The Schertz Planning and Zoning Commission convened on January 10,2006 at 6:30 p.m. at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building #1, Schertz, Texas.

1. Call to Order/Roll Call
~ Mr. Richmond called the meeting to order at 6:30 P.M.
2. Citizen Comments
There was no one present to address the Commission.
3. Consent Agenda
A. Consider and act upon approval of the October 25, 2005 Planning and Zoning Commission
meeting minutes.
B. PC2005-083
Consider and act upon a request for preliminary plat for Belmont Park Subdivision Unit 9.
The 10.45-acre tract contains 59 single-family lots. The property is zoned Residential-5 District
(R-5).
Applicant: Continental Homes of Texas, L.P.
C. PC2005-084
Consider and act upon a request for a site plan of an 11,600 square foot office/warehouse
located in the Schertz Industrial Park, Block 2, Lot 11. The property is zoned Manufacturing
District- Light (M-1).

Mr. Wallace moved to approve the items item on the consent agenda. Ms. Tutschke seconded the
motion. Vote unanimous. Motion carried.

4. Public Hearing
A. SUP2005-004
Hold a public hearing and consider and act upon a request for a Specific Use Permit for Laura
Heights Subdivision. The 131.809::1: acre tract contains 159 single-family lots located at the
intersection of Ware Seguin Road and Boenig Lane. The property is zoned Residential-
Agriculture (RIA).
Applicant: H.L.H Development, L.P.
Ms. Nichols reviewed staff comments, attached herewith and made part of these minutes, which include a
recommendation of approval.
There were twelve letters mailed, with no responses. The City Council will hold a public hearing on
February 7, 2006.
Mr. Harlohs stated that he is against the proposed development because it is in the approach path of
Randolph Air Force Base. He mentioned that when he moved here the City stated that there would never
be any high-density developments in the southern portion of the City that is affected by the flight path of
Randolph Air Force Base.
Ms. Handley stated that she has concerns with the impact this development will have on the roads, Boenig
Lane is not a paved road and Ware-Seguin Road is already in need of repair. She asked and asked how this
development will affect the drainage.

Mr. Briones responded to the concerns of the property owners and explained that he has contacted the
FAA and Randolph, and ensured that the builder will comply with the added requirements for buildings
within the Air Installation Compatible Use Zone. He also stated that drainage would not affect Ms.
Handley since this site will drain into the floodplain located in the southern portion of the property.
Public Hearing Closed at 6:45 p.m.
Mr. Wallace asked how would the road issue be addressed.
Mr. Briones stated Boenig Lane would not be improved. Ms. McBeth mentioned that the Master
Thoroughfare Plan indicated that Boenig Lane will be vacated, and Ware-Seguin will be re-directed and
constructed as an 80-foot right-of-way.
Mr. Wallace then asked if the 80-foot right-of-way improvement is planned to extend to FM 1518.
Ms. McBeth stated yes it would.
With no further discussion, Mr. Wallace moved to recommend approval to the City Council. Mr. Grant
seconded the motion. Vote Aye: Mr. Richmond, Mr. Grant, and Mr. Wallace. Vote Nay: Mr. Van Dine,
Mr. Sommers, and Ms. Tutschke. Tie Vote.

Hold a public hearing and consider and act upon a request to rezone 45.973::1: acres from
Residential! Agricultural District (R-A) to Residential District-7 (R-7). The tract is situated
out of the Rafael Garza Survey, Abstract No. 138 and Abstract No. 175 in Guadalupe and
Comal Counties, Schertz, Texas. The property is generally located between IH 35 and Old
Wiederstein Road, east of the Belmont Park Subdivision.
Applicant: Congregation of Holy Ghost Western Province, Inc.

Ms. Ellis reviewed staff comments, attached herewith and made part of these minutes, which include a
recommendation of approval.
There were four letters mailed, with no responses. The City Council will hold a public hearing on
February 7, 2006.
Mr. Arrington read a typed statement indicating his concerns and interpretation of the location of the right-
of-way for Old Wiederstein Road. is located. He also mentioned that as a property owner within 200-feet
of the requested zoning he was not notified of the zoning request.
Mr. Schaezler stated that the load limit on Old Wiederstein Road is not being enforced, large truck traffic
continues. He would like to see some enforcement. He added that the proposed development would create
additional traffic issues as well as drainage issues, adding to the problems that already exist.
Mr. Wilson stated that the concerns of the citizens do not affect the zoning of this property. These items
will be addressed at master plan and platting. He stated that an engineer's seal ensures that there will be
no additional water shed onto other property. This development includes a collector street that will
alleviate added congestion on Old Wiederstein Road.

Mr. Wallace asked if the City requirements are higher than the County on road construction. He also
asked ifthere would be any interconnectivity with Belmont Park.
Ms. McBeth stated that yes the City standards are much greater that the County. She also stated that there
are two means of interconnectivity with Belmont Park. One will be near the 100-foot power easement and
the other is the planned thoroughfare that parallels IH 35.
With no further discussion, Mr. Wallace moved to recommend approval to the City Council. Mr. Van
Dine seconded the motion. Vote Aye: Mr. Richmond and Mr. Wallace. Vote Nay: Mr. Van Dine, Mr.
Sommers, Mr. Grant, and Ms. Tutschke. Motion failed.

B. Director's Report
Ms. McBeth: Stated that she sent an email to Commissioners regarding last weeks City Council Meeting
and the notification process of the Planning Department. ---..J
The Specific Use Permit request for Mr. Zuniga was approved at City Council last week.
Mr. White donated $1,000,000 to the city for the new library.
C. Planning Commissioner Comments
(1) Hold a discussion and prepare a list of Planning and Zoning Commission priorities
for 2006 for the purpose of the City Council's Strategic Plan.
Mr. Richmond stated that he asked for this item to be placed on the agenda to create a list of items for
the joint meeting of the Planning and Zoning Commission and City Council.
The list of priorities:
1. Update City Zoning Map
2. Zone General Business (GB) buffer along IH 35 and FM 3009 currently zoned Light
Manufacturing (M -1)
3. Prepare for rapid rail with proposed station in Schertz.
4. Revise Sign Ordinance.
5. Develop plan for area between IH 10 and FM 78.
6. Develop more parks for children and less park fees.
7. Construct sidewalks on FM 3009, Live Oak Road and Green Valley Road.
8. Develop new Town Center concept. .
9. Revise Tree Ordinance to be more restrictive; use Alamo Heights example.
10. Improve roads such as Ware-Seguin Road and Pfeil Road.
11. Add time frame on developers for projects.

General Discussion:
Mr. Richmond: Asked for an update on the Green Valley School recycle dumpster and fence issue. He
also asked if the Planning Department has been contacted for a new development for 25,000-square feet
of retail proposed for the Austofeld property located at FM 3009 and Elbel Road; there is a sign
advertising the future development for the summer of2006.
Ms. McBeth stated that the fence will be replaced and the dumpster will be screened, they are under
design review by the school. The wrought iron fence has rusted and cannot be re-installed.
Ms. McBeth stated that the Planning Department has not received any information on a proposed
development in this area. She will research and respond to the Commission at next meeting.
