The Schertz Board of Adjustment convened on October 24, 2011 at 6:00 p.m. at the Municipal Complex,
Council Chambers, 1400 Schertz Parkway Building #4, Schertz, Texas.

1. CALL TO ORDER/ROLL CALL

Mr. Hartzog called the regular meeting to order at 6:00 pm. The Chairman recognized all members present
and introduced Mr. Dziewit as a voting member of the Board and welcomed Mr. Reynolds as the new
Alternate appointed to the Board.

No action required.

5. MINUTES:
A. Regular Meeting - February 24, 2011
Mr. McElroy moved to approve the minutes. Mr. Montgomery seconded the motion. Vote was unanimous.

Ms. Sanchez made the following announcements:
• Activity report provided
• UDC updated in May 2011 and copy provided to each Board Member

A. BOA 2011- 002 5000 Schertz Parkway
Hold a public hearing, consider and act upon a variance to Article 11, Section 21.11.12 Multi-tenant
Signs, to allow aMulti-tenant sign to exceed the maximum number of signs permitted by one (1) at
5000 Schertz Parkway.
Public hearing opened at 6:18 pm.
Ms. Sanchez gave a short presentation on the variance request which included the following: the general
location of the lot, the Unified Development Code (UDC) regulations related to amulti-tenant monument sign
and the properly owners ability to comply with regulation by platting the property into two lots, which would
allow them to have two signs. The public hearing notices were published and mailed with fourteen (14)
responses received including: two (2) in favor, zero (0) neutral and one (1) opposed.
Mr. Hartzog recognized the following to speak:
• Mr. Birmingham, property owner, commented on the proposed sign and his concerns with the safety
related to the existing sign. He was proposing the second sign to help alleviate traffic from the
current entrance.
There being no one else to speak the public hearing closed at 6:27 pm.
Mr. Dziewit commented on the traffic safety with regard to the existing drive.
Mr. Birmingham responded with more information related to the existing drive and traffic complaints.
Mr. Montgomery asked if the complaints were documented by a traffic study or feedback.
Mr. Birmingham responded by stating the complaints have been verbal.
Mr. Montgomery asked the applicant why he does not plat the property in two lots.
Mr. Birmingham stated it was a cost issue.
Mr. Hartzog commented on the ownership of the buildings.
Mr. Slocum asked Mr. Birmingham if the City caused the hardship.
Mr. Birmingham responded yes.
Mr. Montgomery commented on that this request was for a sign variance not traffic.
Mr. McElroy asked Mr. Birmingham about his comment that the hardship was created by the City.
Mr. Birmingham responded that the hardship was safety.
Mr. Hartzog commented on the Design Engineers responsibility on the placement of the sign and
consideration of safety.
Mr. Dziewit commented that the existing sign maybe located in the wrong location.
Mr. Birmingham stated that the sign cost $17,000 and would be expensive to move.
Discussion followed between the Board, staff and the applicant regarding median cuts, safety and the location
of the sign.
Mr. Slocum asked for staff recommendation.
Ms. Sanchez responded with the recommendation of disapproval because the applicant has the option to plat
the property into two (2) lots and the two lots would give them the ability to place one (1) sign per site.
Mr. McElroy moved to disapprove the variance request and stated that other remedies exist to have a second
sign on the property. Mr. Slocum seconded the motion. Vote unanimous. Motion carried.

Mr. Dziewitt, Mr. Reynolds and Mr. Slocum commented on theirs attendance at the Planning Charette.
Mr. Hartzog reminded Members of reappointments and asked all members to attend the November 29,
2011 City Council meeting where members will be appointed/reappointed.
