A RESOLUTION
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS AUTHORIZING
THE CITY TO SEEK PERMISSION FROM THE TEXAS BUILDING AND
PROCUREMENT COMMISSION TO PARTICIPATE ON A VOLUNTARY
BASIS IN ITS PURCHASING PROGRAM AND OTHER MATTERS IN
CONNECTION THEREWITH
WHEREAS, the City Council of the City of Schertz (the "City") desires to participate in the
purchasing program (the "Program") established by the Texas Building and Procurement Commission (the
"Commission"); and
WHEREAS, Section271.083 of the Texas Local Government Code, as amended (the "Provision"),
provides that in order for the City to participate in the Program, the City must file a resolution adopted by the
City Council with the Commission (A) requesting thatthe City be permitted to participate in the Program on
a voluntary basis and to the extent the Commission deems feasible and (B) stating that the City will (i)
designate an official to act for the City in all matters relating to the Program, including the purchase of items
from the vendor under any contract, and that the City Council will direct the decisions of the representative;
(ii) be responsible for submitting requisitions to the Commission under any contract, electronically sending
purchase orders directly to vendors, or complying with the Commission procedures governing a reverse
auction purchase, and electronically sending to the Commission reports on actual purchases made under the
Provision that provide the information and are sent at the times requested by the Commission; (iii) be
responsible for making payment directly to the vendor; and (iv) be responsible for the vendor's compliance
with all conditions of delivery and quality of the purchased item; NOW, THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS:
SECTION 1. The City Council hereby authorizes the City to file this Resolution with the Commission
requesting permission to participate in the Program on a voluntary basis and to the extent the Commission
deems feasible.
SECTION 2. The City Council hereby designates Dewey P. Cashwell, Jr., or his designee, to act
on behalf of the City in all matters relating to the Program.
SECTION 3. The City Council hereby acknowledges that the City will be responsible for (i)
submitting requisitions to the Commission under any contract, electronically sending purchase orders directly
to vendors, or complying with the Commission procedures governing a reverse auction purchase, and
electronically sending to the Commission reports on actual purchases made under the Provision that provide
the information and are sent at the times requested by the Commission; (iii) making payment directly to the
vendor; and (iv) the vendor's compliance with all conditions of delivery and quality of the purchased item.
SECTION 4. This Resolution shall take effect and be in full force immediately upon its adoption.
