A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF
SCHERTZ, TEXAS AUTHORIZING A PROFESSIONAL SERVICES
AGREEMENT WITH FORD ENGINEERING, INC., RELATING TO
ENGINEERING, DESIGN AND HYDRAULIC STUDY FOR WATERLINE
RELOCATION AT INTERSECTION OF FM 30x9 AND FM 2252, AND
OTHER MATTERS IN CONNECTION THEREWITH
WHEREAS, the City staff of the City of Schertz (the "City") has determined that the City
requires professional services relating to engineering, design and hydraulic study for the
Waterline Relocation at the intersection of FM 3009 and FM22S2 for TX-Dot Intersection
Improvements ;and
WHEREAS, City staff has determined that Ford Engineering, Inc. is uniquely qualified to
provide such services for the City; and
- WHEREAS, pursuant to Section 252.022(a)(~1), the City is not required to seek bids or
proposals with respect to a procurement for personal, professional, or planning purposes; and
WHEREAS, funds for this project are to be appropriated in the budget and $2SS,000 will
be transferred in from the Water & Sewer Fund Balance; and
WHEREAS, the City Council has determined that it is in the best interest of the City to
contract with Ford Engineering, Inc. pursuant to the Engineering Services Agreement attached
hereto as Exhibit A {the "Agreement").
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SCHERTZ, TEXAS
THAT:
Section 1. The City Council hereby authorizes the City Manager to execute and
deliver the Agreement with Fard Engineering, Inc. in substantially the form set forth on Exhibit
A.
Section 2. The recitals contained in the preamble hereof are hereby found to be true,
and such recitals are hereby made a part of this Resolution for all puYpases and are adopted as a
part of the judgment and findings of the City Council.
Section 3. Ail resolutions, or parts thereof, which are in conflict or inconsistent with
any provision of this Resolution are hereby repealed to the extent of such conflict, and the
provisions of this Resolution shall be and remain controlling as to the matters resolved herein.
Section 4. This Resolution shall be construed and enforced in accordance with the
laws of the State of Texas and the United States of America.
Section S. If any provision of this Resolution or the application thereof to any person
or circumstance shall be held to be invalid, the remainder of this Resolution and the application
of such provision to other persons and circumstances shall nevertheless be valid, and the City
Council hereby declares that this Resolution would have been enacted without such invalid
provision.
Section 6. It is officially found, determined, and declared that the meeting at which
this Resolution is adopted was open to the public and public notice of the time, place, and subject
matter of the public business to be considered at such meeting, including this Resolution, was
given, all as required by Chapter 551, Texas Govel-nment Code, as amended.
Section 7. This Resolution shall be in force and effect from and after its final
passage, and it is so resolved.

We are pleased to provide this proposal to provide professional engineering services to the City
of Schert•~ for design of the above referenced project. '
fur understanding of the scope of work is generally as follows: Ford Engineering Inc will
provide necessary civil engineering professional consulting services for the City to bid and
construct the relocation ofthe 18-inch water line on PM 3009 and the 12-inch water line an FM
2252 that is in conflict with proposed T~DOT improvements at the intersection of FM 2252
and FM 3004.

In order to facilitate the delivery of said project, Ford Engineering Inc will provide the
topographical survey of the existing Nacogdoches TartJc site, adjacent southern propertylexisting
water 1s`ne easement, and TXD{?T right~f--way to determine locations of existing utilities and
pertinent topographic features, It is understood that 'T'~DOT is currently surveying the right-of-
way for the limits of the intersection reconstruction, and that CAA Files and hard copies survey
slang with proposed 'I7I13QT improvements available to the City will be provided to Ford
Engineering Inc, within a reasonable time frame to aid in our design. The Ciiy will provide
`potholing' services to locate the existing water lines.
Ford Engineering will prepare a water network analysis and design calculations far the new
water line detee3nining pipe sizes necessary to meet the design flow required. It is anticipated
that the 18-inch line will be relocated to parallel the existing 12-inch in an existing easement
and reconnect to FM 2252, The design will be incorporated to the construction plans and a
report will be compiled for submittal for review.
Ford Engineering will prepare a set of construction plans, specifications, and quantity estimate,
for review, approval, and construction with associateed details per the standards indicated in
Statement of Work. Plans and specifications will be 'sn conformance with City of Schema
standards of construction and materials. Plans will include the pipe fine layout; pipe proFiles (as
required), and details for construction.
Ford Engineering will have a representative available for pre••c-construction and periodic project
meetings during construction. Ford Engineering will provide construction staking to consist of a
single line of stakes with guard stakes showing the stationing, and offset of harizon#al Pl, PC
and PT of the pipe alignment, locations of tees and bends, points of tie-in to existing system,

and major appurtenances. When the construction stakes have been set, the preservation of such
stakes as to position, elevation and marking shall become the responsibility of the contractor.
After construction has been completed and work approved by the Owner, Ford Engineering will
incorporate any changes trade during construction, as indicated by the contractor on a marked
up set ofplans, into a set of 1'raject Record Drawings.
It is tinderstood #hat at this time that TXDOT expects to have final plans available by May of
2412 and to let their project in August of 2412. It is understand that the City of Schert~ would
have their utilities relocated prior to August of 2fl 12.
Engineering ~'ee
Compensation far these services will be in the amount of 532,450.0[1 which will cover all costs
associated with the scope described above.
Additional services and significant changes will be caa~pensated for as provided by Attachment
1 to the Second Amendment to agreement for Engineering Services between the City of Schertz
and Ford Engineering, Inc, dated April 1, 2012 (the "Second Amendment). Further, the services
described in this letter shall be subject to the terms of the Agreement far Engineering Services
between the City of Schert~ and Ford Engineering, Ino. dated February 9; 2010, as amended by
the First Amendment to Agreement far Engineering Services dated October 1, 24l 1 and the
Second Amendment.
