ORDINANCE CREATING CITY PLANNING AND ZONING COMMISSION
SCHERTZ, TEXAS
AN ORDINANCE CREATING THE SCHERTZ CITY PLANNING
AND ZONING COMMISSIDN, PRESCRIBING THE DUTIES
AND QUALIFICATIONS OF IT'S MEMBERS AND THEIR
TERM OF OFFICE, PROVIDING FOR THE APPOINTMENT
OF IT'S MEMBERS, THE METHOD OF FILLING
VACANCIES, MAIONG DEPARTMENT HEADS AND
OFFICIALS AVAILABLE TO CITY PLANNING AND ZONING
COMMISSION, PRESCRIBING POWERS AND DUTIES OF
THE CITY PLANNING AND ZONING COMMISSION,
PFWVIOING FOR ADOPTION OF RUL.ES AND REGULATIONS
AND BY'-LAWS, REPEALING ALL ORDINANCES OR PARTS
DF DRDINANCES, INCONSISTENT OR CONTRARY HERETO.

SECTION 1 CREATION AND PURPOSE
A P 1 ann i ng and Zon I ng Comm i ss i on is hereby cr.eated In or'der' to
accompl ish the following:
(11 To identify community needs and to advise the City Council
of their short-range and long-range impl icatlons for the
total development of the City;
(2 I To recommend aeh i evab 1 e commun i ty goa 1 s as a bas I s for long'-
range planning and development programs;
(31 To recommend plans, programs, and policies that will aid the
entire community in achieVing it's defined goals; and
(4) To interpret the adopted plans and programs to concerned
citizens so that pr'ivate activities and desires may be
accompl ished in harmony with publ ic needs and pol icies.

SECTION 2 MEMBERSHIP AND APPOINTMENT
(II The Planning and Zoning Commission shall be composed of
seven (71 regular members. Appointment of regular members will
be for two (2) year periods. The City Council will appoint to
the Comm i ss i on on 1 y those persons l~ho have demonstrated the i r
c I v I c i nter'est, gener'a 1 knowl edge of the commun I ty, I nter'est In
planning and zoning, and availability to prepare for and attend
meet i ngs.
(2) The members o' the City Planning and Zoning Commission shall
be registered voters o' the corporate limits o' the City o'
Schertz, Texas and shall be representative 0' separate sections
o' the City dependent upon the availabil ity o' quali'ied
per'sonne' .
(3) All vacancies occurring on the City Planning and Zoning
Commission shall be .illed by appointment o' the City Council.

SECTION 3 TERMS OF OFFICE AND REMOVAL FROM OFFICE

Commission created by this Article will expire on October 'irst

number'ed year'. Commission member's may be appointed to succeed
themselves, but, no member shall be appointed 'or a term in

appointments.
(2) The City Counc i I may r.emove member's o' the PI ann I ng and
Zoning Commi;,sion 'r'om o..ice 'or mal'easance, conviction o' a
crime involving moral turpitude, or three (3) consecutive
unexcused absences 'rom regular meetings o' the Commission.

SECTION 4 ORGANIZATION
The Cornmission cr.eated under' this Ar.tlcle shall hold an
organ i zat I ona 1 meet i ng in October every tl~O (2 I years and sha 11
elect a Chairman and Vice-Chairman 'rom among it's members be'ore
proceeding to any other matters o. business. No member currently
s""~r'v i ng as Cha i r'man or. V I ce-Cha i r'man sha 11 be nom i nated to
succeed hi mse 1. as Cha i r.man or Vi ee-Cha i rman i. he has served a
'ull one--year' ter'm in either' o' such capacities. The Commission
shall elect a Secretary and such other o..icers as it deems
n~,cessar'y either' 'r'om it's member'ship or. 'r'om Sta"
representatives assigned by the Chief Executive o. the City to
~lC)r'k with the Commission. The Commission shall adopt it's own
r'u I es o. pr'ocedure and keep a r'eeor'd o. it' s proC:j~ed i ngs
consistent with the provisions o. this Article and the
requirements o. appl icable State Statutes. The Commission shall
meet regularly and shall designate the time and place o. it's
meetings.

SECTION 5 DUTIES AND POWE~~
The P 1 ann I ng and Zon i ng Comm i ss i on is her'eby char'ged I~ i th the
duty and invested with the authority to:
(1) Inspec t pr'oper.ty and pr'em i ses at reasonab 1 e hour's wher'e
required in the discharge o' it's responsibil ities under the
laws o. the State and o. the City.
(2) Formulate and recommend to the City Council 'or it's
adoption a City Plan 'or' the or'der'ly gr'owth and development
o. the City and it's environs, and 'rom time to time
recommend such changes in the Plan as it 'inds will
'acilitate the movement o' people and goods, and the health,
recreation, sa'ety, and general wel'are o' the citizens o.
the City.
(3) For'mul ate a zon i ng plan as may be deemed best to car'ry out
the goals o. the City Plan; hold public hearings and make
recommendations to the City Council relating to the
creation, amendment, and implementation o. zoning
regulations and districts as provided in Articles 1011a to
1011k, Revised Civil Statutes, as amended authorizing cities
and incor'por'ated villages to pass regulations; all pOI~ers
granted under such Statute are speci.ically adopted and made
a par.t her. eo'.
(4 I Exer'c i se a 11 the power's o. a Comm i ss i on as to appr'ova lor'
disapproval o' plans, plats, or replats and vacation o'
plans, plats or replats set out in Articles 974a and 970a,
Revised Civil statutes.
(5) Study and r'ecommend on the 1 ocat ion, extens i on and pl ann i ng
o' publ ic rights-o'-way, parks or other public places, and
on the vacat ing or. closing o. same.
(61 Study and recommend on the general design and location o'
publ ic buildings, bridges, viaducts, street 'ixtures and
other structures and appurtenances and study and recommend
on the design or. alter'ation and on the location or'
relocation o. works o. art which are, or may become, the
proper.ty o' the City.
(7) Initiate, in the name o' the City, 'or consideration at
publ ic hearings all proposals:
a. For the opening, vacating or closing o' publ ic
rights-o'-way, parks or other public places;
b. For the original zoning o. annexed areas; and
c. For the change oP zoning district boundaries on an
ar'ea-w i de bas i s. No 'ee sha 11 be r'equ i r'ed 'or' the
Pil ing o' any such proposal in the name o. the City.

(8) Formulate and recommend to the City Council 'or it's
adoption, policies and regulations consistent with the
adopted City Plan gover'ning the lo~;ation and/or' oper'ation o.
utilities, publ ic 'acil ities and services owned or under the
control o' the City.
(91 Keep itself in'ormed with re'erence to the progress of City
planning in the United States and other countries and
recommend improvements in the adopted plans o. the City.
(10) Submit each October 'irst a progress report to the City
Council summarizing it's activities, major accompl ishments
'or the past year, and a proposed work program 'or the
coming year'. The r'epor.t shall contain 'or' the year the
attendance record o. all members and the identity o.
Commission o"icer's.

SEer ION 6 MEET I NG AND QUORUM
(1) A quorum 'or the conduct o. business shall consist o. 'our

SECTION '7 COMMISSION ACTIONS
( 1) A mot i on may be made by any member' of the Comm i ss i on cr'e" ted
by this Article other than the presiding o"icer.
(2) A motion to approve any matter be'ore the Commission or to
recfJmmend approva 1 of' any r'equest r'equ i ring Counc i 1 ac t ion sha 11
r.equir'e 'our' (4) 'avor'able votes o. the members pr'esent. When
'ewer than all the members are present 'or the voting and when
all motions to recommend on a given appl ication fail to carry by
'our (41 votes, consideration o. the appl ication shall be
cont i nued to the next r'egu 1 ar. meet i ng upon mot i on carr' i ed by a
maJority o. those present; provided, 'urther, that, no request or
appl ication shall be continued under this rule beyond the next
regular meeting; 'ailure o. the Commission to secure 'our (41
concurring votes to approve or recommend approval at the next
regular meeting shall be recorded in the minutes as a denial of
the proposal under this rule.
(3) Recommendat ions 'orwar'ded to the City COllnc i I shall conta i n

SECTION 8 DISQUALIFICATION FROM VOTING

SECTION 9
REPEAL OF CONFLICTING ORDINANCES OR ORDERS
Ordinance and all orders, ordinances or parts o' ordinances in
con'lict with this Ordinance, speei.ically Ordinance 93-Z, or
inconsistent with the provisions o' this Drdinance are hereby
repealed to the e:><tent necessary to give this Ordinance 'ull
'orce and e"ect.
