1989S16- AMENDING THE ZONING ORDINANCE ORDINANCE ?~-s-/t, AN ORDINANCE BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS, AMENDING THE ZONING ORDINANCE, NO. 87-S- 1, ARTICLE v, SINGLE FAMILY DWELLING DISTRICT REGULATIONS R-1, SECTION 3.9; ARTICLE VI, SINGLE FAMILY DWELLING DISTRICT REGULATIONS R-2, SECTION 3.9; ARTICLE VII, SINGLE FAMILY DWELLING DISTRICT REGULATIONS R-6, SECTION 3.9; ARTICLE VIII, SINGLE FAMILY DWELLING MANUFACTURED HOUSING DISTRICT REGULATIONS R-7, SECTION 3.9; ARTICLE IX, TWO FAMILY DWELLING DISTRICT R-3, SECTION 3.9; ARTICLE X, APARTMENT/MULTI-FAMILY DWELLING DISTRICT R-4, SECTION 3.9; ARTICLE XI, GARDEN HOME DWELLING DISTRICT R-5A AND R-5B, SECTION 4.10 AND SECTION 6.10; ARTICLE XIV, OFFICE AND PROFESSIONAL DISTRICT, SECTION 5.8; ARTICLE XV, NEIGHBORHOOD SERVICES DISTRICT, SECTION 5.9; ARTICLE XVI, GENERAL BUSINESS DISTRICT, SECTION 5.8; ARTICLE XIX, PLANNED UNIT DEVELOPMENT, SECTION 1.1, ITEM 9 AND PROVIDING A REPEALING CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT, ZONING ORDINANCE 87-s-1 of the City of Schertz, Texas is hereby amended in the following manner: ARTICLE V, SINGLE FAMILY DWELLING DISTRICT REGULATIONS R-1, add as a second paragraph to Section 3.9, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE VI, SINGLE FAMILY DWELLING DISTRICT REGULATIONS R-2, add as a second paragraph to Section 3.9, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE VII, SINGLE FAMILY DWELLING DISTRICT REGULATIONS R-6, add as a second paragraph to Section 3.9, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE DISTRICT 3.9, the VIII, SINGLE FAMILY DWELLING MANUFACTURED HOUSING REGULATIONS R-7, add as a second paragraph to Section following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE IX, TWO FAMILY DWELLING DISTRICT R-3, add as a second paragraph to Section 3.9, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet.' ARTICLE X, APARTMENT/MULTI-FAMILY DWELLING DISTRICT R-4, add as a second paragraph to Section 3.9, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE XI, GARDEN HOME DWELLING DISTRICT R-5A AND R-5B, add as a second paragraph to Section 4.10 and Section 6.10, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE XIV, OFFICE AND PROFESSIONAL DISTRICT, add as a second paragraph to Section 5.8, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE XV, NEIGHBORHOOD SERVICES DISTRICT, add as a second paragraph to Section 5.9, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. - 2- ARTICLE XVI, GENERAL BUSINESS DISTRICT, add as a second paragraph to Section 5.8, the following: The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. ARTICLE XIX, PLANNED UNIT DEVELOPMENT, Section 1.1, add item 9 as follows: 9. Accessory Buildings: No accessory building, as permitted herein shall occupy more than forty (40%) percent of the required rear yard. Accessory buildings shall be set back three (3') feet from common property lines, provided however, that where the rear lot line of an alley or easement twenty (20') feet or more in width, no setback shall be required. No accessory buildings may be closer than ten (10') feet to the main building in the rear yard. Accessory buildings as permitted herein may be allowed in required side yards, provided however, that no accessory buildings may be closer than ten (10') feet to any main building on the same lot, nor closer than three (3') feet to a common property line. No accessory building shall be constructed in the front yard or an easement. The wall height of the accessory building shall be limited to not more than eight (8') feet and total building height shall not exceed fifteen (15') feet. (This applies to residential areas only. ) Repeal of Conflicting Ordinances or Orders. All orders, ordinances or parts of ordinances in conflict with this Ordinance, specifically Ordinance 87-S-1, or inconsistent with the provisions of this Ordinance are hereby repealed to the extent necessary to give this Ordinance full force and effect. -3- Approved on first reading the a day of ~ ,19 l??
