In the exercise of its governmental regulatory authority, the City Council of the City of Schertz, Texas does hereby amend and change the rate schedules for electric service from the Schertz Electric System operated by the City Public Service Board of San Antonio, to provide for rates as follows: CITl( RJBLIC SERVICE B:WID OF SI\N AND:NIO RESIIEn'IAL SERVICE EIH:'IRIC RATE RE APPLICATION '!his rate is aF{llicable to all alten1ating current service for residential purposes on! y, to any CUstomer whose entire residential requirements on the premises are supplied at one point of delivery through one meter. When a portion of a residence or household unit served through one meter is used for non-residential purposes, this rate is not applicable. However, if the wiring is so arranged that the service for residential purposes am that for non-residential purposes are separately metered, this rate is applicable to the service supplied for residential purposes. '!his rate is not applicable to service for resale or to service for hotels, roan:ing houses, l:xJarding houses, motels, dormitories, or to premises used for other than residential purposes. 'Ihe determination of the number of residential units served will be in a=rdance with city Public Service's practices am procedures. IATE PAYMENT mARGE 'Ihe Monthly Bill will be charged if payment is made within the period indicated on the bill. Bills not paid within this period will be charged an additional 2 percent times the Monthly Bill excluding the adjustment for fuel CXJSts, garbage fees am sales taxes, with the exception that the late payment charge Will be on the budget billing aIOOUIlt for those custorrers on the City Public Service Board's Budget Payment Plan. TERM OF SERVICE 'Ihe Term of Service shall be in a=rdance with the City Public Service AF{llication am 1\gl:eement for Electric Service. RUlE3 AND RmJIATIONS Service is subject to City Public Service Rules am Regulations AF{llying to Electric Service which are incorporated herein by this reference. aJRI'AIIMENT city Public Service shall have the right at any am all times to inunediately adjust in whole or in part, the supply of electricity to CUstomers, in order to adjust to fuel supplies for generation of electricity or to adjust to other factors affecting delivery capability. CITl( RJBLIC SERVICE B:WID OF SI\N AND:NIO RESIIEn'IAL AIL EIH:'IRIC SERVICE EIH:'IRIC RATE RA APPLICATION '!his rate is applicable to all alten1ating current service for residential purposes only, to any CUstomer whose total energy needs are satisfied by electric service supplied by City Public Service. In order to qualify for this tariff the residential CUstomer should have no other source of energy for use in space heating, air corrlitioning, water heating, cooking or other major loads. 'Ibe service to the premises is supplied at one point of delivery through one meter. When a portion of a residence or household unit served through one meter is used for non-residential purposes, this rate is not awlicable. However, if the wiring is so arranged that the service for residential purposes am that for non-residential purposes are separately metered, this rate is applicable to the service supplied for residential purposes provided all other awlication =iteria have been satisfied. Initially, the rate will be applied to a limited number of customers, selected as representative of the group. 'Ibe service to the premises is supplied at one point of delivery through one meter. When a portion of a residence or household unit served through one meter is used for non-residential purposes, this rate is not applicable. Monthl v Demand 'Ibe Demand will be the KW as determined from the reading of the City Public Service deman:1 meter for the 15 minute period of the CUstomer's greatest Demand readin;J during the month. Billinc:f Demand For the period June through September, the Billing Demand is equal to the Monthly Demand as defined above. For the period october through May, the Billing Demand is equal to the Monthly Demand or 80% of the highest measured demarrl established during the previous SlD11l1ler period months (June through September), whichever is greater. Prior to the establishment of a previous Slll1U1ler peak Demand, the Billing Demand shall be equal to the Monthly Demand as defined above. Power Factor When, based on a test of the CUstomer's power factor, the power factor is below 85% lagging, the Billing Demand may be increased by adding 1% of the Actual Demand for each 1% that the power factor is below 85%. Hiah Voltaqe DiSCOOl'lt '!his discount applies only to electric service supplied at City Public Service naninal distril:ution voltage of l3.2 lW or higher, when (a) such service voltage requires no more than one (1) step down transformation from transmission voltage of 69 lW or higher, am when (b) such service can be supplied in a=rdance with City Public Service distril:ution system design =iteria. For service supplied un::ler this discount, the Energy C1large per KWH for usage up to 200 KWH per KW of Billing Demand will be discounted by $0.00225 per KWH. 'Ibis rate is not aF{llicable (a) when another source of electric energy is used by the CUstomer or (b) when another source of energy (other than electric) is used for the same pw:pose or an equivalent pw:pose as the electric energy furnished directly by City Public service, except that such other source of energy as mentioned in (a) am (b) may be used during terrporary failure of City Public Service electric service. City Public Service generating unit start-up CXJSts if start-up, in City Public Service's sole determination, is required to ac:cornmodate the particular sale. 6. A charge constituting a payment to the City of San Antonio in the aIOOUIlt authorized by the City Public Service Board Borrl Irrlenture, but excluding the portion of such payment which would be based on revenues attributable to fuel costs. 7. Any other tenns and corrlitions of a contractual nature required by City Public Service mutually agreeable to City Public service and the purchasing party. It is neces"'!:lry to the successful operation of the rider that the load be interrupted instantaneously am in the aIOOUIlts contracted for by the CUstomer. Interruptible service is available only if such service to CUstomer will not, in CPS' sole judgement, ilnpair CPS' ability to serve the requirements of its firm system customers. 3. 'Ihe Irrlustrial High Voltage Service (Rider El) am Irrlustrial Transmission Voltage Service (Rider E6) discounts are applicable to this rider. 4. Service un::ler this rider will be taken on a separate circuit in:iepen1ent of CUstomer's firm load. 'lhe interruptible circuit Will be separately metered am all related metering installation costs will be paid for by the CUstomer. 'Ibe CUstomer will guarantee to CPS that the interruptible load circuit will remain in::iepen::lent of the firm load circuit am that the equiprent will be connected to the corresporrling circuit in a manner that makes it :inp:>ssible to effect transfer of electric load between the two circuits. CPS retains the right at any time to inspect CUstomer facilities to insure c::onpliance. If CUstomer's equiprent associated with the firm load is penranently, tenp:>rarily or otherwise connected to the interruptible circuit or vice versa, CPS will inunediately discontinue the delivery of interruptible service am will have the right to reccmplte the intenuptible monthly bills for a past period up to 6 months as if the service had been supplied un::ler the firm load rate. CPS retains the right to require payment fran the CUstomer under this provision, and CUstomer shall make payment, within fifteen (l5) days of invoice for any difference in billings (newly reccmplted firm load rate bills less the already billed intenuptible load rider billS). 'Ibe CUstomer is required to pay the difference, if any, in these billings. 5. CPS retains the right to remove fran this rate at its sole discretion any customer whose minimum monthly load factor on the interruptible circuit is less than 80% during any six month period. 6. CUstomer is required to install, own, operate, am maintain necessary monitoring devices am interrupt-exmtrol equiprent, including protective devices, on CUstomer's side of the point of delivery, as specified by CPS. In addition, CUstomer is required to pay CPS for interrupt-a:mtrol equipnent installed on CPS' side of delivery. 7. In addition to the foregoing, CUstomer will be required to enter into a Service AF{llication am 1\greement with CPS including certain starrlard terms with respect to in:1emni.fication of CPS, force majeure, CUstomer's right to increase interruptible load, penalty for failure by CUstomer to interrupt, CUstomer responsibility for equiprent am cost, term of the Agreement, am other con:1itions of service. 8. SECTION 2. The foreqoing shall be the maximum rate to be uniformly applied in determining the charges for electric service to each customer for each class of service. SECTION 3. With respect to the implementation by City Public Service of the OS Rate Schedule for Off System Non-Firm Enerqy Sales attached hereto, in recognition of the benefits to City Public Service ratepayers offered by such sales and the fact that a market for such sales does not exist if such energy is priced to include the full payment to which the City is entitled, the City hereby waives its right under the City Public Service Board Bond Indenture to receive that portion of the City Payment attributable to revenues from the fuel cost component of such enerqy sales. SECTION 4. Said electric rates have been adopted after a complete investiqation of facts bearinq upon the rates, and based on such investigation and hearing, the City council of the City of Schertz, Texas, hereby finds and determines that said rates are fair and reasonable, are equal and uniform and nondiscriminatory amonq the classes of consumers, are necessary to meet the operating and maintenance expenses and provide for depreciation and replacement of the System, to prOVide for reasonable extensions and additions thereto in order to render efficient service to pay principal and interest on revenue bonds and to prOVide benefits and payments to the City; and that said rates are sufficient to provide only a reasonable and proper return upon the fair value of the electric service. SECTION 5. Said electric rates shall be applied respectively to consumption as estimated or as shown on all electric meter registrations determined by the monthly readings commencing January 31, 1991. SECTION 6. That the effective date of this Ordinance shall be governed by the provisions of Section 7 hereof if this Ordinance is adopted by the affirmative vote of at least three members of the City Council. SECTION 7. By reason of the urgent requirements for additional revenue necessary to continue dependable service to the customer of the electric system, an emergency is hereby declared to exist making it necessary for the preservation of the public peace, property, health and safety that this Ordinance become effective immediately upon its enactment, and it is so enacted.
