AN ORDINANCE
OF THE CITY OF SCHERTZ, TEXAS RETAINING THE TAXES
IMPOSED BY THE LOCAL SALES AND USE TAX ACT (ARTICLE
1066c, VERNON'S TEXAS CIVIL STATUTES) ON THE SALE
AND DISTRIBUTION OF GAS AND ELECTRICITY FOR RESI-
DENTIAL USE IN SAID CITY,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:

The City of Schertz by majority vote of the City Council,
hereby votes to retain the taxes authorized by the Local Sales and
Use Tax Act (Article 1066c, Vernon's Texas Civil Statutes) on the
receipt from the sale, production, distribution, lease, or rental
of, and the use, storage, or other consumption of gas and electri-
city for residentail use, as authorized by Section 6 of House Bill
No.1, Acts 1978, 65th Legislature, Second Called Session.

Dear Mayor Bueker:
Our Sales Tax Division has advised me we have no record that your city has
taken action to repeal or retain the 1% city tax on residential natural gas
and electric bills,
The tax relief bill which exempted residential use from the 4% State sales
tax became effective on October I, 1978, However, the statute states that
unless an ordinance retaining the tax is received from your city by May 1,
1979, the 1% city sales tax on residential use of gas and electricity will
be automatically abolished effective October I, 1979.
The attached guidelines explain the city council's options for keeping or
repea 1 i ng the tax and the sample copy of an ordi nance conti nui ng the
imposition of the 1% city sales tax is provided for your information.
Whatever your council's decision, I would very much appreciate hearing from
you at the earliest possible time so we can assist you in implementing any
changes necessary.

NOTE: If a city desires to retain the 1% city sales tax for the sale and dis-
tribution of gas and electricity within the city, the governing body of the
city must enact an ordinance similar to the one in this example, before May 1,
1979. This must be done at a regular or special meeting duly called with
posted notice listing this item of the agenda for the meeting. A certified
copy of the ordinance (note the sample certificate of the City Secretary) must
be mailed to the State Comptroller by Registered Mail or by Certified Mail.
