The Schertz Planning and Zoning Commission convened on September 8, 2010 at 6:30 p.m. at the Municipal
Complex, Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

Mr. Richmond called the meeting to order at 6:30 P.M.

Mr. Richmond seated Amy McBrearty and Jake Jacobs as voting members in the absence of Commissioner
Sommers and Commissioner Murray.

Consider and act upon the minutes for the regular meeting of August 25,2010.
After the reading of the Consent Agenda, Mr. Jacobs moved to approve the item. Mr. Greenwald seconded
the motion. Vote unanimous. Motion carried.
5.
PUBLIC HEARING:
A.
ZC2010-006 UDC Revision-R6 & R7 Zoning
Hold a public hearing, consider and act upon a request to amend the Unified Development Code
(UDC) to suspend additional properties with Single Family Residential Distrlct-6 (R-6) and Single
Family Residential District-7 (R-7) zoning classifications within the City of Schertz.

Chairman Richmond opened the public hearing at 6:35 p.m.
Ms. Sanchez reviewed staff comments and advised the Commission that the City Council recently held
discussions and reviewed the City's existing residential zoning policies and anticipates overall modifications
to the zoning provisions in the UDC. Council determined that limitations be placed on certain zoning
categories to include Single Family Residential District - 6 (R6) and Single Family Residential District-7
(R7) zoning classifications. Legal notice of the City Council public hearing was published in the Daily
Commercial Recorder and the Herald News on September 2, 20 I 0 as required by the UDC. The changes will
be effective as of August 17, 20 I O.
There being no one else to speak the public hearing was closed at 6:38 pm
Mr. Evans expressed concerns with the order of the proceedings.
Mr. Greenwald commented that the Single Family Residential- Rl and R2 are less developed than what is on
the ground today.
Mr. Richmond moved to forward a recommendation of approval to City Council. Mr. Jacobs seconded the
motion. Vote was 5/2 with Commissioners Evans and Greenwald voting nay. Motion carried
B. ZC2010-005 Master Thoroughfare Plan
Hold a public hearing, consider and act upon a request to amend the Master Thoroughfare Plan Figure
5.2 of the Comprehensive Land Plan.
Chairman Richmond opened the public hearing at 6:54 p.m.
Ms. Sanchez reviewed staff comments and advised the Commission that the last Master Thoroughfare Plan
(MTP) was approved April 2006. City Staff has determined that there are numerous areas of the MTP that
require immediate attention and we also are proposing several general housekeeping changes, corrections and
to identify and remove areas that are complete.
. The following areas are complete and proposed to be removed: proposed 60' collector adjacent to the
existing Mid-Cities Parkway, extension of the east/west 60' collector for Lookout Road from the
intersection of Evans, the road east to the intersection ofTri-County Parkway, the abandoned the
north/south 60'collector of Lookout Road, the proposed north/south 60' collector of Enterprise
Avenue, proposed north/south 60' collector of Belmont Parkway, extension of north/south 60'
collector of Westchester from the intersection at Elbel Road south, expansion of east/west 60'
collector of Borgfeld Road from the intersection at FM 3009 east to the city limits, abandoned a
portion of Maske Loop in the Mesa Oaks subdivision only, and the extension of north/south 86'
secondary arterial of Schwab Road from IH 35 north to FM 482.
. The following are corrections and clarifications to the MTP: extension ofa north/south 60'collector at
Mid- Cities Parkway, change the east/west 120' principal arterial at FM 482 from proposed to
expansion, change the north/south 86' secondary arterial at Eckhardt Road to a 60' collector. This is a
street less than two miles long and intersects with IH 35 to the north and Green Valley Road to the
south. An 86' secondary arterial is impractical for a street that is less than 2 miles in length, change
the east/west 120' principal arterial at FM 2252/01d Nacogdoches Road from proposed to expansion,
and remove proposed east/west 60' collector as a connector between The Ridge at Scenic Hills east to
city limits.
. The following are proposed additions to the MTP: change the expansion of the north/south 60'
collector of Hubertus Road to an expansion of 120' principal arterial to reflect the same right-of-way
as FM 1103, extension ofa 120' north/south principal arterial of Hubertus Road from the intersection
at FM 482 north to fOld Nacogdoches Road, propose an expansion/extension of a 60' collector for
Froboese Lane/Schmucks Road from Schwab Road east to the end of the City's Extra Territorial
Jurisdiction (ETJ).

After a short discussion on Eckhardt Road, Mr. Greenwald moved to forward a recommendation of approval
to City Council. Ms. Tutschke seconded the motion. Vote unanimous. Motion carried.

C. ZC2010-007 UDC Revision-Impervious Cover
Hold a public hearing, consider and act upon a request to amend the Unified Development Code
(UDC), Section 21.5.7 Dimensional and Developmental Standards, Table 21.5.7.A (k) Swimming
Pools and Maximum Impervious Cover Limitations within residential districts.
Chairman Richmond opened the public hearing at 7:11 p.m.
Ms. Sanchez reviewed staff comments and advised the Commission that the City Council recently held
discussions and reviewed the Unified Development Code regarding existing residential dimensional
requirements as they pertain to swimming pools and maximum impervious coverage restrictions.
It is City Council's desire to continue to limit maximum impervious coverage within the City in an effort to
control and regulate storm water run-off, however, Council's proposal is to exempt from the impervious cover
calculation the water surface area of a swimming pool, for in-ground and above ground pools in residential
districts R-l, R-2, R-3, R-6, R-7, R-A and GH zoning classifications. All remaining residential zoning
districts and non-residential (commercial/manufacturing) zoning districts will continue to be restricted as
currently written.
There being no one to speak the public hearing closed at 7:28 pm
Mr. Evans commented that exempting the water surface area does not allow for absorption of water into the
ground; this request makes no sense.
Mr. Glombik commented that it appears we have competing objectives; one is to restrict maximizing lot area
with homes, yet making an allowance to maximize the rear yard area for a pool.
Mr. Richmond commented that the City has taken significant steps to ensure proper drainage in the city; this
is counter productive; leave restriction on pools as is.
Ms. Tutschke commented that she agrees with commissioners.
Ms. McBrearty commented that she was concerned about overflow of pools and drainage impact to
neighboring property.
Mr. Jacobs commented that he agreed with the commission comments and that the UDC needs to have a
definition for impervious cover.
Mr. Greenwald moved to forward a recommendation of disapproval to the City Council. Ms. McBrearty
seconded the motion. Vote unanimous. Motion carried.
6.
ITEMS FOR INDIVIDUAL CONSIDERATION:
A.
PC2010-030 Laura Heights Estates, Unit 4 - Preliminary Plat
Consider and act upon a request for approval of a preliminary plat for Laura Heights Estates Unit 4,
consisting of a 19.055::1:: acre tract of land in the Stacy B. Lewis Survey No. 317 and the Antonio
Zamora Survey No. 36, City of Schertz, Bexar County, Texas and is generally located near the
intersection of Ware Seguin Road and Boenig Road. The property is zoned Residential Agricultural
(RA).
Ms. Sanchez reviewed staff comments and advised the Commission that the subdivision is being reviewed
under the old UDC. She commented on the history of the property stating the following Unit 1 was approved
by the Planning and Zoning Commission on April 26, 2006; Unit 2 was approved on September 16, 2006;
Unit 3 was approved on March 24, 2010. This property is affected by the AICUZ and received an SUP for the
entire development on April 11, 2006 (Ordinance # 06-S-19). Ms. Sanchez advised the Commission that the
plat complies with all requirements and offered staff recommendation.
After a short discussion between Commission, staff and applicant on the sound measurement in the
AICUZ, Mr. Greenwald moved to approve the item. Ms. McBrearty seconded the motion. Vote
unanimous. Motion carried.

B. PC2010-027 Cypress Point Subdivision - Master Plan
Consider and act upon a request for approval of a master plan 87.735::1:: acre tract of land out of the
C.M. Gahagan Jr. Survey No. 258, Abstract No 142 Guadalupe County Texas and Abstract 182,
Comal County Texas. This property is generally located near the intersection of IH 35 and Eckhardt
Road. (Formerly known as Tanglewood Park) and is zoned GB, R-6 and R-7.
Ms. Sanchez reviewed staff comments and advised the Commission that the property is partially developed
and has not yet been accepted by the City for maintenance. The development is impacted with dedicating half
the right-of-way for Eckhardt Road as identified on the Master Thoroughfare Plan (MTP). Currently the street
is proposed as an 86 foot right-of-way that only extends from IH 35 to the intersection of Green Valley Road.
Staff is in the process of revising the MTP and is proposing a 60 foot right-of-way. Staff is also proposing that
Froboese Lane be added to the MTP as a 60 foot east/west collector which is reflected on the master plan.
After a short discussion between Commission, staff and applicant, Mr. Greenwald moved to approve the
item. Ms. Tutschke seconded the motion. Vote unanimous. Motion carried.
C. PC2010-028 Cypress Point Subdivision, Unit 1- Preliminary Plat
Consider and act upon a request for approval of a preliminary plat for Cypress Point Subdivision Unit
1, consisting of 31.576::1:: acre tract of land out of the C.M. Gahagan Jr. Survey No. 258, Abstract No
142 Guadalupe County Texas and Abstract 182, Comal County Texas. This property is generally
located near the intersection of IH 35 and Eckhardt Road (Formerly known as Tanglewood Park) and
is zoned GB and R-7.
Ms. Sanchez reviewed staff comments and advised the Commission that the property is partially developed
and has not yet been accepted by the City for maintenance. This development is impacted with dedicating half
the right-of-way for Eckhardt Road as identified on the Master Thoroughfare Plan (MTP). The zoning for this
property was approved for General Business, R-7 in the front and R-6 for the remainder of the development
on July 6, 2010. Ms. Sanchez advised the Commission that the plat complies with all requirements and
offered staff recommendation.
After a short discussion between Commission, staff and applicant, Ms. Tutschke moved to approve the item.
Ms. McBrearty seconded the motion. Vote unanimous. Motion carried.
