04-26-1994 PLANNING AND ZONING MINUTES
`The Schertz Planning and Zoning Commission convened in Regular
Session on Tuesday, April 26, 1994 at 7:00 p.m. in the
Municipal Complex Conference Room, 1400 Schertz Parkway,
Schertz, Texas. Those present were as follows:

#1 CALL TO ORDER
Chairman Andrews called the meeting to order at 7:03 P.M.
#2 APPROVAL OF MINUTES: Regular Session April 12, 1994
Merwin Willman made a motion to approve the minutes for the
Regular Session April 12, 1994. Pia Jarman seconded the motion
wand the vote was unanimous in favor. Motion carried.
#3 CITIZENS' INPUT OTHER THAN AGENDA ITEMS
Bill Hamm of 1512 Oak Tree Circle requested information on the
Homeowners Association in Greenshire. Chairman Andrews told
Mr. .Hamm the Commission has nothing to do with the creation of.
or the management of the Homeowners Association and then asked
Mr. Hamm how it will effect him.
Mr. -Hamm indicated he needs to talk, with the .developer before
Greenshire Unit 2 is built and make his feelings known.
Chairman- Andrews advised Mr. Hamm the .developers write their
own deed restrictions and the City :does not enforce deed
restrictions - that is a civil matter.-

Pia Jarman mentioned there may be some confusion resulting from
discussion at the March 22nd meeting regarding Greenshire. It
was stated the current residents of Greenshire Oaks may have to
join the Homeowners Association. This "have to" was meant, not
as a mandatory have to, but as a means to work with the new
residents of Greenshire to maintain the integrity of the
subdivision.
Chairman Andrews apologized for any confusion that may have
been caused. Mr. Andrews then commented that, regarding
covenants, a Homeowners Association can place a greater
restriction on an area than is required by the Subdivision
Ordinance, but they cannot place a lesser restriction than what
is required by the Subdivision Ordinance. They must maintain
and adhere to the Subdivision Ordinance.
Steve Simonson told Mr. Hamm he would give him the name and
address of the developer when the meeting was over.
#4 CONSIDER AND TARE APPROPRIATE ACTION: Request from MBC
Engineers, On Behalf of Anchor International
Inc., for Preliminary Plat Approval of
Greenshire Subdivision Unit 2 (PC #209-94) i
Sam Bledsoe was at the meeting to represent this request.
Chairman Andrews noted that, with the exception of one lot,
they have made every change we requested. They will. be
building on 80' x 120' lots in just about all cases.
There was some concern expressed about the size of Lot 1 on the
corner, so Steve Simonson explained that Lot 1 is 60' plus a
15' tangent on the curve and it is 93' in the back. Taking the
tangent and everything into consideration, Lot 1 is 75.75' in
front. Mr. Simonson added there is a similar situation on
Lot 4.
Mr. Andrews then asked for Staff input.
Steve Simonson informed the Commission there are several
housekeeping items that need to be taken care of on the plat:
(a) there is no floodplain:statement;
(b) there is no homeowners association statement;
(c) they sio not show the park/greenbelt/greenway;
(d) the Guadalupe County Commissioners statement needs to be
deleted; and,
(e) they need to show a 1' non-access easement on Lot 14;

Pia Jarman mentioned that in Unit 2 it says Block 3. Shouldn't
it be Block 1?
There was some discussion on this with the Commission deciding
it should be changed to Block 1.
Mrs. Jarman then brought up the fact that in the Master Plan
they stated the houses on Greenshire Drive would be a minimum
of 2,000 square feet.
Merwin Willman pointed out the Commission has nothing to do
with the size house they build and Chairman Andrews added that
would be in the deed restrictions.
Merwin Willman asked if the utilities shouldn't be shown in the
.front and Steve Simonson replied yes they should.
Merwin Willman made a motion to approve the request from MBC
. Engineers, on behalf of Anchor International Inc., for
preliminary plat approval of Greenshire Subdivision Unit 2
contingent on the following:
(a) adding the floodplain statement;

(b) deleting Guadalupe County Commissioners statement;
(c) showing front yard utility easements;
(d) showing 1' non-access easement on Lot 14; and,
(e) correcting block number.
Tony Moreno seconded the motion and the vote was unanimous in
favor. Motion carried.
#5 CONSIDER AND TARE APPROPRIATE ACTION: Request from MBC
Engineers, on Behalf of Anchor International
Inc., for Preliminary Plat Approval of
Greenshire Subdivision Unit 3 (PC #210-94)
Chairman Andrews asked for Staff input.
Steve Simonson acknowledged that basically the same items are.
missing from this plat as were missing from the previous plat:
(a) there is no floodplain statement;
- (b} there is no homeowners association statement;
(c) they do not show the park/greenbelt/greenway; -
(d) the utility easements are not shown;

(e) the Guadalupe County Commissioners statement needs to bed
deleted; and,
(f) they need to show a 1' non-access easement along Woodland
Oaks Drive and several other lots.
There was further discussion on which lots should have the 1'
non-access easement. Merwin Willman felt there should be a 1'
non-access easement on Lots 1,6, 7 and 12 of Block 4; on Lots
1,17, 28-35, 36-41 and 50 of Block 5; and, Lots 1 and 16 of
Block 6.
Steve Simonson wondered if we want the 1' non-access easement
on some of the interior lots.
It was decided to require the 1' non-access easement on all
lots along Woodland Oaks Drive and Lots 35 and 36 of Block 5 at
the entrance.
Chairman Andrews related that between now end the final plat he
would like to see the developer look real hard at the size of
some of the corner lots - 36, 16, 50 and 39 in particular. If
they have a 10' setback on one side and then a 10' setback on
the other side, then on down the road they may come in and say
they can't fit a house on one of those lots because it's too
narrow and at that point, the Commission would have to say
"sorry."
George Vick wanted to know who's going to enforce what we
approve on these plats and was told. by .Steve Simonson the
Inspection Department will enforce it when they come in with
their building plans.
Mr. Willman also remarked that the street names are not shown.
After being questioned by Steve Simonson about that, Sam
i8ledsoe indicated they are working on it. -
Pia Jarman questioned the different sizes of lots. For
..example, in Unit 3 there are big lots (9600 square feet) which
fall under R-1, but then there are other lots of 7200 square
feet which are less than that required in R-2.
Steve Simonson explained the Greenshire area is zoned as a ~PUD
which is a mixture of several types of zonings.
Merwin Willman made a motion to approve: the request from ,MBC
Engineers, on behalf of_ Anchor International Inc., _f or
preliminary plat approval of Greenshire Subdivision Unit 3
contingent on the following:
- (a) adding the floodplain statement;
(b) deleting Guadalupe County Commissioners statement;

(c) showing front yard utility easements;
(d) showing 1' non-access easement on all lots along Woodland
Oaks Drive and Lots 35 and 36 of Block 5;
(e) correcting block numbers; and,
(f) showing authorized street names.
George Vick seconded the motion and the vote was as follows:
AYE5: B. Andrews, G. Vick, M. Willman, T. Moreno
NAYS: P. Jarman
ABSTENTIONS: None
Motion carried.
Steve Simonson reminded Sam Bledsoe two questions still need to
be addressed - the parkland donation and/or cash contribution
and the issue of the homeowners association.
Merwin Willman advised, also, that the area along FM 3009 will
have to be rezoned before they can build any homes there.
#6 GENERAL DISCUSSION
Pia Jarman:
Asked why David Elder and Lavon Major, who were on the agenda
of the Commission's last meeting, withdrew their request for a
Specific Use Permit.
Steve Simonson replied that as was discussed at the last
meeting, the Schertz Development Foundation's covenants would
not have permitted them to have a residence on their property
in the Schertz Business Park. They still want to locate their
business in Schertz and are trying to find another location.
Steve Simonson:
Reported that since the storm, the City has issued over 100
roofing permits and 14+ citations to roofers from out of town
and out of State who did not obtain permits.
George Vick remarked he has had several. calls from roofers out
of town.
Chairman Andrews. commented he had a roofer compiain to him
- about having to get a permit until he explained to him it was
for the protection of the-citizens against shoddy work.
Mr. Simonson declared overtime has been authorized for
weekends to try and catch these roofers without permits.

Chairman Andrews:
Expressed his pleasure at the turnout of citizens at the
meeting and noted that from the City's side, a lot of things
these citizens are looking for, the Commission can do nothing
about - their hands are tied. The Commission must abide by the
ordinances. Mr. Andrews stressed, though, that citizen
activity, as displayed here, carried forward to the developer,
to the builder and to the buyer will ensure they get what they
want. The City and the citizens are both looking ,for good
development.
Mr. Andrews took a few questions from the citizens at this
time.
Betsy Pond of 3013 Bent Tree asked if she could read a letter
she had written which contains the thoughts of the residents of
Greenshire Oaks about new development in the Greenshire
subdivision. (Copies had been provided to the Commission.)
Chairman Andrews invited Mrs. Pond to come to the next meeting
and do that because the Commission would like to have time
first to read over the letter.

Don Buehl of 3001 Greenshire Drive brought up the limited
access to Greenshire and the extensive traffic these new homes
will create.
Chairman Andrews informed Mr. Buehl the City has a Master Plan
for streets and they try to look 20 years down the road.
Mr. Buehl then mentioned he knows that the Commission wants to
protect the integrity and quality of the City and they have
done a pretty good job with getting parks and green areas, but
if there's no incentive to plant trees, shrubs, etc., then it's
not going to be done. Mr. Buehl suggested having an
"extending of the green" policy.
Chairman Andrews thought that was a good idea and promised the
Commission will talk about it.
George Vick commented that if you read the papers you may have
noticed that when people were going out to Arizona for health
reasons, they were being required to have lawns. The greenery'
has caused the almost 0~ humid-ity to rise considerably.
Don Buehl briefly mentioned xeriscape type lawns..
Mario- Bruno of 3009 Greenshire Drive observed he does not see
any access on these plats to Green Valley Road.

Chairman Andrews indicated that portion has not been °platted
yet and assured Mr. Bruno the City requires two means of
access to every subdivision.
ADJOURNMENT
Chairman Andrews adjourned the meeting at 7:50 p.m.
There is a public hearing scheduled for the next meeting on May
10, 1994.
