ORDINANCE NO. 06-E-05
AN ORDINANCE CALLING A BOND ELECTION TO BE HELD IN THE
CITY OF SCHERTZ, TEXAS; CONTRACTING WITH THE ELECTIONS
ADMINISTRATOR OF GUADALUPE COUNTY TO CONDUCT THIS
ELECTION; RESOLVING OTHER MATTERS INCIDENT AND
RELATED TO SUCH ELECTION; AND PROVIDING AN EFFECTIVE
DATE

WHEREAS, the City Council (the Council) of the CITY OF SCHERTZ, TEXAS (the
City) hereby finds and determines that an election should be held to determine whether the
Council shall be authorized to issue general obligation bonds of the City in the amounts and for
the purposes hereinafter identified; and
WHEREAS, the Council hereby finds and determines that it is in the best interests of the
City to enter into an agreement with the Elections Administrator of Guadalupe County (the
Guadalupe County Elections Administrator) to conduct all aspects of this bond election in
accordance with the laws of the State of Texas (the State) and applicable federal laws; and
WHEREAS, the Council hereby finds and determines that the necessity to construct
various capital improvements within the City necessitates that it is in the public interest to call
and hold a bond election at the earliest possible date to authorize the issuance of general
obligation bonds for the purposes hereinafter identified; and
WHEREAS, the Council hereby finds and determines that this action is in the best
interests of the citizens of the City; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
THAT:
SECTION 1. An election shall be held on the 13th day of May, 2006, a uniform election
date, in the CITY OF SCHERTZ, TEXAS, which date is not less than sixty two (62) days nor
more than ninety (90) days from the date of the adoption of this ordinance (the Ordinance), for
the purpose of submitting the following propositions to the qualified voters of the City:
PROPOSITION NO. I
"Shall the City Council of the City of Schertz, Texas be authorized to issue and
sell general obligation bonds of the City in the principal amount of $6,000,000 for
the purpose of making permanent public improvements, or for other public
purposes, to wit: constructing and equipping a new library facility and the
purchase of land relating thereto; such bonds to mature serially or otherwise not
more than forty (40) years from their date; and any issue or series of said bonds to
bear interest at such rate or rates (fixed, floating, variable or otherwise) as may be
determined within the discretion of the City Council, provided that such rate of

interest shall not exceed the maximum rate per armum authorized by law at the
time of the issuance of any issue or series of said bonds; and shall the City
Council of the City be authorized to levy and pledge, and cause to be assessed and
collected, armual ad valorem taxes, within the limitations prescribed by law, on all
taxable property in said City sufficient to pay the armual interest and provide a
sinking fund to pay the bonds at maturity?"
PROPOSITION NO.2
"Shall the City Council of the City of Schertz, Texas be authorized to issue and
sell general obligation bonds of the City in the principal amount of $7,500,000 for
the purpose of making permanent public improvements, or for other public
purposes, to wit: constructing and equipping a new recreation center and the
purchase of land relating thereto; such bonds to mature serially or otherwise not
more than forty (40) years from their date; and any issue or series of said bonds to
bear interest at such rate or rates (fixed, floating, variable or otherwise) as may be
determined within the discretion of the City Council, provided that such rate of
interest shall not exceed the maximum rate per armum authorized by law at the
time of the issuance of any issue or series of said bonds; and shall the City
Council of the City be authorized to levy and pledge, and cause to be assessed and
collected, armual ad valorem taxes, within the limitations prescribed by law, on all
taxable property in said City sufficient to pay the armual interest and provide a
sinking fund to pay the bonds at maturity?"
PROPOSITION NO.3
"Shall the City Council of the City of Schertz, Texas be authorized to issue and
sell general obligation bonds of the City in the principal amount of $20,000,000
for the purpose of making permanent public improvements, or for other public
purposes, to wit: constructing street, curb, and sidewalk improvements (including
utility relocation) and drainage incidental thereto and the purchase ofland relating
thereto; such bonds to mature serially or otherwise not more than forty (40) years
from their date; and any issue or series of said bonds to bear interest at such rate
or rates (fixed, floating, variable or otherwise) as may be determined within the
discretion of the City Council, provided that such rate of interest shall not exceed
the maximum rate per armum authorized by law at the time of the issuance of any
issue or series of said bonds; and shall the City Council of the City be authorized
to levy and pledge, and cause to be assessed and collected, armual ad valorem
taxes, within the limitations prescribed by law, on all taxable property in said City
sufficient to pay the armual interest and provide a sinking fund to pay the bonds at
maturity?"

sell general obligation bonds of the City in the principal amount of $4,000,000 for
the purpose of making permanent public improvements, or for other public

purposes, to wit: constructing drainage improvements and the purchase of land
relating thereto; such bonds to mature serially or otherwise not more than
forty (40) years from their date; and any issue or series of said bonds to bear
interest at such rate or rates (fixed, floating, variable or otherwise) as may be
determined within the discretion of the City Council, provided that such rate of
interest shall not exceed the maximum rate per armum authorized by law at the
time of the issuance of any issue or series of said bonds; and shall the City
Council ofthe City be authorized to levy and pledge, and cause to be assessed and
collected, armual ad valorem taxes, within the limitations prescribed by law, on all
taxable property in said City sufficient to pay the armual interest and provide a
sinking fund to pay the bonds at maturity?"
PROPOSITION NO.5
"Shall the City Council of the City of Schertz, Texas be authorized to issue and
sell general obligation bonds of the City in the principal amount of $1,500,000 for
the purpose of making permanent public improvements, or for other public
purposes, to wit: constructing and equipping new athletic fields and related
facilities; such bonds to mature serially or otherwise not more than forty (40)
years from their date; and any issue or series of said bonds to bear interest at such
rate or rates (fixed, floating, variable or otherwise) as may be determined within
the discretion of the City Council, provided that such rate of interest shall not
exceed the maximum rate per armum authorized by law at the time of the issuance
of any issue or series of said bonds; and shall the City Council of the City be
authorized to levy and pledge, and cause to be assessed and collected, armual ad
valorem taxes, within the limitations prescribed by law, on all taxable property in
said City sufficient to pay the armual interest and provide a sinking fund to pay
the bonds at maturity?"
SECTION 2. Pursuant to Section 61.012, as amended, Texas Election Code, the City
shall provide at least one accessible voting system in each polling place used in the election.
Such voting system shall comply with Texas and federal laws establishing the requirement for
voting systems that permit voters with physical disabilities to cast a secret ballot. Touch screen
machines shall be used for early voting and election day voting by personal appearance. Certain
early voting may be conducted by mail. The County shall also utilize a Central Counting Station
(the Station) as provided by Section 127.001, et seq., as amended, Texas Election Code. lR.
Perez has been appointed as the Manager and Lisa Adam has been appointed as the Presiding
Judge of the Station and she may appoint Station clerks and establish a written plan for the
orderly operation of the Station in accordance with the provisions of the Texas Election Code.
The County has appointed John Bumguardner as the Tabulation Supervisor and Lisa Adam as
the Programmer for the Station. Lastly, the County will publish notice and conduct testing on
the automatic tabulation equipment relating to the Station and conduct instruction for the
officials and clerks for the Station in accordance with the provisions of the Texas Election Code.
SECTION 3. The City election precincts established for this election shall be the
precincts disclosed on Exhibit A attached hereto. A list of the City election precincts, the County
election precincts, and the polling places designated for each such election precinct are identified

on Exhibit A to this Ordinance, and this Exhibit is incorporated by reference for all purposes. At
least 63 days prior to the scheduled election date, the Council, in coordination with the
Guadalupe County Elections Administrator, will identify and formally approve the appointment
of the Presiding Judges, Alternate Presiding Judges, Election Clerks, and all other election
officials for this election or will use the election officials recommended for approval by the
Guadalupe County Elections Administrator as reflected in the election agreement between the
City and the Guadalupe County Elections Administrator.
Each Presiding Judge shall appoint not less than two (2) resident qualified voters of the
County to act as clerks to properly conduct the election. However, if the Presiding Judge
appointed actually serves, the Alternate Presiding Judge shall serve as one of the clerks. The
appointment of such clerks may include a person fluent in the Spanish language to serve as a
clerk to render oral aid in the Spanish language to any voter desiring such aid at the polls on the
day of the election. In the absence of the Presiding Judge named above, the Alternate Presiding
Judge shall perform the duties of the Presiding Judge.
The election shall be held in the City as prescribed by applicable law and on the day of
the election, the polls shall be open from 7:00 o'clock a.m. to 7:00 o'clock p.m.
The Guadalupe County Office Building, 1101 Elbel Road, Schertz, Texas 78154, is
hereby designated as the main early voting place at which early voting shall be conducted. J.R.
Perez, the Elections Administrator of Guadalupe County (whose mailing address is Post Office
Box 1346, Seguin, Texas 78156) is hereby appointed as the Early Voting Clerk to conduct such
early voting in the election. The Early Voting Clerk shall appoint not less than two (2) Deputy
Early Voting Clerks in accordance with the provisions of the Texas Election Code. Early voting
shall be conducted at the Guadalupe County Office Building, 1101 Elbel Road, Schertz, Texas
78154 from May 1, 2006 through May 9, 2006, with the exception of Saturdays, Sundays, and
official State holidays. The hours for early voting shall be from 8:00 a.m. to 8:00 p.m. on May 8,
2006 and May 9, 2006, and from 8:00 a.m. to 5:00 p.m. on all other early voting days.
Applications for ballots by mail must be received by the Early Voting Clerk not later than the
close of business on May 5, 2006.
An Early Voting Ballot Board is hereby established for the purpose of processing early
voting results. Missy Doss is appointed the Presiding Judge of the Early Voting Ballot Board.
The Presiding Judge shall appoint not less than two (2) nor more than ten (10) resident qualified
voters of the County to serve as members of the Early Voting Ballot Board.
SECTION 4. The official ballots shall be prepared in accordance with the Texas Election
. Code, as amended, so as to permit voters to vote "FOR" or "AGAINST" the aforesaid
propositions which shall appear on the ballot substantially as follows:

SECTION 5. All resident qualified voters of the City shall be permitted to vote at the
election and on the day of the election, such voters shall vote at the designated polling place.
The election shall be held and conducted in accordance with the provisions of the Texas Election
Code, as amended, Chapter 1331, as amended, Texas Government Code, and the City's Home
Rule Charter and as may be required by any other law. All election materials and proceedings
shall be printed in both English and Spanish.
SECTION 6. A substantial copy of this Ordinance shall serve as a proper notice of the
election. This notice, including a Spanish translation thereof, shall be posted at three (3) public
places within the City and at the City Hall not less than fifteen (15) days prior to the date the
election is to be held, and be published on the same day in each of two (2) successive weeks in a
newspaper of general circulation in the City, the first of these publications to appear in such
newspaper not more than thirty (30) days, and not less than fourteen (14) full days prior to the
day of the election.
SECTION 7. The Council authorizes the City Manager, or his designee, to negotiate and
enter into an election agreement with the Guadalupe County Elections Administrator in
accordance with the provisions of the Texas Election Code. The rate of pay for all election
officials shall be established in this election agreement.
SECTION 8. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Ordinance for all purposes and are adopted as a
part of the judgment and findings of the Council.

SECTION 9. All ordinances and resolutions, or parts thereof, which are in conflict or
inconsistent with any provision of this Ordinance are hereby repealed to the extent of such
conflict, and the provisions of this Ordinance shall be and remain controlling as to the matters
ordained herein.
SECTION 10. This Ordinance shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
SECTION 11. If any provision of this Ordinance or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Ordinance and the application
of such provision to other persons and circumstances shall nevertheless be valid, and this
Council hereby declares that this Ordinance would have been enacted without such invalid
provision.
SECTION 12. It is officially found, determined, and declared that the meeting at which
this Ordinance is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Ordinance, was
given, all as required by Chapter 551, as amended, Texas Government Code.
SECTION 13. Pursuant to the provisions of Section 1201.028, as amended, Texas
Government Code, this Ordinance shall be effective immediately upon adoption, notwithstanding
any provision in the City's Home Rule Charter to the contrary concerning a multiple reading
requirement for the adoption of ordinances.

rates (fixed, floating, variable or
otherwise) as may be deter-
mined within the discretion of
the City Council, provided that
such rate of interest shall not
exceed the maximum rate per
annum authorized by law at the
time of the issuance of any
issue or series, of said bonds;
and shall the City Council of the
City be authorized to levy and
pledge, and cause to be
assessed and collected, -annual
ad, valorem taxes, within the
limitations prescribed by law, on
all taxable property in said City
sufficient to pay the annual

fund to pay the bonds at maturi-

rized to levy and pledge, and
cause to be assessed and col-
lected, annual ad valorem
taxes, within the limitations pre-
scribed bylaw, on all taxable
property in said City sufficient to
pay the annual interest and pro-
vide a sinking fund to pay the
bonds at maturity?"
PROPOSITION NO.5
"Shall the City Council of the
City of Schertz, Texas be

$1,500,000 for the purpose of
making permanent public
improvements, or for other pub-
lic purposes, to wit: constructing
and equipping new athletic
fields and related facilities; such
bonds to mature serially or oth-
erwise not more than forty (40)
years from their date; and any
issue or series of said bonds to
bear interest at such rate or
rates (fixed, floating, variable or
otherwise) as may be deter-
mined within the discretion of
the City Council, provided that
such rate of interest shall not
exceed the maximum rate per
annum authorized by law at the
time of the issuance of any
issue or series of said bonds;
and shall the City Council of the
City be authorized to levy and
pledge, and cause to be
assessed and collected, annual
ad valorem taxes, within the
limitations prescribed by law, on
all taxable property in said City
sufficient to pay the annual
interest and provide a sinking
fund to pay the bonds at maturi-
ty?"
SECTION 2. Pursuant to
Section 61.012, as amended,
Texas Election Code, the City
shall provide at least one
accessible voting system in
each polling place used in the
election. Such voting system
shall comply with Texas and
federal laws establishing the
requirement for voting systems
that permit voters with physical
disabilities to cast a secret bal-
lot. Touch screen machines
shall be used for early voting
and election day voting by per-
sonal appearance. Certain early
voting may be conducted by
mail. The County shall also uti-
lize a Central Counting Station
(the Station) as provided by
Section 127.001, et seq., as
amended, Texas Election
Code. J.R. Perez has been
appointed as the Manager and
Lisa Adam has been appointed
. as the Presiding Judge of the
Station and she may appoint
Station clerks and establish a
written plan for the orderly oper-
ation of the Station in accor-
dance with the provisions of the
. Texas Election Code. The
County has appointed John
Bumguardner as the Tabulation
Supervisor and Lisa Adam as
the Programmer for the Station.
Lastly, the County will publish
notice and conduct testing on
the automatic tabulation equip-
ment relating to the Station and
conduct instruction for the offi-
cials and clerks for the Station
in accordance with the provh
sions of the Texas Election
Code.
SECTION 3. The City elec-
tion precincts .established for
this election shall be the
precincts disclosed on Exhibit A
attached hereto~ A list of the
City election precincts, the
County election precincts, and
the polling places designated
for each such election precinct
are identified on Exhibit A to
this Ordinance, and this Exhibit
is incorporated by reference for
all purposes. At least 63 days
prior to the scheduled election
date, the Council, in coordina-
tion with the Guadalupe County
Elections Administrator, will
identify and formally approve
the appointment of the
Presiding Judges, Alternate
Presiding Judges, Election
Clerks, and all other election
officials for this election or will
use the election officials recom-
mended for approval by the
Guadalupe County Elections
Administrator as reflected in the
election agreement between
the City and the Guadalupe
County Elections Administrator.
Each Presiding Judge shall
appoint not less than two (2)
resident qualified voters of the
County to act as clerks to prop-
erly conduct the election.
However; if the Presiding Judge
appointed actually serves, the
Alternate Presiding Judge shall
serve as one of the clerks. The
appointment of Such clerks may
. include a person fluent in the
Spanish language to serve as a
clerk to render oral aid in the

Spanish language to any voter
desiring such aid at the polls on
the day of the election. In the
absence of the Presiding Judge
named above, the Alternate
Presiding Judge shall perform
the duties of the Presiding
Judge.
The election shall be held in
the City as prescribed by
applicable law and on the day
of the election, the polls shall
be open from 7:00 o'clock, a.m.
to 7:00 o'clock p,m.
The Guadalupe County
Office Building, 1101 Elbel
Road, Schertz, Texas 78154, is
hereby designated as the main
early voting place at which early
voting shall be conducted, J.R.
Perez, the Elections Adminis-
trator of Guadalupe County
(whose mailing address is Post
Office Box 1346, Seguin, Texas
78156) is hereby appointed as
the Early Voting Clerk to con-
duct such early voting in the
election. The Early Voting Clerk
shall appoint not less than two
(2) Deputy Early Voting Clerks
in accordance with the provi-
sions of the Texas Election
Code. Early voting shall be con.
ducted at the Guadalupe
County Office Building, 1101
Elbel Road, Schertz, Texas
78154 from May 1, 2006
through May 9, 2006, with the
exception of Saturdays,
Sundays, and official State holi-
days. The hours for early voting
shall be from. 8:00 a.m. to 8:00
p.m. on May 8, 2006 and May
9, 2006, and from 8:00 a.m. to
5:00 p.m. on all other early vot-
ing days. Applic:ations for bal-
lots by mail must be received
by the Early Voting Clerk not
later than the close of business
on May 5, 2006.
An Early Voting Ballot Board
is hereby established for the
purpose of processing early
voting results. Missy Doss is
appointed the Presiding Judge
of the Early Voting Ballot Board.
The Presiding Judge shall
appoint not less than two (2)
nor more than ten (1 0) resident
qualified voters of the County to
serve as members of the Early
Voting Ballot Board.

SECTION 5. All resident
qualified voters of the City shall
be permitted to vote at the elec-
tion and on the day of the elec-
tion, such voters shall vote at
the designated polling place.
The election shall be held and
conducted in accordance with
the provisions of the Texas
Election Code, as amended,
Chapter 1331, as amended,
Texas Government Code, and
the City's Home Rule Charter
and as may be required by any
other law. All election materials
and proceedings shall be print-
ed in both English and Spanish.
SECTION 6. A substantial
copy of this Ordinance shall
serve as a proper notice of the
election. This notice, including a
Spanish translation thereof,
shall be posted at three (3) pub-
lic places within the City and at
the City Hall not less than fif-
teen (15) days prior to the date
the election is to be held, and
be published on the same day
in each of two (2) successive
weeks in a newspaper of gener-
al circulation in the City, the first
of these publications to appear
in such newspaper not more
than thirty (30) days, and not
less than fourteen (14) full days
prior to the day of the election.
SECTION 7. The Council
authorizes the City Manager, or
his designee, to negotiate and
enter into an election agree-
ment with the Guadalupe
County Elections Administrator
in accordance with the provi-
sions of the Texas Election
Code. The rate of pay for all
election officials shall be estab-
lishedin this election agree-
ment.
SECTION 8. The recitals
contained in the preamble here-
of are hereby found to be true,
and such recitals are-hereby
made a part of this Ordinance
for all purposes and are adopt-
ed as a part of the judgment
and findings of the Council.
SECTION 9. All ord,inances
and resolutions, or parts there-
of, which are in conflict or
inconsistent with any provision
of this Ordinance are hereby
repealed to the extent of such
conflict" and the provisions, of
this Ordinance shall be and
remain controlling as to the
matters ordained herein.
SECTION 10. This Ordi-
nance shall be construed and
enforced in accordance with the
laws of the State of Texas and
the United States of America.
SECTION 11. If any provi-
sion of this Ordinance or the
application thereof to any per-
son or. circumstance shall be
held to be invalid. the remain-
de.r ,.al tbis...ordinance and the
application of such provision to
other persons and circum-
stances shall nevertheless be
valid, -and this Couhcil hereby
declares that this Ordinance
would have been enacted with-
out such invalid provision.
SECTION 12.' It is officially
found, determined, and de-
clared that the meeting at which
this Ordinance is adopted
was open to the public and pub-
lic notice of the time, place. and
subject matter of the public
business to be considered at
such meeting, includin~ this
Ordinance: was given. all as
required by Chapter 551, as
amended, Texas Government
Code, '
SECTION 13. Pursuant to
the provisions of Section
1201.028, as amended, Texas
Government Code, this
Ordinance shall be effective
immediately upon adoption,
notwithstanding any provision in
the City's Home Rule Charter to
the contrary concerning a multi-
ple reading requirement for the
adoption of ordinances.

SECCION 2. De conformi-
dad con la Secci6n 61.012 del
C6digo de Elecci6n de Texas,
en su forma mOdificada, la
Ciudad debera proporcionar por
10 men os un sistema accesible
de votaci6n en cada uno de las
casillas electorales utilizadas en
la elecci6n. Dicho sistema
debera cumplir con las leyes
federales y de Texas las cuales
establecen los requisitos de los
sistemas para votar los cuales
permiten que los votantes con
incapacidades fisicas emitan un
voto en' secreto. Maquinas con

deberan ser utilizadas para la

conducira pruebas del equipo
de tabulaci6n automatico rela-
cionado con la Estaci6n e
instruira a los oficiales y depen-
dientes de la Estaci6n de
acuerdo con 10 dispuesto con el
C6digo de ~lecci6n de Texas.
SECCION 3. Los recintos de
la elecci6n de la Ciudad
deberan ser los dados a cono-
cer en el Anexo A de esta de la
presente. EI Anexo A de este
ordenamiento identifica los
precintos de elecci6n de la
Ciudad,y las casillas elec-
torales designadas para cad a
uno de de dichos precintos de
elecci6n, y dicho anexo es
incorporado como referencia.
Por 10 menos 63 dias previos al
dfa de la elecci6n programada,
el Concilio, en conjunto con el
Administrador de Elecciones
del Condado de Guadalupe,
identificaran y formal mente
aprobaran la asignaci6n de los
Jueces Presidentes, Jueces
Presidentes 'Alternos, Secre-tar-
ios de Elecci6n, y todos los of i-
ciales de esta elecci6n, 0 uti-
Iizaran a los oficiales de elec-
ci6n recomendados para que
sean aprobados por parte del
Administrador de Elecciones
del Condado de Guadalupe de
conformidad con el acuerdo de
elecci6n celebrado entre la
Ciudad y el Administrador ,de
Elecciones del Condado de
Guadalupe.
Cada uno de los Jueces
Presidentes debera nombrar a
no menos de dos (2) resi-
dentes, votantes calificados del
Condado para actuar como
dependientes y lIevar a cabo la
elecci6n propiamente. Sin
embargo, si el Juez Presidente
de hecho presta sus servicios,
entonces el Juez Presidente
Alterno debera prestar sus ser-
,vicios como dependiente. EI
nombramiento de estos depen-
dientes podra incluir a una per-
sona que domine el idioma
Espanol para que sirva como
dependiente y prestar ayuda
oral en espanol a 'cualquier
votante que as! 10 solicite en las
casillas electorales el dia de la
elecci6n. En ausencia del juez
Presidente, mencionado anteri-
ormente, el Juez Presidente
Alterno debera cumplir con las
responsabilidades del Juez
Presidente.
La elecci6n debera lIevarse
a cabo en la Ciudad de acuerdo
a 10 previsto por la ley aplicable
y el dia de la elecci6n, las casil-
las--elactorarg'creberan--estar
abiertas de 7:00 a.m. a 7:00
p.m.
Por medio de la presente se
designa el Edificio de la Oficina
del Condado de Guadalupe,
1101 Elbel Road, Schertz,
Texas 78154, como el lugar
principal para la votaci6n tem-
prana, donde se puede lIevar a

SECCION 5., A todo resi-
dente, votante calificado de la
Ciudad;' sa Ie permitinivotar en
la elecci6n, y el dfa de la elec-
ci6n, dichos votantes deberan
votar en las casillas electorales
designadas. La elecci6n se lIe-
vara a cabo y sera conducida
de acuerdo con las disposi-
ciones del C6digo de Elecci6n

cado, Capitulo 1331 del C6digo
de Gobierno de Texas, y los
Estatutos Domesticos de la
Ciudad y de acuerdo a como

SECCION 6. Una copia sub-
stancial de esta Orden debera
servir como aviso formal de la
elecci6n. Este aviso, incluyendo
una traducci6n al Espanol del
mismo, sera publicado en tres
(3) lugares publicos dentro de
la Ciudad y la Presidencia
Municipal por no menos de
quince (15) dias antes dEl la
fecha en que se lIeve a cabo la
elecci6n y ser publicado el
mismo dia durante dos (2) sern-
anas sucesivas en un peri6dico
de circulaci6n general en la
Ciudad, y la primera de estas
publicaciones del aviso debera
aparecer en tal peri6dico no
mas de treinta (30) dfas y no
menos de catorce (14) dias pre-
vios al dia de la elecci6n.
SECCION 7. EI Concilio
autoriza al Gerente de la
Ciudad, 0 a su designado, a
negociar y celebrar un acuerdo
de elecci6n 0 acuerdos con el
Administrador de Elecciones
del Condado de Guadalupe, de
conformidad con 10 dispuesto
por el C6digo de Elecci6n de
Texas. EI pago de todos los of i-
ciales de la elecci6n debera ser
establecido en este acuerdo de
elecci6n.
SECCION 8. La narraci6n
contenida en el preambulo de la
presente, se determinan por
medio de la presente como ver-
dad eras, y tal narraci6n es por
medio de la' presente incorpora-
da a esta Orden para todo fin y
se adoptan como parte de la
sentencia y hallazgos del
Concilio.
SECCION 9. Todas las
6rdenes y resoluciones, 0 parte
de estas, las cuales esten en
conflicto 0 sean inconsistentes
con 10 previsto en esta Orden,
son derogadas al extremo de
que tal conflicto y 10 previsto
POr esta Orden deban y per-
manezcan en control en cuanto
a los asuntos orden ados por la
presente.
SECCION 10. Esta Orden
debera ser interpretada y hecha
valer de conformidad con las
leyes del Estado de Texas y
Los Estados Unidos de
America.
SECCION 11. Si alguna dis-
posici6n de esta Orden 0 la
aplicaci6n de ella sobre alguna
persona 0 circunstancia
pudieran sostenerse como
invalida, el resto de esta Orden
y la aplicaci6n de la misma a
otras personas y circunstancias
no obstante, debera ser valida,
y el Concilio por medio de la
presente declara que esta
Orden sea promulgada sin
dicha provisi6n ipvalida,
SECCION 12. Se ha con sid-
erado oficialmente, determina-
do y declarado que la junta en
la cual esta Orden es adoptada,
fue una audiencia publica y se
dio previo aviso publico de la
hora, lugar y agenda del asunto
de incumbencia publica a con-
siderarse en dicha junta,
incluyendo esta Orden, de
acuerdo a 10 requerido por el
Capftulo 551, en su forma mod-
ificado, del C6digo de Gobierno
de Texas.
SECCION 13. De conformi-
dad co'n 10 dispuesto por la
Secci6n 1201.028, en su forma
modificada. C6digo de Elecci6n
de Texas, este Ordenamiento,
debera ser vigente y puesta en
operaci6n desde y despues de
su adopci6n, no obstante a
cualquier disposici6n de los
Estatutos Domesticos de la
Ciudad de 10 contrario con-
cernientes al requisito de multi-
ples lecturaS para la adopci6n
de los ordenamientos.
