AN ORDINANCE
REGULATING THE RATES FOR ELECTRIC
SERVICE THROUGH THE ELECTRIC SYSTEM
OPERATED BY THE CITY PUBLIC SERVICE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION 1. In the exercise of its governmental
regulatory authority, the City Council of the City of Schertz,
Texas does hereby amend and change the rate schedules for
electric service from the Schertz Electric System operated by the
City Public Service Board of San Antonio, to provide for rates as
follows:

'!his rate is aF{llicable to all alten1ating current service for
residential purposes on! y, to any CUstomer whose entire residential
requirements on the premises are supplied at one point of delivery through
one meter.
When a portion of a residence or household unit served through one
meter is used for non-residential purposes, this rate is not applicable.
However, if the wiring is so arranged that the service for residential
purposes am that for non-residential purposes are separately metered, this
rate is applicable to the service supplied for residential purposes.
'!his rate is not applicable to service for resale or to service for
hotels, roan:ing houses, l:xJarding houses, motels, dormitories, or to premises
used for other than residential purposes.
'!his rate is not aF{llicable when more than four residential units are
served through one meter.

The types of service available un::ler this rate are described in City
Public Service Electric Service starrlards. When facilities of adequate
capacity am suitable ~ am voltage are not adjacent to the premises
served or to be served, the required service may be provided pursuant to

Adiustments
Plus or minus an aIOOUIlt which reflects the difference in the unit fuel
CXJSt factor for the current month above or below a basic CXJSt of $0.Ol60 per
KWH sold. 'Ibe unit fuel cost factor for the current month is computed as
the sum of:
(a) 'Ibe current month's estimated unit fuel cost per KWH, which is
computed based upon the current month's estimated KWH generation
mix, unit fuel CXJSt by fuel type, any known changes in fuel cost,
sales to other than 10n:J-term customers, purchases am line
losses; plus
(b) An adjustment, if indicated by the current status of the over am
un::ler reo::JVery of fuel costs for the reo::JVery year in progress, to
correct for the difference between the preceding month's estimated
unit fuel CXJSt am the current computation for this value. 'Ibis
adjustment is computed by multiplying the difference between the
preceding month's estimated unit fuel CXJSt (corrected for any fuel
supplier surcharge) am the current computation for this value
times the KWH generated during the preceding month am then
dividing the result by the current month's estimated KWH sales;
plus
(c) An adjustment, if indicated by the current status of the over am
un:ler reo::JVery of fuel costs for the reo::JVery year in progress, to

residential units served. r:uring the SUmmer months the Peak Capacity C1large
will be aF{llied to all KWH usage in excess of 600 KWH multiplied by the
number of residential units served. 'Ihe determination of the number of
residential units served will be in a=rdance with city Public Service's
practices am procedures.
IATE PAYMENT mARGE
'Ihe Monthly Bill will be charged if payment is made within the period
indicated on the bill. Bills not paid within this period will be charged an
additional 2 percent times the Monthly Bill excluding the adjustment for
fuel CXJSts, garbage fees am sales taxes, with the exception that the late
payment charge Will be on the budget billing aIOOUIlt for those custorrers on
the City Public Service Board's Budget Payment Plan.
TERM OF SERVICE
'Ihe Term of Service shall be in a=rdance with the City Public Service

APPLICATION
'!his rate is applicable to all alten1ating current service for
residential purposes only, to any CUstomer whose total energy needs are
satisfied by electric service supplied by City Public Service. In order to
qualify for this tariff the residential CUstomer should have no other source
of energy for use in space heating, air corrlitioning, water heating, cooking
or other major loads.
'Ibe service to the premises is supplied at one point of delivery
through one meter. When a portion of a residence or household unit served
through one meter is used for non-residential purposes, this rate is not
awlicable. However, if the wiring is so arranged that the service for
residential purposes am that for non-residential purposes are separately
metered, this rate is applicable to the service supplied for residential
purposes provided all other awlication =iteria have been satisfied.
'Ibis rate is not applicable to service for resale or to service for
hotels, roan:ing houses, l:xJarding houses, motels, dormitories, or to premises

rate shall be determined at the sole discretion of City Public Service.

is used by the CUstomer or (b) when another source of energy (other than
electric) is used for the same pw:pose or an equivalent pw:pose as the
electric energy furnished directly by City Public Service, except that such
other source of energy as mentioned in (a) am (b) may be used during
teitpJrary failure of the city Public Service electric service.
'!his rate is not applicable to emergency, starrlby, or shared service.
It also is not aF{llicable to resale service except that submetering will be

Monthl v Demand
'Ibe Demand will be the KW as determined from the reading of the City
Public Service deman:1 meter for the 15 minute period of the CUstomer's
greatest Demand readin;J during the month.
Billinc:f Demand
For the period June through September, the Billing Demand is equal to
the Monthly Demand as defined above. For the period october through May,
the Billing Demand is equal to the Monthly Demand or 80% of the highest
measured demarrl established during the previous SlD11l1ler period months (June
through September), whichever is greater.
Prior to the establishment of a previous Slll1U1ler peak Demand, the
Billing Demand shall be equal to the Monthly Demand as defined above.
Power Factor
When, based on a test of the CUstomer's power factor, the power factor
is below 85% lagging, the Billing Demand may be increased by adding 1% of
the Actual Demand for each 1% that the power factor is below 85%.
Hiah Voltaqe DiSCOOl'lt
'!his discount applies only to electric service supplied at City Public
Service naninal distril:ution voltage of l3.2 lW or higher, when (a) such
service voltage requires no more than one (1) step down transformation from
transmission voltage of 69 lW or higher, am when (b) such service can be
supplied in a=rdance with City Public Service distril:ution system design
=iteria.
For service supplied un::ler this discount, the Energy C1large per KWH for
usage up to 200 KWH per KW of Billing Demand will be discounted by $0.00225
per KWH. 'Ihe CUstomer IlD.lSt be demarrl metered am IlD.lSt own am maintain at
CUstomer expense all other transformers am facilities that might be
required to utilize this service.

holidays will be considered Off Peak: New Year's cay, Mem:lrial cay, July

llJMINAIRE C1iANGIDJ'IS
City Public Service will consider CUstomer requests for the changeout
of existing operational ANSIs (luminaire, lanp, photocell) for another type
of ANSL. Requests for changeout Will be contingent upon overall City Public
Service work schedule am changeouts will be scheduled so as not to
interfere with normal City Public Service operations (lighting maintenance,
new lighting installation, etc...). 'Ihe CUstomer will be responsible for
all applicable costs am charges associated with the requested ANSL
changeout. city Public Service reserves the right to reject or delay, for
any reason, a request for an ANSL changeout.
aJRI'AIIMENT
city Public Service shall have the right at any am all times to
inunediately adjust in whole or in part, the supply of electricity to
CUstomers, in order to adjust to fuel supplies for generation of electricity
or to adjust to other factors affecting delivery capability.

detailed herein shall be subject to the following:
1. 'Ibe availability of capacity on the City Public Service transmission
system am related facilities as determined by City Public Service,
during the period for which services are requested.
2. 'Ihe determ:incltion by City Public Service that such transmission wheeling
services will not create urrlue interference with City Public Service's
obligation to provide electric service to its own regular customers or

wheeling (Le. the cases in which the magnitude of the power flow is
greater with wheeling than without wheeling) shall be multiplied

Transmission lines. 'Ihese megawatt-mile increases for all such
lines shall be sununed to determine the total megawatt-mile

TYPE OF SERVICE
SUch service will be made available, deperrling on availability of fuel
am generation capacity, for periods of time less than one year, in varying
quantities to be determined on a case-by-case basis. City Public service
will have camplete discretion concerning designation of generating units and
mix of fuels used to generate energy sold pursuant to this rate schedule.
Service un:ler this rate will be supplied at transmission voltages subj ect to
the adequacy of transmission line capacity for such transfers. 'Ibe
purchasing party shall be responsible for negotiation of any required
wheeling arrangements which may be 1leCeE9ary for transportation of such
energy outside the City Public Service system am for payment of any and all
wheeling charges associated with such transportation. SUch service shall be
interruptible by City Public Service without notice in the event the energy
is required for city Public service system needs or in the event of
=n:1itions beyorrl City Public Service control affecting delivery capability.
If deemed aF{lropriate by City Public Service, the terms am coooitions of a
specific sale may be set out in a written agreement with the purchaser.
RATE
'Ihe chal:ges for off-system non-firm energy sales shall include the
following aF{llicable CXlIl1pOnents:
1. Fuel charges on a megawatt-hour-SOld basis which enable City Public
Service to reo::JVer the fuel costs associated with generating such
energy. City Public Service will have camplete discretion
c:onc::el:lling designation of generating units, mix of fuels, am
allocation of fuel purchases for use in generating energy for off-
system non-firm sales.
2. Operating am maintenance CXJSt for each megawatt-hour based on
costs ass=iated with production of such energy.
3. A capacity availability charge on a megawatt-hour-sold basis or
other basis deemed appropriate by City Public Service to compensate
for fixed CXJSts related to the facilities utilized to produce such
energy .
4. Electric line losses attributable to such sales.
5. City Public Service generating unit start-up CXJSts if start-up, in
City Public Service's sole determination, is required to
ac:cornmodate the particular sale.
6. A charge constituting a payment to the City of San Antonio in the
aIOOUIlt authorized by the City Public Service Board Borrl Irrlenture,
but excluding the portion of such payment which would be based on
revenues attributable to fuel costs.
7. Any other tenns and corrlitions of a contractual nature required by
City Public Service mutually agreeable to City Public service and
the purchasing party.
PAYMENT AND BILLING
City Public Service shall render bills on or before the tenth of each
month for off-system non-firm energy sales ren:1ered during the previous
month. 'Ihe aIOOUIlts billed shall be due am payable without deduction by the
purchaser within fifteen (15) days of the billing statement. If required by
city Public Service, payment shall be wired to an account specified by city

BILLING
1. 'Ihe Block Exten:1er will be changed to 250 KWH per KW of Billing

(A) Fuel Cost Adiustment
Plus or minus an aIOOUIlt which reflects the difference in the unit fuel
CXJSt factor for the current rronth above or below a basic cost of $0. 0160 per
KWH sold. 'Ibe unit fuel CXJSt factor for the current month is computed as
the sum of:
(a) 'Ihe current month's estimated unit fuel CXJSt per KWH, which is
COIIplted based upon the current month's estimated KWH generation
mix, unit fuel cost by fuel type, any known changes in fuel cost,
sales to other than 10000-term customers, purchases am line
losses; plus
(b) An adjustment, if irrlicated by the current status of the over and
un::ler reo::JVery of fuel costs for the recovery year in progress, to
correct for the difference between the preceding month's estimated
unit fuel cost am the current COIIpltation for this value. 'Ibis
adjustment is COIIplted by multiplying the difference between the
precedin;J month's estimated unit fuel CXJSt (corrected for any fuel
supplier surcharge) am the current computation for this value
times the KWH generated during the preceding month am then
dividing the result by the current month's estimated KWH sales;
plus
(c) An adjustment, if indicated by the current status of the over and
un::ler reo::JVery of fuel costs for the reo::JVery year in progress, to
correct for the difference between the preceding month's estimated
value for the secorrl precedin;J month's unit fuel cost am actual
unit fuel CXJSt for that month. '!his adjustment is computed by
multiplying the difference between the preceding month's estimated
value for the secon:1 p~ing month's unit fuel CXJSt am the
actual unit fuel cost for that month (corrected for any fuel
supplier surdlarge) times the KWH generated during the preceding
month am then dividin;J the result by the current month's
estimated KWH sales; plus
(d) An adjustment, as necesE'~, which may be derived am applied to
the unit fuel cost factors during the months preceding, including ,
arn;or following January each year, depending on the dollar amount
of adjustment necessary to balance the annual curm.tlative actual
fuel CXJSt with the annual curm.tlative fuel CXJSt reo::JVery through
these rates; plus
(e) An adjustment to reflect offsetting credits to or additions to
fuel costs resulting fran judicial orders or settlements of legal
proceedin:Js affecting fuel costs or CXlIl1pOnents thereof, including
taxes or transportation costs, or to reflect accounting am bill-
ing record corrections or other out-of-period adjustments to fuel
costs .
Plus or minus the proportionate part of the increase or decrease in
taxes, required payments to governmental entities or for governmental or
municipal purposes which may be hereafter a5'5'~=<:l, i1tpJsed, or otherwise
required am which are payable out of or are based upon revenues of the
electric system.
(B) Interruption Adiustment
'Ibe reduced price of the service supplied un:ler this experimental rider
is based on the premise that the CUstomer's total interruptible load is part
of the "spinning reserve" that CPS is obligated to maintain in order to
secure the reliability of the electric service to its customers. It is
neces"'!:lry to the successful operation of the rider that the load be
interrupted instantaneously am in the aIOOUIlts contracted for by the
CUstomer. Consequently if at the time that an intentional interruption
occurs the CUstomer's interruptible load is:
l) Less than 80% of the contracted interruptible deman:1, the monthly
bill will be adjusted as follows:
For each percentage that the average interrupted deman:1 during the
billing month is below 80% of the contracted deman:1, the monthly
bill will be increased by one one hun::lredth (one percent) times
the difference between the bill calculated un:ler the firm rate
aF{llicable to the CUstomer am the interruptible rider, or
2) Less than l,OOO KW, CPS retains the right to assess an additional
penalty, if in CPS' sole judgement, such drop in load ilnpairs CPS'
ability to serve the requirements of its firm system customers or
if such drop in load could increase CXJSts to CPS' firm service
customers. '!his additional penalty will be assessed by:
(a) Calculating firm am interruptible bills assuming a load of
1,000 KW on both am "I"'<:Ol:'sing a penalty equal to lOOt of the
difference between the firm am interruptible bills, am
(b) Calculating firm am interruptible bills using the
interruptible Billing Deman:i minus the firm am interruptible
bills calculated in (a) above times the penalty percentage as
derived in (l) above.
<XlNDITIONS OF SERVICE
1. 'Ihe aWl.egate aIOOUIlt of capacity available for interruptible service
to all CPS customers will be aFflOrtioned in a fair manner amon:J the
customers who have submitted to CPS the aF{lropriate service application
ayl.o=ments. CPS shall determine the aWl.egate aIOOUIlt of "spinning
reserve" available for this rider.
2. Interruptible service is available only if such service to CUstomer
will not, in CPS' sole judgement, ilnpair CPS' ability to serve the
requirements of its firm system customers.
3. 'Ihe Irrlustrial High Voltage Service (Rider El) am Irrlustrial
Transmission Voltage Service (Rider E6) discounts are applicable to
this rider.
4. Service un::ler this rider will be taken on a separate circuit
in:iepen1ent of CUstomer's firm load. 'lhe interruptible circuit Will be
separately metered am all related metering installation costs will be
paid for by the CUstomer. 'Ibe CUstomer will guarantee to CPS that the
interruptible load circuit will remain in::iepen::lent of the firm load
circuit am that the equiprent will be connected to the corresporrling
circuit in a manner that makes it :inp:>ssible to effect transfer of
electric load between the two circuits. CPS retains the right at any
time to inspect CUstomer facilities to insure c::onpliance. If
CUstomer's equiprent associated with the firm load is penranently,
tenp:>rarily or otherwise connected to the interruptible circuit or vice
versa, CPS will inunediately discontinue the delivery of interruptible
service am will have the right to reccmplte the intenuptible monthly
bills for a past period up to 6 months as if the service had been
supplied un::ler the firm load rate. CPS retains the right to require
payment fran the CUstomer under this provision, and CUstomer shall make
payment, within fifteen (l5) days of invoice for any difference in
billings (newly reccmplted firm load rate bills less the already billed
intenuptible load rider billS). 'Ibe CUstomer is required to pay the
difference, if any, in these billings.
5. CPS retains the right to remove fran this rate at its sole discretion
any customer whose minimum monthly load factor on the interruptible
circuit is less than 80% during any six month period.
6. CUstomer is required to install, own, operate, am maintain necessary
monitoring devices am interrupt-exmtrol equiprent, including
protective devices, on CUstomer's side of the point of delivery, as
specified by CPS. In addition, CUstomer is required to pay CPS for
interrupt-a:mtrol equipnent installed on CPS' side of delivery.
7. In addition to the foregoing, CUstomer will be required to enter into a
Service AF{llication am 1\greement with CPS including certain starrlard
terms with respect to in:1emni.fication of CPS, force majeure, CUstomer's
right to increase interruptible load, penalty for failure by CUstomer
to interrupt, CUstomer responsibility for equiprent am cost, term of
the Agreement, am other con:1itions of service.
8. Whenever the CUstomer's interruptible load must be shut down due to
CUstomer requirements (e.g. maintenance), CUstomer is required to give
the CPS System Operator a minimum of twenty-four (24) hours advance
notice of the shutdown.

Regulatory Commission (or it's successor in function) Rules. City Public Service
will determine whether or not adequate capacity exists for starrlby service at any
particular customer location. '!his rider is aF{llied in conjunction with firm
schedules GENERAL SERVICE ElECI'RIC RATE (PL), IAR:;E LIGHI'ING AND KMER SERVICE
ElECI'RIC RATE (LLP), or ElITRA IAR:;E KMER SERVICE ElECI'RIC RATE (ELF).
CUstomer's facilities may be connected for parallel operation with City Public
Service, or isolated for operation with supplementary, erroeJ:gency or maintenance
service provided by City Public Service by means of double throw switches.
CUstomer shall be responsible for all inter=nnection, system protection am
metering costs in excess of those usually provided to full-service customers of
similar load/usage characteristics am which are deemed necessary by city Public
Service. City Public Service shall be the sole authority relative to necessary
interconnection, metering, am system protection facilities. CUstomer shall
agree to peD1Iit City Public Service access to customer's premises to inspect the
facilities for which City Public Service is providin;J Starrlby Service. CUstomer
may also be required to enter into a separate contract with City Public Service
for services un::ler this rider.
DEFINITIONS
SuF{llementary Service - Electric pc:Mer supplied by City Public Service in
addition to the electric pc:Mer which customer's
generation equipnent supplies. SuF{llementary Power
used by customer will be billed a=rding to the
aF{llicable firm rate (PL, LLP, or ELF) .
EmeJ:gency Service - Electric pc:Mer supplied by City Public service to
replace pc:Mer ordinarily generated by a customer's
generation equipnent during an unscheduled outage.
Maintenance service - Electric pc:Mer supplied by City Public Service
during sd1eduled outages of customer's generation
equipnent. Maintenance schedules will be aF{lroved
by City Public Service am will take place during
the months of October through March only.
TYPE OF SERVICE
CUstomer must have adequate facilities or be willing to upgrade, at customer
expense, the facilities to satisfy the minimum stan:1ards provided for in City
Public Service Electric Service Starrlards. CUstomer facilities may be operated
in parallel with those of city Public Service if constructed am operated in
a=rdance with current starrlards in use at City Public Service. These starrlards
include but are not limited to City Public Service Electric Service Starrlards,
applicable state arn;or federal regulations, am other such corrlitions as may be

SECTION 3. With respect to the implementation by City
Public Service of the OS Rate Schedule for Off System Non-Firm
Enerqy Sales attached hereto, in recognition of the benefits to
City Public Service ratepayers offered by such sales and the fact
that a market for such sales does not exist if such energy is
priced to include the full payment to which the City is entitled,
the City hereby waives its right under the City Public Service
Board Bond Indenture to receive that portion of the City Payment
attributable to revenues from the fuel cost component of such
enerqy sales.
SECTION 4. Said electric rates have been adopted after a
complete investiqation of facts bearinq upon the rates, and based
on such investigation and hearing, the City council of the City
of Schertz, Texas, hereby finds and determines that said rates
are fair and reasonable, are equal and uniform and
nondiscriminatory amonq the classes of consumers, are necessary
to meet the operating and maintenance expenses and provide for
depreciation and replacement of the System, to prOVide for
reasonable extensions and additions thereto in order to render
efficient service to pay principal and interest on revenue bonds
and to prOVide benefits and payments to the City; and that said
rates are sufficient to provide only a reasonable and proper
return upon the fair value of the electric service.
SECTION 5.
Said electric rates shall be applied
respectively to consumption as estimated or as shown on all
electric meter registrations determined by the monthly readings
commencing January 31, 1991.
SECTION 6. That the effective date of this Ordinance shall
be governed by the provisions of Section 7 hereof if this
Ordinance is adopted by the affirmative vote of at least three
members of the City Council.
SECTION 7.
By reason of the urgent requirements for
additional revenue necessary to continue dependable service to
the customer of the electric system, an emergency is hereby
declared to exist making it necessary for the preservation of the
public peace, property, health and safety that this Ordinance
become effective immediately upon its enactment, and it is so
enacted.
SECTION 8.
All other ordinances which may be in conflict
with this ordinance are hereby repealed.
