BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, PROVIDING THAT THE CODE OF ORDINANCES
BE AMENDED BY REVISING CHAPTER 12 1/2 PARKS
AND RECREATION, AND REPEALING ALL ORDINANCES
OR PARTS OF ORDINANCES IN CONFLICT WITH THIS
ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS;

THAT Chapter 12 1/2, Code of Ordinances, City of
Schertz, Texas is hereby amended to read as follows:

Sec. 12 1/2-1. Tracts of land will be named as follows:

for any person or persons to use any part of the parks or park

written permission as approved by the city councilor city
manager as described in section 12 1/2-4 of this article; said
permission to be considered only for the following conditions:
(a) Large group special use) activities, such as fairs,
carnivals, city sponsored functions, and/or other activities
where fees are charged for entrance or participation in any
activities; or when charges are made for consumable or non-
consumable items, when approved by the city manager in accordance
with section V(l)(b) of this ordinance.
(b) Special activities such as scouting or organized youth group
activities or jamborees, family reunions, company picnics, etc.,
when approved in writing by the city manager.
(c) Other presently unforeseen special events, when approved by
the city manager; and only when such permission will not
constitute a nuisance to residents adjacent to any park area.

Sec. 12
1/2-3. Possession or consumption of alcoholic beverages
in parks and recreational areas.
Alcoholic beverages may be possessed and/or consumed in all
parks and recreation areas between the hours of 8:00 A.M. and
8:00 P.M., or between the hours of 8:00 A.M. and 11:00 P.M. in
authorized areas provided reservations have been made for the use
of a specified area and authorization has been granted.
Exception, the possession and/or consumption of alcoholic
beverages is not authorized at any time in the ballfield areas,
including the picnic area next to and including the area of the
Scout Hut, that area being in H.P. Thulemeyer Park; Lone Oak Park
in the Lone Oak Subdivision; Coy J. Simmons Park in Oak Forest
Subdivision and the swimming pool facility in G.W. Pickrell Park.

(b) Reservation Policies:
(1) Reservation Requirements, where made

or less) usage of picnic areas, unless alcoholic
beverages will be possessed andlor consumed after
8:00 p.m. by those persons using an area.
b. Reservations are required for large group activities
(26 or more) usage.
c. Reservations are made in person, by a city resident,
at the Municipal Complex administration offices
during normal working hours.
(2) Reservations and setting of fees for park areas, or
either of the pavilions for special use activities, such
as fairs, carnivals, city sponsored functions, etc. will
be determined by the city council for each separate
occasion.
(3) The individual or group making reservations will be
responsible for posting "Reserved" signs at designated
area by 8:00 a.m. the day of reservation. These
"Reserved" signs must include the name of party and time
and date of reservation.
(4) The parks and recreation department will be notified of
time, date and type of group making reservations.
Security personnel will be scheduled by the parks and
recreation department using a formula approved by city
manager.
(5) No musical groups except city sponsored functions will
be allowed to perform in the city parks without prior
written permission of the city manager.
(6) No Glass Containers: All glass containers are
prohibited within the City park areas.
(7) Use of ballfield complex lighting systems, will be
limited to reservation only. Lighting fees listed in
Attachment "CO.

Sec. 12 1/2-6.
Motorized vehicles prohibited; exceptions.
No motorized vehicles~ except maintenance or emergency
vehicles, will be allowed in any part of any park, except
designated parking areas, without special permission.
Sec. 12 1/2-7.
Penalty for violation.
Any person, firm, partnership, association or persons, or
corporation, or any agent or employee thereof, who shall violate
any of the rules~ regulations or provisions of this ordinance~ or
any part of it or any portion thereof, by any act either of
commission or omission~ or cause the same to be done~ shall be
deemed guilty of a misdemeanor and upon conviction thereof shall
be punished by a fine in an amoount not to exceed $200.00 for
each and every violation. Each violation of each part or any
part of this ordinance shall be and constitute a separate
offense; and shere such violation is continued act each day such
violation is continued~ or permitted to be continued shall be a
separate offense, and shall be punishable accordingly."

ATTACHMENT "A"
USE AND REGULATIONS OF BALLFIELD COMPLEX
1. The use of ballfield areas will be opened to the public any
time during the year except as follows:
A. Park and Recreation approved scheduled leagues, will
take precedence over all other ballfield reservations.
When there is a league scheduled, use of the league
reserved field(s) will be limited to their scheduled
practice and/or league games.
B. All groups or organizations wishing to use ballfields
for league play must submit a written request to the
city manager showing all of the following:
(1) groups or organizations
(2) name of league
(3) name, address, home and employment phone number of
league representatives
(4) number of teams in league
(5) dates of season
(6) number of ballfields needed
(7) schedule of time and date of games and scheduled
practice
(8) date of playoff tournaments at end of season.
C. Leagues will be assessed a flat seasonal fee of $300.00
to defray the cost of ballfield maintenance (i.e. daily
conditioning of playing area to include dragging
infields, chalking required lines and policing trash in
and around ballfield complex). In addition, each league
will be assessed an "electric charge" for electricity
usage during the scheduled season, as computed by use of
the presubmitted schedule of times and dates (See B(7)
above).
The $300.00 seasonal fee may, at the option of the city
manager, be decreased to $100.00 if all of the following
conditions are met throughout the league:
(1) Leagues provide bases.
(2) Leagues provide daily conditioning of playing

3. Any invitational tournament not associated with city approved
league activities will be charged the base fee of $30.00 per team
entering the tournament plus an "electric charge" will be
assessed for electricity usage in accordance with rates listed in
Attachment "CO.
Groups or organizations wishing to schedule their invitational
tournaments must submit a written request to the city manager a
minimum of thirty (30) days in advance reflecting all the
following:
A. Name of group or organization.
B. Names, addresses, home and employment phone numbers of
tournament sponsors and/or representatives.
C. Number of teams entered in tournament.
D. Date(s) of tournament.
E. Number of ballfields needed, including type field
(softball, baseball, or combination of)
F. Tournament bracket schedules, reflecting time of day
for each game.
G. Certified copy of liability insurance coverage.
4. Reservations for any ballfield usage by special activities or
individual patron(s) may be accepted anytime during the year,
with the following exceptions:
A. During scheduled league usage
B. During scheduled tournaments
C. During City sponsored activities
During scheduled league andlor tournament period(s), only the
adult softball field (A-3), (next to Scout hut), will be
available for reservation. This will normally be restricted to
Saturday andlor Sunday. However, reservation request for other
than these days may be approved based on leagueltournament
scheduling.

2. Regulations:

responsible person 15 years of age or older.
B. Persons in street clothes will be allowed in authorized

C. Admittance to the pool may be refused for the following
reasons:
(1) Where it is apparent the individual is physically
unable to care for himself.
(2) Drunkenness
(3) Any kind of contagious disease.
(4) Any person, in the opinion of the pool manager or
senior lifeguard, whose behavior would be detrimental to
the operation of the swimming pool.
D. Conduct of persons in the pool area.

NEWS RELEASE
The City of Schertz Parks and Recreation Division is now
selling swimming pool season passes at the Schertz Municipal
Complex, 1400 Schertz Parkway. Persons 60 years of age and
older will receive a 40% discount on purchase of season pass.
Passes may be purchased on a three month time purchase plan
beginning February 1 and ending April 30.
