1988R06- PURCHASE OF LAND FOR STEET RIGHT OF WAY RESOLUTION NO. ~-R....- " A RESOLUTION BY THE TEXAS, STREET CITY COUNCIL OF THE CITY OF SCHERTZ, AUTHORIZING THE PURCHASE OF LAND FOR RIGHT OF WAY. Texas, Market WHEREAS, the City has determined that Road 78 to accommodate Council of the City of it is necessary to widen the flow of traffic; and Schertz, Farm to WHEREAS, The City has been unable to necessary easement for right of way purposes on and lands hereinafter described in this resolution; and obtain across the the WHEREAS, the City Council has determined that it is necessary to acquire such land to complete the widening project; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS: THAT the City Manager be directed and authorized to negotiate the purchase of 0.183 of an acre of land, more or less, same being out of a part of that certain 40.08 acre tract of land out of the Genobera Malpaz Survey No. 67, Abstract No. 221, which 40.08 acre tract of land was conveyed to John A. Senneff by deed dated April 15, 1983 and recorded in Volume 667 Pages 549-562 of the Deed Records of Guadalupe County, Texas, said 0.183 of an acre of land, more or less, being described by metes and bounds as follows: BEGINNING at a point lying in the existing south right-of-way line of Farm-to-Market Highway 78, said being a northwest re- entrant corner of the Senneff property, same being the northeast corner of the Cibolo Creek Municipal Authority property, said point is further described as being at right angles to and 50.00 feet right of Engineer's Survey Line Station 31+12.10, said point is further described as being North 84 degrees 43 minutes 00 seconds East, a distance of 1,174.1 feet from the existing northwest corner of the said Senneff property; THENCE North 84 degrees 43 minutes 00 seconds East along the existing south right-of-way line of Farm-to-Market Highway 78, a distance of 321.60 feet to a point on the east bank of Dietz Creek, said point being the northeast corner of the said Senneff property, same being the northwest corner of the Arvid F. Darnell, et ux property; THENCE South 17 degrees 40 minutes 45 seconds West, along said common property line, a distance of 31.92 feet to a point, said point is further described as lying in a northeast line of the Senneff property, same being a northwest line of the Arvid F. Darnell, et ux property; THENCE South 84 degrees 43 minutes 00 seconds West, a distance of 221.04 feet along the proposed south right-of-way line of Farm- to-Market Highway 78 to a point, said point being at right angles to and 80.00 feet right of Engineer's Survey Line Station 31+98.14; THENCE North 76 degrees 50 minutes 14 seconds West, a distance of 92.88 feet along the proposed southwest right-of-way line of Farm-to-Market Highway 78, to the place of BEGINNING and containing an area of 0.183 of an acre of land, more or less. The cost of purchase not to exceed $3,900.00, plus closing costs.
