The Schertz Planning and Zoning Commission convened on July 28, 20 I 0 at 6:30 p.m. at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

Mr. Richmond called the meeting to order at 6:30 P.M.

Mr. Richmond seated Amy McBrearty as voting members in the absence of Commissioner Sommers.

HEARING OF RESIDENTS
Robert Brockman complimented Ms. Sanchez on her presentation at City Council and City Council
discussions and actions.
4.
CONSENT AGENDA:
A.
Consider and act upon the minutes for the regular meeting of June 23, 20 I O.
After the reading of the Consent Agenda, Mr. Greenwald moved to approve the item. Ms. Tutschke
seconded the motion. Vote unanimous. Motion carried.
5.
PUBLIC HEARING:
A.
ZC2010-003 Crescent Bend Park and CCMA Property
Conduct a public hearing, consider and take possible action to rezone approximately 3 10.04::1:: acres of
land west of the Lost Meadows Subdivision known as Cibolo Creek Municipal Authority, being part
of the G. Malpez Survey No. 67, Abstract No. 464, Bexar County Block No. 5054, the A.S. Lewis
Survey No. 78, Abstract No. 130 I, Bexar County Block No. 5472 and the William Bracken Survey
No. 65, Abstract No. 48, Bexar County Block No. 5055, situated in Bexar County, Schertz, Texas
from Pre-Development District (PRE) to Public Use District (PUB) and; approximately 187.99::1:: acres
of land known as Crescent Bend Park located north of Schaefer Road and east of the Lost Meadows
Subdivision situated in the A.S. Lewis Survey No. 78 and the Williams Bracken Survey No. 65 In
Bexar County, Schertz, Texas from Pre-Development District (PRE) to Public Use District (PUB).

Chairman Richmond opened the public hearing at 6:33 p.m.
Ms. Sanchez reviewed staff comments and advised the Commission that Crescent Bend Nature Park property
was a manufactured home subdivision several years ago. After the 1998 flood, Bexar County purchased
several of the flooded properties from the residents that lost their homes in the flood and developed and
nature park.
The Crescent Bend Nature Park was annexed in two parts, on January 12,2010 (Formerly Crescent Bend
Subdivision) and on May 18,2010 two adjoining lots of the Lost Meadows Subdivision were annexed. She
presented the public hearing information related to the publish date, notices mailed and responses received.
Staff offered approval of the proposed rezoning and that a favorable recommendation be forwarded to the
City Council.
Mr. Richmond recognized the following:
. Steve Layton, 12231 Lost Meadows - located in ETJ, stated concerns about referenced acreage and
with regard to private residents living on Voges Pass shown within the proposed rezoning district.
. Robert Brockman questioned houses located in the proposed district.
. Ruben Call on, 241 Bethany Way, questioned the notification process.
. Ms. Sanchez responded with a clarification to all questions.
The public hearing closed at 6:52 pm
A short discussion followed between the Commission, Staff and Applicant on the annexation map exhibit,
Mr. Greenwald moved to forward a recommendation of approval to the City Council. Ms. Tutschke seconded
the motion. Vote unanimous. Motion carried.
B. ZC2010-004 Former Schertz Animal Shelter
Conduct a public hearing, consider and take possible action to rezone approximately 0.563 acres of
land west of FM 1518 and east of the Cibolo Creek known as the former location of the Schertz
Animal Shelter being a part of the G. Malpaz Survey No. 67, Abstract No. 221 Guadalupe County,
Schertz, Texas from Pre-Development District (PRE) to Public Use District (PUB).
Chairman Richmond opened the public hearing at 6:58 p.m.
Ms. Sanchez reviewed staff comments and advised the Commission that the property was annexed on
September 8, 2009 and is currently a fenced in storage area for the parks department. She stated the public
hearing information related to the publish date, notices mailed and responses received. Staff offered approval
of the proposed rezoning and that a favorable recommendation be forwarded to the City Council.
There being no one to speak the public hearing closed at 7:01pm
Mr. Greenwald moved to forward a recommendation of approval to the City Council. Ms. Tutschke seconded
the motion. Vote unanimous. Motion carried.
6.
ITEMS FOR INDIVIDUAL CONSIDERATION:
A.
PC2010-024 Laura Heights-Amended Master Plan
Consider and act upon a request for an amended master plan of the Laura Heights Subdivision, a
131.809::1:: acre tract of land in the Stacy B. Lewis Survey No.3 I 7 and the Antonio Zamora Survey No.
36, City of Schertz, Bexar County, Texas and is generally located near the intersection of Ware Seguin
Road and Boenig Road. The property. is zoned Residential Agricultural (RA).

Ms. Sanchez reviewed staff comments and advised the Commission that this subdivision is developed with
primarily Y2 acre lots and the purpose for this request is to create additional stub out streets to the adjacent
property. In addition, they are reducing the lot count by 2 lots because they are widening the lots to
accommodate for the larger homes and to account for the required 25' side yard setbacks. Staff offered a
recommendation of approval.
After a short discussion between Commission, staff and applicant about the number of homes on the ground,
Mr. Greenwald moved to approve the item. Mr. Glombik seconded the motion. Vote unanimous. Motion
carried.
7.
DISCUSSION ONLY:
A.
Discussion on frontage setbacks. (J. Murray)
The Commission and staff had a short discussion on the UDC related to front yard setbacks within the City
and enforcement of the UDC dimensional requirements.
8.
REQUESTS AND ANNOUNCEMENTS
A.
Requests by Commissioners to place items on a future Planning and Zoning Agenda.
Discussion on the tree preservation and mitigation ordinance was requested to be placed on the first available
meeting after September 6, 2010. (D. Richmond)
B. Requests by Commissioners to Staff for information.

C. Announcements by Commissioners

· Mr. Richmond summarized the City Council meeting attend on July 27, 2010.
· Mr. Greenwald expressed concerns with a moratorium proposed on lots sizes and the effect it will
have on growth within the City. It was a major factor in the low growth rate in Schertz in the 80's.
D. Announcements by City Staff

· NEW SITE PLAN APPLICATIONS: No site plan applications were submitted to
the Planning and Zoning Division between June 28, 20 10 and July 19, 20 I O.
Ms. Sanchez gave a brief update on the following:
. Reported July 27,2010 City Council information.
. August 25, 2010 meeting has been cancelled.
