TIlE OFFICE OF CITY MANAGER FOR TIlE CITY
SCHERTZ ,TEXAS, AND PRESCRIBING
HIS POWERS AND DUTIES
BE IT ORDAINED BY TIlE CITY COUNCIL
TEXAS:
OF TIlE CITY OF SCHERTZ ,
SECTION 1. The Governinl Body of the city shall appoint a City
Manaler for the City of SCHERTZ who shall be the administrative head
of the municipal lovernment under the direction and supervision of the
Governinl Body.
SECTION 2. RESIDENCE OF CITY MANAGER: The City Manaler mayor may
not be a resident of the City of SCHERTZ when appointed, but durinl the
term of his office, shall reside in the city of SCHERTZ.
SECTION 3. TERM OF OFFICE: At the will of the City Council, the
City Manaler shall be appointed for an indefinite period and shall be
subject to discharle at the will of the loverninl body of the City.
SECTION 4. ABSENCE OR DISABILITY OF CITY MANAGER: Durinl pro1onled
or diabi1ity of the City Manaler, the loverninl body shall desilnate some
properly qualified person to perform the duties of said office.
SECTION 5. POWERS AND DUTIES: The powers and duties of the City
Manaler shall be:
(a) To devote all of his workinl time and attention
to the affairs of the City, and be responsible
to the loverninl bOdy for the efficient administration
of its affairs.
(b) To see that all laws and ordinances are enforced.
(c) With the advice of the loverninl body of the
city, to appoint and remove all heads of departments.
He shall have the power to appoint or remove all
subordinate employees.
(d) To exercise supervision and control over all
departments created by the loverninl body or
that may hereafter be created by said loverninl
body of the City.
(e) To attend all meetinls of the loverninl body
with the rilht to take part in the discussion,
but havinl no vote; and he shall be notified of
all special meetinls or executive sessions of
said loverninl body.
(f) To see that all terms and conditions imposed in
favor of the City of SCHERTZ, and its inhabitants
in any public utility franchise are faithfully
kept and performed and upon know1edle of any

violation thereof to call the same to the
attention of the loverninl body.
(I) To act as Budlet Officer and as such to prepare
and submit to the loverninl body, prior to the
belinninl of each fiscal year, a budlet of pro-
posed expenditures for the ensuinl year, showinl
in as much detail as practicable the estimated
amounts required for the efficient operation of
each department of the City Government and the
reasons for such estimated expenditures.
(h) The City Manaler, in addition to the foreloinl
paralraph (I), shall make and file a budlet as
required by State Law.
(i) To make a full written report to the loverninl
body as soon after the close of each month's
accounts as possible, showinl the operation and
expenditures of each department for the precedinl
month, and a comparison of such monthly ex-
penditures, by departments, with the yearly
allowances made for such departments in the annual
budlet, and to keep the loverninl body fully
advised at all times as to the financial condition
and needs of the city.
(j) To act as purchasinl alent for the City of SCHERTZ
and to purchase all merchandise, material and supplies
needed by the City and may establish, if needed,
a suitable storehouse where such supplies shall
be kept and from which same shall be issued as
needed; and to adpot such rules and relu1ations
loverninl requisitions and transaction of business
between himself as such purchasinl alent and the
heads of the departments, officers and employees
of the City as the loverninl body may approve.
It shall be the duty of the purchasinl alent to live opportunity
for competition on purchases and sales, except when the nature of the
purchase or sale is such t~t compet~~h9~~ is impossible or impracticable.
All purchases in exce88 of .2. 000 ~ Dollars, except of real
estate, or rilhts or easements therein, shall be by cO~J~ to the~~est
responsible bid and all sales in excess of "/. C() ~ LlI Dollar.,
except of real estate or rilhts or easements therein, shall be made to
the hilhest bidder after public notice and the receipt of sealed bids,
unless the loverninl body, by ordinance, determines that it is
impossible or impracticable to purchase or sell in such manner. All
sealed bids received shall be opened in public and thereafter shall be
subject to public inspection. The purchasinl alent may, at the direction
of the loverninl body, reject all bids and readvertise for new bids.
The purchasinl alent may require successful bidders to furnish
security conditioned upon the faithful performance of their contract or
conditioned upon the payment of the wales and compensation of all
laborers employed on work for which a contract is made by the contractor,
subcontractor, alent or any other person, or condition for both. The
purchasinl alent shall not let any contract for periods exceedinl
one year for street 1ilhtinl, public improvements, labor or supplies.
In case of accident or other circumstances creatinl an emerlency,
the City Manaler may, with the consent of the loverninl body, award

contracts and make purchases for the purpose of repairina damaaer caused
by said accident or avoidina said public emeraency; but immediately
afterwards, he shall file with the Mayor a certificate showina such
emeraency and the necessity of such action toaether with an itemized
account of all expenditures.
(k) To recommend to the aovernina bOdy the salaries to be paid
each appointive officer and subordinate employee of the City; and it
shall be the duty of the aovernina body to pass ordinances or resolutions,
from time to time, fixina rates of compensation.
(1) To recommend to the aovernina body, in writina, from time to
time, ,for adoption, such measures as he may deem necessary or expedient.
(m) To do and perform such other duties as may be prescribed by
ordinance or resolution of the aovernina body of the City.
SECTION 6. COMPENSATION AND BOND OF CITY MANAGER: The City
Manaaer shall receive such compensation as the aoverninl body shall fix
from time to time by ordinance and shall furnish such surety bond as
may be required by the aovernina body by ordinance, the premium to be
paid by the City.
SECTION 7. All ordinances of the City prescribina the duties of
heads of departments shall remain in full force and effect except in so
far as they conflict with the provisions of this ordinance in which case
the provisions of this ordinance shall lovern.
SECTION 8. All ordinances or resolutions of the city prescribina
the duties of the "City Secretary" or "City Administrator" as chief
executive officer of the city in so far as they conflict with the provi-
sions of this ordinance are hereby repealed.
