AN ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF SCHERTZ,
TEXAS, PROVIDING THAT THE CODE OF ORDINANCES
OF THE CITY OF SCHERTZ, TEXAS BE AMENDED BY
REVISING CHAPTER 10, MISCELLANEOUS OFFENSES
AND PROVISIONS, ARTICLE VII, GARAGE SALES, SEC-
TION '10-102(c), SECTION 10-102(d) AND SECTION
10- 103(a), (b) AND (d); PROVIDING AN EFFECTIVE
DATE; AND PROVIDING A REPEALING CLAUSE.
BE It ORDAINED BY THE CITY COUNCIL OF THE CITY
Of SCHERTZ, TEXAS:
SECTION1
"THAT, Section10-102 (c) and (d) of the Code of Ordinances, City
of Schertz, Texas be amended as follows:
Section 102 - Application for a Permit
(c) Only the owner or lessee of the property, upon which the garage sale
is being conducted, may obtain such permit and two officially authorized
signs for an approved garage sale.
(d) Before such permit shall be issued, the applicant shall provide proof of
address (driver's license, utility bills or other identification) and any
other pertinent information as may be reasonably required by the City.
Upon verification and compliance with provisions of this Section and
payment of the proper fee, the applicant shall be issued a permit for
a garage sale by the City. The City must receive an application,
along with a list of participants, no later than noon Wednesday
before the event. Anyone wishing to be a part of a neighborhood
garage sale, after the application has been submitted, shall be
required to apply for a separate permit.
SECTION 2
THAT, Section 10-103 (a), (b) and (d) of the Code of Ordinances,
City of Schertz, Texas be amended as follows:
Section 103 - Permit Cost
(a) Cost for a permit to operate a garage sale is $10.00 for one numbered
permit and two officially authorized garage sale signs.
(b) Cost for a neighborhood garage sale permit is $10.00 for the permit and
$1.00 for each participant in the neighborhood garage sale.
Neighborhood garage sale will receive one number permit and one
officially authorized garage sale sign for each participant.
(d) Persons operating a garage sale outside the City limits, but who desire to
place signs within the City limits, shall pay a permit fee of $10.00 for one
numbered permit and two officially authorized garage sale signs."
SECTION 3
THAT, this Ordinance shall be in force and effect from and after its
final passage and shall be published and be effective as provided in the City
Charter, and it is so ordained.
SECTION 4
THAT, all ordinances or parts of ordinances in conflict with this
Ordinance are hereby repealed.
