INVOCATION AND PLEDGES OF ALLEGIANCE TO THE FLAGS OF THE UNITED STATES AND STATE OF TEXAS. Councilmember Fowler gave the invocation followed by the Pledges of Allegiance to the Flags of the United States and State of Texas. Mayor Baldwin welcomed everyone this evening. Mayor Baldwin stated that the first item this evening is the City Events. CITY EVIiaNTS Announcements of upcoming City Events (D. Harris/J. Bierschwale} Mayor Baldwin recognized Assistant City Manager David Harris who provided the following announcement: • Trunk or Treat, October 31, 2011, fiom 6:00 p.m. to 8:00 p.m. at Pickrell Park. Assistant City Manager David Harris introduced and welcomed the new Economic Development Director David Gwin. Mr. Haxi•is stated that Mr. Gwin comes to us fiom the City of College Station; prior to that he was in Carrollton. Mr. Gwin has 20 years of experience in the industry. Mr. Gwin came forward thanking the City for the warm welcome and is anxious to get started working with the City and Community. Mayor Baldwin moved the presentation item to after the workshop. Hearing of Residents 10-25-2011 l~iinutes Mayor Baldwin announced that this is your opportiuiity to speak regarding the Pulte issue. He stated that when we get to the workshop item, all discussion will be between Council, Staff, and representatives from Pulte. Mayor Baldwin recognized the following who spoke: Ms. Maggie Titterington, President of the Schertz Chamber of Commerce, who provided updated info~•rnation regarding the Chamber. (L. Dublin/J. Bierschwale) This item was placed on the agenda by Mayor and Council at the meeting of September 20, 20.11. Mayor Baldwin recognized Engineer Larry Dublin who introduced this item stating that several meetings have been held with the City and representatives fiom Pulte to discuss the problems residents are having in the Fairhaven Subdivision. Mr. Dublin stated that in those meetings Pulte indicated a timeline that has been furnished to the Council along with infoi7nation regarding the meetings Pulte has had with the residents. Mr. Dublin stated that during one of the meetings with Pulte it was encouraged to have meetings with the HOA and residents to have further discussions. The City met with Ms. Taylor on October 11, 2011, and discussed her issues again and was trying to facilitate meetings with all parties concerned. Mr. Dublin stated that the City met again with Pulte today, October 25, 2011, as an on going discussion to bring out the residents' issues and to work on facilitating a meeting. Mr. Dublin further mentioned to Pulte that many residents would be at the IO-25-201.1 minutes Page - 2 - Council meeting to speak regarding their issues and concerns. Mr. Dublin stated that three representatives from Pulte, Mr. Jason Bastoni, Mr. Warren Darnell, and Mr. Richard Mott are here this evening to address the Council and address the concerns raised by the residents. Mayor Baldwin asked Mr. Dublin as an engineer, what is the problem with the settling and the land? What it not properly accessed as to the type of soil or soil conditions? Mr. Dublin stated that he hasnot seen the raw data. He stated that generally when a developer goes into a subdivision they do geotechnical reports. He stated that what he does know is all of the slabs were engineered by xegistered professionals. The designs were accomplished in accordance with the generally accepted practices, which was required as part of our permitting process. He has talked to the geotechnical engineer and the structural engineer that Pu1te was using to come up with a solution as a French drain behind the subdivision, as discussed earlier to stabilize the water. Mr. Dublin stated that there is an unusual situation in that area with ground water on top of the hill. He stated that with the installation of French drains it has helped in mitigate the water. He stated that this is natural water that percolates through the lenses of the area. it is not common, but he has in his career seen it three or four times in developments, particularly in hills. Mr. Dublin stated that he could not answer the Mayor's question defuutively. Mr. Dublin stated that slabs are designed to compensate for issues such as these and are designed to float. There are allowances for some cracks. He stated that any house you go in and pull up the carpet you will fmd has some cracks in the slab, if they don't grow or migrate, engineering doesn't feel they are a big problem. But if they grow and continue to migrate and if they widen, then that creates problems. This can sometimes happen with these types of expansion soils. Mayor Baldwin recognized Councilmember Edwards who asked Mr. Dublin in his best estimation does he believe that Pulte is standing behind their product and doing the very best they can. Mr. Dublin stated that from what he knows and what he sees, Pulte has given them the information. It appears to him that they are trying to represent and trying to address everyone's concerns. He will allow members from Pulte to actually address his question. Mr. Edwards asked when the site work that is currently going on behind the subdivision is completed, would Pulte go back and address the residents? Mr. Dublin stated that Pulte has hired a third party independent engineering firm to approach this problem and to affect a solution. He is familiar with them and they are familiar with all the individuals. They have engaged to do this work and they are highly respected in the industry. He stated that he has discussed with them their thoughts and their process in coming up with a solution and it appears to him to be a logical solution. Will things stabilize with the installation of the French drain? Time will tell. This is not something that you get immediate gratif cation, it takes a while to stabilize. Mayor Baldwin recognized Mayor Pro-Tem Fowler who addressed issues on shifting, cracks, and was the design and construction not completed properly? Mr. Dublin indicated he could not comment again as he has not seen the raw data. Mr. Dublin indicated that there are problems that have occurred in the area due to the extreme drought conditions causing clay expansion problems. He stated that these problems exist in some of the roads that have been newly built due to the underlying soils and the moisture coming out. He stated that engineers design slabs to move in conditions such as these, but sometimes there are extreme weather condirtions that cause problems. 10-25-2o111Vlinutes Page - 3 - Mayor Baldwin recognized Councilmember Scagliola who asked would it be beneficial to Mr. Dublin to have the geotechnical plans from the previous sites that were done. Mr. Dublin indicated he would benefit from the data sa that he could know what was going on. It would only be speculation on his part, and that is exactly what he would be doing. Mayor Baldwin introduced Mr. Lauren Darnell, Division President for Pulte Homes in SchertzlSan Antonio who came forward stating that he appreciated the opportunity to come and speak. He thanked the residents of Fairhaven who have come out and expressed their concerns. Mr. Darnell stated that they do not take lightly the respansibilit_y that the homeowners place on them. Pulte has a long history of building quality neighborhoods in Schertz and stands behind their homeowners that commitment has not changed. There have been several comments this evening and reflecting on the Council's comments at the meeting in September, they met with staff, and tonight he wants to clear up concerns with general warranty questions. Mr. Darnell addressed concerns with the work being done behind Columbia, stating that this work was prompted because several of the homeowners in that area were experiencing issues with their homes, most noticeably with separation in their foundations and driveways. Pulte went out avid hired a third party geotechnical engineering firm and hired a third party structural engineer to come out and actually analyze each of these homes, put together a report, and provided those reports to the homeowners, so that they could see it. Ultimately we wanted their guidance and to follow their recommendations an what the appropriate steps are to take, and to ultimately get to the root cause. One of the things that came to light was through that testing; they noticed there was subsurface water in that area. We know that this past summer we went through one of the worst droughts experienced in decades, so that obviously seemed highly irregular. Therefore, Pulte put together a plan as they are installing additional drainage in that area to insure that water is being conveyed away, just as a safety measure. This plan was presented to staff for their comments for an appropriate plan. He indicated that they tried to get the ward out to those that were affected in those areas. He apologized to them that when you have large equipment out you will be having dust and house shaking issues and they should be done within a couple of weeks. After they are completed with the project, they will begin to revegetate the area. The other concern he heard as he reviewed the minutes had to do with overall foundation issues and communication: He stated that Vice President of construction Jason Bastoni will address these concerns. Mr, Darnell further clarified that as Mr. Dublin Hated in this part of town we have expansive soils, which basically works like a sponge. When it dries out, it contracts. When it gets wet, it swells. Our foundations are not designed to absorb that movement; they are designed to actually move along with the ground. We build post tension foundations and they are designed to do that. They also take the geotechnical data that they gather out in the community and design the Foundations to accommodate those soil conditions. Mayor Baldwin recognized Mr. Bastoni, who came forward stating that shortly after moving to San Antonio, he was made aware of the situation in Fairhaven. He personally got involved in early March. He stated he has been communicating .with the homeowners that had brought to their attention that there were problems. Mr. Bastani stated that he contacted them and stated that he was new to the area and was going to get involved and develop a plan to understand what was going on. In later March, he 10-25-20ll Minutes Page - 4 - communicated that they had hired a third party geotechnical engineer to come out and start doing soil testing, as well as find a third party structure engineer, separate from the engineer that designed their home and one that was a soils expert. ' He also stated that he was going to move an employee into the area to be a liaison for the community that would f x any issues that the homeowners would address. Mr. Bastoni stated that he contacted everyone back in early May and gave them a plan. They were going to move forward and test the sail. They will be moving through the community and communicating with homeowners who have addressed their concerns. He has written a few names down this evening that he has not met with, who he will be addressing, He stated that in early June through September he met one on one with each homeowner and took the engineer with him to explain what was going on and what he recommended Pulte do. Some cases were to stop watering. Some cases were to water more. Some cases they asked them to be more patient and wait for the result. He stated again, they do stand behind their product and empathize with them. It is not a fun thing to go through, and it is not something they look forward to dealing with. Mayor Baldwin recognized Mayor Pro-Tem Fowler who asked are the problems the residents are having a Localized area on Columbia, or is it widespread in the subdivision? Mr. Bastoni stated na, it is not just Columbia. There are issues on Storm King, issues on Columbia, and issues within the community, It is not in a centralized area. Mayor Baldwin stated that you sent out the engineering reports to the homeowners, but that some are indicating they did not received them. Did you in fact send the reports to those that complained about their issues? Mr. Bastoni stated that he believes they are talking about two different things. He clarif ed the engineering report was lane specifically to the homes with the individuals he met with. Yes they did provide those reports. Mayor Baldwin stated he has lived in Scheriz for 45 years. He has seen every subdivision built since 1967 in one way or another. He does not know of any other subdivision #hat has this problem. He remembers when Northcliffe was built. He was the Tax Assessor Collector at that time. He remembers the foundations were cracking and same of the walls and bricks were separating, but not to the extent of the residents in Fairhaven. Mayor Baldwin asked, what is the solution? Do you have a cure for the residents, so that they feel they can retain the value of their homes? Mr. Darnell stated yes, that is why they brought in third party engineers to give them recommendations, and they will follow those recommendations. Mayor Baldwin stated that he would have felt a lot better if they would have brought an engineer with them this evening, especially the engineer who designed their project, so he could have answered the questions he had. Mayor Baldwin stated that it was not a secret about the clay in Texas. Everyone knows it is very expansive. He has never heard of some of the things the residents are talking about. There are subdivisions neighboring Fairhaven that do not have these problems. They haven't heard any complaints such as expansive soils, slabs breaking, or utility plumbing lines breaking in the house. Mr. Darnell clarified that they talked about foundation cracking. He uses the analogy of tension foundation as is like a canoe in water; they don't want it to be like a blow up raft, that's when a foundation fails. If it is maintaining its consistency being able to move up and down, it has not failed. Mr. Bastoni indicated, the third party engineers were brought and basically we have one foundation that has been considered to have failed and they are addressing that with the homeowner directly. Mr. Darnell explained how the. french drain 10-25-2011 Minutes Page - 5 - will be used in handling the problem. He s#ated a portion will be used as a subsurface drainage system that conveys the water from one area to the next. The other portion was a different design system that is more significant. It utilizes gravel to convey the water through that area. They worked with the City to get this project permitted to ensure that the subsurface water that they discovered was being conveyed away from the area. The other point he wanted to clarify is some residents expressed concern on the retaining walls in the area. The wall was designed and built by a third party. An engineer came out a year and a half later and re-inspected the wall to insure that it is performing per design; and it is. Pulte is committed to working with homeowners on theix individual concerns; they are not going anywhere, and stand behind theix homes and community. Mayor Baldwin recognized Councilmember Edwards who stated that as leaders they are abnormal and cut through the cloudy and murky issues and pass that information along. They tend to be rivers and not reservoirs and not hold information back. His question is about predevelopment. You mentioned earlier that you found water and you thought that was unusual. You found it in the middle of a drought. During the predevelopment phase, were core samples taken? Mr. Darnell stated yes. Mr. Edwards asked was that when they found the water? Mr. Darnell stated that no. They do geotechnical borings before they develop it. When they went back in looking into this, these conditions were not discovered initially. This problem was uncovered in the spring. The individual that has moved into the community has been available to address the residents. If the complaint is above his expertise, he wlll bring it to the attention of Mr. Bastoni. Councihmember Edwards stated that he has been in Schertz for eight years and they have been put in the position to protect the vision of Schertz. Schertz has a vision. He wants to know right now, in front of everyone, are you going to stand behind your product 100%? That is what the City expects. Mr. Darnell answered, yes; they issue a ten year warranty to the residents and will stand by this wholeheartedly. Councilmember Edwards stated that by the shaking of the heads this evening, he believes that they do not feel confident. You need to have more meetings one on one with the citizens. Meet with our engineer and make yourselves mote accessible. We are open books in Schertz and we want this taken care o£ He doesn't want the public to see Schertz as the community that everything has gone array. Mayor Baldwin stated that Schertz has a great reputation for homebuilding. We are well known for the quality of construction and the housing. We have subdivisions in Schertz built by Pulte. We have a reputation to protect. Pulte has a reputation to protect. When you go down, Schertz goes down. Then we get the reputation of building inferior homes that don't stand up to the clays and shifting soils in Texas. We are looking to you to resolve the issues and make the homeowners happy. This is going to be on the news this evening, and this is the type of information #hat hurts the City. Mayor Baldwin recognized Councilmember Antuna who thanked everyone from the Fairhaven Subdivision and from Pulte that came out this evening. He too, has lived in Texas all his life and has had several homes within the San Antonio area; he understands the type of soils and the challenges. He stated tha# he knows there are portions of the State that should not be developed. The soil can not handle some of the construction. Knowing what you know now, he is wondering if this area should have ever been developed. With all the geotechnical data and studies they have done, would you Mr. Developer have 10-25-20ll Minutes Page - 6 - developed that; and Mr. Builder, would you have built a home on tha# site? Mr. Darnell stated that he doesn't want to be evasive, but they are still trying to get to the bottom of that and can not give him an accurate answer. Mr. Darnell stated that was an unfair question. Councilmember Antuna stated that he has a serious doubt that a PE would sign off on a project, knowing there was surface water. He hopes that Pulte can rectify the situation; we have a reputation to protect. Mayor Baldwin recognized Mayor Pro-Tem Fowler asked that once you do your geotechrucal plan and you know there are some sand lenses in the ground, once you really get a handle on the geography that is underneath, would you be willing to bring that forth to the community what the exact situation is. Mr. Darnell stated Pulte is trying to get to the root of the cause and fix i# once and have everyone go on with their lives. Mayor Baldwin recognized Councilmember Scagliola who stated that they have talked a lot about reputation and how important that it is far both Schertz and Pulte to maintain. He stated that they have spent an enormous amount of time fixing the symptoms of the problem, but f xing the symptoms of the problem does not really f x the problem. Fixing the problem fixes the symptoms. Are there 40 or so residents with significant complaints or are these the only ~0 that showed up tonight? Ts this the tip of the iceberg? There are 325 homes. How many complaints has Pulte received in that subdivision? Mr. Darnell stated that from his perspective no, it is not the tip of the iceberg, but the reason they have hired the engineers. They have to get to the root cause. They do not want to fix the symptoms; they want to f~ the root cause. Councilmember Scagliola stated that definitely communication is the process. Next is to develop a mitigation plan, learn from your mistakes, and make sure they are not repeated. Secondly, correct the existing problems. Does Pulte have a schedule to fix the problems? What can the residents expect in the next three months etc.? Mr. Darnell indicated that Mr. Bastoni has been working with the complaints they know about, and have had some residents this evening come to them. They will be working with them as well to get a plan together and get their issues resolved. They are sensitive to the reputation the City is trying to protect, and the vision you are trying to achieve. They do not take that lightly. They have a reputation to protect as well. Mayor Baldwin recognized Councilmember Carpenter who stated when things go wrong and a business is challenged, in good companies it is an opportunity. This is when heroes are made, this becomes an opportunity, an opportunity to remediate the issues, to win the trust of the residents and of the people on the dais, and win the trust of the market. Those companies who fix problems when things like this come up stand out above those that do not. You have an opportunity here, if you are to remediate it with each and every one of the homeowners, to become what he would classify as "referenceable account". People will speak well of you, if you are able to pull that off, but lets be clear, the work that is to be done belongs to Pulte. The burden lies on you. The Residents will watch with great interest and lots of communication. We will become a burden on you, if you do not fix it. The residents will come back before us and let us know how things are progressing. We will go out and drive in the neighborhood and we will see how things are going. Make yourselves a referenceable account; win the trust of the residents and the individuals on the dais. 10-25-207.2 Minufes page _ ~ _ Mayor Baldwin recognized City Manager John Kessel wha stated that he appreciates the citizens' attendance. We are a community, This is a place where you can come and bring issues forth. We aze here; we have heard your concerns. We have met with Pulte on several occasions and will continue to do so. The issue for us right now, from a City perspective, is to create that dialog and insure that the citizens are being heard and their issues resolved in a meaningful way. He proposes to the Council that they would come back every other month with a report and update to Council on the progress of how Pulte is addressing the problems and hopes that Pulte will attend. We will continue this dialog and no# let it fall by the wayside. Mr. Kessel stated that to the citizens, as well as to Pulte, we have a lot of mutual :interests; no one wants to see the neighborhood not thrive. We are looking for meaningful results. We are going to have to work very hard from today to accomplish this. The City is committed to do their part to help in that process. The citizens will continue to participate. The Council Chambers and other City facilities are the community's facilities where we can host those meetings. He has heard a commitment from Pulte and hears one more time that they would commit to come back regulazly to get these problems resolved to everyone's satisfaction. Mr. Darnell stated they are committed to making sure they are getting things resolved. Mayor Baldwin recognized City Attorney Michael Spain who stated that since there are residents here tonight, we will want to work out the best way to get the word out to everyone as to when those meetings will be held, Mayor Baldwin indicated that the City could contact Ms. Diana Taylor and she would get the word out. Mayor Baldwin thanked the representatives from Pulte who came out this evening and for standing up to the heat. These problems affect everyone and we really want to work together, Mayor Baldwin also thanked the residents for coming this evening and invited them to come back anytime to speak under hearing of residents. He reminded them to take photos of their problems to the Tax Assessors Collectors office, and show it to them to get your taxes discounted. Mayor Baldwin took a five minute recess to allow the audience to break up. Mayor Baldwin recognized Ms, Cari Baker Wells, Ms. Wells introduced Mr. Ronald Rocha and Ms. Matti Gatlin and daughter McKinsey of Linebazger Goggan Blair & Sampson, LLP, who were ' in the audience this evening. Mayor Baldwin indicated that the Council will consider items 1, 4, and 5 on consent and asked for a motion to do so. Discussion and/or Action Ttems 1. Resolution No. 11-R-47 -Consideration and/or action approving a resolution authorizing an Ambus Project Agreement with Southwest Texas Regional Advisory Council. (D. Veliz/S. Pulaski) Mayor Baldwin recognized Councilmember Edwards who moved, seconded by Councilmember Antuna to approve items 1, 4, and 5 an consent. The vote was unanimous. Motion carried. Mayor Pro-Tem Fowler left at 8: 00 p.m. 2. Ordinance No. 11-5-31 - ZC20ll-009 -Consideration and/or action approving an ordinance upon a request to rezone approximately 121.97+/- acres of land known as Pride Rock Ranch from Pre-Development {PRE) to Planned Development District (PDD). The property is generally located 2,800 linear feet east of intersection of FM 1 S 1 S and Lowex Seguin Road. Final Reading (J. Kessel/M. Sanchez) Mayor Baldwin recognized Development Services Director Michelle Sanchez who stated that Council will consider and act upon a request from Todd Burek of Croton Properties, to rezone approximately 122 acres of land lrn~own as Pride Rock Ranch from Pre-Development to Planned Development, The property is generally located 2,800 feet east of the intersection of F.M. 1518 and Lower Seguin Road. The developer submitted an application for a master plan prior to the City's annexation on April 19, 2011. The site is proposed to be developed in seven phases and consists of 547 residential lots with a 6 acre private park and two points of access to Ray Corbett Drive and Lower Seguin Road. The site has been reviewed and approved by City staff and complies with Schertz Unified Development Code. Council voted unanimously at the October 18, 2011, meeting to rezone the property. No Fiscal impact and recommends approval of final reading. Mayor Baldwin recognized Councilmember Carpenter who expressed his desire to make sure the developer meets with the residents. Mayor Baldwin recognized Councilmember Scagliola who stated that as he understands there are deals in the works that the owners might change and the developers might change as well. Mayor Baldwin recognized City Attorney Michael Spain who came forward indicating that was true, there is a contract in place and the party who would be buying the property has agreed to the same terms as the previous owner. Councilmember Scagliola stated that we still have the opportunity of lines of communication open up to us and wants this subdivision to be something that we can be proud of and if we keep the lines of communication open, that can be accomplished. Mayor Baldwin recognized Councilnember Antuna who moved, seconded by Councilmember Carpenter. to approve Ordinance No. 11-S-31 final reading. Yote was unanimous. Motion carried. 3. Ordinance No. 11-D-32- Consideration and/or action approving an Ordinance amending the speed Iimit an Hillbroak Drive to 20 mph and revising the Code of Ordinances of the City of Schertz, Texas, by amending and revising Section 86-115, Maximum Limits generally on .specific streets; and providing a repealing clause. Resolution No. 11-R-49 -Consideration and/or action approving a resolution authorizing a memorandum of understanding with the San Antoztio River Authority (SARA) acknowledging that SARA will be an authorized LOMAR Delegation for the Federal Emergency Management Agency (FEMA) to review all Conditional letters of map revisions (CLOMRs) and Letter of map revisions (LOMARs) submitted for properties located in the City of Schertz that are located in Bexar County. Willoughby/J, Hooks) Mayor Baldwin recognized Pubic Works Superintendent Jimmy Hooks who came forward to introduce this item, Mayor Baldwin recognized Councilmember Edwards who stated that it is absolutely important that we maintain a working relationship with the San Antonio River Authority (SARA) and there is no impact to the City and it is important that we do this. Mayor Baldwin recognized City Manager John Kessel who stated that he wanted to thank the SARA representatives who were here tonight, He stated that this is the first of two agreements that we hope to move forward as well as some continued partnerships particular as it relates to then entire watershed. He stated that SARA has been a fantastic group to reach out to us and we are reaching back and looking for additional partnerships in the future. Mayor Baldwin recognized Councilmember Edwards who moved, seconded by Councilmember Carpenter to approve resolution No. 11-R-49. The vote was unanimous. Councilmember Edwards also thanked staff for the recent open house for the newly annexed residents. 11.
