2003R23- ASSESSMENT ROLL FOR THE SCHERTZ I-35/3009-PID Project RESOLUTION NO. ()3 -I< -c:< 3 A RESOLUTION APPROVING AND ADOPTING A SERVICE AND ASSESSMENT PLAN FOR THE SCHERTZ 1-35/3009 PUBLIC IMPROVEMENT DISTRICT; ACCEPTING A PROPOSED ASSESSMENT ROLL FOR THE SCHERTZ 1-3513009 PUBLIC IMPROVEMENT DISTRICT AND REQUIRING SUCH ASSESSMENT ROLL TO BE FILED WITH THE CITY SECRETARY FOR PUBLIC INSPECTION; SETTING A PUBLIC HEARING TO BE HELD ON SUCH ASSESSMENT ROLL; APPROVING AND AUTHORIZING THE GIVING OF NOTICE OF SUCH PUBLIC HEARING; AND RESOLVING OTHER MATTERS INCIDENT AND RELATED THERETO WHEREAS, the City of Schertz, Texas (the "City") has received from the required property owners a petition filed with the City Secretary of the City that complies with the requirements of the Public Improvement District Assessment Act, Chapter 372 of the Texas Local Government Code, as amended (the "Act"), requesting the City to create a public improvement district, which shall be designated the Schertz 1-35/3009 Public Improvement District (the "District"); WHEREAS, the City Council passed and approved Resolution 03-R-I1 dated June 3, 2003, making certain findings as to the advisability of the creation of the District, the nature of the proposed improvements to the District, the estimated costs of the improvements, the boundaries of the District, the method of assessment, and the apportionment of the costs between the City and the District and authorizing the City Manager to appoint members to an Advisory Board for the District; WHEREAS, the City Council further passed and approved Resolution 03-R-12 dated June 3, 2003, authorizing the creation of the District as a public improvement district under the Act in accordance with the findings of Resolution 03-R-11; WHEREAS, on June 8, 2003, Resolution 03-R-11 was duly published in the Seguin Gazette, where upon the District became effective. WHEREAS, in accordance with Section 372.013 and Section 372.014 of the Act, the Advisory Board of the District must present a service and assessment plan to the City Council for review and approval; WHEREAS, Section 372.016 of the Act requires the City Council to (i) prepare a proposed assessment roll, which states the assessment against each parcel of land in the District, and (ii) call a public hearing to consider the proposed assessments; and SECTION 1. The service and assessment plan attached hereto as Exhibit A presented to the City Council by the Advisory Board (the "Plan") is adopted and approved. The City Council authorizes the Advisory Board to negotiate and approve changes to the Plan that are deemed necessary by the Advisory Board and the City Manager and legally appropriate by the City Attorney. The Plan shall be reviewed annually by the Advisory Board for the purpose of determining the annual budget. SECTION 2. The City Council accepts the proposed assessment roll attached hereto as Exhibit B. The City Council hereby directs that the proposed assessment roll be immediately filed with the City Secretary, who shall make such document available for public inspection during regular business hours of that office. SECTION 3. A public hearing is hereby ordered to be held on December 2, 2003, at 7:00 p.m. in the City Council Chambers of the Municipal Complex, 1400 Schertz Parkway, Schertz, Texas, to consider the proposed assessments. SECTION 4. The City Secretary is hereby authorized and directed to cause a notice of public hearing (i) (in substantially the form of Exhibit C) to be published in a newspaper of general circulation in the City of Schertz, Texas and (ii) (in substantially the form of Exhibit D) to be mailed to the last known address of the property owner or owners, as reflected on tax rolls, of the property subject to assessment within the District. The date of the final publication of such notice and the date of mailing notice to the property owners must occur prior to the 10th day before the date of the hearing. The notice mailed to the property owners as described in (ii) above must be addressed to "Property Owner". SECTION 5. It is officially found, determined, and declared that the meeting at which this Resolution is adopted was open to the public and public notice of the time, place, and subject matter of the public business to be considered at such meeting, including this Resolution, was given, all as required by Texas Government Code, Chapter 551, as amended. SECTION 6. This Resolution shall take effect and be in full force immediately upon its adoption.
