmeyer, Mr.: and:Mrs. :.Saenz's" neighbor, spoke up~~' . ...at~ this ~~:time saying there is a -.sewer line that runs through the ;,alley. ~ ~ . ~ ~ - Steve Simonson said he was riot aware of that but woulci~have the Public Works Aepartment check it out. Chairman Andrews mentioned the fact of the new house being on an angle and Rick Saenz stated that,is.._to make. the house, look~~ nicer. ~ ~ ~ ~ ~ ~ . . George: ~ Vick. reiminded Rick Saenz he had been granted ~a var~ian~e ~ two years ago to build a new house at this same location. Mr. Saenz commented he wishes to ignore the previous plan for which the variance was granted. At that time the interest rates were up and he was called to the Persian Gulf war, so things didn't work out. Merwin Willman expressed concern about. the way the .new. ~house~ .is being placed on .the lot.. Mr..Saenz old him. the house ` looks~~ more beautiful that way because of the trees.. Rita Saenz asked if the Commission had spoken to any of the neighbors. Chairman Andrews informed her the process starts with the Commission before it gets to that stage. If the .request goes to a Board of Adjustment hearing, then the neighbors within so many feet will be notified. ~~~E.H:~ Nordmeyer, saying he is the neighbor adjacent to the Saenz property, stated he has. no objection to their plans. It meets with his approval. Chairman Andrews asked Mr. Nordmeyer how close he is to the Saenz property and Mr. Nordmeyer replied it is approximately 11 1/2 from his house to their lot. - ~George Vick questioned what the gas company says and Rita Saenz related they had checked with them to make sure of the safety - and they have no problem with. the. building of the house. =Tony Moreno asked Rick Saenz if he has a builder and Mr. Saenz - replied it is a Rayco. Mr: Moreno then wanted to know if there is a way Rayco could build the house in compliance with the existing setbacks. Motion carried. #9 _ CONSIDER AND MAKE RECOMMENDATION: Request From Lonnie Nielson, 1012 Andrew Low, for a 4' Special Exception to the Rear Yard Setback Require- - ments of the Zoning Ordinance Allowing Him to Build-a Patio Cover. (BOA-#47) - Lonnie_Nielson was at the meeting to represent this request. - Chairman Andrews noted this request will also need to go to the Board of Adjustment and then asked for Staff input. Steve Simonson commented this does not effect the easement, but because it will become attached to the building, it has to come before the Commission. Steve Simonson informed the Commission this. is a single lot .outside Units 1, 2 and.3 that was never platted. The utilities are there and some minor things are needed•on the plat, but .the biggest problem is what to call the subdivision. Mr. Simonson suggested Richardson Subdivision so it can be identified separately .from Oak Forest and prevent confusion. Fred Niemietz corrected Steve Simonson saying it will be two lots split on the Crest Oak side-. Mr. Simonson said that was his misunderstanding, he understood it was only one lot. There was a brief discussion about the corrections needed on _ the:plat and Chairman Andrews advised David Lambert to get with- _ Steve. Simonson for a copy of the Subdivision Ordinance. Steve Simonson had: received a memo from. City Manager, Kerry Sweatt, with the following comments, suggestions and recommendations as discussed by City Council: "1. preparation•of a' brief executive summary so this might be provided to those persons inquiring of the City's Comprehensive Plan but unable to spend the time for detailed individual review; 2. consider including -long-range plan for each department in the report; 3. review the documents for wording .correction such as use of acronyms-- insure versus ensure, no as not possessive, etc.; 4. attached is a copy of the Comprehensive Plan with pencil notation of various terminology, spelling, punctuation and other general construction items; - 5. should we describe the: Sout=hern Pacific Railroad as _separating and dividing the City (described on page 5)' in such a negative manner.?; _ 6. page six (6) - statement in item A-3 - should we .soften this wording to lessen impact that educational opportunities are too far to allow .many to take advantage of the opportunities? It seems .as if the developer. bypassed ~~the Commission when the Subdivision Ordinance definitely states the list. of names should come to us .•first. (b) Remarked the Commission should be getting information on the APA conference to be held in October: (c) Asked .the status of the .renaming of Live Oak Blvd. Steve Simonson replied that Selma and Cibolo have tentatively agreed - to the name change. George Vick• Noted he had read in the paper the City is considering annexing .property at FM 1518 and IH-35 and wondered, jokingly, why we're annexing Selma. - _ Merwin Wi-llman advised that the property being considered for annexation is along.-the.-Cibolo Creek behind the Lone Oak - Subdivision. - ,Councilman.-Ken Greenwald:. ,(a) Acknowledged City Council had a discussion with Pia Jarman and her husband about people running. along Cibolo Creek shooting back toward Schertz. The only way the City can physically control it is to annex it.
