RESOLUTION
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS APPROVING THE ACQUISITION OF A CERTAIN
TRACT OF REAL PROPERTY BY THE GUADALUPE
COUNTY APPRAISAL DISTRICT.
WHEREAS, the Texas Property Tax Code, Section 6.051, allows the
acquisition of real property and construction of improvements thereon by
appraisal districts, and allows the validation by the voting taxing units of such
acquisition by the appraisal district; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS:

Texas.
BE IT FURTHER RESOLVED:
THAT by this approval, the Schertz City Council evidences its intent to
validate such acquisition in all respects.

Dear Mayor Baldwin,
On October 1, 2001, the Board of Directors of the Guadalupe County Appraisal
District adopted a resolution to accept an Offer to Sell real property for the
purpose of expanding the current facility. There are no immediate plans for
expansion, however due to past, present and anticipated growth it is evident that
an expansion will become necessary in the foreseeable future. Considering
recent interest and activity in the undeveloped tracts surrounding our facility, the
Board indicated that it would be prudent to acquire additional land area for this
purpose, while it was still available and affordable.
Our present site, a .794 ac tract, was purchased in 1984 for 95 cents per square
foot. The facility was initially 4335 square feet in area. In 1991, 1122 square feet
was added bringing the total square footage to 5457. Expansion options on the
existing tract are limited to moving east into the parking lot or adding a second
floor to the existing structure. Developing current parking area would leave the
facility with inadequate parking space. Construction of a second floor is not a
viable option due to the design and construction of our current building. Also,
this option would not address future parking needs.
Undeveloped land is available to the south and west of our tract. The 1.5 acre
tract to the south, which has frontage on Austin 81., was under contract earlier
this year for $50,000 or 76 cents per square foot. This sale fell through when it
was discovered that the property was encumbered by an unused state right-of-
way easement. The second tract, and subject of this resolution, is directly behind
our facility. This .918 acre was offered for sale to the District at 50 cents per
square foot. A review of area commercial land sales indicates that this is a fair
market value for the property. The District has adequate funds for this purchase
and would not seek a budget amendment for this proposal.
The acquisition of real property by an appraisal district must be approved by the
governing bodies of three-fourths of the taxing units entitled to vote on the
appointment of board members. On or before the 30th day after the date the
presiding officer receives notice of the proposal, the governing body, by
resolution, may approve or disapprove the proposal. If there is no action, it is
treated as if the proposal were disapproved by the governing body. We will be
available to meet with your governing body, if you or those members would like a
formal presentation on this matter. In the meantime, questions may be directed
to myself or any member of our Board of Directors.

RESOLUTION OF THE
GUADALUPE COUNTY APPRAISAL DISTRICT
WHEREAS, the Board of Directors of the Guadalupe County Appraisal
District recognizes that to satisfy operational requirements attributed to increased
growth and development in the county, it has become necessary to expand the
current facility.
WHEREAS, Sec 6.051, TEX. Tax Code, authorizes the Board of Directors
of an appraisal district to purchase real property and improvements as necessary
to establish and operate the appraisal office.
WHEREAS, the Board of Directors of the Guadalupe County Appraisal
District has received an Offer to Sell from Glendora S. Ewald, Mavis S. Grimm
and Lee Jahns ET AL regarding the sale of the real property described in Exhibit
A, attached.
WHEREAS, the referenced provisions of the Texas Property Tax Code
authorized the following action:
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the
Guadalupe County Appraisal District:
· RESOLVED, that the Guadalupe County Appraisal District accept the Offer to
Sell, contingent upon the provisions set forth in Sec 6.051, TEX. Tax Code, to
the District the real property described in Exhibit A. The offering price on the
property is $0.50 per square foot, not to exceed $20,000.
· RESOLVED, the Board of Directors of the Guadalupe County Appraisal
District shall notify the presiding officer of each taxing unit entitled to vote on
the approval of the proposal by delivering a copy of the board's resolution
together with information showing the costs of other available alternatives to
the proposal.
· RESOLVED, that this Resolution is for purposes of obtaining the required
approval of each taxing unit entitled to vote on the approval of the proposal
and that the passage of this resolution does not constitut~ final acceptance of
the Offer to Sell.
· RESOLVED, the Chairman of the Board of Directors of the Guadalupe
County Appraisal District is hereby authorized to execute any necessary
documents, agreements, or contracts to carry out the terms and conditions of
this Resolution.
